Judges' Salaries and Pensions Act 1950

The Act defines a compact of salary determination, pension entitlement, survivor and children’s benefits, and administrative mechanics. Key concepts are defined in s 2 and used throughout; understanding them is necessary to apply the substantive provisions.

• Judge, pensionable office and final salary/current judicial salary. The Act applies to the Chief Justice, the President of the Court of Appeal and other judges appointed under s 7A of the Supreme Court Act 1935 (s 3). Final salary is the salary payable immediately before retirement or death, including annual allowances (s 2 definition). Where a pensionable office has been abolished, the Minister determines the rate to be used for pension calculations (s 2(2)). The Act distinguishes final salary (used for earlier cohorts) from current judicial salary (defined in s 2(1) and used in pensions for judges retiring on or after the commencement of the 1987 Act).

• Pension entitlement formulas and caps. Section 6 contains the headline pension formulas. It separates judges who retired before the commencement of the 1987 Act (s 6(1)-(2)) from those who retire on or after that commencement (s 6(2a)-(2b) and later subclauses). For example, pre‑1987 judges who retire at 60 with at least 10 years’ service receive a pension equal to 50% of final salary (s 6(1)). For post‑1987 retirements, a judge retiring at 60 after at least 10 years’ service is entitled to 60% of current judicial salary (s 6(2a)). Disability retirements are dealt with separately and have different percentage floors and accrual rates (s 6(2), s 6(2b)). Section 6 also makes it explicit that a judge removed under s 55 of the Constitution Act 1889 or s 9 of the Supreme Court Act 1935 is not entitled to a pension unless the Governor decides otherwise (s 6(2c)).

• Derivative pensions and children’s allowances. The Second Schedule sets out survivor benefits. For deaths on or after 1 December 1987 a surviving spouse or de facto partner receives 37.5% of current judicial salary if the judge died in office (Second Schedule Part I cl 1(b)); for a retired judge a surviving spouse receives 62.5% of the pension that would have been payable (cl 2(b)). Children’s allowances are expressed as percentages of a defined “relevant pension” and differ depending on whether the death occurred before or after the 1987 Act (Second Schedule Part II Divisions A and B).

• Indexation and its limits. Section 8B ties annual pension increases to the Perth CPI (the Index), via a year on year percentage change methodology. Important operational details include the prescribed calculation rules for first increases where pensions have not been in force for a full 12 months (s 8B(2)-(3)), and a year of non‑increase where the Index falls (s 8B(4)). Section 8B(6) creates significant exceptions: indexation does not apply to pensions of judges retiring on or after the commencement of the 1987 Act nor to certain derivative pensions payable to their spouses, de facto partners or eligible children.

• Commutation and tax surcharge interface. The Act permits commutation of pensions or lump sum benefits to satisfy a surcharge payable under Commonwealth law (s 16, s 18). Commutation is done on the basis of actuarial equivalence and requires the Minister to follow notice and form processes; actuarial advice is mandated (s 16(6)(b), s 16(7)). The surcharge is defined by reference to Commonwealth superannuation taxation statutes and other prescribed Commonwealth Acts (s 16(8), s 18(4)).

• Election and transitional mechanics. Section 12 allows judges serving when the Act commenced to elect within six months to come within the pensions regime of ss 6-11. Those who do not elect retain their pre‑Act pension rights under the Acts listed in the First Schedule (s 12(2)-(4)). Section 12A treats service as an acting judge as commencing a judge’s service for pension purposes where the person was appointed acting judge and later appointed judge (s 12A(1)).

• Administrative allocation of cost and payment. Salaries and pensions are charged to the Consolidated Account (s 5(2), s 11) and the costs of administering ss 6-17 are also charged to the Consolidated Account (s 19). Pensions accrue daily and are payable monthly unless otherwise agreed (s 11).

• Limits on post‑retirement practice. Section 15 provides that the right to a pension is forfeited if the pensioner practises as a barrister, solicitor or proctor in Western Australia or elsewhere in Her Majesty’s Dominions, unless the Governor exercises a written exemption (s 15(1)-(3)). This directly affects choices about returning to legal practice after retirement.

Several terms explicitly import Commonwealth statutes and external legal instruments (for example, Index defined by reference to the Census and Statistics Act 1905, and references to Superannuation Industry (Supervision) Act 1993 and Superannuation Guarantee (Administration) Act 1992 in s 17). The Act therefore operates in a network with Commonwealth superannuation and taxation law; application requires cross‑reference to those instruments for certain computations.

This Act primarily affects a defined and concentrated group of legal officeholders and their dependents, and secondarily affects public budgets and the Ministerial/administrative actors who implement its provisions.

• Judges of the Supreme Court of Western Australia. The Act applies expressly to the Chief Justice, the President of the Court of Appeal and all other judges of the Supreme Court appointed or to be appointed under s 7A of the Supreme Court Act 1935 (s 3). That cohort includes judges appointed before and after various amendment dates; coverage and entitlement depend on the timing of retirement or death and whether the judge elected to come within the new provisions if serving when the Act commenced (s 12).

