Judgments Act 1839 (Imp)

The Judgments Act 1839 (Imp) introduces several core legal concepts that are essential to understanding its impact: registration, purchasers, mortgagees, lis pendens, Crown debts and quietus, and bankruptcy protections.

Registration. The Act creates a statutory scheme requiring the registration of certain interests in land in order for those interests to bind purchasers and mortgagees. Registration involves leaving a memorandum with the senior master of the Court of Common Pleas (in WA, the equivalent office now sits within the Supreme Court). The memorandum must include specific details such as the name, abode, trade or profession of the person whose estate is intended to be affected, the court, the title of the cause, and the date. The officer enters these details in a book in alphabetical order. This is a manual, pre-digital system that imposes a compliance burden on anyone wishing to preserve priority against future buyers. Failure to register renders the interest ineffective against a purchaser or mortgagee who has no express notice.

Purchaser and mortgagee. The Act defines its protected class broadly: any person who buys land or takes a mortgage over it. The concept of a purchaser includes those who give valuable consideration, but the Act does not explicitly define “purchaser” further. The intention is to protect those who acquire an interest for value without actual knowledge of the competing interest. The Act does not protect donees or those with actual notice.

Lis pendens. The term lis pendens refers to a pending suit or litigation that affects title to land. The common law rule was that a lis pendens constituted constructive notice to anyone who purchased during the pendency of the suit. The Act overrides that rule: a lis pendens does not bind a purchaser or mortgagee unless it is registered as prescribed. This removes the secret nature of pending litigation and forces litigants to register if they wish to preserve their claim against third parties. Importantly, section 7 also states that the provisions regarding re-entering judgments every five years (which were part of the deleted sections 1-6) extend to registered lis pendens. Since those provisions were deleted, there is now ambiguity about whether a lis pendens registration lapses after five years or continues indefinitely. This gap in the legislative scheme creates potential uncertainty for conveyancers.

Crown debts. The Act covers a wide range of Crown claims: judgments obtained in the Crown’s name, statutes or recognisances acknowledging Crown debts, inquisitions finding debts due to the Crown, obligations under the 33 Hen. VIII statute (which created the Court of Surveyors), and acceptances of office that make land liable for arrearages under 13 Eliz. I. All these must be registered in the “Index to Debtors and Accountants to the Crown” to bind purchasers. A quietus (formal discharge) must also be registered to remove the entry. This scheme imposes a duty on Crown officers to register debts and discharge them, but the cost of registration (two shillings and sixpence per entry) is trivial. The real burden is the administrative cost of maintaining the register and of searching it.

Discharge by Treasury certificate (section 10). This is a practical mechanism: even if a Crown debt is not fully paid, the Treasury Commissioners can certify that certain lands are exonerated in the hands of a purchaser or mortgagee, on terms they think fit (including payment of a sum into the Exchequer). This allows the Crown to release specific properties from the debt without requiring full discharge. However, section 11 preserves the Crown’s rights against other lands of the debtor, so the discharge is partial. This gives the Crown flexibility but also creates negotiation leverage over purchasers who want clean title.

Bankruptcy protections. Sections 12 and 13 protect purchasers from the secret operation of bankruptcy. Under section 12, a conveyance of property by a bankrupt made bona fide and before the date and issuing of the fiat is valid even if there was an earlier act of bankruptcy that could have made the conveyance void, provided the purchaser had no notice of that prior act. Section 13 goes further: even if a purchaser had notice of a prior act of bankruptcy at the time of purchase, the purchase cannot be impeached unless the commission is sued out within twelve months of that act. This creates a statute of limitations for attacking pre-bankruptcy transactions; after twelve months, the transaction is safe. These provisions limit the power of bankruptcy trustees and encourage prompt action by creditors. They also give purchasers certainty after a defined period.

The Judgments Act 1839 (Imp) directly impacts a narrow but important set of participants in real property transactions in Western Australia: purchasers, mortgagees, judgment creditors, the Crown (State and Commonwealth), trustees in bankruptcy, and legal practitioners involved in conveyancing. Its indirect effects are felt by anyone dealing with land that may be subject to old system title or historically recorded Crown debts.

