Jervis Bay Territory Rural Fires Rules 2024

Several recurring legal and operational concepts structure the Rules. First, the brigade constitution: the Rules require a constitution in a form approved by the Minister and list mandatory content areas, including the brigade’s name, governance body and officers, member classifications, meeting arrangements, voting rights, and how fundraising is conducted and applied (s 6(1)(a)-(f)). Members must review that constitution annually and consider Service Standards when deciding whether to amend it (ss 6(2)-(3)). The constitution thus becomes the primary internal rulebook for a brigade, subject to Ministerial approval and periodic review.

Second, membership control and the brigade register. A person is eligible for listing on a brigade register if they comply with the constitution’s procedures and any Minister‑determined requirements (s 7(1)). The Minister retains a gatekeeping power to refuse listing on fitness and propriety grounds (s 7(2)) and to impose conditions on listing (s 7(4)). The Rules create a default probationary membership period of six months (s 8(1)), with specified grounds for removal at the end of that period, notably failing to reach competencies required by the Service Standards (s 8(2)(a)). Removal from membership is further addressed in s 9, which lists mandatory removals (death, written request) and discretionary removals including breaches of discipline, mental incapacity, conviction of serious offences, or a Ministerial finding of unfitness (s 9(1)-(2)). Procedural protections for removals include notice and a 21‑day interval before removal where required, and an internal review process for certain decisions (s 10).

Third, discipline and appeal. The Rules define what constitutes a breach of discipline (contravention of the Ordinance or Rules, negligence or incompetence, failure to comply with Service Standards or conditions of membership, s 11(1)). The Minister may appoint an NSW RFS officer at or above Superintendent rank as the “appropriate disciplinary authority” (s 11(2)), and disciplinary action may only be taken where the alleged breach has been processed in accordance with the Service Standards and notice given in accordance with s 12(1) (s 11(3)). Permitted disciplinary actions include reprimand, suspension, and recommendations to the Minister for demotion, disqualification from holding rank, removal from the register or imposition of membership conditions (s 11(4)). The Rules require at least 14 days’ written notice of the investigation’s findings and proposed disciplinary action, and allow the member 14 days to appeal to the Minister; the Minister may confirm, vary or set aside the disciplinary decision (s 12).

Fourth, the Service Standards as delegated detail. Multiple operational duties (competency thresholds, report contents and timing, disciplinary procedures, incident reporting timeframes and contents) are specified to be “in accordance with” or “required by” the Service Standards (see e.g. ss 6(3), 8(2)(a), 11(3)(a), 13(2)). The Service Standards are thus a central repository of operational detail and of procedures referenced by the Rules but not reproduced within them.

Fifth, inter‑agency coordination and proximity rules. The Rules create particular duties where private land subject to hazard reduction notices or Ministerial hazard reduction work lies within 8 kilometres (or a shorter distance specified by the bush fire management plan) of Commonwealth land (ss 17-18). Those duties require prompt written notification to the authority responsible for the Commonwealth land: copies of notices must be given within 24 hours when a hazard management officer requires an owner/occupier to take action (s 17(2)-(3)), and the Minister must give written notice no later than 24 hours before entry where the Minister intends to carry out hazard reduction work under subsection 59(1) of the Ordinance (s 18). The Rules also prescribe that Commonwealth land is a category of land to which the Minister’s obligation to notify certain bodies on issuing a fire permit applies, and that the authority responsible for that land is the body to be notified (s 19).

Sixth, notice service mechanisms. The Rules detail methods for serving notices or directions under the Ordinance, including personal delivery, leaving with a person apparently over 14 at the premises, prepaid post to the last known address or PO box, fax or email to addresses given by the person, fixing on a conspicuous part of the premises, and attachment to a vehicle where an offence involves a vehicle (s 20(1)(a)-(g)). They also provide for service on an agent where a person appears to be absent from the Territory, and advert-based service where premises are unoccupied and an owner’s address is unknown (s 20(2)).

Seventh, voluntary cooperation with public authorities. The Rules prescribe certain functions of public authorities for the limited purpose of section 27 of the Ordinance, which allows brigades to voluntarily cooperate with public authorities in the exercise of prescribed functions (s 22(1)). Those prescribed functions include functions under the Jervis Bay Territory Emergency Management Ordinance 2015, prevention and suppression of bush fires, hazardous materials response duties for Fire and Rescue NSW and assistance functions for AFP, Ambulance Service of NSW and NSW State Emergency Service (s 22(1)(a)-(f)). The Rules then prescribe which bodies are “public authorities” for that limited purpose (s 22(2)).

Finally, administrative registers and recordkeeping: the Minister must keep a register of members who receive commendations or awards (s 21), and brigades must keep brigade registers (defined in s 4) and follow incident reporting obligations (s 13). Collectively, these concepts form an administrative architecture that centralises Ministerial control over membership and disciplinary outcomes, delegates operational detail to Service Standards and NSW RFS officers, and creates punctual inter‑agency notification duties when bush fire management actions interact with Commonwealth land.

The Rules affect a range of actors in the Jervis Bay Territory and, to an extent, adjacent Commonwealth and NSW agencies.

Primary groups directly affected

• Rural fire brigade members: The Rules govern eligibility for listing on brigade registers (s 7), probationary membership (s 8), grounds for removal from membership (s 9), disciplinary definitions and penalties (s 11), appeals (s 12) and incident reporting duties for officers in charge (s 13). Members’ rights and obligations therefore change materially: constitutions must be Minister‑approved (s 6(1)), members must observe Service Standards to avoid probationary or disciplinary removal (ss 8(2), 11(1)(c)), and disciplinary procedures and remedies are prescribed (ss 11-12).

• Brigade governance bodies: Every brigade must have a constitution in a form approved by the Minister setting out governance arrangements and fundraising rules (s 6). The members must review the constitution annually and take into account Service Standards (s 6(2)-(3)). The brigade’s council or governing body is described as part of constitution content (s 6(1)(b)), so volunteer governing structures must conform to Ministerial expectations.