• Retired judges and their spouses, de facto partners and children. Retired judges may receive pensions under s 6. Derivative pensions and children’s allowances are payable under the Second Schedule to spouses, de facto partners and eligible children of judges and retired judges (Second Schedule, Part I and Part II). Entitlement and calculation differ depending on whether the triggering death or retirement occurred before or after the commencement of the 1987 Act (Second Schedule, Part II and s 7(2)).

• Judges serving as auxiliary judges. Auxiliary judges are treated specially for pay and pension interaction. If an auxiliary judge receives a non‑contributory pension under this Act or another law, the salary payable is the difference between that pension and the annual salary rate otherwise payable (s 5(1b)). Service as an auxiliary judge does not count as service as a judge for the purposes of pension accrual (s 6(3b)); where a person in receipt of a pension holds the office of auxiliary judge, the pension reduction rules in s 6(3) do not apply to that person in relation to that office (s 6(3a)).

• The Minister and the Governor. The Act gives the Minister several decision powers: to determine what rate of salary to use if a pensionable office is abolished (s 2(2)); to certify disability for pensionable retirement (s 6(2), s 6(2b)); to receive and act upon notices for commutation and to set forms and information requirements (s 16(3), s 16(7), s 18(2)); and to decide payment frequency (s 11). The Governor has powers to approve allowances (s 5(3)) and to grant written exemptions permitting a pensioner to practise as a barrister or solicitor without forfeiting their pension (s 15(2)).

• The Attorney‑General’s and Treasury/Finance portfolios. The financial mechanics, including the statement that salaries and pensions are charged to the Consolidated Account and permanently appropriated to the extent required (s 5(2)), and that administration costs are charged to the Consolidated Account (s 19), mean that Treasury and the relevant agencies must provide appropriation and budgeting. The Minister administering the Act is the decision maker on many operational points; departments must implement payment and actuarial processes.

• Executors, administrators and beneficiaries. Executors and administrators of judges’ estates may be affected where commutation is used to meet surcharge debts from the estate (s 16(2)). Where a judge dies without a spouse or de facto partner, a lump sum benefit may be payable to the judge’s executor or administrator (s 17(2), s 17(5)).

• Commonwealth statutory administrators and tax authorities. The Act explicitly references Commonwealth superannuation and taxation instruments for the surcharge definition (s 16(8), s 18(4)) and for preserved benefit calculations and shortfalls (s 17(3), s 17(4), s 17(8)). That creates operational interactions with Commonwealth regulators and the Commissioner of Taxation where surcharges or employer‑sponsored components are involved.

Who pays and who decides. Payments are largely paid from the Consolidated Account (s 5(2), s 11, s 17(6), s 19). The Minister performs many determinations and receives notices for commutation; the Governor has defined discretionary powers for approvals and exemptions. Actuarial advice is required for commutation and preserved benefit calculations (s 16(6)(b), s 17(3)).

What behaviour the Act changes. The Act alters retirement incentives and post‑retirement choices by specifying pension levels, caps and a barrister/practice forfeiture rule (s 15). It provides mechanisms to commmute pensions or lump sums to satisfy Commonwealth surcharge liabilities, creating a predictable route for meeting those tax obligations (s 16, s 18). It may influence appointment and acting arrangements through s 12A and the treatment of auxiliary judges under s 5(1b) and s 6(3a)-(3b).

The Act creates specified entitlements for judges and their dependents, duties on the Minister and Governor to administer and make determinations, and obligations that fall on recipients and executors in particular circumstances. These are the principal rights and duties, with section references.

Rights of judges and beneficiaries

• Right to salary. While a judge’s commission remains in force, an annual salary is payable determined under the Salaries and Allowances Act 1975 (s 5(1)). The Act sets ordering constraints between judicial offices (s 5(1)(a)-(b)), and specifies that a person holding more than one office is entitled to only one office’s salary (s 5(4)).

• Right to pension on retirement. Judges who meet age and service thresholds or who are certified by the Minister as retired due to permanent disability or infirmity have entitlements under s 6. The exact percentage depends on timing relative to the 1987 Act and on age and years of service (s 6(1), s 6(2a), s 6(2aa), s 6(2ab), s 6(2b)). Maximum caps are stated (for example, 50% of final salary for certain cohorts, or 60% of current judicial salary for post‑1987 retirees, s 6(1), s 6(2a), s 6(2b)).

• Rights of spouses, de facto partners and children. The Second Schedule provides derivative pensions and children’s allowances with specified percentages and timing (Second Schedule Part I cl 1-3; Part II Div B Items 1-2). Spouse pensions are payable from the day after death unless particular deferrals apply (Second Schedule cl 3(1)-(2)). Only the greatest benefit is payable where a person is entitled to multiple items under the Schedule (Part III Item 1).

