International Transfer of Prisoners (Military Commission of the United States of America) Regulations 2007

The regulations and the Schedule create several defined concepts that are critical to understanding the limited scope of the transfer regime. “Applicable United States area” means the United States Naval Station at Guantanamo Bay, Cuba, an area over which the United States exercises complete jurisdiction and control under the 1903 lease agreement and the 1934 Treaty of Relations. This definition confines the entire arrangement to prisoners sentenced within that specific geographic and legal enclave. “Sentence” means any punishment or measure involving deprivation of liberty ordered by a United States military commission on account of a criminal offence. This is broad enough to capture detention as a sentence, but does not cover pre trial detention or immigration detention. “Judgment” means a decision or order of a United States military commission imposing a sentence. The term “prisoner” is defined as a person sentenced to a term of imprisonment by a United States military commission, which excludes persons awaiting trial or those held without sentence. “United States military commission” means a military commission established pursuant to the Military Commissions Act of 2006 and the United States Code. This ties the arrangement to a specific United States statutory scheme enacted in the wake of the United States Supreme Court decision in Hamdan v Rumsfeld (2006). The “United States Code” reference is to chapter 47A of title 10, as amended by section 3(a) of the Military Commissions Act of 2006. The most expansive definition is that of “national of Australia”. It includes a person who is an Australian citizen, or who is permitted to travel to, enter and remain in Australia indefinitely under the Migration Act 1958 and has community ties with a State or a Territory. This latter category is not limited to permanent residents in the ordinary migration sense; it captures any holder of a visa permitting indefinite stay who can demonstrate community ties. The arrangement’s general principles state that transfer may only occur from the applicable United States area, and only the two governments may formally request a transfer, albeit upon application by the prisoner. The arrangement also establishes a duty on the United Sates to inform any Australian national charged before a military commission of the substance of the arrangement. The concept of “consent” is central: all three parties (the United States, Australia, and the prisoner) must consent voluntarily and with full knowledge of the legal consequences. The prisoner’s consent may be given by a person entitled to act on the prisoner’s behalf if, due to age or physical or mental condition, either government considers it necessary.

The primary persons affected are Australian nationals, or persons with indefinite stay rights and community ties in Australia, who have been sentenced to imprisonment by a United States military commission in Guantanamo Bay. As of the date of the regulations, the only known person in this category was David Hicks, an Australian citizen captured in Afghanistan and later convicted by a military commission of providing material support for terrorism. The regulations were drafted specifically with his case in mind, though they are expressed in general terms and would apply to any future Australian detainee sentenced by the same commissions. The instrument also affects the Government of Australia, particularly the Attorney General’s Department, which is the designated channel for requests and replies. The Secretary of that Department must communicate with the Legal Advisor to the Appointing Authority for Military Commissions on the United States side. Australian correctional authorities are affected because they must take custody of the transferred prisoner and continue enforcement of the sentence under Australian law immediately upon transfer. The Department must also arrange for information provision, consent verification, and periodic reporting to the United States on enforcement status. Legal practitioners representing Australian detainees at Guantanamo Bay must be aware of the transfer pathway and advise clients on whether to apply for transfer, the implications of consent, and the fact that the United States retains exclusive control over any review of the judgment or pardon. The prisoner’s family and community may also be affected, as the transfer relocates the prisoner from Guantanamo Bay to an Australian prison, which changes visits, legal representation, and conditions of detention. The regulations do not affect United States authorities in their capacity to try detainees; they only affect the post conviction custodial phase. They also do not affect ordinary Australian prisoners or other foreign prisoners; the instrument is extremely narrow in its personal and geographic scope. The arrangement does not provide for transfer from Australia to the United States, so it does not affect any Australian held prisoner who might be wanted by a United States military commission.

