International Transfer of Prisoners (India) Regulation 2016

The regulation and the incorporated Agreement rest on a handful of structural concepts that determine when and how transfers happen.

• Transfer country and application of the Act. The regulation declares India a transfer country under s 8(1) of the International Transfer of Prisoners Act 1997 (reg 5). It also specifies that the Act applies to India subject to the bilateral Agreement (reg 6). Thus transfers involving India must comply both with the Act and with the Agreement’s terms as set out in Schedule 1.

• Competent Authorities. The Agreement designates the Australian Government Attorney‑General’s Department as Australia’s Competent Authority and India’s Ministry of Home Affairs as India’s Competent Authority (Schedule 1, Article 3.1). These authorities are the official decision makers who will process transfer requests, communicate directly, notify changes of authority, and consult (Articles 3 and 15).

• Conditions for transfer. Article 4 lists substantive eligibility conditions. Key thresholds include: the conduct underlying the conviction must constitute a criminal offence under the receiving State’s law (Article 4(a)), citizenship requirements where India is the receiving State (Article 4(b)) or where Australia is the receiving State (Article 4(c)), at least six months remaining of the sentence on the day of receipt of the request (Article 4(d)), a final judgment (Article 4(e)), no other proceedings requiring the sentenced person’s presence (Article 4(f)), mutual agreement of the States (Article 4(g)), and the sentenced person’s informed consent (Article 4(h)). There are specific bars or qualifications: the death penalty must not be imposed (unless commuted), military law convictions are excluded unless otherwise agreed, and transfers must not prejudice sovereignty or security interests (Articles 4(i)-(k)).

• Consent and procedural safeguards. The Agreement requires the transferring State to take reasonable steps to ensure voluntary, informed consent according to the law of the transferring State (Article 7). The receiving State may verify consent prior to transfer. The Contracting States must also consent in writing to the transfer (Article 8). The transferring State retains exclusive jurisdiction over review, revision, modification or cancellation of convictions (Article 9.1).

• Continued enforcement and adaptation of sentence. The receiving State enforces the sentence as if the sentence had the same duration and termination date as imposed by the transferring State, and under the receiving State’s laws and procedures (Article 10.1-10.2). If the sentence as imposed is incompatible with the receiving State’s law, the receiving State may propose an adapted sentence that is not more severe than the original; in doing so the receiving State is bound by the transferring State’s factual findings appearing from the conviction, judgement or sentence (Article 10.3).

• Information exchange and administrative requirements. The Agreement specifies detailed documentary information to be supplied with a transfer request (Article 6.5 and 6.6), requires documents or translations in English (Article 13), and assigns translation cost responsibility to the sending State (Article 14.3). Location, dates, remissions, medical and correctional reports, and sentencing materials are among the enumerated items.

• Costs and transport. The receiving State bears the costs of transfer and of continued enforcement after transfer, except for expenses incurred exclusively in the territory of the transferring State; however, the receiving State may seek to recover transfer costs from the sentenced person (Article 14.1-14.2). The receiving State is responsible for transport of the sentenced person from the transferring State and custody outside the transferring State’s territory, with delivery occurring at a place and date within the transferring State agreed by both parties (Article 6.9).

• Entry into force and termination. The Agreement is subject to ratification and enters into force 30 days after the date of last notification (Article 18.1). The Agreement applies to sentences imposed before or after entry into force (Article 18.2) and continues in force indefinitely until terminated by written notice with six months’ effect; transfers already executed remain governed by the Agreement notwithstanding termination (Article 18.3-18.4).

These core concepts structure the division of decision-making authority, the eligibility gatekeeping, documentary burdens, cost allocation, and the legal effect of transfers. The regulation’s domestic effect is to treat transfers involving India as subject to these detailed rules when exercising the powers under the International Transfer of Prisoners Act 1997.

The regulation and the incorporated Agreement affect five distinct groups: sentenced persons, the two national governments (and their designated Competent Authorities), prisons and correctional services, legal advisers and courts, and (indirectly) the taxpayers of the receiving State.

• Sentenced persons: Individuals who are serving a sentence of imprisonment under a conviction are the primary subjects. The Agreement defines “sentenced person” broadly to include persons conditionally released or subject to suspended sentences (Article 1.4). Transfers require voluntary, informed consent of the sentenced person (Article 4(h) and Article 7), except that consent can be given by an authorised person if the sentenced person is incapable under domestic law (Article 4(h)). Sentenced persons face concrete legal consequences if transferred: their sentence will be enforced in the receiving State under that State’s laws (Article 10), including different remissions, parole or release conditions. Where the receiving State may adapt an incompatible sentence, the adaptation cannot be more severe and must respect factual findings from the original conviction (Article 10.3).