• Rights to commutation to meet surcharge debt. A retired judge in receipt of a pension who is liable to pay a surcharge may commute part of the pension to pay that surcharge (s 16(1)-(6)). A judge who becomes entitled to a lump sum benefit under s 17 and is liable to pay a surcharge may convert all or part of that benefit into a commutable pension and then commute it to a lump sum to meet the surcharge (s 18(1)-(3)). Requested amounts cannot exceed the surcharge (s 16(3), s 18(2)).

Duties and procedural requirements

• Notice and form requirements for commutation. To commute a pension or lump sum a person must give the Minister a notice specifying the requested amount; after the Minister’s acknowledgement of the actuarial consequences, the person must confirm their intention to proceed (s 16(3)-(6)). The Minister may prescribe the form and manner of notice and required accompanying information (s 16(7)).

• Election for judges serving at commencement. A judge serving at the date of commencement of the Act must elect within six months to come within the application of ss 6-11; if they elect they substitute the Act’s pension rights for any right under the previous statute listed in the First Schedule (s 12(2)-(3)). Judges who do not elect retain their previous statutory pension arrangements (s 12(4)).

• Actuarial advisory duty. Where commutation or preserved benefit calculation is required, the Minister must determine pension reductions or lump sum amounts on the advice of an actuary (s 16(6)(b), s 17(3)).

• Payment frequency and accrual. Pensions and allowances grow due daily and are payable monthly or at other agreed frequencies, charged to the Consolidated Account (s 11).

• Governor’s powers to exempt. The Governor may exempt a person from the pension forfeiture rule if the person practises as a barrister, solicitor or proctor (s 15(2)). The Governor also approves travelling and other allowances as the Governor may from time to time approve (s 5(3)).

Constraints, offsets and reductions

• Reduction for other judicial or State pensions. A pension payable under this Act is reduced by any salary received for holding another judicial office remunerated from the Crown, and by other judicial pensions and the State share of pensions under the Superannuation and Family Benefits Act 1938 (s 6(3)-(4)). There is an exception for an auxiliary judge while holding that office (s 6(3a)-(3c)).

• Forfeiture on practicing as lawyer. If a pensioner practises as a barrister, solicitor or proctor anywhere in Her Majesty’s Dominions, the pension is forfeited unless the Governor grants a written exemption (s 15(1)-(3)).

• Pension non‑payable on removal for misbehaviour. No pension is payable to a judge removed under specified constitutional or statutory provisions unless the Governor decides otherwise (s 6(2c)).

Administrative and fiscal obligations

• Charges to Consolidated Account. Salaries, pensions, allowances and administration costs are to be charged to the Consolidated Account and are appropriated to the necessary extent (s 5(2), s 11, s 17(6), s 19).

• Information and form compliance. Commutation and certain claims require complying with forms and information as determined by the Minister (s 16(7)). The Minister also determines salary rates when a pensionable office is abolished (s 2(2)), and may certify service as continuous for service‑length calculations (s 2(3)(a)).

These duties and rights set up a predictable entitlement architecture but allocate considerable discretionary and administrative tasks to the Minister and Governor, and technical valuation tasks to actuaries. The Act links into Commonwealth superannuation and taxation law for specific calculations, creating cross‑jurisdictional obligations for recipients and the administering authority.

The Act concentrates on entitlements, reductions and forfeitures rather than on criminal penalties. The enforcement architecture is administrative: pensions may be reduced, ceased or commuted; the Governor and the Minister hold the enforcement levers; actuarial determinations and prescribed forms control process. Key enforcement mechanisms follow.

Forfeiture and cessation

• Forfeiture on practising. The principal punitive‑style enforcement device is the automatic forfeiture of pension if the pensioner practises as a barrister, solicitor or proctor in Western Australia or elsewhere in Her Majesty’s Dominions (s 15(1)). The effect is that the pension, if already granted, ceases to be payable. The Governor may grant written exemptions (s 15(2)-(3)). That is a direct statutory consequence rather than a penalty subject to criminal process.

• Non‑payability upon removal. Section 6(2c) provides that, unless the Governor decides otherwise, no pension is payable to a judge removed under s 55 of the Constitution Act 1889 or s 9 of the Supreme Court Act 1935. Removal under those constitutional or statutory provisions effectively extinguishes pension rights unless the Governor directs otherwise; again an administrative consequence.

Reductions and offsets

• Offsets for other remunerations. Where a person in receipt of a pension under this Act also holds a remunerated judicial office, or receives another judicial pension or a State share of a pension under certain Commonwealth/State Acts, the pension payable under this Act is reduced by amounts equal to those other payments (s 6(3)-(4)). These are enforcement mechanisms applied at the point of payment to avoid double payments, rather than recoveries through penalty processes.

