International Transfer of Prisoners (Vietnam) Regulations 2009

The agreement defines key terms that govern the entire transfer scheme. A “sentenced person” is a person required to be detained in a prison, hospital, or other place in the territory of the transferring Party to serve a sentence imposed by a court (Article 1(c)). “Sentence” means any punishment or measure involving deprivation of liberty ordered by a court (Article 1(d)). This scope is important: it excludes non-custodial orders, fines, or community-based sentences. “Community ties” is a central concept for determining eligibility when Australia is the receiving Party. It has four limbs: (i) the prisoner’s principal place of residence immediately before being sentenced was in the receiving Party’s territory; (ii) a parent, grandparent, or child of the prisoner has a principal place of residence there; (iii) the prisoner is married to or has a de facto relationship with someone whose principal place of residence is there; or (iv) in exceptional circumstances the prisoner has a close continuing relationship (involving frequent personal contact and a personal interest in the other person’s welfare) with anyone whose principal place of residence is there (Article 1(f)). This definition provides a pathway for non-citizens who have indefinite residency rights and strong ties to Australia to be transferred to Australia, not only Australian nationals. The concept of “territory” in respect of Australia includes all Australian States and Territories (Article 1(e)(ii)). For Vietnam, it means the territory of the Socialist Republic of Vietnam.

The conditions for transfer in Article 4 are the core gatekeeping mechanism. They require: dual criminality (the acts constitute an offence in the receiving Party or would if committed within its jurisdiction), with a waiver option if both Parties agree and permitted by domestic law; nationality or residency and community ties for transfers to Australia; Vietnamese nationality for transfers to Vietnam; at least one year remaining to be served at the time of the request (waivable by agreement); final judgment and no pending legal proceedings relating to the offence or any other offence; consent of both Parties and the sentenced person (or a person entitled to act on their behalf if the prisoner is incapable); consent of the relevant Australian State or Territory government if Australia is the transferring Party (where the sentence was imposed under State/Territory law) or the receiving Party; and full information to the sentenced person about any costs that the receiving Party may seek to recover. The agreement also establishes a procedure for consent (Article 6): the transferring Party must ensure the prisoner consents voluntarily and with full knowledge of legal consequences, and the receiving Party may verify this through its own official.

Another key concept is the retention of jurisdiction by the transferring Party over review, revision, modification, cancellation, pardon, amnesty, or commutation of convictions and sentences (Article 7). The receiving Party does not acquire power to alter the original sentence; it only enforces it. However, Article 8(3) permits the receiving Party to adapt the sentence if its nature or duration is incompatible with its own law. The adapted sentence must be based on the sentencing Party’s findings of fact and cannot be more severe in nature or duration. The receiving Party may also treat a juvenile prisoner as a juvenile according to its own law, regardless of how the transferring Party classified them (Article 8(4)). The receiving Party must modify or terminate enforcement if the transferring Party later takes action under Article 7 (Article 8(5)). Finally, the receiving Party bears the expenses of transfer (except those incurred exclusively in the transferring Party’s territory) and of continued enforcement, but may seek to recover all or part of the cost of transfer from the sentenced person (Article 12).

The Regulations directly affect three categories of persons and bodies. First, sentenced persons who are imprisoned in either Australia or Vietnam and who meet the eligibility conditions. For a person to be transferred from Australia to Vietnam, they must be a Vietnamese national (Article 4(b)). For a person to be transferred from Vietnam to Australia, they must be an Australian national or a person permitted to travel to, enter, and remain indefinitely in Australia and who has community ties with a State or Territory (Article 4(c)). The definition of community ties extends the pool to permanent residents and long term residents with close family or relationships in Australia, not just citizens. This has practical significance: a foreign national who has lived in Australia for many years, holds a permanent visa, and has a spouse or child in Australia may be eligible for transfer to Australia even if not an Australian citizen. Second, the Regulations affect Australian State and Territory governments. Under Article 4(g) and (h), the consent of the relevant State or Territory government is required both when Australia is the transferring Party (if the sentence was imposed under that State/Territory’s law) and when Australia is the receiving Party (for enforcement in that jurisdiction). This means that the transfer regime does not operate solely at the Commonwealth level; it requires active cooperation from sub national authorities, which could create friction or delay if a State or Territory objects. Third, the central authorities designated under Article 3 process requests: the Australian Attorney-General’s Department and Vietnam’s Ministry of Public Security. These bodies communicate directly, make and respond to requests, verify information, and coordinate logistics. Prisoner’s families and legal representatives are also affected indirectly, because they may assist in expressing a wish for transfer, providing evidence of community ties, or ensuring the prisoner is informed of cost implications. Legal practitioners advising prisoners need to understand the dual criminality requirement, the final judgment condition, the one year minimum sentence (unless waived), and the voluntary consent process. There is no mention of any right to appeal a refusal, so prisoners have no legal recourse if either Party or a State/Territory refuses consent. The regime is entirely consensual and discretionary.