• The Minister: The Minister retains wide administrative powers: approving constitutions (s 6(1)); determining requirements for membership (s 7(1)(b)); refusing or imposing conditions on listings (s 7(2), (4)); removing names from registers (s 9); appointing review officers and disciplinary officers via NSW RFS (ss 10(3), 11(2)); receiving incident reports (s 13); keeping awards registers (s 21); and being the appeal authority for disciplinary decisions (s 12(2)-(3)). The Minister is therefore the central decision‑maker for membership and disciplinary appeals.

• NSW Rural Fire Service officers: The Rules explicitly require the appointment of NSW RFS officers to conduct membership reviews (an officer at or above Assistant Commissioner rank, s 10(3)) and permit the appointment of an NSW RFS officer at or above Superintendent rank as the appropriate disciplinary authority (s 11(2)). That integrates NSW operational officials into Jervis Bay Territory administrative processes and means those officers’ availability and procedures influence outcomes.

• Authorities responsible for Commonwealth land: When hazard reduction activities involve land within 8 kilometres of Commonwealth land, the hazard management officer or the Minister must notify the authority responsible for the Commonwealth land within strict timeframes (ss 17-18). The Rules also require that when the Minister issues a fire permit for land prescribed under s 82 of the Ordinance, notice must be given to the authority responsible for Commonwealth land (s 19). Those authorities therefore have a right to receive timely notice and to be part of coordination.

Secondary and indirect groups

• Owners and occupiers of private land near Commonwealth land: The Rules require copies of bush fire hazard reduction notices to be sent to the authority responsible for applicable Commonwealth land within 24 hours when the affected land lies within 8 kilometres of Commonwealth land (s 17). Where the Minister intends to enter such private land to carry out hazard reduction works, the Minister must give written notice no later than 24 hours before entry (s 18). Owners and occupiers will therefore face tighter coordination and likely scrutiny where their land is geographically proximate to Commonwealth holdings.

• Other emergency services and agencies: Functions of Fire and Rescue NSW, Ambulance Service of NSW, NSW State Emergency Service, the AFP and emergency services organisations are prescribed as public authority functions for the limited purpose of voluntary cooperation by brigades (s 22(1)-(2)). Those agencies will be the formal partners for voluntary cooperative activity and may be asked to coordinate or accept notices.

• Donors and fundraising targets: Because brigade constitutions must provide for the conduct of fundraising appeals and the application of any money or benefit received (s 6(1)(f)), charities, donors and entities participating in fundraising will be affected by the governance and recordkeeping rules a brigade implements.

• Contractors and service providers engaged for hazard reduction or fire management: The Rules require that fire permits be consistent with bush fire risk management plans (s 24(1)(a)) and that at least one person be present while a permitted fire burns unless the permit provides otherwise (s 24(1)(b)). Contractors running hazard reduction burns or providing services will need to ensure permit conditions are met and that they coordinate with authorities responsible for nearby Commonwealth land where applicable (ss 17-19).

• The general public and “interested persons”: The Fire Management Committee must publicly display draft bush fire risk management plans for at least 42 days (s 16(1)) and display any documents it deems necessary to assist public understanding (s 16(2)). Members of the public may make submissions while the plan is on display (s 16(3)). This creates a public consultation step affecting landholders and stakeholders with an interest in bush fire risk management.

• Administrators and brigade recordkeepers: The Minister must keep a register of awards and commendations (s 21). Brigades must keep brigade registers as required by the Ordinance (s 4 definition). Administrative staff must implement the wide range of notice and recordkeeping requirements set out in the Rules, including strict timeframes for giving copies and notices (ss 17-18, 20).

Who bears costs and who captures benefits

• Concentrated operational burdens fall on brigade members, brigade governance bodies, and landowners whose land is within the specified proximity to Commonwealth land. These actors must adapt constitutions, manage probationary processes, produce and retain records, provide timely communications and comply with Service Standards.

• Concentrated administrative control benefits the Minister and specified NSW RFS officers, who gain clear statutory roles in membership review and discipline, and the authority to approve constitutions and impose conditions on membership.

• Diffuse public benefits, such as clearer public display of bush fire risk management plans and prescribed inter‑agency notification, are claimed purposes of the Rules (see s 16), but the instrument leaves procedural content to the Service Standards. Overall, the Rules reallocate decision rights and procedural duties across brigades, the Minister and specified NSW agencies.

This section sets out the principal statutory duties the Rules impose and the legally cognisable rights created or preserved for various actors, with explicit references to the operative clauses.

Duties imposed by the Rules

• Duty to adopt an approved constitution: Every rural fire brigade must have a constitution in a form approved by the Minister, and that constitution must contain specified matters including governance arrangements and fundraising conduct (s 6(1)(a)-(f)). Members must review the constitution annually (s 6(2)) and consider Service Standards in deciding amendments (s 6(3)).

• Duty to maintain and observe membership processes: Eligibility for listing on a brigade register depends on compliance with the constitution and any Ministerial requirements (s 7(1)). The Minister may impose conditions on listings (s 7(4)). Members have a default six‑month probationary period (s 8(1)); failure to meet competency, constitution or Ministerial conditions may result in removal at the end of probation (s 8(2)). The Minister must notify a person in writing of refusal to list or removal (ss 7(3), 8(3), 9(4)).

• Duty to maintain a brigade register and report incidents: A brigade must keep a brigade register as required by section 15 of the Ordinance (definition of brigade register, s 4). When a brigade attends a fire or emergency, the officer in charge must ensure the Minister receives a written incident report within the time required and containing the matters required by Service Standards (s 13(1)-(2)).

• Duty to notify Commonwealth land authorities in proximity cases: If a hazard management officer issues a bush fire hazard reduction notice for land within 8 km (or shorter distance specified) of Commonwealth land, the hazard management officer must give a copy of the notice to an officer of the authority responsible for the Commonwealth land within 24 hours (s 17(2)-(3)). If the Minister intends to enter land within that proximity to carry out hazard reduction work under subsection 59(1) of the Ordinance, the Minister must give written notice to the authority responsible for the Commonwealth land no later than 24 hours before entering the land (s 18(1)-(2).