Commutation and tax surcharge enforcement

• Commutation to satisfy surcharge liability. Sections 16 and 18 create a statutory route to convert pension or lump sum rights into lump sum payments to meet a surcharge payable to the Commissioner of Taxation under Commonwealth law (for example, under the Superannuation Contributions Tax (Members of Constitutionally Protected Superannuation Funds) Imposition Act 1997 or another prescribed Commonwealth Act). The process is managed administratively: a person gives notice, the Minister provides actuarial information, if the person confirms the requested commutation the Minister effects the commutation and the person becomes entitled to the lump sum (s 16(3)-(6); s 18(2)-(3)). The Act limits requested amounts to not exceed the surcharge (s 16(3), s 18(2)). This enforces Commonwealth tax liabilities through conversion of State pension rights.

Procedural obligations and ministerial determinations

• Forms, notices and actuarial advice. The Minister is required to set the form and manner of notices for commutation, and to determine amounts on the advice of an actuary (s 16(6)-(7); s 17(3)). Failure to follow prescribed notice procedures or to supply required information could prevent commutation or delay payments; the Act gives the Minister administrative control over the process.

Fiscal enforcement and accounting

• Consolidated Account appropriation and charge. Salaries, pensions and administration costs are charged to the Consolidated Account and appropriated accordingly (s 5(2), s 11, s 19). The fiscal enforcement mechanism is accounting and appropriation: payments are payable from and authorised by the Consolidated Account. The Act does not create separate criminal or civil penalties for mispayment beyond the administrative offsets and forfeitures.

Dispute and remedial pathways

• The Act itself does not specify internal review or appeal routes for disputes over Ministerial determinations, actuarial calculations, eligibility decisions or Governor’s exemptions. Given that many key decisions are administrative determinations (for example the Minister’s certification of disability, s 6(2)/(2b); the Minister’s determination of actuarial equivalence for commutation, s 16(6)(b)), affected persons would likely need to rely on general administrative law remedies outside this statute for review of executive decisions, if those remedies are available. The Act contains no express criminal sanctions; enforcement is effectuated by withholding or reducing entitlements.

In short, enforcement under the Act is executed by administrative adjustments to benefit payments and by the statutory forfeiture mechanisms. The Governor and the Minister are the primary enforcers through their statutory discretions. The Act does not create separate criminal penalties; compliance is managed through payment adjustments, commutation mechanics and the fiscal framework.

The Act is deliberately interconnected with both State and Commonwealth statutes. It imports definitions, cross‑references mechanisms and uses Commonwealth law to define certain obligations. These linkages produce interaction obligations that administrators and recipients must observe.

State law interactions

• Salaries and Allowances Act 1975. The Act delegates the determination of judicial salary rates to the Salaries and Allowances Act 1975 (s 5(1) and the reference to that Act). That means the quantum of salary is not fixed in the Judges’ Salaries and Pensions Act itself but is determined under the broader State salary‑setting framework. The Act imposes internal caps and relative ordering (s 5(1)(a)-(b)), but salary-setting mechanics and adjustments will occur under the Salaries and Allowances Act.

• Supreme Court Act 1935. Application and reference to the Supreme Court Act 1935 are integral. The Act applies to judges appointed under s 7A of the Supreme Court Act 1935 (s 3). Acting appointments under s 11 of the Supreme Court Act 1935 are treated as commencing a judge’s service for pension purposes if the person is later appointed a judge (s 12A(1)). Removal mechanisms under the Constitution Act 1889 and s 9 of the Supreme Court Act 1935 can eliminate pension entitlement unless the Governor decides otherwise (s 6(2c)).

• First Schedule amendments. The First Schedule amends specified Acts listed therein (s 4 and First Schedule). The Schedule documents historic amendments and connects the Act to the evolution of other State statutes.

Commonwealth law interactions

• Consumer Price Index definition. The Index used for annual pension adjustment is defined as the Consumer Price Index number (All Groups Index) for Perth published by the Commonwealth Statistician under the Census and Statistics Act 1905 (s 2 definition of Index). That draws measurement from Commonwealth statistics law.

• Superannuation and Family Benefits Act 1938 and State Superannuation transitional law. The Act contains references to the Superannuation and Family Benefits Act 1938 when reducing pension entitlements by the State share of a pension (s 6(3)(c), s 6(4)). The compilation notes explain that the 1938 Act was repealed and its provisions continue to apply in certain transitional circumstances under the State Superannuation (Transitional and Consequential Provisions) Act 2000. Administrators must therefore account for transitional preservation of historical Commonwealth/State scheme entitlements (Compilation notes and s 17(3) references).

• Commonwealth superannuation regulatory and taxation statutes. Section 17(3) and (4) reference the Superannuation Industry (Supervision) Act 1993 for preservation and treatment of preserved benefits. The definition of individual superannuation guarantee shortfall refers to the Superannuation Guarantee (Administration) Act 1992 (s 17(8)). Sections 16 and 18 refer to a surcharge as an amount payable under the Superannuation Contributions Tax (Members of Constitutionally Protected Superannuation Funds) Imposition Act 1997 of the Commonwealth or another prescribed Commonwealth Act (s 16(8), s 18(4)). Those references mean that commutation processes to meet Commonwealth tax liabilities require administrators to apply Commonwealth tax rules to State pension conversion. When an estate or individual owes a Commonwealth surcharge, the Act provides the State mechanism to convert pension rights into lump sums to meet that Commonwealth tax charge.

