Jervis Bay Territory Marine Safety Rules 2016

The instrument introduces and relies on several key concepts, some defined within the Rules themselves and others imported from the Ordinance. “Required safety equipment” and “required standards” are the two central legal categories, each defined by reference to the provisions of this instrument via subsection 66(3) of the Ordinance. The Ordinance itself defines “recreational vessel”, “power-driven vessel”, “sailing vessel”, “NSW waters”, “appropriate lifejacket” and “vessel”, and those definitions are incorporated by note in section 4.

Within the instrument, three vessel types receive bespoke treatment and are defined in section 4. A “dragon boat” means a paddle craft that is carvel constructed with a single hull and a keel tunnel, propelled by a crew using single bladed paddles. An “off-the-beach vessel” means an unballasted, sail only vessel (including a centreboard dinghy, skiff or multihull) but excludes a vessel with a cabin or a fixed keel. A “tender” means a vessel used only to transport goods or persons between shore and its parent vessel or between parent vessels, that does not operate further than one nautical mile from its parent vessel, and is less than 7.5 metres in length. These definitions are critical because they determine which alternative equipment set applies and whether exceptions are available.

The concept of “alternative requirement” appears in sections 7 and 8. For small tenders (under three metres and operating within 200 metres of shore) and dragon boats meeting certain conditions, the operator may elect to carry a reduced set of equipment instead of the full set under section 6. This is a genuine choice, not a default; the operator must choose one or the other. The dragon boat alternative, for instance, substitutes a rope of specified dimensions and, for night operations, flares or a mobile phone in a watertight container, in lieu of the general list.

The instrument also uses the concept of “NSW waters” as a benchmark for two types of equipment: anchors and fire extinguishers. The anchor must be of the same standard as would be required if the vessel were in NSW waters, and the fire extinguisher must be of the same kind and standard. This creates a cross jurisdictional dependency on the New South Wales marine safety regulatory regime, which may change over time. The instrument does not state whether it incorporates NSW standards as at a fixed date or as amended from time to time.

A further concept is the prohibition on dual use of equipment. Bailers and buckets “must not be used for any other purpose” (sections 11(1)(b) and 12(1)(b)). This imposes a dedication requirement that is unusual in recreational safety regulation. A bucket used for bailing cannot also be used for washing gear, storing rope or carrying fish. This increases the effective cost of compliance because the operator must either carry a dedicated bailer or bucket alongside other containers, or forgo using that item for any other task while on board.

The primary affected group is any person who owns, operates or is in charge of a recreational vessel in the Jervis Bay Territory. Jervis Bay Territory is a small Commonwealth territory on the south coast of New South Wales, used mainly for recreational boating, sailing, kayaking, dragon boating, fishing and tourism. Because the territory is small and the number of vessels is modest, the practical impact falls on a relatively narrow population, but each affected vessel operator faces a compliance burden that includes purchasing, maintaining and carrying the prescribed equipment.

The instrument applies to a broad range of vessel types: power-driven vessels, sailing vessels, tenders, dragon boats, row boats, dinghies and inflatables, provided they are recreational vessels under the Ordinance. However, it carves out several categories. Sail training vessels operated by clubs, schools or similar organisations are exempt from the general equipment requirement if they are accompanied by a power-driven rescue vessel. Off-the-beach vessels (e.g., small centreboard dinghies, skiffs, catamarans without cabins) are exempt if they do not have sufficient storage room to carry the equipment. Very small row boats, dinghies and inflatables under three metres length, without engine or fuel, operating within 200 metres of shore and only in daylight, and which float when swamped, are also exempt. These exceptions primarily affect recreational sailors and day boaters, reducing their compliance load but also introducing subjectivity (what counts as “sufficient storage room”?).

Tenders under three metres operating within 200 metres of shore have a choice between the full general requirement and a reduced set (paddle or oars, bailer or bucket or bilge pump, and a torch if at night). This affects boaters who use small inflatable dinghies to ferry between shore and a moored or anchored larger vessel. Dragon boat crews are also affected: the dragon boat provisions will mainly apply to clubs and community groups that operate dragon boats in Jervis Bay. They must ensure the boat is built to float when swamped, operate within 400 metres of shore, conduct a safety drill for each person on board, monitor weather conditions, follow specific channel navigation rules (row on starboard side, not middle of channel), and display appropriate lights after sunset. The equipment alternative requires a 25 metre “silver rope” and, if operating between sunset and sunrise, flares or a mobile phone in a watertight container.

Manufacturers and retailers of marine safety equipment are indirectly affected because the instrument prescribes specific physical characteristics. For example, buckets must be metal, robust plastic or robust canvas (such as a Wallaby bucket) and must not collapse when full. Bailers must have a lanyard. Waterproof torches must be floating type. These specifications may limit product choices and increase costs, especially for operators who would otherwise use cheaper multi-purpose items.