• Duty to display draft bush fire risk management plans: The Fire Management Committee must publicly display the draft plan for at least 42 days and display supplementary documents it considers necessary; submissions may be made while the plan is displayed (s 16(1)-(3)).

• Duty to serve notices according to prescribed methods: Notices or directions required or permitted under the Ordinance must be served by specified methods such as personal delivery, leaving at premises with a person apparently over 14, prepaid post, fax or email to addresses provided, fixing on conspicuous parts of land, or attachment to a vehicle where relevant (s 20(1)). Additional provisions allow for service on an agent or by advertisement in limited circumstances (s 20(2)).

• Duty to ensure permit conditions are met: Conditions of a fire permit authorising lighting of a fire include consistency with the bush fire risk management plan and, unless the permit provides otherwise, at least one person must be present while the fire burns (s 24(1)(a)-(b)).

Rights and procedural safeguards

• Right to written notice of refusal or removal: If the Minister refuses to list a person or removes a person from the brigade register, the Minister must notify the person in writing (ss 7(3), 8(3), 9(4)).

• Right of internal review for certain membership decisions: A person may apply to the Minister for review of decisions to refuse listing (s 7(2)) and certain removals under s 9(2)(b), (c), (d) or (e) (s 10(1)). The application must be in writing, set out reasons and be lodged within 21 days of the decision (s 10(2)). The Minister must appoint an NSW RFS officer at or above Assistant Commissioner rank as review officer (s 10(3)). The review officer, after taking into account all relevant information, may confirm the decision or include the applicant’s name on the brigade register or decide to retain the applicant’s name (s 10(4)). The review officer must notify the applicant in writing of the decision and reasons (s 10(5)). If a decision to remove a name is under review, the name must not be removed until the review is decided (s 10(6)).

• Right to procedural fairness in disciplinary proceedings: Before disciplinary action is taken, the appropriate disciplinary authority must investigate the alleged breach and give the member at least 14 days’ written notice of the investigation’s findings and proposed disciplinary action (s 12(1)). The member may appeal in writing to the Minister within 14 days of receiving the notice (s 12(2)). The Minister has power on appeal to confirm the disciplinary decision or determine that no action or some other action be taken (s 12(3)).

• Right to appeal to Minister for disciplinary matters: The member’s appeal to the Minister is a statutory right, drawing the final decision up to Ministerial level (s 12(2)-(3)).

Delegated authorities and discretion

• Ministerial discretion to refuse and impose conditions: The Minister may refuse to list a person as not being “fit and proper” and may impose conditions on listing (s 7(2)-(4)). The Minister may remove names for a range of grounds, including fitness and propriety, conviction of serious offences and mental incapacity (s 9).

• Delegation to NSW RFS officers: The appointment of NSW RFS officers as review officers (Assistant Commissioner or above, s 10(3)) and as disciplinary authorities (Superintendent or above, s 11(2)) delegates substantive investigatory and adjudicative tasks to external agency members.

• Delegation of procedural detail to Service Standards: The Rules repeatedly reference Service Standards for competency thresholds, disciplinary procedure steps, incident report content and timing, and other operational detail (see e.g. ss 6(3), 8(2)(a), 11(3)(a), 13(2)). The Service Standards therefore set out essential procedural elements that will determine how statutory duties are implemented.

Scope limits and prescribed functions

• The Rules prescribe certain public authority functions for the limited purpose of section 27 of the Ordinance, allowing brigades to voluntarily cooperate with public authorities in those functions (s 22(1)). The Rules then list the public authorities prescribed for this limited purpose (s 22(2)). The prescription is limited to the functions and the specific authorities named, not a blanket authorisation for all inter‑agency activity.

• The Rules prescribe that certain types of land are to be treated as “managed land” for the Ordinance’s purposes: land dedicated for a public purpose and roads vested in the Commonwealth (s 23).

Taken together, the Rules create both affirmative duties (constitutions, reporting, notice) and processes that protect individuals through notice, review and appeal rights. Many of the operative details that determine the scope and intensity of those duties are contained in Service Standards and in the delegated roles of NSW RFS officers, so the practical effect of the Rules depends heavily on those external instruments and appointments.

The Rules set out an administrative enforcement regime for rural fire brigades centred on membership status and disciplinary measures rather than criminal penalties. The instrument prescribes who may take disciplinary action, the range of permissible sanctions, procedural requirements before sanctions can be imposed, and immediate administrative enforcement steps for membership removal.

Types of enforcement actions available

• Reprimand and suspension: The appropriate disciplinary authority may reprimand a member or suspend the member from service with the rural fire brigade for a specified period (s 11(4)(a)-(b)). Suspension is an administrative sanction that temporarily removes service privileges.

• Recommendations to the Minister: The appropriate disciplinary authority may recommend to the Minister that the Minister take a range of actions, including demotion of an officer, disqualification from holding rank in the brigade, removal of the member’s name from the brigade register, or imposition of membership conditions under s 7(4) (s 11(4)(c)(i)-(iv)). These recommendations are binding on Ministerial decision processes only to the extent the Minister chooses to act on them; the Rules give the Minister final administrative power in membership decisions.

• Removal from the brigade register: The Minister must remove a person’s name where the person dies or requests removal (s 9(1)), and may remove a person’s name for a range of reasons, including breach of discipline (s 9(2)(a)). Removal from the register is the most definitive administrative sanction because it ends formal membership.

Procedural and temporal constraints on enforcement

• Procedural prerequisites for disciplinary action: The Rules require that an alleged breach of discipline be dealt with in accordance with the procedure set out in the Service Standards and that the notice requirements of s 12(1) are complied with before an appropriate disciplinary authority may take disciplinary action (s 11(3)(a)). This means that the Service Standards’ procedures are a precondition to any disciplinary sanction.

