#### 9 Civil liability in relation to protected conduct extinguished 9 Civil liability in relation to protected conduct extinguished > Any civil liability to which this Part applies that is incurred (whether before, during or after the assent day) by any of the following persons in respect of any protected conduct of the person is extinguished— > > > (a) any liable entity, > > > (b) the Compensation Foundation, > > > (c) James Hardie Industries NV, > > > (d) any controlled entity of James Hardie Industries NV, > > > (e) any person who engaged in the conduct in the person’s capacity as a director or other officer, employee, advisor or agent of— > > > > > (i) any liable entity, or > > > > > (ii) the Compensation Foundation, or > > > > > (iii) James Hardie Industries NV, or > > > > > (iv) any controlled entity of James Hardie Industries NV.