The instrument does not apply to commercial vessels, because the Ordinance limits its operation to recreational vessels. However, it does apply to visitors from other jurisdictions who bring their vessels into Jervis Bay Territory. Such visitors may find that their existing equipment does not comply (e.g., a torch that sinks, a bucket without a lanyard) and may need to acquire compliant equipment for the duration of their stay.

The principal duty imposed by the instrument is the obligation to carry the required safety equipment specified in Division 1, and to ensure that equipment meets the required standards specified in Division 2. This duty is not absolute; it is contingent on the vessel falling within the scope of section 65 of the Ordinance (which is not reproduced here, but which the note to section 5 indicates limits the requirement to “certain recreational vessels”). For vessels that are subject to the requirement, the operator must choose either the general requirement under section 6 or, where applicable, the alternative requirement under section 7 (for small tenders) or section 8 (for dragon boats). This is a right to elect, but once elected the operator must carry that full set.

A further duty relates to the condition and configuration of the equipment. The waterproof torch must be “in operational order” and “capable of being used to signal”. The anchor chain or line must be “securely attached to both the anchor and the vessel”. The bailer lanyard must be “securely attached to the bailer” and of a length that allows the bailer to be cast over the side and retrieved. The bucket lanyard must allow the bucket to be cast over the side and retrieved “full of water”. These are physical performance standards, not mere recommendations.

The instrument also imposes a duty not to use certain items for any other purpose. Sections 11(1)(b) and 12(1)(b) expressly state that a bailer and a bucket or fire bucket “must not be used for any other purpose”. This is an unusual and potentially onerous restriction. It means that the bailer cannot be used as a scoop for fuel or water, and the bucket cannot be used for storing gear, catching fish, or as a seat. The bucket must be dedicated solely to bailing and fire fighting. This increases the number of separate items a vessel must carry, as the operator cannot rely on a single multi-purpose container.

For dragon boat operators, additional duties apply under section 8(1): the boat must be built to float when swamped, each person must have undergone a safety drill in respect of possible emergencies, weather or water conditions must not be or be predicted to become unsuitable, and if operating in a channel the boat must be rowed on the starboard side (bow side) and not in the middle. After sunset, the boat must display appropriate lights. These are not merely equipment duties; they impose operational and procedural obligations on the person in charge.

The instrument does not create any express rights of review, appeal, waiver or exemption. Such rights, if any, would be found in the Ordinance or in general administrative law. The instrument also does not provide any mechanism for the regulator to grant individual dispensations from the equipment requirements. This means that an operator who cannot practically comply (e.g., a small kayak with no storage for a metal bucket) must rely on the exceptions in section 6(2) or risk non-compliance.

The instrument itself contains no penalty provisions. It defines “required safety equipment” and “required standards” for the purposes of subsection 66(3) of the Ordinance. That subsection, and the surrounding provisions of the Ordinance, are the source of any criminal or civil penalties for failing to carry the required equipment or for carrying equipment that does not meet the required standards. The instrument cannot be read in isolation to determine the maximum fine or whether the offence is strict liability.

Enforcement is likely to be carried out by Jervis Bay Territory authorities, such as the Administrator’s office, authorised officers, or the Australian Federal Police. Officers may board vessels and inspect the equipment, check that lifejackets are “appropriate”, test that torches float and operate, and verify that bailers and buckets have lanyards and are not being used for other purposes. Because the instrument is prescriptive, enforcement is relatively straightforward: an officer can point to a specific section and state that the item does not meet the standard.

The practical risk for operators is that even minor non-compliance (e.g., a bucket used to store a rope, a torch that does not float) could result in a penalty notice or prosecution under the Ordinance. The instrument does not provide any defence of ignorance or reasonable excuse, though such defences may exist in the Ordinance. The lack of a de minimis or “substantial compliance” provision means that an operator who carries 90% of the required equipment but omits one item (e.g., a sound signal) is in breach.

Because the instrument is made under a Territory ordinance, enforcement is likely proportionate to the small size of the jurisdiction. However, the absence of published infringement amounts or enforcement statistics (which are not in the instrument) makes it difficult to assess the real risk. Operators should assume that non-compliance could result in a fine and, potentially, a direction not to operate the vessel until equipment is obtained.

The instrument does not authorise seizure of vessels or equipment as a penalty; that power, if it exists, would be in the Ordinance. It also does not create any civil liability to third parties (e.g., for failing to carry a lifejacket that could have been used in a rescue). Liability for injury or damage arising from non-compliance would be determined under general tort law, but the instrument may be relevant as evidence of a statutory standard of care.