Administrative and regulatory interfaces

• Actuarial determinations. The Act requires actuarial advice for determining actuarial equivalence and for calculating preserved benefits to avoid an individual superannuation guarantee shortfall (s 16(6)(b), s 17(3)). Actuaries must therefore apply Commonwealth superannuation regulatory rules when producing valuations, and their advice determines the State’s payment obligations.

• Interaction with other pensions and double‑payment avoidance. Section 6(3) mandates pension reductions where the person is receiving other judicial remuneration or other judicial pensions, or State share of pensions. This creates direct interactions with other State pension schemes and requires cross‑checking across entitlements to ensure correct offsets.

Procedural interactions

• Forms and Ministerial determinations. The Minister is empowered to set forms and procedures for notices required by the Act (s 16(7)). That requires administrative procedures to be consistent with other State and Commonwealth administrative processes, and to coordinate with the Commissioner of Taxation where surcharge liabilities are being satisfied.

• Payment timing and dependants. The Second Schedule contains timing rules and Ministerial discretion for payments to spouses or de facto partners who were not partners at retirement (clause 3(2)). That discretion intersects with eligibility rules in other State or Commonwealth benefit schemes and the Family Law Act frameworks where marital status or de facto relationships may be relevant.

In sum, the Act is not a standalone code. It embeds and depends on other State salary law, the Supreme Court Act, State superannuation history, Commonwealth superannuation regulation and Commonwealth tax law. Administrators must routinely cross‑reference those instruments when calculating entitlements, offsets, commutations and preserved benefits.

The Act has an extended amendment and reprint history documented in the compilation table and via marginal amendment notes inside the Act text. The compilation table in the source provides an authoritative chronology of amendments, with key legislative milestones and commencement dates. The following synthesises the amendment history as recorded.

Foundational enactment and early amendments

• Judges’ Salaries and Pensions Act 1950 (No. 35 of 1950), assented 16 December 1950, commenced 16 December 1950, is the principal Act. The First Schedule records amendments to earlier statutes consequential on the 1950 Act.

• A series of early amendments throughout the 1950s and 1960s adjusted salary and pension provisions: amendments were made by Acts in 1953, 1955, 1959, 1960, 1961, 1962, 1964, 1966 and 1969. These are recorded in the compilation table with their respective assent and commencement dates. Example notations in the Act text indicate amendments to defined term lists and other provisions (see s 2 amendment note).

Major structural amendments

• 1975 and 1976 amendments. Multiple amending Acts in the 1970s altered provisions, including changes recorded in 1972, 1973, 1974, 1975 (Acts Amendment in 1975 and Judges’ Salaries and Pensions Act Amendment Act 1975). The compilation table shows an increased pace of reform in the 1970s with reprints in 1974 and 1978.

• 1987 Judges’ Salaries and Pensions Amendment Act (No. 82 of 1987) is a significant structural amendment for modern pension calculation. The Act introduces the distinction between "current judicial salary" and "final salary" and creates different pension computations for judges retiring on or after the commencement of that amendment (see s 2 definition and s 6(2a) and related subsections). The 1987 Act commenced on 1 December 1987.

• Subsequent substantive amendments in 1989 and 1990 further refined pension age and accrual rules. For example, s 6(2aa) records a 1990 amendment that created pension entitlements for judges retiring between ages 55 and 60 with at least 10 years’ service.

2000s modernisation and equality reforms

• Acts in 2003 and 2004: The Acts Amendment (Equality of Status) Act 2003 (Pt 33, No. 28 of 2003) made changes effective 1 July 2003, which included Second Schedule updates relating to de facto partners and equal treatment in derivative benefits (Second Schedule is revised and annotated as inserted by No. 28 of 2003, s 99). The Acts Amendment and Repeal (Courts and Legal Practice) Act 2003 (No. 65 of 2003, ss 98-105) commenced 1 January 2004 and inserted provisions dealing with commutation to meet surcharge debt (s 16, s 18) as well as Part II children’s allowance modernisation and other provisions (see insertion notes throughout).

• 2004 Court of Appeal Act. The Acts Amendment (Court of Appeal) Act 2004 (No. 45 of 2004) is noted in the compilation table and has consequential effects on application (s 3 amended).

Recent reprints and minor amendments

• Financial and administrative amendments in 2006 and 2007 (Financial Legislation Amendment and Repeal Act 2006; Judges’ Salaries and Pensions Amendment Act 2007) are recorded. A reprint as at 7 March 2008 consolidates amendments up to that date.

• Standardisation and minor amendments in 2010 and the Statutes (Repeals and Minor Amendments) Act 2011 are recorded with respective commencement dates. These are largely formatting and minor editorial adjustments rather than substantive policy shifts (compilation table entries for No. 19 of 2010 and No. 47 of 2011).