The arrangement imposes several duties on the two governments and confers rights on the prisoner. The United States Government must inform any Australian national charged before a military commission of the substance of the arrangement (Paragraph 3(1)). It must afford the prisoner the opportunity to apply for transfer (Paragraph 3(2)). If the prisoner expresses interest, the United States must inform Australia as soon as practicable and, after the judgment becomes final, promptly make available means for the prisoner to communicate with an Australian representative (Paragraph 3(3)). The prisoner must be informed in writing of any action taken by either government regarding the transfer request, and of any decision on the request (Paragraph 3(4)). Australia may request a visit by an official to meet the prisoner prior to transfer to verify that consent is voluntary and with full knowledge of consequences (Paragraph 7(2)). The United States must ask the prisoner for consent and ensure it is given voluntarily and with full knowledge, and must inform the prisoner in writing that if consent is not given, the prisoner will not be detained beyond the term of imprisonment imposed or otherwise penalised (Paragraph 7(1), (3)). The prisoner has a right to apply to either government for transfer, though neither government is compelled to agree. Both governments may deny a request without giving reasons (Paragraph 4(3)). Upon transfer, Australia has the right to continue enforcement of the sentence immediately, governed by Australian law, and Australia alone is competent to take all appropriate decisions regarding enforcement (Paragraph 9). This includes the power to adapt the sentence to a punishment prescribed by Australian law for a similar offence if the original sentence is incompatible in nature or duration, but it cannot aggravate the sanction (Paragraph 10(2)). Australia has a duty to respect and maintain the legal nature and duration of the sentence as determined by the United States, subject to the adaptation power (Paragraph 10(1)). Australia must terminate enforcement if informed by the United States of a decision or measure making the sentence unenforceable (Paragraph 13). Australia must provide information to the United States on enforcement when completed, if the prisoner escapes, or upon request for a special report (Paragraph 14). The United States retains the exclusive right to decide on any application for review of the judgment or to pardon the offence (Paragraph 12). Either government may grant amnesty or commutation in accordance with its own constitution or laws (Paragraph 11). The prisoner has no right under the arrangement to seek review of the judgment in Australia.

The regulations themselves do not create any penalty provisions. They are a mechanism to facilitate transfer of custody. The enforcement of the transferred sentence occurs under Australian law once the prisoner is taken into Australian custody. The arrangement requires that enforcement of the sentence in Australia be governed by the law of Australia, and Australia alone is competent to take all appropriate decisions (Paragraph 9). In practice, this means the prisoner is subject to the same prison rules, parole systems, and remissions as any other prisoner serving a comparable sentence in the relevant Australian jurisdiction. The adaptation power under Paragraph 10(2) allows Australia to convert the nature or duration of the sentence to correspond with an Australian punishment for a similar offence, provided it does not aggravate the original sanction. If no adaptation is required, Australia must respect the legal nature and duration as determined by the United States. However, if the sentence is incompatible with Australian law, adaptation is mandatory, not optional. If the United States later grants amnesty, commutation, pardon, or review resulting in the sentence ceasing to be enforceable, Australia must terminate enforcement immediately upon notification (Paragraph 13). Escape from custody before enforcement is completed is a reportable event to the United States (Paragraph 14(b)). There is no penalty under the regulations for the prisoner failing to comply with Australian prison rules; that is handled by ordinary Australian corrections law. For the governments, the primary sanction for non compliance is diplomatic: a party may withdraw from the arrangement at any time by written notice (Paragraph 17). There is no enforcement mechanism within the arrangement for breach of its terms; it is a non binding executive agreement. The United States retains the power to suspend enforcement of the sentence upon transfer (Paragraph 8(1)), and ceases enforcement altogether if Australia considers enforcement completed (Paragraph 8(2)). This means Australia effectively has the final word on when the sentence is served, subject to the United States’ right to grant clemency or review the judgment.

