Nothing in this Act or the special Act prevents the undertakers from being liable to any action or other legal proceedings to which they would have been liable for any damage or injury done or occasioned to any mines by means or in consequence of the waterworks, if their waterworks had not been constructed or maintained by virtue of this Act or the special Act .