The instrument is subordinate legislation made under the Jervis Bay Territory Marine Safety Ordinance 2016. It operates within the framework of that Ordinance. The Ordinance likely contains provisions on the scope of application (e.g., which vessels are “recreational vessels”), the definition of key terms (e.g., “appropriate lifejacket”), and the penalty provisions that enforce the instrument’s requirements. Any amendment or repeal of the Ordinance would directly affect the force of the Rules.

The instrument incorporates by reference the NSW marine safety standards for anchors and fire extinguishers. Section 10(2) states that the anchor must be “of the same standard as an anchor that the vessel would be required to carry if it were in NSW waters”. Section 14 states that a fire extinguisher must be “of the same kind and standard as a fire extinguisher that the vessel would be required to carry if it were in NSW waters”. This creates a dynamic interaction with the law of New South Wales, but the instrument does not specify whether the reference is to the law as at 26 November 2016 or as amended from time to time. If NSW amends its standards, a question arises whether the Jervis Bay Territory Rules automatically update or remain static until amended. This uncertainty imposes a compliance burden on operators who must determine the current NSW requirements.

The instrument does not interact with Commonwealth laws such as the Navigation Act 2012 or the Marine Safety (Domestic Commercial Vessel) National Law, because those apply to commercial vessels. However, a vessel that is used for both recreational and commercial purposes may need to comply with both regimes. The instrument also does not address environmental laws (e.g., pollution, ballast water) or fisheries laws, which apply separately.

There is no express provision saving or displacing any other instrument. The Rules are the sole source of prescribed safety equipment requirements for recreational vessels in the Jervis Bay Territory. To the extent that the Ordinance incorporates definitions from other jurisdictions (e.g., “NSW waters”), the interaction is set at the Ordinance level.

Based on the text provided, the instrument was made on 21 November 2016 by the Minister for Local Government and Territories, Fiona Nash, and commenced on 26 November 2016 (the day after registration). The commencement table in section 2 only lists the original making. No amendments are evident from the text. The instrument does not contain a table of amendments or a note indicating that it has been amended.

It is possible that amendments have been made since 2016 but are not included in the version provided to the user. The user has supplied what appears to be the original version as enacted. Without access to the Federal Register of Legislation or the current compilation, we cannot confirm whether any subsequent amendments exist. The instrument does not contain a sunset clause or an automatic review date. It remains in force until repealed or amended.

If amendments have occurred, they would likely relate to changes in NSW standards (since the instrument references them), clarification of definitions, or addition of new vessel types. However, nothing in the source supports any specific amendment.

The source text does not mention any litigation concerning the instrument. Given the small size of the Jervis Bay Territory and the relatively narrow scope of the Rules, it is plausible that there have been no reported or unreported cases. The instrument is a prescribed legislative instrument that sets out technical standards; disputes are more likely to arise under the Ordinance (e.g., prosecutions for non compliance) rather than under the Rules themselves.

Interpretive disputes could arise over the definitions of “off-the-beach vessel” (does a particular skiff have a “cabin” or a “fixed keel”?) and “sufficient storage room” (can a small compartment count?). The definition of “dragon boat” is quite specific and may exclude some paddle craft that operators call dragon boats. The requirement that a bucket “be designed so as not to collapse, distort or lose the handle when full of water” could be litigated if a bucket fails in use. However, no case law is cited in the instrument, and we cannot invent any.

The instrument contains several provisions that may surprise or catch out operators who are familiar with other jurisdictions’ marine safety requirements.

First, the prohibition on using bailers and buckets for any other purpose (sections 11(1)(b) and 12(1)(b)). This means a dedicated piece of equipment is required. A plastic bucket used to store fishing lures is non-compliant even if it is carried on board. An operator who has a bailer that also serves as a fuel scoop must obtain a separate bailer.

Second, the lanyard requirements. The bailer lanyard must be of a length that allows the bailer to be cast over the side and retrieved. The bucket lanyard must allow the bucket to be cast and retrieved “full of water”. This effectively mandates a lanyard at least as long as the beam of the vessel plus some excess. A short lanyard tied to the bailer is not enough if you cannot reach the water.

Third, the off-the-beach vessel exception is not automatic. It only applies if the vessel “does not have sufficient storage room to carry the safety equipment”. An off-the-beach vessel with a small storage locker, even if the locker is too small for a full sized bucket, may still be deemed to have sufficient room for some items. The operator bears the risk of that subjective assessment.

Fourth, the dragon boat alternative requires a “safety drill” for each person on board. The instrument does not specify what the drill must cover, how often it must be conducted, or whether it must be documented. However, if an enforcement officer asks and nobody can describe the drill, the condition may not be satisfied.