The agreement imposes a range of duties on both Parties. The transferring Party must ensure that the sentenced person consents voluntarily and with full knowledge of legal consequences (Article 6(1)). This includes providing an opportunity for the receiving Party to verify consent through its own official if desired (Article 6(2)). The transferring Party must also provide detailed information to the receiving Party upon request: a statement of facts and relevant law, the termination date, time served, remissions, copies of conviction and sentencing documents, details of any extradition requests, medical and social reports, and any other information requested (Article 5(3)). The receiving Party must provide, before transfer if requested: a document or statement confirming nationality or residency status, a statement that the acts constitute an offence under its law (or a waiver of dual criminality), a statement describing how the sentence will be enforced, and any other information (Article 5(4)). After transfer, the receiving Party must provide ongoing information to the transferring Party: if the prisoner is granted conditional release; when enforcement is completed; if the prisoner escapes or dies; or if the transferring Party requests a report (Article 9). The receiving Party must also enforce the sentence as imposed (Article 8(1)), subject to adaptation only if incompatible with its law, and must adapt in a way that is not more severe (Article 8(3)). It must modify or terminate enforcement if the transferring Party later takes action under Article 7 (Article 8(5)). Both Parties must inform the sentenced person in writing of any actions or decisions under Article 8(2) to (5) (Article 8(6)).

The sentenced person has the right to express a wish to be transferred, either to the transferring or receiving Party (Article 5(2)(a)). They must be fully informed by the receiving Party of any costs that the receiving Party may seek to recover from them under Article 12(2) before giving consent (Article 4(i)). There is no explicit right to be transferred; the process is permissive and requires consent of both Parties and the sentenced person (Article 4(f)). The sentenced person does not have a right to choose the destination State or Territory within Australia; that is a matter for the receiving Party and the relevant State/Territory government to consent. The sentenced person also has a right to be informed of any action or decisions taken under Article 8(2)-(5) (Article 8(6)). There is no provision for legal aid or representation in the agreement. The cost risk is significant: the receiving Party may seek to recover all or part of the cost of transfer from the sentenced person (Article 12(2)). This could be a substantial financial burden, particularly for prisoners with limited means. The prisoner is not given a right to challenge the amount or terms of recovery; that would be left to domestic law.

The Regulations and the agreement do not create criminal penalties for non-compliance. Instead, the enforcement mechanism for the transfer regime is administrative and diplomatic. If a Party fails to comply with its obligations, the other Party may invoke the dispute resolution provisions of Article 14: the central authorities seek to resolve disputes, and if that fails, the Parties seek resolution through diplomatic channels. There is no provision for arbitration or international adjudication. The ultimate sanction is termination of the agreement under Article 16(3), which takes effect six months after written notice. However, the primary enforcement duty lies on the receiving Party to continue enforcing the sentence in accordance with Article 8. If the receiving Party fails to enforce the sentence properly (for example, by releasing the prisoner prematurely without authorisation from the transferring Party), the transferring Party retains jurisdiction over the sentence and could potentially take steps to revoke the transfer, though the agreement does not specify a mechanism for reversing a completed transfer. There is also a duty on the receiving Party to inform the transferring Party of events such as conditional release, completion of sentence, escape, or death (Article 9). Failure to provide such information could be treated as a breach of the agreement, but again the only remedy is diplomatic. The threat of reputational harm or termination may be the primary incentive for compliance. The agreement also provides for cooperation in transit of sentenced persons through the territory of the other Party (Article 10), but this is subject to domestic law. The receiving Party bears the costs of transfer and enforcement (Article 12(1)), which creates a financial incentive to ensure the regime operates efficiently; there is no penalty for failing to bear costs, but the funding must come from public budgets. The agreement does not impose any obligations on private actors; non-compliance by the sentenced person (such as escaping) triggers a reporting duty but no penalty under the agreement itself. Domestic criminal law would govern the escape.

