69 Recovery of costs
(1) A first adjoining owner who repairs or restores a fence in accordance with an order under subsection 68(5) is entitled to recover the cost of carrying out the work from the second adjoining owner. (2) Any money that a second adjoining owner is required or liable to pay under this section may be recovered as a debt in a court of competent jurisdiction. (3) In any proceedings for the recovery of the money, a certificate of the ACT Magistrates Court as to the making and content of an order made by it under subsection 68(5) is evidence of the matters set out in the certificate.