Transitional and uncommenced provisions

• The compilation table records an uncommenced provision: State Superannuation (Transitional and Consequential Provisions) Act 2000 s 51 (No. 43 of 2000) which, as amended by No. 65 of 2003 s 106, remains to be proclaimed. The compilation notes caution that some historical superannuation provisions from the Superannuation and Family Benefits Act 1938 continue to have effect in particular transitional contexts, and those continuities affect how s 6(3)(c) and s 17 operate.

Interior amendment notes

• The Act text itself carries amendment notes at many sections indicating the amending Acts and sections, these appear after the section text (for example, s 2 amended by No. 82 of 1987 s 4; No. 28 of 2003 s 94; and others), providing the legislative genealogy for particular provisions. The Second Schedule has several insertions marked as No. 28 of 2003 s 99 and No. 82 of 1987 s 7 for Part II changes.

What the amendment history shows in mechanical terms

• Major policy changes occurred in 1987 and later, creating the bifurcation between pre‑1987 and post‑1987 entitlements, inserting modern mechanisms for de facto partners and children, and addressing tax surcharge interaction in the 2003 amendments. The cumulative effect is a statute that must be applied by reference to the date of the triggering retirement or death and the judge’s period of service, with transitional election mechanics for judges serving at amendment dates (s 12).

For practitioners, the compilation table and the marginal amendment notes in the Act text are the authoritative record of amendment history. The Act’s current operational form is a product of layered amendments rather than a single redesign; applying the Act requires tracking which cohort and timing rules govern a particular judge or beneficiary.

The source text of the Act contains no reported litigation history, no cited cases and no references to judicial decisions that have interpreted the Act. The compilation and notes provided are administrative in character and do not include court determinations. Accordingly, the Act as presented in this source has the following implications for litigation risk and likely judicial review pathways, derived from the statute’s structure rather than from any reported case law in the source.

• Administrative decision points susceptible to challenge. The Act vests several discretionary or determinate functions in the Minister or the Governor, certification of retirement due to permanent disability or infirmity (s 6(2), s 6(2b)), the Minister’s determination of salary where a pensionable office is abolished (s 2(2)), the Minister’s determinations of actuarial equivalence for commutation (s 16(6)(b), s 18(3)), and the Governor’s power to grant exemptions from pension forfeiture for practising as a barrister or solicitor (s 15(2)). Those administrative decisions are the likely loci of legal challenge if an affected person alleges a failure to exercise discretion according to law, error of fact, or procedural unfairness. The Act does not supply its own decision review regime; ordinary State administrative law review mechanisms would be the probable pathway.

• Valuation and actuarial disputes. Sections that require actuarial advice to determine actuarial equivalence and preserved benefits (s 16(6)(b), s 17(3)) create technical areas where disputes could arise about the correctness of actuarial methodology and assumptions. The Act calls for an actuary defined as a Fellow or Accredited Member of The Institute of Actuaries of Australia (s 2(1)), which prescribes the professional standard but leaves actuarial judgement to be tested possibly in litigation.

• Surcharge commutation and Commonwealth law interface. Commutation provisions to meet Commonwealth surcharge liabilities (s 16, s 18) require coordination with Commonwealth tax law and the Commissioner of Taxation. Potential disputes could centre on whether a particular amount constituted a surcharge under the Commonwealth legislation referenced in the Act, and whether commutation calculations satisfy both State and Commonwealth tax administration requirements.

• Eligibility and timing disputes. The Second Schedule contains timing rules for survivor pensions and deferrals in particular situations (Second Schedule cl 3(2)). Disputes regarding whether a person was a spouse or de facto partner at relevant times, or whether a child is an eligible child for the purposes of Part II Division B, could give rise to contestation. The Schedule expressly gives the Minister opinionated discretion for dependency assessments (Second Schedule Part II definition of eligible child) which could be reviewed if exercised unlawfully.

• Absence of statutory penalty provisions. The Act does not establish distinct criminal sanctions for breaches. Enforcement is primarily administrative. Consequently, litigation would predominantly be about administrative law remedies, statutory interpretation, and valuation issues rather than criminal prosecution.

Because the source provides no case law, practitioners must rely on general principles of administrative and public law and on related decisions in other contexts when predicting how a court would resolve a dispute under the Act. Any concrete litigation history must be identified from external legal research sources beyond the text provided here.

This section flags statutory features that commonly produce operational mistakes, misinterpretation or unintended outcomes. Each item cites the relevant provision and explains the concrete mechanism by which it produces risk.

1. Indexation does not apply to post‑1987 pensions and certain derivative benefits (s 8B(6)). Many users might assume all pensions are CPI indexed. The Act expressly disapplies s 8B to pensions of judges who retire on or after the commencement of the 1987 Act and to certain derivative pensions payable in respect of judges who die after the commencement. Practically, this means two cohorts have different inflation protections; failure to check the relevant retirement/death date will produce incorrect benefit projections.

