44 Power to appoint includes power to remove (1) Subject to subsection (3), where an Act confers on any person or authority a power to make appointments to any office or position, the power shall be construed as including a power to terminate such an appointment or to remove or suspend any person appointed. (3) Where a power to make appointments to an office or position is exercisable only upon the recommendation or subject to the approval or consent of some other person or authority, the power of termination or removal referred to in subsection (1) is exercisable only upon the recommendation or subject to the approval or consent of that other person or authority.
