What it does
The Iron Ore (Marillana Creek) Agreement Act 1991 (WA) is one of Western Australia's "resource agreement Acts" -- statutes that ratify and give legislative force to major resource development agreements between the State and private mining companies. This Act ratifies the original 1990 agreement between the State and BHP Minerals Limited for the development and mining of iron ore in the Marillana Creek area of the Pilbara, plus four variation agreements executed over subsequent decades.
The Act makes the Agreement binding on the State and the Company, authorises its implementation, and gives it paramount effect over inconsistent State legislation (sections 4-10). The Agreement itself (Schedule 1 and Schedules 2-5) contains the substantive rights and obligations: the mining lease framework, royalty structure, infrastructure arrangements, environmental conditions, and workforce accommodation.