2. Forfeiture for practising as a legal practitioner applies broadly and is absolute unless exempted by the Governor (s 15(1)-(3)). The prohibition applies not only in Western Australia but in "any other part of Her Majesty’s Dominions." Unless a written exemption is sought and obtained from the Governor, a pensioner who resumes practice as a barrister, solicitor or proctor risks immediate forfeiture of pension. Practitioners advising retired judges must ensure they secure a Governor’s exemption where post‑retirement practice is planned.

3. Auxiliary judge salary and pension interactions can be counterintuitive (s 5(1b); s 6(3a)-(3c)). An auxiliary judge who is receiving a non‑contributory pension has their salary reduced to the difference between the pension and the full rate. Conversely, service as an auxiliary judge does not count as service as a judge for pension accrual purposes. If a retired judge wishes to accept auxiliary judicial work, the compensation mechanism and pension interaction should be carefully modelled.

4. Commutation process limitations and forms (s 16(3)-(7); s 18(2)-(3)). Commutation to meet a Commonwealth surcharge is an administratively mediated process: the person must request a specific "requested amount" not exceeding the surcharge; the Minister must supply actuarial implications; the person must confirm. The Minister prescribes forms and information (s 16(7)). Failure to adhere to the prescribed form, to supply necessary information, or to meet the time windows could prevent or delay commutation. Requested amounts cannot exceed the surcharge, which may mean partial commutation is insufficient to meet interests or penalties. The Act does not specify maximum timeframes for Ministerial responses.

5. Multiple derivative entitlements are limited to the greatest payable benefit (Second Schedule Part III Item 1). If a person is entitled to more than one pension or allowance under the Schedule, only the greatest is payable. That is a non‑obvious limitation where multiple claims could otherwise be thought cumulative. Administrators must check which benefit is the highest and apply the non‑cumulation rule.

6. Pension reduction by other judicial pensions and State share of other pensions (s 6(3)-(4)). Where a pensioner receives another judicial pension or a pension under the Superannuation and Family Benefits Act 1938 (or its transitional equivalents), the Judges’ Act pension is reduced by the amount of that other judicial pension or the State share. This creates the risk of under‑ or over‑payments if administrators do not accurately identify and net other pension receipts. The statutory cross‑references to historical legislation complicate this calculation because transitional arrangements persist.

7. Deferred payment for spouses who were not partners at retirement (Second Schedule cl 3(2)). Where a person was not the spouse or de facto partner when the judge retired and has not attained age 55 when the former judge dies, the spouse’s pension is payable only from age 55 unless the Minister decides otherwise. This is a timing and eligibility trap for new spouses where counsel might expect immediate survivor pension entitlement.

8. Acting judge service counted in specific circumstances only (s 12A(1)). If a person was an acting judge and was later appointed a judge while holding that acting appointment, service is deemed to have commenced at the acting appointment. That is favourable but only applies where the acting appointment preceded substantive appointment and within the particular date windows set by s 12A(2) for older appointments. Failure to establish the chronology can affect service length calculations.

9. Removal from office extinguishes pension barring Governor’s discretion (s 6(2c)). A judge removed under s 55 of the Constitution Act 1889 or s 9 of the Supreme Court Act 1935 loses pension rights unless the Governor decides otherwise. This is an absolute statutory consequence that may surprise practitioners unfamiliar with those constitutional removal processes.

10. Reliance on Commonwealth definitions and transitional State schemes (ss 2, 16(8), 17(3), 17(8)). The Act ties certain computations and definitions to Commonwealth statutes and to transitional applications of the now repealed Superannuation and Family Benefits Act 1938 (compilation notes). Those interdependencies create complexity in applying the Act because actuaries and administrators must consult Commonwealth instruments and transitional State provisions to determine employer‑sponsored components, State shares, and surcharge definitions. Misreading which Commonwealth provision applies can produce incorrect commutation amounts or preserved benefit calculations.

These "gotchas" are operational realities embedded in the text. Practitioners should cross‑check relevant dates, carefully apply non‑cumulation rules for derivative benefits, confirm whether indexation applies, and ensure formal Ministerial processes are followed for commutation and exemption requests.

This section sets out practical compliance steps for each relevant actor: judges and retirees, spouses/de facto partners and children seeking benefits, the Minister’s office and administrators, actuaries, and Treasury/Finance.

For judges and prospective retirees

1. Establish cohort and entitlement date. Determine whether you are in the pre‑1987 or post‑1987 cohort for pension calculation purposes (check the date of retirement or death relative to the commencement of the Judges’ Salaries and Pensions Amendment Act 1987; see s 6 and s 7). This determines the applicable pension formula and whether CPI indexation under s 8B applies.

2. Calculate pension based on correct salary definition. Confirm whether pension calculations should use final salary or current judicial salary as defined in s 2(1), including any allowances of an annual nature. If a pensionable office has been abolished, the Minister’s determination under s 2(2) will determine the rate to use.

3. If serving when the Act commenced, make the six‑month election if you want to come under ss 6-11 (s 12(2)). Provide written notice to the Minister within six months of the Act’s commencement date to elect. If you do not elect, preserve your historic pension rights and document those rights carefully (s 12(3)-(4)).