Fifth, the anchor requirement for vessels that are not sailing vessels under six metres. A small powerboat under six metres still needs an anchor (with chain or line) suitable for its size and weight, and of the same standard as NSW. Many small boats may not have an anchor on board, or may carry a lightweight anchor that is not suitable for the area of operation.

Sixth, the requirements for fire extinguishers depend on whether the vessel has “an electric start motor, a gas installation, a fuel stove or a battery”. A vessel with a battery but no other fire source still requires an extinguisher. A vessel with none of these does not require one, even if it carries flammable materials like fuel in portable tanks (unless the start motor is electric). This may create a gap.

Seventh, the waterproof torch must be “capable of being used to signal”. This suggests it must have a signalling function (e.g., strobe or flashing mode) or at least be bright enough to attract attention. A simple non-floating torch is non-compliant, and even a floating torch that only emits a steady beam may be challenged.

Finally, the instrument does not specify any transitional provisions or grace periods for existing vessels. On commencement, all affected vessels were required to comply immediately. Operators who had not carried such equipment before had to purchase and install it.

Compliance requires a systematic approach. Step one: confirm that the vessel is a recreational vessel under the Ordinance. If it is used solely for commercial purposes, these Rules do not apply. Step two: determine whether the vessel falls within an exception in section 6(2). If it is a sail training vessel accompanied by a rescue craft, an off-the-beach vessel with insufficient storage, or a small row boat under three metres with no engine within 200 metres of shore in daylight that floats when swamped, then the general requirement does not apply. In that case, no further equipment is required under these Rules (though other laws may apply).

Step three: if no exception applies, check whether the vessel is a small tender (under three metres, operating within 200 metres of shore) or a dragon boat meeting the conditions in section 8(1). If so, the operator may elect either the full general requirement set under section 6 or the relevant alternative set under section 7 or 8. If the vessel is neither, the general requirement is mandatory.

Step four: for the general requirement, obtain and carry the following: one lifejacket for each person (must be “appropriate lifejacket” under Ordinance), a sound signal (airhorn, whistle or bell), a waterproof torch (floating, operational, signal capable), fire extinguishers (if vessel has electric start motor, gas installation, fuel stove or battery; must meet NSW standards), bilge pumps (if covered bilge or closed under-floor compartment not airtight), at least one paddle or a pair of oars with rowlocks (if vessel under six metres and only one independent means of propulsion; note that two or more sails count as one means), an anchor with chain or line (unless vessel is a sailing vessel under six metres), and a bailer, bucket or fire bucket (unless vessel is a sailing vessel with self draining hull or already required to carry bilge pump under paragraph (e)).

Step five: ensure each item meets the specific standards in Division 2. For anchors, choose one suitable for the vessel’s size, weight and area of operation, and that would be required in NSW waters. For bailers, ensure it has a securely attached lanyard of length allowing casting and retrieval, and do not use it for any other purpose. For buckets, choose metal, robust plastic or robust canvas (e.g., Wallaby bucket) that will not collapse when full, attach a lanyard of sufficient length to retrieve full of water, and dedicate it to bailing and fire fighting only. For bilge pumps, ensure they can drain each relevant compartment and have a strainer. For fire extinguishers, select the same kind and standard as required in NSW (typically an appropriate class and rating). For lifejackets, ensure they are “appropriate” per the Ordinance (likely based on type of vessel and water conditions). For paddles and oars, ensure they are capable of rowing the vessel. For the waterproof torch, verify it is floating type, water resistant, in operational order, and can be used to signal (e.g., has a strobe function or can be directed to signal other vessels).

Step six: maintain the equipment. Check torch batteries, fire extinguisher pressure, lifejacket condition, lanyard integrity. Replace any item that is damaged or expired.

Step seven: if using the small tender alternative, carry either the full set or the reduced set (paddle or oars, bailer or bucket or bilge pump, plus torch if at night). If using the dragon boat alternative, comply with all conditions in section 8(1) and carry the alternative equipment set (bailer or bucket, 25 metre silver rope of 12mm diameter securely attached for towing, and if at night, flares or mobile phone in watertight container). Ensure all crew have undergone a safety drill and that the boat operates within 400 metres of shore, in suitable weather, and follows channel navigation rules.

Step eight: keep documentary evidence of compliance where practical, such as receipts for equipment that meets the standards, and records of safety drills for dragon boat crews.

Step nine: if visiting Jervis Bay Territory from another jurisdiction, review the equipment list before departure. Items that are compliant elsewhere (e.g., a sinking torch, a multi-purpose bucket) may need to be replaced or supplemented. Failure to comply may result in enforcement action under the Ordinance.