Purchasers and mortgagees are the primary beneficiaries. The Act protects them from being bound by unregistered lis pendens and Crown debts if they lack express notice. This reduces the due diligence burden for a buyer who can rely on the absence of a registration entry rather than having to investigate all possible litigation or Crown claims. However, the protection comes with a caveat: the Act does not abolish constructive notice entirely; it only removes the effect of lis pendens and certain Crown interests unless registered. Other encumbrances (such as easements or restrictive covenants) may still bind by other doctrines. The Act also imposes a practical burden on purchasers to search the index (the book kept by the senior master) to confirm that no entries exist. The fee for searching is one shilling, regardless of how many books are searched. While the fee is trivial, the search itself may require attendance at the court office, especially since the Acts are now rarely used and may not be integrated into modern electronic systems. This creates a trap for the unwary.

Judgment creditors and Crown debtors are adversely affected if they fail to register. A creditor who obtains a judgment against a debtor’s land must register that interest under the Act (or rely on other legislation such as the Property Law Act 1969 or the Torrens system). If the creditor does not register, a later purchaser who takes without notice will take free of the judgment. This creates a strong incentive to register promptly. For Crown debtors, the Act imposes an obligation on the debtor to register a quietus to clear title; failure to do so leaves the debtor’s land still potentially encumbered in the eyes of third parties.

Trustees in bankruptcy are constrained by sections 12 and 13. A trustee cannot challenge a conveyance made by a bankrupt before the fiat if the purchaser acted bona fide and without notice of a prior act of bankruptcy. Even if the purchaser had notice, the trustee has only twelve months from the act of bankruptcy to sue out a commission. After that, the purchase is immune. This forces trustees to act quickly and limit the clawback of pre-bankruptcy transactions. This is a significant constraint on the trustee’s powers and may reduce the pool of assets available for distribution to creditors. From a free-market perspective, this constraint may marginally increase credit risk, but it also rewards prompt action and gives purchasers certainty after a defined period.

Legal practitioners and conveyancers must be aware of the Act’s continued existence. When dealing with old system land, or when advising on priority disputes, they need to search the register that the Act created. The register may not be well maintained or easily accessible given its age. The deletion of sections 1-6 removed the rules for re-registration of judgments every five years, but section 7 purported to extend those rules to lis pendens. The effect of that deletion is uncertain: it may mean that lis pendens registrations are now permanent, or that they have lapsed. Practitioners must navigate this statutory hole.

The Crown itself is both a beneficiary and bound party. The Crown benefits from the requirement to register its debts only if it wishes to bind purchasers; but it also must maintain the registration system and process quietuses. The Treasury Commissioners have discretion under section 10 to discharge lands on terms. This gives the Crown administrative power and flexibility, but also imposes an administrative cost. For the State of Western Australia, the Act now operates as part of the inherited law, and the Crown (State) likely relies on it for old Crown debts.

The Judgments Act 1839 (Imp) creates a set of duties on those who hold certain legal interests and rights on those who purchase or mortgage land.

Right of purchaser and mortgagee to be free from unregistered interests. The central right is that no lis pendens, Crown debt (as defined in section 8), or commission in bankruptcy (under section 12 and 13) shall bind a purchaser or mortgagee unless registration has occurred or the purchaser had express notice. This right is automatic: the purchaser does not need to prove damage; the interest is simply void against them if unregistered. The right is valuable because it provides a clear rule for priority, reducing transaction costs in conveyancing. However, the right is not absolute. It only applies to the specific interests listed: lis pendens, Crown debts (judgments, statutes, recognisances, inquisitions, obligations, specialties, acceptances of office), and certain bankruptcy transactions. Other interests (e.g., equitable charges, restrictive covenants) are not covered. Also, a purchaser who has actual notice loses the protection. The Act does not define “express notice” which likely means actual knowledge rather than constructive notice. This can be difficult to prove.