• Pre‑disciplinary notice and appeal window: Before disciplinary action occurs, the appropriate disciplinary authority must investigate the alleged breach and give the member at least 14 days’ written notice of the investigation’s findings and the disciplinary action proposed (s 12(1)). The member has 14 days after receiving that notice to appeal to the Minister (s 12(2)). The Minister may confirm, vary or overturn the disciplinary action (s 12(3)). These timing rules impose minimum procedural safeguards.

• Notice and stay on removals subject to review: If the Minister proposes removal for certain grounds (ss 9(2)(b), (c), (d) or (e)), the Minister must notify the person before removal (s 9(4)), and must not remove the person’s name until 21 days after giving notice or until the conclusion of any review under s 10 (s 9(5)). If an application for review under s 10 is made, the person’s name cannot be removed until the review officer decides (s 10(6)). These provisions create a temporal stay on removal while internal review processes proceed.

Enforcement actors and delegated powers

• Appropriate disciplinary authority: The Minister may appoint an officer of the NSW Rural Fire Service at or above Superintendent rank to be the appropriate disciplinary authority (s 11(2)). If no officer is appointed, a disciplinary panel constituted in accordance with the Service Standards will perform the function (s 11(5)(b)). The appropriate disciplinary authority conducts investigation and proposes sanctions subject to the Service Standards’ procedure (s 11(3)(a)).

• Ministerial role: The Minister is the final decision‑maker for listing refusals and for appeals from disciplinary measures (ss 7(2), 10, 12). The Minister also imposes conditions on membership and removes names from registers (ss 7(4), 9).

• Review officer: For specified membership decisions, the Minister must appoint an NSW RFS officer at or above Assistant Commissioner rank to undertake review (s 10(3)). The review officer may confirm the Minister’s decision, include the applicant’s name on the register subject to conditions, or retain the applicant’s name on the register (s 10(4)). This creates an internal review mechanism that is not court‑based but uses an external agency officer to reconsider Ministerial decisions.

Enforcement scope and limits

• Administrative rather than penal: The Rules do not prescribe criminal penalties. The enforcement tools are organisational and administrative (reprimand, suspension, demotion, disqualification, removal from register, imposition of conditions). Criminal offences and their penalties, if any, would be found in the Ordinance or other legislation; the Rules focus on internal and administrative discipline.

• Dependence on Service Standards: Several enforcement steps are conditional on procedures in the Service Standards (e.g. ss 11(3)(a), 13(2)). Where the Rules defer to Service Standards, actual enforcement practice will depend on how those standards are drafted and applied. The Rules therefore create enforcement authority but delegate much of the tactics and evidence requirements to a separate instrument.

• Inter‑agency enforcement interactions: Duties to notify and coordinate with authorities responsible for Commonwealth land (ss 17-19) create administrative enforcement expectations across agencies. However, the Rules do not set out explicit sanctions for failing to provide the required notice to these authorities; enforcement in such cases would be subject to the Ordinance or other administrative remedies where relevant.

Recordkeeping and public accountability

• Incident reports: Brigades must provide written incident reports to the Minister in accordance with Service Standards (s 13). The Minister’s register of awards and commendations must be kept (s 21). These recordkeeping duties provide documentation that can support enforcement actions and transparency.

• Public display obligations: The Fire Management Committee must publicly display a draft bush fire risk management plan for 42 days (s 16). Public consultation steps introduce potential reputational and political enforcement via stakeholder feedback and scrutiny.

Implementation risks and enforcement burden

• Enforcement requires coordination and timely action by Ministerial staff and appointed NSW RFS officers. The Rules mandate specific short timeframes for notification and review (14 days for disciplinary notice and appeal, 21 days before removal after notice under s 9(4), 24 hours for certain inter‑agency notices under ss 17-18). Meeting these timeframes may impose administrative burden and raise operational risk if staff and officers are not available.

• The Rules confer discretionary power (e.g. “fit and proper person”, ss 7(2), 9(2)(e)) and rely on delegated standards, which concentrates enforcement discretion in Ministerial and delegated hands, albeit constrained by notice and review steps.

In summary, enforcement under the Rules is administrative and procedural, anchored in membership status and internal disciplinary mechanisms, uses defined notice and appeal windows, and delegates significant practical enforcement detail to Service Standards and NSW RFS officers.

The Rules are expressly made under the Jervis Bay Territory Rural Fires Ordinance 2014 (s 3), and they operate as subordinate instruments that fill procedural, governance and operational detail for provisions of the Ordinance. The text also references and interacts with other statutory instruments and public authorities, producing a network of inter‑instrument and inter‑agency linkages.

Primary statutory interaction with the Ordinance

• Source of power: The Rules are made under subsection 98(1) of the Jervis Bay Territory Rural Fires Ordinance 2014 (s 3). The Rules therefore implement and provide detail to operational powers granted by the Ordinance. Several Rules provisions explicitly reference and operate under specific Ordinance provisions: for example, the public display requirement in s 16 relates to subsection 47(1) of the Ordinance, notice duties in ss 17-18 engage subsections 58(3) and 59(1) of the Ordinance respectively, and the fire permit notice in s 19 relates to section 82 of the Ordinance.

• Delegation to Service Standards under the Ordinance: The Rules frequently refer to Service Standards for procedural detail (see e.g. ss 6(3), 8(2)(a), 11(1)(c), 13(2)). The Ordinance defines Service Standards (not reproduced here) and authorises their use as instruments establishing operational expectations and competency requirements. The practical interplay is that the Rules establish legal framing and timing while Service Standards set out the technical requirements that members and brigades must meet.

Inter‑jurisdictional and agency interactions

• NSW Rural Fire Service (NSW RFS): The Rules require the Minister to appoint NSW RFS officers as review officers for membership reviews (Assistant Commissioner or above, s 10(3)) and allow appointment of NSW RFS officers as the appropriate disciplinary authority (Superintendent or above, s 11(2)). This integration creates administrative cross‑border interaction: NSW RFS personnel will exercise review and disciplinary functions under the Rules, applying Service Standards and providing operational expertise. The Rules therefore create institutional linkages between Commonwealth territory administration and NSW emergency services.

