#### 23 Amaca not liable for certain claims—rehabilitation of mine 23 Amaca not liable for certain claims—rehabilitation of mine > > (1) Amaca is not liable under this Part in respect of any Marlew asbestos claim or Marlew contribution claim that is a claim in respect of a liability that is the subject of an indemnity granted by the Minister for Mineral Resources by way of a release and indemnity agreement dated 11 March 1996 between that Minister and James Hardie Industries Limited (now ABN 60). > > > (2) The Minister is to cause a copy of the agreement referred to in this section to be published in the Gazette. > > Note— > > The agreement referred to releases James Hardie Industries Limited from liability for asbestos related death or injury of employees of the Department of Mineral Resources or Fuller Earthmoving Pty Ltd in connection with the rehabilitation of an asbestos mine at Baryulgil.