The Regulations operate under the International Transfer of Prisoners Act 1997 (Cth), which provides the statutory framework for bilateral prisoner transfer schemes. The Act applies to Vietnam subject to the agreement (regulation 5), meaning that where the Act and the agreement conflict, the agreement prevails to the extent of the inconsistency. The Act itself contains default provisions on topics such as transfer of responsibility for enforcement, but the agreement may modify those provisions. For example, the Act provides for transfer only if the person is an Australian citizen or a permanent resident; the agreement expands eligibility to persons permitted to enter and remain indefinitely who have community ties, even if not permanent residents in the strict sense. The agreement also requires consent of the relevant Australian State or Territory government both as transferring and receiving Party, which aligns with the Act’s requirement to obtain State/Territory consent. The Regulations and agreement also interact with extradition law and procedure. Article 5(3)(d) requires the transferring Party to provide details of any extradition request concerning the sentenced person. This is to avoid a situation where a person is transferred to serve a sentence while a separate extradition request from a third state is pending. The agreement does not affect the operation of the Extradition Act 1988 (Cth) or bilateral extradition treaties; it is a distinct mechanism. The agreement also interacts with domestic sentencing and corrections laws of the Australian States and Territories. When a sentence is transferred, the receiving Party enforces it in accordance with its own laws and procedures (Article 8(2)). This means that parole eligibility, remission, work credits, and early release provisions of the enforcing State/Territory will apply, not those of the transferring Party. The transferring Party retains jurisdiction over pardon, amnesty, and commutation (Article 7), so a decision by the Australian Governor-General or a State Governor to grant a pardon would need to be communicated to Vietnam, and Vietnam would then modify enforcement accordingly (Article 8(5)). The agreement also interacts with juvenile justice laws: if a sentenced person is a juvenile under the law of the receiving Party, the receiving Party may treat them as a juvenile regardless of how the transferring Party classified them (Article 8(4)). This could lead to different custodial arrangements. The agreement does not create any right of appeal under domestic law; a prisoner challenging a refusal of transfer would have to rely on general administrative law remedies such as judicial review for procedural error, but the discretion to refuse is broad.

The Regulations were made on 29 October 2009 by the Governor-General on the advice of the Federal Executive Council, and registered as Select Legislative Instrument 2009 No. 282. They commenced on the day the agreement came into force for Australia (regulation 2). The source text does not indicate any subsequent amendments to the Regulations. The agreement itself has not been amended according to the information provided; Article 16(3) allows termination by either Party but no amendment procedure is specified. The Regulations may have been amended subsequently (for example, if the agreement was renegotiated or if the Act was amended), but the source text does not reflect any such amendments. Practitioners should verify the current status on the Federal Register of Legislation. The note at the end of the instrument states that all legislative instruments and compilations are registered on the Federal Register of Legislative Instruments under the Legislative Instruments Act 2003. Given the age of the instrument (2009), it is possible that the Regulations have been reissued or sunsetted under the Legislation Act 2003, but the source text does not say. The agreement itself has a continuing effect unless terminated. Under Article 16(2), the agreement applies to any request for transfer presented after its entry into force, even if the sentence was imposed before that date. There is no provision for retrospective operation of amendments.

The source text does not refer to any litigation concerning the International Transfer of Prisoners (Vietnam) Regulations 2009 or the bilateral agreement. No cases are mentioned in the instrument, and I have no independent knowledge of such cases. It is plausible that the scheme has operated without reported judicial challenges, possibly because the transfer process is entirely consensual with broad discretion vested in the Parties, leaving little room for legal dispute. Prisoners have no legal right to be transferred; they can only express a wish. The conditions for transfer are relatively clear and leave limited interpretive ambiguity. However, there may be unreported administrative disputes or challenges under Australian administrative law (e.g., a refusal of consent by a State/Territory government could theoretically be challenged for procedural unfairness or lack of reasons, but the agreement does not require reasons). Potential grounds for litigation could include a dispute over whether a person has “community ties” within the meaning of Article 1(f) if the receiving Party refuses consent on that basis. The definition contains objective elements (principal place of residence, parent/child relationship, marriage or de facto relationship) and a discretionary “exceptional circumstances” limb. A court might be asked to interpret the scope of that limb, but no such case is reported. Another potential area: if a sentenced person is transferred and then asserts that the receiving Party adapted the sentence in a manner that is more severe (contrary to Article 8(3)), there could be litigation in the receiving Party’s domestic courts. But again, no such litigation is referenced. The agreement’s dispute resolution mechanism (Article 14) channels disputes between the Parties through central authorities and diplomatic channels, not courts. Therefore, the likelihood of reported case law is low. Any litigation would arise under Australian domestic law interpreting the Act or the Regulations, not the agreement itself.