• Australian Government Attorney‑General’s Department (AGD): The AGD is Australia’s Competent Authority for implementing the Agreement (Schedule 1, Article 3.1). The AGD will process requests, supply and receive the detailed documentary materials specified in Article 6, ensure consent requirements are met (Article 7), consult with India’s Competent Authority (Article 15), and communicate decisions. The AGD also bears administrative responsibilities under the Act and this regulation, such as ensuring any domestic preconditions under the International Transfer of Prisoners Act 1997 are met. The Minister must also make the commencement announcement required by reg 2.

• Republic of India’s Ministry of Home Affairs: As India’s Competent Authority (Article 3.1), the Ministry handles incoming and outgoing transfer requests involving India, provides required assurances and documents (Article 6.6), enforces transferred sentences in India or cooperates in arranging transit (Article 12), and may refuse transit or transfer where it affects sovereignty, safety or public order.

• Correctional services and transport providers: The receiving State has responsibility for transporting the sentenced person from the transferring State and for custody outside the transferring State (Article 6.9). Correctional authorities in both States must supply correctional, medical and social reports and implement continued enforcement under their respective national laws (Article 6.5 and Article 10).

• Courts and legal advisers: The Agreement affects courts where sentences were imposed in that the transferring State retains exclusive jurisdiction for review or revision of convictions (Article 9.1). Legal advisers will need to advise sentenced persons on consent implications, possible adaptation of sentences upon transfer, potential recovery of transfer costs by the receiving State from the sentenced person (Article 14.2), and the differing operational legal regimes for parole, remission and conditional release after transfer (Article 10.2).

• Taxpayers and budgets of the receiving State: The receiving State bears the direct financial cost of transfer and post‑transfer enforcement (Article 14.1). The receiving State may seek to recover transfer costs from the sentenced person, but the Agreement places primary bearing of transport and enforcement costs on the receiving State. This is a direct budgetary implication for the receiving State’s corrections and foreign affairs budgets.

• Secondary affected parties include diplomatic services (for transmission through diplomatic channels per Article 6.3 and Article 18), translation services (documents must be English or translated, Article 13), and third States in transit arrangements (Article 12).

The regulation therefore channels activity through the Competent Authorities and imposes document, consent and eligibility burdens on sentenced persons and their advisers. It assigns decision‑making power mainly to the Competent Authorities of the Contracting States and conditions transfers on mutual written consent of those authorities and the sentenced person (Articles 6.3, 7, 8).

The Agreement establishes a series of duties and rights for each Contracting State, the Competent Authorities, and the sentenced person. Below are the principal legal obligations and entitlements expressly contained in the Schedule and the regulation.

Duties of the Competent Authorities and Contracting States

• Process and communicate transfer requests. Competent Authorities must process requests in accordance with the Agreement and may communicate directly (Article 3.2-3.3). Either State must notify the other of any change of Competent Authority in writing (Article 3.4).

• Take reasonable steps to inform. The Contracting States must take reasonable steps to inform sentenced persons of the substance of the Agreement after conviction (Article 6.1). This is a duty on the State that holds the sentenced person after conviction.

• Ensure consent is voluntary and informed. The transferring State must take reasonable steps to ensure that consent is voluntary and given with full knowledge of consequences, using the transferring State’s law for procedural governance (Article 7.1). The receiving State may verify that consent was voluntary and informed prior to transfer (Article 7.2).

• Provide detailed documentation. The transferring State must provide detailed information when a request is made and when the receiving State requests it (Article 6.5-6.6). This includes identity and citizenship details, factual statements of the conviction, law creating the offence, sentence dates and nature, time already served, remissions, eligibility for release, correctional and medical reports, and copies of judgements and sentencing remarks.

• Mutual written consent. Both Contracting States must consent in writing to the transfer (Article 8.1). The sentenced person must also consent (Article 4(h)).

• Retain jurisdiction and notify pardons. The transferring State retains exclusive jurisdiction over review, revision, modification or cancellation of convictions imposed by its courts (Article 9.1). Either State may grant pardon or commutation under its own laws and must notify the other State in writing of such decisions (Article 9.2).

Duties and rights relating to enforcement and adaptation of sentence

• Continued enforcement under receiving State law. The receiving State shall enforce the sentence as though it had the same duration or termination date as the original and as if it had been imposed there (Article 10.1). Enforcement thereafter is governed by the receiving State’s laws and procedures (Article 10.2).

• Adaptation limited by severity and facts. If the sentence is incompatible with the receiving State’s law, the receiving State may adapt the sentence, but the adapted sentence must not be more severe in nature or duration (Article 10.3). The receiving State must be bound by the transferring State’s findings of fact as appearing from the conviction, judgement or sentence when adapting.

• Obligation to inform. The Contracting States must take reasonable steps to inform the sentenced person in writing of decisions under Article 9 or Article 10 (Article 10.5).