• Fire & Rescue NSW, Ambulance Service of NSW, NSW State Emergency Service and AFP: The Rules prescribe certain functions of these agencies as “prescribed functions” for the purpose of section 27 of the Ordinance, enabling brigades to voluntarily cooperate with them (s 22(1)). The Rules then prescribe which bodies are “public authorities” for that limited purpose (s 22(2)). They also specify that some prescribed functions include hazardous materials response, traffic control by the AFP and assistance with incidents or patient care (s 22(1)(c)-(f)). The interaction is therefore operational: brigades may lawfully assist these agencies in specified functions under the Ordinance as implemented by the Rules.

• Jervis Bay Territory Emergency Management Ordinance 2015: The Rules prescribe, as a public authority function for cooperative purposes, functions that may be exercised by a public authority under the Jervis Bay Territory Emergency Management Ordinance 2015 (s 22(1)(a)). This references the emergency management framework for the Territory and aligns rural fire brigade cooperation with the broader emergency management statutory architecture.

Commonwealth land and proximity rules

• Commonwealth and Territory land interfaces: The Rules create specific notification duties where bush fire hazard reduction notices and Ministerial hazard reduction entries involve land within 8 kilometres (or a shorter distance specified by the bush fire management plan) of Commonwealth land (ss 17-18). Commonwealth land is also prescribed for purposes of section 82 notice obligations (s 19). These provisions therefore create a statutory duty to coordinate between territorial hazard management activities and Commonwealth land authorities. The Rules do not amend Commonwealth land governance in other legislation, but they require cross‑entity communication and coordination which can affect how responsibilities under multiple instruments are executed.

Notice and service rules vis‑à‑vis other process legislation

• Methods of service under s 20 specify precise ways notices or directions under the Ordinance must be served. These methods will interact with procedural requirements in the Ordinance itself and potentially with administrative law notions of effective service or actual notice. The Rules expand available service methods (including email and fax where addresses are given, fixing notices to premises, and attachment to vehicles) and provide for agent service or advertisement in limited cases (s 20(2)). How these service methods align with due process standards under other legislation remains a matter of legal interpretation, but the Rules specify mandatory methods for the Ordinance’s notice regime.

Limits of statutory interaction

• The Rules do not purport to alter criminal law or penalties outside administrative membership and disciplinary measures. They do not create new offences or criminal penalties; the disciplinary and membership outcomes are administrative (ss 11-12). Any criminal provisions or broader enforcement powers would be located in the Ordinance or other statutes, not in the Rules.

• The Rules delegate many operational specifics to Service Standards and to NSW RFS officers. The precise interactional effect therefore depends on the content of the Service Standards and the nature of appointments and memoranda of understanding (if any) between the Territory Minister and NSW RFS. Those instruments and arrangements are external to the Rules, meaning the Rules create the legal scaffolding but rely on other instruments and agency practices to carry out day‑to‑day interaction.

Administrative law and review mechanisms embedded in the Rules

• The Rules provide internal review mechanisms for specified decisions (s 10). They also provide an internal appeal to the Minister for disciplinary actions (s 12). These internal review rights are statutory; the Rules require the Minister to appoint NSW RFS officers to conduct certain reviews (s 10(3)). The Rules do not specify external judicial review rights; whether and how judicial review would apply is governed by general administrative law principles and not by the Rules themselves.

In sum, the Rules operate as a subordinate, procedural instrument to the Ordinance and cross‑reference and require coordination with NSW emergency services, Commonwealth land authorities and the Territory’s emergency management framework. The practical reach of the Rules depends on Service Standards and inter‑agency appointments and agreements, turning the Rules into a statutory bridge between local brigade governance and broader multi‑agency emergency management arrangements.

This instrument replaces and repeals the Jervis Bay Territory Rural Fires Rule 2014 in its entirety (Schedule 1). The Rules were made by the Minister on 18 March 2024 as indicated on the instrument and commence on 1 October 2024 (s 2 and the front matter). The instrument is expressly made under subsection 98(1) of the Jervis Bay Territory Rural Fires Ordinance 2014 (s 3). Apart from the repeal noted in Schedule 1, the Rules amend no other instrument by express textual amendment clauses; instead, they establish new or revised procedural rules and replace the earlier 2014 Rules wholly.

Documented explicit changes in structure and content

• Repeal of 2014 Rules: Schedule 1 directs the repeal of the whole of the 2014 instrument (Schedule 1, item 1). That is the explicit statutory change in instrument form: the 2014 Rules cease to operate and are superseded by this 2024 instrument on commencement.

• New provisions and recodifications: The Rules set out a standalone framework for constitution requirements (s 6), the default probationary membership period (s 8), appointment of NSW RFS officers for review and disciplinary roles (ss 10(3), 11(2)), specific inter‑agency notice timeframes for land within 8 kilometres of Commonwealth land (ss 17-18), a 42‑day public display period for draft bush fire risk management plans (s 16(1)), and explicit prescribed public authority functions for voluntary cooperation (s 22). Whether these are substantially new policy positions relative to the 2014 Rules cannot be determined from the text alone, but the instrument’s operational mechanics appear to provide greater specificity on probation, review and NSW RFS involvement than a bare reference would.

Instrument provenance and legal authority timeline

• Made and signed: The Rules are signed by the Minister, Kristy McBain, Minister for Regional Development, Local Government and Territories, with the making date shown as 18 March 2024 in the instrument’s front matter.

• Commencement: The Rules do not commence immediately on signing; they have a deferred commencement date of 1 October 2024 (s 2). That creates an implementation window during which brigades, the Minister’s office and relevant agencies may prepare for the new obligations, review constitutions, and set up necessary registers and appointments.

• Reliance on the Ordinance: Because the Rules are subordinate to the Ordinance, any future amendments to the Ordinance could change the Rules’ scope or render parts obsolete. Similarly, amendments to Service Standards (to which the Rules frequently defer) will affect operational implementation; those changes are not recorded in this instrument but form part of the broader dynamic legal environment.