Several provisions could trap unwary practitioners or prisoners. First, the “community ties” definition includes a close continuing relationship “involving frequent personal contact and a personal interest in the other person’s welfare” but only “in exceptional circumstances” (Article 1(f)(iv)). This is a high threshold. A prisoner who has a supportive pen pal or a distant cousin may not qualify. The receiving Party has discretion to assess this. Second, the dual criminality waiver is available only “to the extent permitted by the domestic law of the receiving Party” (Article 4(a)). If Australian law does not permit waiver for certain offences (e.g., if the offence is not an offence under any Australian law, and it is not possible to waive under the International Transfer of Prisoners Act), the waiver may be unavailable. Third, the one year minimum sentence requirement can be waived, but only by agreement of both Parties (Article 4(d)). A prisoner with less than a year remaining cannot assume waiver will be granted. Fourth, the receiving Party may seek to recover “all or part of the cost of transfer” from the sentenced person (Article 12(2)). This could include escort costs, airfares, and administrative expenses. The prisoner must be informed of this possibility before consenting (Article 4(i)), but the amount may not be specified in advance. The receiving Party could impose a significant debt on the prisoner after transfer. Fifth, the consent of an Australian State or Territory government is required both when Australia is the transferring Party (if the sentence was imposed under that State/Territory’s law) and when Australia is the receiving Party (for enforcement in that jurisdiction) (Article 4(g), (h)). If a State/Territory refuses consent, the transfer cannot proceed. No reasons need be given, and there is no appeal. Sixth, the transferring Party retains jurisdiction over pardon, amnesty, and commutation (Article 7). This means that if Australia transfers a prisoner to Vietnam and later grants a pardon, Vietnam must modify or terminate enforcement (Article 8(5)). But the prisoner is in Vietnam and may be subject to Vietnamese procedures; the agreement does not specify how the receiving Party will verify or implement the transferring Party’s decision. Seventh, language barriers: all requests and accompanying documents must be translated into an official language of the receiving Party (Article 11). This imposes costs and delays. Eighth, the agreement applies to any request for transfer presented after entry into force, even if the sentence was imposed before the agreement existed (Article 16(2)). But there is no provision for transfers of persons who were already serving sentences before the agreement; they are still eligible. Ninth, the termination provision (Article 16(3)) means the agreement can be terminated with six months’ notice. If a transfer is in progress but not completed when termination takes effect, the legal basis may vanish. Tenth, the agreement does not specify a maximum time for processing requests; delays could occur. Finally, the prisoner cannot dictate the destination State/Territory within Australia; the receiving Party (in consultation with the relevant State/Territory) decides.

Compliance depends on the actor. For a sentenced person in Australia who wishes to be transferred to Vietnam, the first step is to determine eligibility: they must be a Vietnamese national (Article 4(b)) and must meet the other conditions (final judgment, at least one year remaining, consent, etc.). The prisoner should express a wish in writing to the transferring Party (Australian authorities) or the receiving Party (Vietnamese authorities) (Article 5(2)(a)). It is prudent to do so through the prison administration or legal representative. The Australian Central Authority (Attorney-General’s Department) will process the request and coordinate with Vietnam. The prisoner must consent voluntarily, and the transferring Party will verify that. The prisoner should also obtain information about potential cost recovery from Vietnam (Article 12(2)). Legal practitioners should advise clients that State/Territory consent may be needed and that the decision is discretionary.

For a sentenced person in Vietnam who wishes to be transferred to Australia, eligibility requires either Australian nationality or indefinite stay permission plus community ties (Article 4(c)). The prisoner must gather evidence of nationality (passport, citizenship certificate) or visa status and community ties (proof of residence, relationship documents, evidence of frequent contact). The wish can be expressed to Vietnamese authorities or the Australian Embassy. The Australian Central Authority will assess the request, and the relevant State/Territory must consent to enforcement in its jurisdiction. The prisoner must be informed of possible cost recovery and consent voluntarily.

For legal practitioners advising a prisoner, the key steps are: confirm eligibility under Articles 4 and 1(f); advise on the discretionary nature of the process; ensure the client understands that the receiving Party will enforce the sentence under its own law, which may differ (e.g., parole rules, remission); explain the cost risk; assist in preparing documentation (translation, evidence of ties); and notify the client that there is no right of appeal if consent is withheld. Practitioners should also check whether the prisoner has any pending extradition requests or other proceedings that would preclude transfer (Article 4(e)). For State/Territory correctional authorities, compliance involves responding to requests for consent in a timely manner, and if consent is given, providing information to the receiving Party about how the sentence will be enforced (Article 5(4)(c)). For the Commonwealth Central Authority, compliance involves processing requests, verifying consent, exchanging information with Vietnam, and ensuring that all conditions are met before authorising transfer. The receiving Party must then enforce the sentence and provide ongoing information under Article 9. All actors should maintain clear records and translations. There is no prescribed form for requests, but written communication is required (Article 5(2)(b)).
