65 Application of this Division
(1) Subject to subsections (2) and (3), this Division applies to recreational vessels. (2) This Division does not apply to the following recreational vessels: (a) canoes; (b) kayaks; (c) sailboards; (d) kiteboards. (3) Except to the extent that it imposes obligations relating to lifejackets, this Division does not apply to a recreational vessel that: (a) is not ordinarily operated in Territory waters or NSW waters; and (b) has not been continuously in Territory waters or NSW waters for a period of more than 3 months; and (c) complies with the requirements for the carriage of safety equipment that apply to the vessel’s place of registration or home port.