The regulations are made under section 8 of the International Transfer of Prisoners Act 1997, which allows the Governor General to declare that the Act applies to a foreign country subject to conditions. The Act itself already declared the United States a transfer country under the International Transfer of Prisoners (Transfer of Sentenced Persons Convention) Regulations 2002, but that declaration covers sentences imposed by ordinary courts under the Council of Europe Convention on the Transfer of Sentenced Persons. The 2007 regulations carve out an additional pathway for military commission sentences that are not covered by that convention. The arrangement (Schedule 1) explicitly preserves other international agreements: Paragraph 16 states that the arrangement does not affect rights and undertakings derived from extradition treaties and other treaties on international cooperation in criminal matters providing for the transfer of prisoners for purposes of confrontation or testimony. This means a prisoner could still be extradited or transferred temporarily for testimony under other instruments. The definition of “national of Australia” in the arrangement incorporates the Migration Act 1958 for the category of indefinite stay residents and requires community ties with a State or Territory. This allows persons who are not citizens but have permanent residence or equivalent status to be eligible, but only if they have community ties. The arrangement does not affect Australian migration laws; the prisoner after serving sentence would still need valid visa status to remain in Australia, though the transfer itself does not grant any migration right beyond entry to serve the sentence. The regulations do not override the International Transfer of Prisoners Act; they merely extend its application. If there is any inconsistency with the Act, the Act prevails because the regulations are subordinate legislation. The arrangement is not a treaty and does not have the force of a treaty in Australian domestic law; it is an executive arrangement that the Governor General has deemed sufficient for application of the Act. The note to regulation 4 reminds readers that the United States is already a transfer country under the convention regulations, so the military commission pathway is an addition, not a replacement. The regulations interact with state and territory correctional laws because the sentence is enforced by the relevant Australian jurisdiction where the prisoner is held. Australia is free to determine the place of imprisonment and conditions, subject to its laws and international obligations (Paragraph 6(1)(e) requires humane treatment under Australian law and international obligations).

The source legislative instrument does not record any amendments. The regulations were made on 29 March 2007, signed by Governor General Philip Michael Jeffery and Attorney General Philip Ruddock, and commenced the day after registration. No amending instruments are listed in the provided text. The Federal Register of Legislative Instruments may show subsequent amendments, but this deep dive is confined to the source. It is notable that the United States military commissions ceased operations for new cases after a period, though the Military Commissions Act of 2006 was later amended by the Military Commissions Act of 2009 under the Obama administration. The reference to chapter 47A of title 10 of the United States Code in the definition remains current even if the 2006 Act has been superseded, but the arrangement is tied to “the Military Commissions Act of 2006” as a specific statute. If that Act were repealed and replaced without a saving provision, the definition of “United States military commission” might no longer have a referent, potentially rendering the regulations inoperative. No such repeal has occurred to the analyst’s knowledge. The arrangement itself allows either government to withdraw at any time by written notice (Paragraph 17), so the continued operation of the regulations is contingent on both governments not exercising that right. As of the source date, the instrument had not been amended. Users should check the Federal Register of Legislative Instruments for any subsequent amendments, compilations, or repeals.

The source provides no information about litigation involving these regulations. No cases are cited in the instrument itself. Given the narrow scope of the regulations it is unlikely that they have been the subject of reported judicial interpretation. Any legal challenge would likely arise under the International Transfer of Prisoners Act 1997 or the Administrative Decisions (Judicial Review) Act 1977, or possibly as part of habeas corpus proceedings in relation to the prisoner’s detention. The only widely known transfer under this instrument was that of David Hicks in May 2007. Hicks pleaded guilty to one count of providing material support for terrorism before a military commission and was sentenced to nine months’ imprisonment, with all but seven months suspended, and was transferred to Australia to serve the remainder in Adelaide’s Yatala Labour Prison. After his transfer, Hicks challenged the validity of his conviction and the military commission process in United States courts, but those cases did not involve the Australian regulations directly. In Australia, there was political and legal debate about the validity of the Hicks conviction and whether Australian authorities should enforce the sentence, but no reported case appears to have tested the regulations themselves. The High Court of Australia has not considered these regulations. The Administrative Appeals Tribunal or Federal Court could in theory review a decision by the Australian government to consent to a transfer or to adapt a sentence, but no such application has been documented in the source. The instrument is a legislative instrument, so it could be challenged on grounds of constitutional validity or procedural fairness in the making process, but no such challenge is recorded. The litigator should note that any challenge to a transfer decision would likely be against the executive action under the Act or the regulations, not the regulations themselves.

