64A Appointment of non-citizens to public office
(1) Despite any rule of law to the contrary, the fact that a person is a non-citizen does not, of itself, affect the person's eligibility for appointment to a public office or disqualify the person from appointment to a public office.
(2) Subsection (1) does not apply if—
(a) the power to appoint a person is conferred by or under an Act or a subordinate instrument; and
(b) the contrary intention expressly appears in that Act or subordinate instrument.
(3) In this section—
***non-citizen*** includes a person who is not an Australian citizen or who is an alien as known at common law.