Duty of judgment creditors and Crown officers to register. While the Act does not explicitly state a duty to register, it creates a strong incentive: if the creditor wants the judgment or Crown debt to bind a subsequent purchaser, registration is necessary. If the creditor does not register, the interest is lost against a purchaser without notice. This effectively imposes a duty of active registration on anyone seeking to preserve priority. The duty includes providing specific particulars: name, abode, trade or profession, court, title of cause, date, amount of debt, etc. For Crown debts, the particulars are even more detailed: for a recognisance, the sum acknowledged, before whom, and date; for an inquisition, the sum found due; for an obligation or specialty, the sum bound; for acceptance of office, the name of the office and time of acceptance. This level of detail ensures the index is accurate but imposes a burden on the registrant. Failure to include all required particulars may invalidate the registration, though the Act is silent on the effect of defective registration.

Right of Crown to grant discharge (section 10). The Commissioners of HM Treasury have the right to certify that lands held by a purchaser or mortgagee are discharged from further Crown claims, even if the debt is not fully paid, upon such terms as they think proper (including payment of a sum into the Exchequer). This gives the Crown flexibility to release specific properties. The right is discretionary: the Commissioners “may” certify. There is no duty to grant a discharge. The purchaser or mortgagee has no statutory right to demand a discharge; it is a matter of negotiation and payment. This creates a potential hold-up problem: the Crown can demand a high price for releasing land, or refuse to do so, leaving the purchaser subject to a continuing Crown claim. Section 11 preserves the Crown’s right to levy the debt from other lands of the debtor, so the discharge only benefits the particular land.

Duty of debtor or accountant to register quietus (section 9). If a debtor obtains a quietus (formal discharge) from the Crown, they should register an office copy with the senior master, together with a certificate from the Accountant General that the quietus may be registered. The master then enters it in the index. This duty ensures that the index is kept current and that subsequent searchers can see that the debt is cleared. If the debtor fails to register, the index will still show the debt as outstanding, potentially harming the debtor’s ability to sell or mortgage the land. The duty is on the debtor, not the Crown. This is a trap: a debtor who has paid the debt but does not follow up with registration may face difficulties.

Rights and duties in bankruptcy. Under section 12, a bankrupt can make a conveyance before the fiat, and that conveyance is valid if it is bona fide and the purchaser had no notice of a prior act of bankruptcy. The bankrupt has no duty to disclose prior acts; the burden is on the purchaser to inquire. Section 13 gives a purchaser who had notice of a prior act of bankruptcy a right to rely on that purchase if the commission is not sued out within twelve months. The duty here is on the creditors (or trustee) to act quickly. After twelve months, the purchase is safe. This effectively creates a statute of repose for bankruptcy challenges. The trustee has a duty to investigate promptly and sue out a commission within the year, or lose the right to impeach. This limits the trustee’s powers but also reduces uncertainty for purchasers.

No explicit duties for the senior master? The senior master is directed to enter the memorandum in the book and to allow searches. The fee for registration is two shillings and sixpence; search fee one shilling. The master must maintain the books. These are administrative duties, but there is no penalty for failure. The Act does not specify what happens if the master makes an error. Presumably the government is liable for administrative failures, but this is not addressed.

The Judgments Act 1839 (Imp) does not contain any criminal penalties or monetary fines for non-compliance with its registration requirements. The enforcement mechanism is entirely civil and procedural: the consequence of not registering an interest is simply that the interest does not bind a subsequent purchaser or mortgagee who has no express notice. This is a loss of priority, not a penalty per se. However, there are indirect consequences and potential for enforcement through other legal avenues.

Loss of priority. The primary enforcement mechanism is that the holder of an unregistered interest loses their ability to assert that interest against a protected purchasor. For example, a judgment creditor who does not register under the Act (or under other applicable registration systems) may find that the debtor has sold the land to an innocent buyer, and the judgment is unenforceable against the land. The creditor is left only with a personal claim against the debtor, which may be worthless. This is a de facto penalty for failing to comply with the Act’s registration requirements.

Bankruptcy time bar. Section 13 provides that a purchase from a bankrupt cannot be impeached if the commission is not sued out within twelve months after the act of bankruptcy. This is not a penalty on anyone but a limitation on the right of creditors to challenge transactions. If the trustee or creditor fails to act within twelve months, they lose the right to set aside the purchase. This can be seen as a penalty on the trustee for delay, but it is more accurately a statute of repose that protects purchasers.