Several features of the regulations and the arrangement could trap unwary practitioners or lead to unintended outcomes. First, the instrument only authorises transfer to Australia, not from Australia. A person convicted by a United States military commission can be sent to Australia to serve their sentence, but there is no reciprocal provision for an Australian sentenced by an Australian court to be transferred to a United States military commission facility. Second, the arrangement is limited to prisoners sentenced in the “applicable United States area” (Guantanamo Bay). A person sentenced by a United States military commission elsewhere, such as in Afghanistan or on a United States naval vessel, would not fall within the arrangement’s terms. Third, consent is required from all three parties: the United States, Australia, and the prisoner. Either government may deny a request without reason (Paragraph 4(3)), so the prisoner has no right to compel a transfer even if they consent. Fourth, the definition of “national of Australia” is broader than citizenship: it includes persons permitted to travel to, enter and remain in Australia indefinitely under the Migration Act 1958 and who have community ties with a State or Territory. This could theoretically include a non citizen detainee who had a permanent visa and lived in Australia for many years, but it also imposes an additional requirement of “community ties” that is not defined. This invites administrative interpretation and potential disputes. Fifth, the United States retains the exclusive right to decide on any application for review of the judgment or to pardon the offence (Paragraph 12). This means the prisoner cannot seek review or pardon from Australian authorities, and any successful review or pardon by the United States would render the sentence unenforceable and Australia must terminate enforcement (Paragraph 13). Sixth, Australia may adapt the sentence under Paragraph 10(2) if it is incompatible in nature or duration with Australian law, but the adaptation cannot aggravate the sanction. This means Australia could substitute a longer sentence if the original sentence were, say, 50 years (incompatible with many Australian sentencing regimes) but the adaptation must not “aggravate, by its nature or duration, the sanction imposed by the United States”. The prohibition on aggravation prohibits increasing duration, but what about converting a determinate sentence into an indeterminate sentence? This is ambiguous. Seventh, the arrangement does not oblige Australia to seek the prisoner’s consent independently; the United States verifies consent, but Australia may also verify by a visit if it so desires. If Australia does not exercise that option, it relies on the United States’ verification. Eighth, the regulations do not expressly deal with the situation of a prisoner who is sentenced but whose judgment is not yet final because appeals remain pending. Transfer can only occur if the judgment is final (Paragraph 6(1)(c)). Ninth, the arrangement is not a treaty and may be withdrawn by either government at any time (Paragraph 17), creating political risk for a prisoner relying on the transfer pathway. Tenth, the regulations do not grant the prisoner any right to judicial review in Australia of the sentence itself; only the enforcement is handled by Australian courts, not the conviction or original sentence.

Compliance with the regulations primarily concerns the Australian Government, specifically the Attorney General’s Department. When the United States informs Australia that a prisoner has expressed interest in transfer, the Department must be prepared to process a formal request. The Secretary of the Department is the channel for written requests and replies. Upon request by Australia, or upon the prisoner’s application to Australia, the Department must decide whether to consent to the transfer. There is no prescribed decision making process in the regulations, but the Department must ensure that the conditions in Paragraph 6 are satisfied: the prisoner is a national of Australia, the sentence is one of imprisonment, the judgment is final, all three parties consent, and the prisoner will be treated humanely and in accordance with Australian laws and international obligations. The nationality condition must be verified using the prisoner’s identity documentation. If the prisoner is not a citizen, the Department must determine whether the prisoner holds indefinite stay permission under the Migration Act 1958 and has community ties with a State or Territory. That assessment involves immigration records and may involve contacting state authorities to confirm ties. Once Australia agrees to transfer, it must request supporting documents from the United States as listed in Paragraph 5: a statement of identity and nationality, a statement of facts, the sentence termination date and time served, certified copies of all judgments and determinations, medical and social reports, and any additional information requested. The Department must also coordinate with state or territory correctional authorities to arrange reception and immediate continued enforcement of the sentence upon transfer (Paragraph 9). If the sentence is incompatible with Australian law in nature or duration, the Department must seek a court or administrative order to adapt the sanction to a punishment prescribed by Australian law for a similar offence, ensuring it corresponds as far as possible and does not aggravate the original sanction (Paragraph 10(2)). The adaptation is not discretionary; it is required if incompatibility exists. The Department must inform the United States when enforcement is considered completed, if the prisoner escapes, or upon request for a special report (Paragraph 14). Throughout, the Department must respect the United States’ exclusive rights concerning review, pardon, amnesty, and commutation (Paragraphs 11 and 12), and must terminate enforcement if notified of any decision making the sentence unenforceable (Paragraph 13). For legal practitioners advising a prisoner, compliance means assessing whether the prisoner falls within the definition of national of Australia and advising on the implications of consent, including that the United States retains review and pardon rights and that the sentence will be enforced under Australian law with a possible adaptation. Practitioners should also verify that the judgment is final and that there are no pending appeals that would prevent transfer.