Notable structural features that reflect amendment or drafting choices

• Delegation of operational detail: The Rules consistently refer to “Service Standards” for detailed operational requirements (ss 6(3), 8(2)(a), 11(1)(c), 13(2)). This reflects a drafting approach that fixes high‑level duties and procedures in the Rules but leaves technical, competency and reporting details to an administratively easier-to‑amend instrument. From an amendment‑history perspective, this means operational practice can change without primary instrument amendment, by changing Service Standards instead.

• Cross‑jurisdictional appointments: The express requirement that NSW RFS officers at specified ranks be used for review and disciplinary roles (ss 10(3), 11(2)) institutionalises an intergovernmental practice within the Rules. If those interface arrangements change, say, by a change in policy or in the availability of NSW RFS staff, the Rules would either need amendment or administrative workaround.

• Repeal-only schedule: The instrument’s schedule merely repeals the 2014 Rules; it does not make textual amendments to other instruments. This one‑to‑one replacement style simplifies the amendment history: the 2014 Rules are replaced and the 2024 instrument operates from its commencement date forward.

Absence of other legislative amendment markers

• The Rules do not purport to amend any other named legislation in their text. The instrument’s reference to other laws is operational: it prescribes how parts of the Ordinance are to be implemented and names other authorities for cooperative purposes.

In summary, the amendment history is straightforward within the instrument: the 2024 Rules replace the 2014 Rules, they are made on 18 March 2024 and commence on 1 October 2024, and they operate under the Ordinance’s authorising power. Many of the Rules’ operative effects will be shaped over time by changes to Service Standards and by the practical operation of the cross‑jurisdictional relationships the Rules establish.

The Rules themselves do not include any litigation history or list of judicial decisions. The instrument contains no references to past cases or prior judicial interpretation. As a standalone statutory instrument, it sets out administrative rights, duties and internal review mechanisms but does not summarise or record any judicial challenges to those provisions.

Statutory internal review mechanisms

• The Rules create specified internal administrative review and appeal routes that are statutory in character. For example, a person who is refused listing on a brigade register or who is removed under certain grounds may, within 21 days, apply for a review to be conducted by an officer of the NSW Rural Fire Service at or above Assistant Commissioner rank (s 10(1)-(4)). Disciplinary action affords a written notice requirement and a 14‑day appeal to the Minister (s 12). These internal mechanisms may be used by affected persons as the primary administrative recourse prior to, or instead of, pursuing external judicial review.

Potential dispute points created by the Rules (where litigation could arise, though no cases are named)

• Fitness and propriety decisions: The Minister’s discretion to refuse listing or to remove a person’s name from a brigade register where the Minister forms the opinion the person is not fit and proper to be a member (ss 7(2), 9(2)(e)) creates a discretionary decision that could generate dispute over whether the exercise of discretion complied with applicable principles. The Rules prescribe an internal review route (s 10), but do not eliminate the possibility of external legal challenge.

• Disciplinary procedures and Service Standards reliance: The Rules make disciplinary action contingent on procedures set out in the Service Standards and require notice and appeal rights (ss 11(3)(a), 12(1)). Disputes may arise over whether procedures in the Service Standards were correctly followed, whether the Service Standards themselves are reasonable, or whether the appropriate disciplinary authority had jurisdiction. The Rules themselves provide for internal appeals to the Minister (s 12(2)-(3)), but questions about lawfulness of the process or reasonableness of sanctions might attract external review.

• Notice and service disputes: The Rules set detailed methods of serving notices (s 20). Disputes could arise about whether service was effective, particularly where service by email, fax or advertisement was employed. The Rules specify when such methods can be used (e.g. addresses “given by the person” for fax and email, s 20(1)(d)-(e); advertisement for unoccupied premises where the owner’s address is not known, s 20(2)(b)), but parties may contest whether the prerequisites for those service methods were satisfied.

• Inter‑agency coordination and Commonwealth land proximity rules: The tight notification timeframes for hazard reduction notices and Ministerial entry near Commonwealth land (ss 17-18) could generate disputes if an authority responsible for Commonwealth land claims inadequate notice leading to harm or operational conflict. The Rules do not prescribe sanctions for failing to give these notices; disputes would likely be administrative and fact‑sensitive.

Limits in the Rules that bear on litigation prospects

• The Rules provide internal statutory procedures for review and appeal in specific circumstances (ss 10 and 12). These internal remedies are prerequisites often relevant to any external judicial review because courts may expect claimants to exhaust available administrative remedies.

• The Rules do not themselves create criminal offences; enforcement is administrative and internal (ss 11-12). Litigation, where it occurs, will likely concern administrative law issues (procedural fairness, jurisdiction, reasonableness) rather than criminal law.

Because the instrument contains no case law or litigation history, any assessment of likely litigation routes must be inferred from the decision points and internal review mechanisms the Rules create. The Rules provide internal statutory appeal and review processes that will be the first forum for many disputes. The instrument does not record whether similar provisions in earlier instruments were litigated, and no judicial decisions are cited in the text of the Rules.

This section flags operational traps, drafting quirks and compliance pitfalls that come directly from the Rules’ wording and structure. Each “gotcha” references the relevant clause and explains the practical consequence for brigades, members, landowners and administrators.

1. Broad “fit and proper” discretion with limited definitional bounds (ss 7(2), 9(2)(e))

• The Minister may refuse to list a person or remove a person from the brigade register if the Minister considers the person not “fit and proper” to be a member. The Rules do not define “fit and proper” in the instrument itself; the absence of an express statutory definition means the Minister’s subjective assessment will drive outcomes. Although internal review is available for certain decisions (s 10), the lack of definition creates uncertainty for applicants and needs careful documentation of fitness factors in Ministerial decisions to withstand challenge.