Potential enforcement through contempt or fraud. While the Act does not mention penalties for fraudulent registration or failure to register, general law principles apply. If a person registers a lis pendens without good faith, they may be liable in damages for wrongful interference with land. But that is not a penalty under this Act. Similarly, a bankrupt who fails to disclose assets might face consequences under bankruptcy law, but not under this Act.

No enforcement mechanism for the registration duty. There is no officer designated to enforce the duty to register. The senior master merely receives and enters memoranda; there is no power to compel registration. The Act is self-executing in that the market works as an enforcer: if you want to protect your interest, you register. The lack of a government enforcement arm reduces compliance costs but also means that some interests may remain unregistered and thus lose priority. This is consistent with the Act’s purpose of protecting purchasers, not creditors.

Enforcement of Crown debts unaffected. Section 11 specifically preserves the Crown’s right to levy debts from other lands not covered by a certificate of discharge. This means that even if the Crown fails to register against a particular parcel, it can still pursue other lands. The only penalty for the Crown’s failure to register is that it cannot enforce against that specific parcel if it has passed to a purchaser. This partial loss is a significant incentive for the Crown to maintain its index.

Discretion of Treasury Commissioners. Under section 10, the Commissioners can set terms (including payment of money) for discharging lands. If the purchaser does not pay or accept terms, the Crown can continue to claim against the land. There is no appeal from the Commissioners’ decision; the Act gives them absolute discretion. This could be seen as executive power that is not subject to judicial review (though general administrative law may apply). In practical effect, the purchaser has no enforcement right against the Crown to demand a discharge; they must negotiate or wait for the debt to be fully paid.

Bankruptcy creditors’ enforcement limited. The twelve-month rule in section 13 effectively limits the period within which a creditor can enforce the bankruptcy against a purchaser. If the creditor delays, the purchase is immune. This imposes a burden on creditors to act promptly, but it also reduces litigation costs and uncertainty. The Act does not provide any remedy for the creditor who misses the deadline; the transaction is simply valid.

The Judgments Act 1839 (Imp) is a small piece of legislation that sits within a much larger framework of property, bankruptcy, and Crown debt laws in Western Australia. Its practical significance today is limited, but it remains on the statute book and can interact with other Acts in specific circumstances.

Torrens system (Transfer of Land Act 1893 (WA)). The Torrens system provides for a register of land titles that is conclusive evidence of ownership and encumbrances. The Judgments Act predates the Torrens system by over fifty years. For land under the Torrens system, interests such as judgments and Crown debts are typically recorded on the certificate of title or via caveats. The Judgments Act may have no application to Torrens land because the Transfer of Land Act provides its own rules for priority and protection of purchasers. However, the Imperial Act was adopted in 1867, before Torrens was introduced in WA in 1874. Some land may still be under old system title, and the Judgments Act would apply to that land. The Property Law Act 1969 (WA) also contains provisions about priorities and registration of instruments, but it does not expressly repeal the Judgments Act.

Bankruptcy Act 1966 (Cth). Sections 12 and 13 of the Judgments Act deal with conveyances by bankrupts and protection of purchasers. The Commonwealth Bankruptcy Act 1966 has its own provisions on relation-back and protection of purchasers (e.g., s. 121 on transfers to defeat creditors, s. 122 on preferences, and s. 123 on protection of purchasers and mortgages). The Judgments Act provisions are narrower: they protect only conveyances before the fiat (now the date of sequestration order) and only if the purchaser had no notice of a prior act of bankruptcy, or if the commission is not sued out within twelve months. The Commonwealth Act may override the Imperial Act by virtue of s. 109 of the Constitution, but the Judgments Act was adopted as a state law, and it may still apply to the extent it is not inconsistent. The twelve-month rule in section 13 might be partially inconsistent with the Commonwealth Act’s longer periods for clawback (e.g., 5 years for transfers to defeat creditors). However, the Commonwealth Act also protects purchasers who acted in good faith and without notice. There is likely overlap, and the Judgments Act may be seen as supplementary or impliedly repealed by implication if the Commonwealth Act covers the field. Practitioners should check consistency.