4. If contemplating post‑retirement legal practice, apply for a Governor’s exemption before practising. A pensioner who practises as a barrister, solicitor or proctor forfeits the pension unless exempted by the Governor in writing (s 15(1)-(3)). Apply for the exemption in writing and retain evidence of any exemption.

For spouses, de facto partners and children claiming benefits

1. Assess eligibility and timing under the Second Schedule. For spouse/de facto partner pensions and children’s allowances, determine whether the death of the judge occurred before or after the 1987 Act commencement as the Second Schedule prescribes different rules. For example, where a judge dies on or after 1 December 1987, spouse benefits are 37.5% of current judicial salary if the judge died in office (Second Schedule Part I cl 1).

2. Check deferred payment rules. If a spouse was not the judge’s spouse at the time of the judge’s retirement and is under 55 when the judge dies, the pension may be payable only from age 55 unless the Minister decides otherwise (Second Schedule cl 3(2)). Make an application to the Minister for earlier payment if grounds exist.

3. Apply for children’s allowances with dependency evidence. For children’s allowances under Part II Division B, the Minister’s opinion of dependency is relevant (definition of eligible child). Provide documentation of full‑time education and dependency where applicable.

For the Minister’s office and administrators

1. Maintain clear forms and information requirements. The Minister must prescribe form, manner and required information for notices related to commutation (s 16(7)). Draft clear templates, publish guidance and maintain processing timelines to avoid delay. For commutation to meet surcharges, ensure requested amounts do not exceed the statutory limit (s 16(3), s 18(2)).

2. Establish actuarial procedures and panels. The Act requires actuarial advice for determining actuarial equivalence for commutation and preserved benefits (s 16(6)(b), s 17(3)). Maintain a roster of qualified actuaries who are Fellows or Accredited Members of The Institute of Actuaries of Australia (s 2 definition of actuary), and document methodologies consistent with Commonwealth superannuation law where references exist.

3. Coordinate with Commonwealth authorities for surcharge matters. When a pensioner or estate must pay a Commonwealth surcharge, administrators must liaise with the Commissioner of Taxation or other Commonwealth agencies to confirm the surcharge amount and the way State commutation will discharge it (s 16(8), s 18(4)). Ensure accounting and payment routing are agreed and recorded.

4. Implement offset checks and cross‑scheme reconciliations. Before paying a pension, verify whether the recipient holds other judicial positions remunerated from the Crown or other judicial pensions or State share pensions that require offsets under s 6(3)-(4). Create data sharing and verification procedures with other State payroll and superannuation administrators.

For actuaries and valuation professionals

1. Apply prescribed professional standards and the correct legislative base. Actuarial determinations required by s 16(6)(b) and s 17(3) must be performed by an actuary as defined by the Act (s 2(1)). Ensure actuarial assumptions reflect the legislative mandate and interact with Commonwealth superannuation rules where relevant.

2. Document actuarial equivalence calculations transparently. Commutation requires reducing the ongoing pension to an actuarially equivalent amount less the requested lump sum (s 16(6)(b)). Prepare reports showing discount rates, mortality assumptions and the method by which equivalence was calculated to allow for auditability and potential administrative review.

For Treasury, Finance and budget officers

1. Ensure Consolidated Account provisioning. Salaries, pensions, allowances and administration costs are charged to and appropriated from the Consolidated Account (s 5(2), s 11, s 17(6), s 19). Budget for these liabilities and for the variable costs associated with commutation or preserved benefits.

2. Record and report on commutations and surcharge discharges. When commutation pays a Commonwealth surcharge, ensure payment flows and accounting reconcile the State’s payment to the Commissioner. Maintain records linking requested amounts to the associated surcharge evidence.

Practical process checklist for commutation requests

• Person prepares notice specifying the requested amount not exceeding the surcharge (s 16(3), s 18(2)).

• Minister acknowledges and provides the actuarial reduction amount that would apply if commutation proceeds (s 16(4)).

• Person confirms in writing they wish to proceed (s 16(5)). If confirmed, Minister effects lump sum payment and reduces ongoing pension to the actuarially equivalent amount less the requested amount (s 16(6)(a)-(b)).

• Ensure all notices are in prescribed form and accompanied by required information (s 16(7)).

Recordkeeping and audit

• Maintain contemporaneous records of all determinations, forms and actuarial advice. Where the Governor grants an exemption or decides on non‑payability in removal cases, document the written decision and the basis for the exercise of discretion (s 15(2), s 6(2c)).

• Preserve evidence of dependency, marital/de facto status and education for derivative claims. The Second Schedule contains dependency and age conditions for children’s allowances and spouse pensions.

By following these practical steps and by setting clear administrative procedures, the Minister’s office and beneficiaries can comply with the Act’s requirements. The Act’s reliance on Ministerial forms, actuarial advice and Commonwealth interactions makes it essential to integrate legal, actuarial and tax expertise into implementation workflows.