2. Heavy reliance on Service Standards for critical thresholds and procedures (multiple provisions)

• Competency requirements, disciplinary procedure content, incident report timing and content, and the constitution review considerations are repeatedly tied to Service Standards (see ss 6(3), 8(2)(a), 11(3)(a), 13(2)). The Rules therefore shift operational detail to a separate instrument. If Service Standards are not published, are vague, or are changed frequently, brigades and members may face shifting compliance expectations without a clear parliamentary record. Operational officers should ensure they have the current Service Standards and understand amendment protocols.

3. Short timeframes for inter‑agency notices (ss 17(3), 18(2))

• Where land subject to a bush fire hazard reduction notice is within 8 kilometres of Commonwealth land, the hazard management officer must give a copy of the notice to the Commonwealth land authority within 24 hours (s 17(3)). Similarly, the Minister must provide written notice no later than 24 hours before entering land near Commonwealth land to carry out hazard reduction work (s 18(2)). These 24‑hour windows are operationally tight and may be missed if administrative processes are not set up in advance.

4. Probationary membership default and competency test linked to Service Standards (s 8)

• The default probationary period is 6 months (s 8(1)). Removal at the end of probation can occur if the person has not achieved a level of competency required by the Service Standards (s 8(2)(a)) or fails other constitution or Ministerial requirements (s 8(2)(b)-(c)). Members entering brigades need to track competency milestones and training records against the Service Standards from day one; brigades must have systems to document competencies for review and to avoid automatic removal.

5. Delegation of review and disciplinary tasks to NSW RFS officers (ss 10(3), 11(2))

• The Rules require a review officer to be an NSW RFS officer at or above Assistant Commissioner rank (s 10(3)) and permit the appointment of an NSW RFS officer at or above Superintendent rank as the appropriate disciplinary authority (s 11(2)). Practical implications include coordination, travel or availability constraints, and the need to understand NSW RFS procedural practices which may differ from local expectations. Brigades and members should understand the terms of appointment and the procedural rules NSW RFS will apply.

6. Notice service methods require contact information “given by the person” for electronic service (s 20(1)(d)-(e))

• Service by fax or email is permitted only to numbers or addresses “given by the person” as contact points. If a person has not provided an email or fax, those methods may not be valid. Conversely, if a person has provided an address, that method is usable and may be treated as effective service. Parties should maintain up‑to‑date contact details and keep records of any addresses provided to ensure the validity of service.

7. Unoccupied premises service by advertisement where owner’s address not known (s 20(2)(b))

• If premises are unoccupied and the owner’s address or place of residence is not known, service may be by advertisement in an approved form published in a newspaper circulating in the Territory. The Rules do not define the “approved form” or the relevant newspaper(s), which can lead to disputes about whether adequate notice occurred. Administrators should confirm the approved form and circulation requirements beforehand.

8. Fundraising and application of funds must be in constitutions (s 6(1)(f))

• Brigade constitutions must provide for the conduct of fundraising appeals and the application of money or benefits received in fundraising (s 6(1)(f)). For brigades that raise funds or receive donations, this requires formal governance language and possibly accounting procedures; absence of clear rules may trigger internal disputes or affect charitable law compliance. Constitutions should be drafted in consultation with legal or financial advisers.

9. Draft bush fire risk management plan display period is 42 days (s 16(1))

• The Fire Management Committee must display a draft plan for at least 42 days, and may display supporting documents it considers necessary (s 16(1)-(2)). The 42‑day minimum is a fixed statutory minimum; plans should be posted well ahead of any operational timeline to allow for public submissions.

10. Typographical or numbering inconsistencies in s 22(2)

• Section 22(2) prescribes certain public authorities “but only for the purposes of section 27 of the Ordinance and subsection 22(1) of these Rules” and lists paragraphs (a), (b), (d), (e) without a (c). While likely a drafting oversight, it may cause interpretive queries about whether an omitted entry was intended. Practitioners should seek clarification if reliance on the precise list of public authorities is critical.

11. Limited explicit sanctions for failure to provide inter‑agency notices (ss 17-18)

• The Rules require timely notice to authorities responsible for Commonwealth land but do not set out express penalties for failing to give those notices. Consequently, enforcement of those notice obligations may be realised through administrative remedies, reputational channels, or by reference to the Ordinance rather than through specific fines or criminal sanctions in the Rules. Actors should not assume the absence of an express sanction equals absence of liability in other instruments or common law.

12. Conditions on fire permits require consistency with bush fire risk management plan (s 24(1)(a))

• A fire permit condition requires the fire to be consistent with the bush fire risk management plan. If the plan is ambiguous or silent on the activity proposed, permittees may face permit refusals or conditions. Applicants should ensure proposed burns or fires align with the plan or seek clarifying amendments before relying on a permit.

Each of these “gotchas” flows from textually explicit elements of the Rules. Addressing them will typically require administrative preparedness, clear recordkeeping, timely communication, and familiarity with the Service Standards and the procedures of NSW RFS officers who will be playing statutorily prescribed roles.

This section sets out concrete steps and administrative practices brigades, officers, landowners and authorities should adopt to meet the Rules’ requirements. The actions are grounded in the Rules’ text and its cross‑references to the Ordinance and Service Standards.

1. Adopt or update brigade constitutions to the Minister’s approved form (s 6)

• Prepare a constitution that contains the mandatory elements listed in s 6(1): brigade name; the council or governing body and its officers; classification of members other than officers; meeting arrangements; voting rights; and rules for fundraising appeals and the application of any money or benefit received in fundraising (s 6(1)(a)-(f)). Submit the constitution for Ministerial approval and keep records of submission and approval. Ensure the constitution incorporates a process for annual review (s 6(2)) and a mechanism to take Service Standards into account when considering amendments (s 6(3)). If fundraising occurs, include explicit financial governance provisions, disbursement rules and recordkeeping standards.