Crown Suits Act 1947 (WA) and Crown proceedings legislation. The Act deals with Crown debts, but modern Crown debt enforcement is governed by the Crown Suits Act 1947 and the Crown Proceedings Act (Commonwealth). The definition of Crown debts covered by section 8 is archaic (referring to statutes from Henry VIII and Elizabeth I). Many of those specific mechanisms are obsolete. However, the general principle that the Crown must register its claims to bind purchasers may survive in principle, though modern practice would likely use the Torrens register or the Personal Property Securities Act 2009 (Cth). The Judgments Act may be the only remaining law that requires the Crown to register its debt against land in a public index to protect against purchasers. This could be significant if the Crown fails to register under modern systems.

Limitation Act 2005 (WA). Section 13’s twelve-month limit for impeaching purchases from bankrupts is a specific limitation period that trumps the general limitation periods in the Limitation Act for actions to recover property. The Judgments Act provides its own bar.

Federal and state jurisdictional issues. The Act refers to the “senior master of the said Court of Common Pleas” - an English court. In WA, after adoption, the equivalent officer would be a registrar or master of the Supreme Court of Western Australia. The Act’s registration scheme is likely administered by the Supreme Court, but there is no modern practice direction confirming this. The books (the Index to Debtors and Accountants to the Crown and the lis pendens register) may no longer exist or may be merged into other registers. This creates a practical problem: can a person still register an interest under this Act? If the books are gone, the Act is inoperative for new registrations. Existing registrations may be obsolete. This interaction with administrative practice is crucial.

Repeals and amendments. Sections 1-6 (which dealt with ordinary judgments, registration, and re-entry every five years) were deleted in 2004. Section 14 (which may have dealt with definitions or transitional) was deleted in 2025. The remaining sections were left in place. The deletion of sections 1-6 may have inadvertently removed the re-registration requirement that section 7 explicitly extended to lis pendens. This creates a loophole: a lis pendens registered under the Act might have a perpetual life, or it might lapse after five years with no means of re-registration. The Act does not say what happens.

The Judgments Act 1839 (Imp) is an Act of the UK Parliament that was adopted into Western Australian law by the Imperial Acts Adopting Ordinance 1867 (31 Vict. No. 8), which received royal assent on 15 July 1867. The Ordinance adopted many Imperial Acts as they stood at certain dates. Initially, the Act was reprinted as at 26 October 1999, showing its then current state.

2004 amendment. The Courts Legislation Amendment and Repeal Act 2004 (WA) No. 59 of 2004, section 20(1)(e), deleted sections 1 to 6 of the Judgments Act. This amendment came into operation on 1 May 2005. The deletion removed the provisions that dealt with the registration of ordinary judgments (not Crown debts) and the requirement to re-register them every five years. The sections also dealt with the forms, the book to be kept, and fees for searches for judgments generally. The practical effect was that the Act now only applies to lis pendens, Crown debts, quietuses, and bankruptcy; ordinary judgment creditors can no longer register under this Act (but may register under other legislation). The re-registration requirement was eliminated, but section 7 still purported to apply those re-registration provisions to lis pendens - this creates an ambiguity because the provisions no longer exist.

2025 amendment. The Statutes (Repeals and Minor Amendments) Act 2025 (WA) No. 14 of 2025, section 4(1)(a), deleted section 14 of the Judgments Act. Section 14 is not present in the compilation provided; it was likely a transitional or miscellaneous provision. This amendment came into operation on 26 September 2025. The deletion further reduces the Act’s length, leaving only sections 7 to 13.

Adoption history. The Act was originally enacted in the UK as 2 & 3 Vict. c. 11 in 1839. It was given its short title “Judgments Act 1839” by the UK Short Titles Act 1896. It was adopted in WA in 1867 as part of the reception of English law. Importantly, the adoption was not a mere enactment but a reception of the Imperial Act as it stood at the time of adoption. Later UK amendments to the Act (such as the Short Titles Act 1896) would not automatically apply in WA, but the WA adoption may have incorporated the Act as at 1867. However, the WA Parliament has since amended the Act directly. The amendment history shows that the WA Parliament treats the Act as a WA statute.

Other amendments? There may have been other minor amendments not listed in the compilation table. The notes indicate a reprint as at 26 October 1999, but no other amending Acts are shown between 1999 and 2004. The 2025 amendment suggests there may have been some other outdated provisions in section 14.

Current status. As of September 2025, the Act has only seven operative sections. It is a relic of a earlier registration system that anticipated a register of lis pendens, Crown debts, and quietuses, and provided bankruptcy protections. Most of its practical functions have been taken over by the Torrens system, the Commonwealth Bankruptcy Act, and other state laws. Yet it remains in force. There is no indication of imminent repeal, but the 2025 repeal of section 14 shows that the legislature is aware of the Act and willing to remove obsolete parts. Further repeal may occur if the Judgments Act is deemed redundant, but there may be resistance due to potential reliance interests on old registrations.

The source text provided for the Judgments Act 1839 (Imp) does not cite any cases or litigation. This is unsurprising for an old Imperial Act that has been largely superseded. However, the absence of cited cases does not mean the Act has never been considered by Western Australian courts. It is probable that the Act has been the subject of a small number of reported decisions, mainly in the context of priority disputes over old system land or historical Crown debts.

Possible areas of litigation. The Act’s provisions on lis pendens may have been litigated in the 19th or early 20th century to determine whether a pending suit was properly registered and whether a purchaser had notice. The requirement that the lis pendens be registered under the Act to bind purchasers overturns the common law rule that lis pendens provides constructive notice. Cases may have arisen where a purchaser argued that they were not bound because the suit was not registered, while a plaintiff argued that the purchaser had actual notice. The Act’s definition of “express notice” would have been crucial.

Bankruptcy section 12 and 13. The protection of purchases from bankrupts may have been considered in cases involving the interpretation of “bona fide” and “without notice” under section 12, and the calculation of the twelve-month period under section 13. These sections may have been relied on to defeat claims by bankruptcy trustees who failed to act quickly. However, since the Commonwealth Bankruptcy Act 1966 governs most bankruptcy matters, modern litigation is more likely to cite the federal Act.

Crown debts and quietuses. Sections 8 to 11 may have been litigated in disputes over the priority of Crown claims against purchasers. For example, the Crown may have argued that it was not required to register because the purchaser had notice, or that the registration was defective. The discretion of Treasury Commissioners to grant discharges under section 10 may have been challenged on administrative law grounds, but such challenges would be rare given the specific language of the Act.

Obsolescence and judicial notice. In any recent litigation, a court would likely take judicial notice that the Act is largely obsolete and that the practical method for protecting interests is through the Torrens register or other modern mechanisms. A court may also construe the Act narrowly because it is a historical piece of legislation that should not be extended to new situations. There is a risk that a court might find that the Act is impliedly repealed by later inconsistent legislation, but no such case has been clearly recorded in the source.

Searching for cases. A practitioner who wishes to find relevant case law would need to search Westlaw or other legal databases for references to “Judgments Act 1839” in conjunction with “Western Australia”. Given the age of the Act, the cases are likely to be few and of limited persuasive value. It is more likely that the Act is cited in historical legal commentary than in current practice.

Lessons for practitioners. The lack of modern litigation may indicate that the Act is not commonly invoked, but it could also be a trap: if a party fails to register a lis pendens or a Crown debt on the mistaken belief that registration is not required, they may lose priority in a dispute. The Act’s continued existence means that, theoretically, a party could rely on it, but doing so would invite litigation over whether the Act is still operative. There is considerable uncertainty. A prudent practitioner would not advise a client to rely solely on this Act; instead, they would use modern registration methods and treat the Judgments Act as a backup or historical curiosity.

The Judgments Act 1839 (Imp) contains several traps and ambiguities that can easily catch out legal practitioners, purchasers, and creditors who are unaware of its provisions.

1. The missing re-registration provision. Section 7 states that the provisions regarding the re-entering of judgments every five years “shall extend to every case of lis pendens which shall be registered under the provisions of this Act.” However, those re-registration provisions were located in sections 1-6, which were entirely deleted by the 2004 amendment. This means there is now no legislative mechanism to re-register a lis pendens after five years. Does a lis pendens registration lapse, or does it persist indefinitely? The Act is silent. This creates a critical gap. If a lawsuit drags on beyond five years, the lis pendens registration may be considered invalid or expired, but there is no clear rule. A purchaser who searches the register and sees an old lis pendens entry cannot tell if it is still effective. Risk: a plaintiff’s lis pendens might become void after five years without notice, trapping a later purchaser who relies on the register.