2. Maintain and secure brigade registers and membership records (s 4 definition, s 7)

• Keep a brigade register as required under section 15 of the Ordinance (referenced in the definition of brigade register, s 4). Record membership eligibility checks, constitution compliance, any Ministerial conditions imposed on listings (s 7(4)), probationary period start and end dates (s 8(1)), competency assessments against the Service Standards (s 8(2)(a)), and written notices of refusal, removal or condition imposition (ss 7(3), 8(3), 9(4)). For each entry in the register, retain copies of any Ministerial notices and any internal disciplinary or training records.

3. Implement competency tracking during probation and beyond (s 8)

• For probationary members, track competencies required by the Service Standards and schedule training, assessments and qualifications so evidence exists at the end of the six‑month period. If a member does not attain required competencies, ensure procedural compliance with competency review and Ministerial notification for possible removal (s 8(2)-(3)).

4. Prepare for disciplinary procedures and appeals (ss 11-12)

• Familiarise all members with the definition of a breach of discipline in s 11(1) (contravention of the Ordinance or Rules, negligence, failure to comply with Service Standards, or failure to comply with conditions of membership). Ensure the brigade’s internal disciplinary procedures align with Service Standards so that any investigation or sanction will be valid under s 11(3)(a). Maintain robust investigation records to support findings. If a disciplinary notice is issued, observe the minimum 14‑day notice period and prepare an appeal record promptly if the member intends to appeal to the Minister within 14 days (s 12(1)-(2)).

5. Manage inter‑agency notification obligations (ss 17-19)

• Identify properties and operational areas that fall within 8 kilometres of Commonwealth land or any shorter distance specified in the bush fire management plan. For hazard management officers issuing bush fire hazard reduction notices affecting land within that radius, prepare a process to give a copy of the notice to the authority responsible for the Commonwealth land within 24 hours of issuing the notice (s 17(2)-(3)). Similarly, if the Minister plans to enter land within that radius to carry out hazard reduction work, the Minister’s office must ensure written notice is given to the Commonwealth land authority no later than 24 hours before entry (s 18(2)). Build checklist items into operational workflows to prevent missed 24‑hour windows.

6. Comply with public display and consultation requirements for bush fire risk management plans (s 16)

• When a draft bush fire risk management plan is prepared, ensure the Fire Management Committee places the draft on public display for at least 42 days (s 16(1)). Publish any documents the Committee considers necessary to understand the plan (s 16(2)). Provide mechanisms for capturing submissions and ensure that submissions are considered and recorded in accordance with Committee procedures.

7. Use correct service methods for notices and directions (s 20)

• Follow s 20’s specified service methods: personal delivery, leaving with a person apparently over 14 at the person’s premises, prepaid post, fax or email to contact details given by the person, fixing on a conspicuous part of property, or attachment to a vehicle where relevant (s 20(1)(a)-(g)). If the recipient is absent from the Territory, serve their agent as permitted (s 20(2)(a)). For unoccupied premises with no known owner address, use advertisement in the approved form in a newspaper circulating in the Territory (s 20(2)(b)). Retain proof of posting, delivery, email transmission and any advertisements used to demonstrate effective service.

8. Ensure fire permits conform to plan and supervision conditions (s 24)

• When applying for or issuing a fire permit, ensure the intended lighting of the fire will be consistent with the bush fire risk management plan (s 24(1)(a)). Unless the permit provides otherwise, plan for at least one person to be present from lighting until extinguishment (s 24(1)(b)). Document the person(s) responsible and their competencies relative to the Service Standards.

9. Record incident reports consistently and promptly (s 13)

• When a brigade attends a fire or other incident, the officer in charge must ensure a written report is provided to the Minister within the time and with the content required by Service Standards (s 13(1)-(2)). Create incident report templates aligned to the Service Standards to ensure timeliness and completeness. Maintain copies of incident reports, dispatch logs and any associated evidence.

10. Keep Ministerial awards and commendation registers (s 21)

• The Minister’s office must keep a register of members who receive commendations or awards for long service, bravery or meritorious service, including details of the commendation or award (s 21). Brigades should forward details promptly to the Minister’s office when such awards are given to facilitate accurate recordkeeping.

11. Structure voluntary cooperation agreements carefully (s 22)

• If brigades may assist public authorities in prescribed functions, ensure formal written agreements or memoranda of understanding are in place where necessary. The Rules prescribe which functions are covered and which bodies count as “public authorities” for the limited purpose of section 27 of the Ordinance (s 22(1)-(2)). Establish clear command, liability and insurance arrangements before undertaking hazardous materials response, traffic control support, or patient care functions listed in s 22(1).

12. Confirm the content of Service Standards and engagement with NSW RFS personnel

• Because many obligations are defined “by” or “in accordance with” Service Standards, obtain the current Service Standards and integrate them into training, constitutions and operational checklists (ss 6(3), 8(2)(a), 11(3)(a), 13(2)). When facing a review or disciplinary process, be prepared to engage with the NSW RFS officer appointed to act as review officer or disciplinary authority (ss 10(3), 11(2)). Understand the rank requirements and whether substitute arrangements are possible if those officers are unavailable.

13. Maintain transparent documentation for appeals and reviews (ss 10, 12)

• For decisions that carry internal review rights (s 10), ensure written records include reasons for decisions, notice to the affected person, and clear guidance on how to apply for review within 21 days (s 10(2)). For disciplinary notices, provide written findings and proposed sanctions and ensure the 14‑day appeal window is communicated clearly (s 12(1)-(2)). Proper documentation reduces the risk of procedural challenge.

14. Seek clarification where the Rules are silent or operationally ambiguous

• The Rules leave several operational details to Service Standards and to the Minister’s discretion (e.g. the approved form for constitutions, approved form for advertisement, and what constitutes “fit and proper”). Where ambiguity would materially affect compliance, seek clarification from the Minister’s office or the Fire Management Committee and document any guidance received.

By following these steps and embedding the Rules’ procedural timelines into governance checklists and operational workflows, brigades and relevant authorities can operationalise compliance. The recurring theme is to align constitutions and local processes with the Service Standards, maintain robust records, and coordinate proactively with Commonwealth land authorities and NSW RFS personnel where the Rules require cross‑agency engagement.