2. Archaic court and officer references. The Act refers to the “senior master of the said Court of Common Pleas” - an English court that no longer exists in either the UK or Australia. In WA, the Supreme Court has masters and registrars, but there is no specific designated officer to maintain these indexes. It is unclear whether the Supreme Court of Western Australia has actually maintained the two books (the index for lis pendens and the Index to Debtors and Accountants to the Crown) or whether they still exist. If no such books exist, the registration mechanism is practically inoperative. A person wishing to register an interest under the Act would not know where to go or whom to contact. This could make the registration requirements impossible to satisfy, rendering the entire Act a dead letter. Yet, the Act remains in force, meaning that the lack of an available register could be argued to make the registration requirement impossible, and the common law might revive.

3. The “express notice” test. The Act protects a purchaser or mortgagee “without express notice” of the unregistered interest. The term “express notice” is not defined. Does it mean actual knowledge only, or does it include constructive notice that is express in some document? In traditional equity, “express notice” meant actual notice, as opposed to constructive notice. But the Act does not define it. This leaves room for argument: a purchaser who has seen something in a newspaper or heard a rumour might be found to have express notice. The burden of proof is on the person asserting the interest to show express notice, which can be difficult. Conversely, a purchaser who deliberately avoids reading a document might argue they had no express notice. This ambiguity creates litigation risk.

4. Section 8 Crown debts: outdated categories. Section 8 refers to inquisitions for debts due to the Crown under 33 Hen. VIII and acceptances of office under 13 Eliz. I. These specific statutes are obsolete. Modern Crown debts (such as tax liabilities) are not obviously covered by these categories. However, the section also includes “any judgment … in the name or upon the proper account of Her Majesty” and “any obligation or specialty … made to Her Majesty”. This could cover many modern Crown claims. The danger is that a practitioner might assume that a modern Crown debt is automatically effective against a purchaser without registration, but the Act requires registration to bind purchasers. If the Crown does not register, a purchaser could take free of a very large tax debt. Conversely, the Crown might argue that a modern tax assessment is not a “judgment” or “inquisition” and thus not covered by the Act at all, meaning the Act’s protection does not apply. The uncertainty is high.

5. The quietus registration requirement. Section 9 says that when a quietus is obtained, the debtor (or accountant) should leave an office copy with the master together with a certificate from the Accountant General that it may be registered. The duty is on the debtor. If the debtor fails to register, the index will still show the debt as outstanding. A subsequent purchaser who searches the index will see an open debt and may refuse to settle. The debtor might have a quietus in their pocket but no registration. This is very unfair to the debtor. The Act does not provide a remedy if the debtor fails to register; presumably they could rely on the quietus as a defence against the Crown, but the purchaser would be wary. This is a classic trap: pay the debt but forget to register the discharge.

6. Bankruptcy section 12: “before the date and issuing of the fiat”. This phrase is ambiguous. Does it mean before the date of the fiat’s issue, or before both the date and the actual issuing? The bankruptcy process: the fiat was issued on a certain date, but it might be backdated? In modern terms, a sequestration order is made on a particular date. Section 12 protects conveyances made before the “date and issuing” of the fiat. This could be interpreted to require the conveyance to occur before the fiat is both dated and actually issued (i.e., sealed). If a conveyance occurs after the date written on the fiat but before it is physically issued, it might not be protected. This is a fine point that could arise in disputes.

7. Section 13: “twelve calendar months after such act of bankruptcy”. The twelve-month clock starts from the act of bankruptcy, not from the date of the purchase. This means that even if a purchaser had notice, the purchase can be impeached if a commission is sued out within twelve months of the act of bankruptcy. If the act of bankruptcy occurred long before the purchase (e.g., the debtor committed an act of bankruptcy a year before selling), the purchase may already be safe if the commission is sued out after that twelve months. But if the act occurred after the purchase? Section 13 says “such act of bankruptcy” - it refers to the prior act of bankruptcy that the purchaser had notice of. This is confusing. It seems to mean that if the purchaser had notice of a prior act of bankruptcy, the purchase can be impeached only if the commission is sued out within twelve months of that prior act. This gives a purchaser who knows of a bankruptcy risk a limited safe harbour after twelve months.

8. Interaction with modern technology. The Act’s fees are in shillings and pence. Two shillings and sixpence was a trivial sum in 1839 but is now impossible to pay in that currency. The Western Australian government has currency decimalisation and can accept decimal equivalents, but there is no provision. The fee is effectively nominal or uncollectible. This practical problem may make the Act unworkable in the modern economy.

Compliance with the Judgments Act 1839 (Imp) today is challenging because of its age, the deletion of key sections, and the likelihood that the physical registers no longer exist. Nevertheless, a prudent party dealing with land that might be old system title or subject to Crown debts should take the following steps.

For purchasers and mortgagees. When acquiring land, conduct a thorough search not only of the Torrens register (if the land is under Torrens) but also of any records that may have been maintained under the Judgments Act. This includes inquiring with the Supreme Court of Western Australia (or the relevant court registry) whether the “Index to Debtors and Accountants to the Crown” or the “book” for lis pendens still exists. If they exist, search them by the name of the vendor. Also search for any recorded judgments, Crown debts, lis pendens or quietus entries. Since the fees are in shillings, the search fee may be nominal. Ensure that you obtain a certificate or written confirmation of the absence of entries. If the registers do not exist, document your search efforts. Protect yourself by ensuring that the vendor provides a statutory declaration as to any known lis pendens, Crown debts, or bankruptcy proceedings. Also check the Bankruptcy Act 1966 (Cth) registers for any prior bankruptcy of the vendor. For lis pendens, if a pending suit is known, insist that the vendor either have it removed or that the plaintiff register it under this Act (if possible) to make it binding on you; otherwise, you may take free if you have no notice. However, given the registration mechanism is arguably inoperative, you may rely on the fact that the lis pendens is not binding on you under the Act, but you must avoid actual notice.

For judgment creditors and Crown debtors. If you have obtained a judgment against a debtor’s land or hold a Crown debt, you should register it in the appropriate book under the Act. But given the uncertainty about whether the register exists, you should also register the judgment under the Torrens system (by caveat or registration on title) and under the Property Law Act 1969 provisions for charging orders. Do not rely solely on this Act. If you are a Crown debtor who has obtained a quietus, ensure you register it under section 9. If the register is not available, obtain a receipt from the Crown confirming the quietus and keep it with the title documents. You may also need to record the discharge in the Torrens register if the debt was noted there.

For bankruptcy trustees. Section 12 and 13 provide defences to purchasers that you must overcome. To avoid losing the ability to impeach a pre-bankruptcy conveyance, you must act quickly. If you suspect that a bankrupt made a conveyance before the sequestration order, and you wish to challenge it, you must do so within twelve months of the act of bankruptcy, if the purchaser had notice of that act. If the purchaser had no notice, you cannot challenge a bona fide conveyance at all, regardless of timing. Therefore, investigate promptly. The twelve-month clock is not from the date of the sequestration order but from the act of bankruptcy. This may require you to identify the earliest act of bankruptcy and commence proceedings within twelve months of that date. The Bankruptcy Act 1966 (Cth) has its own limitations, but the Judgments Act may provide an additional defence for the purchaser, so you should consider both.

General advice. Given the age and uncertainty of this Act, the safest approach is to perform all due diligence as if the Act does not exist, relying on modern legislation (Torrens system, Bankruptcy Act, caveats, and personal searches). However, do not ignore the Act entirely: it is still in force, and a party who fails to consider it may later be surprised. For high-value transactions on old system land, engage a legal historian or a property specialist experienced with pre-Torrens titles. For Crown land or dealings with the state, obtain written confirmation from the relevant department that no Crown debts are outstanding. For lis pendens, ensure that any pending suit is either withdrawn, stayed, or properly protected by a caveat under the Torrens system, and obtain an undertaking from the plaintiff not to rely on the Judgments Act registration (if any). Keep records of all searches.

Future proofing. Monitor any further amendments to the Act. The deletion of section 14 in 2025 suggests that the legislature may eventually repeal the entire Act. If that happens, transitional provisions may deal with existing registrations. Until then, the Act remains a potential source of rights and obligations, albeit a creaky one.