Financial duties

• Receiving State bears transfer and enforcement costs. The receiving State is principally responsible for paying for the transfer of the sentenced person (except expenses exclusively in the transferring State) and for continued enforcement of the sentence after transfer (Article 14.1). The receiving State may seek cost recovery from the sentenced person (Article 14.2).

• Translation costs. The sending State bears the expenses of translating requests or documents into English (Article 14.3).

Duties around transit and refusal

• Transit cooperation subject to domestic law. If either State transfers via third States, the other must cooperate to facilitate transit through its territory, subject to domestic law and with specified exceptions (Article 12.1-12.3). A State may refuse transit if the sentenced person is its own national or if transit would infringe sovereignty, safety, public order or essential interests (Article 12.1).

Rights of the sentenced person

• Right to be fully informed and give consent. The sentenced person has the right to be informed of the Agreement and must give informed, voluntary consent to transfer (Article 6.1, Article 7.1, Article 4(h)).

• Right to have sentence enforced under receiving State law with limits. The sentenced person can expect enforcement under the receiving State’s law, including potentially different parole or remission regimes; the person is entitled to be informed in writing of actions taken about enforcement and pardon or commutation decisions (Article 10 and Article 11).

• Right to translation and information. Requests and documents must be in English or accompanied by an English translation, which ensures the sentenced person and authorities have accessible documents (Article 13).

These duties and rights are framed as mutual obligations between sovereign Competent Authorities and procedural protections for the sentenced person. The Agreement assigns operational responsibilities to the Competent Authorities, while leaving substantive sentencing law and remission decisions to each State’s domestic legal system, bounded by constraints such as the prohibition on imposing a more severe adapted sentence (Article 10.3).

The regulation itself does not create new criminal offences, penalties, or a dedicated enforcement regime. Instead, enforcement is administrative and contractual between the Contracting States and is embedded in the bilateral Agreement in Schedule 1. The operative mechanisms for effecting compliance and remedying breaches are administrative, diplomatic and legal as follows.

• Administrative enforcement via Competent Authorities. The Competent Authorities (Australian Attorney‑General’s Department and India’s Ministry of Home Affairs, Article 3.1) are the primary enforcers of the Agreement’s procedures. They process requests, exchange documentation, verify consent, and arrange transfer logistics (Article 3, Article 6, Article 7). Non‑compliance with procedural obligations is dealt with by the authorities in the cooperation channel provided by the Agreement (Article 15).

• Mutual consultations and dispute settlement. Article 15 allows Competent Authorities to consult to promote effective use of the Agreement and agree on practical measures to facilitate implementation. Article 16 sets out that Competent Authorities shall endeavour to mutually resolve disputes arising from interpretation, application or implementation, and if they cannot, the dispute is to be resolved through diplomatic channels (Articles 15-16). That confines dispute resolution to administrative and diplomatic means rather than domestic courts, unless domestic law provides otherwise.

• Retention of domestic jurisdiction for conviction review. The transferring State retains exclusive jurisdiction for review, revision, modification or cancellation of convictions imposed by its courts (Article 9.1). This means any legal challenges to the conviction itself remain within the transferring State’s legal processes and associated enforcement mechanisms.

• Obligations to notify and report. The receiving State must provide information to the transferring State concerning enforcement events such as conditional release, completion of enforcement, escape from custody, or reports requested by the transferring State (Article 11). These reporting obligations enable administrative oversight and provide a basis for subsequent diplomatic or logistical action if the transferring State considers the enforcement is not in accord with the Agreement.

• Practical enforcement powers of receiving State. The receiving State enforces the sentence under its own laws, which includes the full range of penal powers available to it (Article 10.2). This is not a new penalty regime created by the Agreement; rather, the receiving State’s domestic penalties and corrections law apply post‑transfer.

• No penal sanctions for non‑compliance with the Agreement text itself. The Agreement does not provide for penal sanctions against States or Competent Authorities that fail to comply. Remedies are administrative and diplomatic (Article 16). For individuals (sentenced persons), non‑compliance with domestic laws (for example escape from custody post‑transfer) would be managed under the receiving State’s penal system and may trigger enforcement action under Article 11.3.

• Financial enforcement via cost recovery. The receiving State may attempt to recover the costs of transfer from the sentenced person (Article 14.2). Recovery mechanisms would depend on the receiving State’s domestic procedures; the Agreement simply permits such recovery as a matter of policy and does not prescribe the enforcement mechanism.

In sum, enforcement of the Agreement’s terms is carried out through the Competent Authorities’ administrative powers, diplomatic channels for disputes, and the domestic enforcement powers of each Contracting State. The regulation itself does not create offences or penalty clauses; instead, it relies on the domestic legal systems of the Contracting States and inter‑governmental administrative processes to give effect to, and to enforce, the Agreement.

The Regulation and the bilateral Agreement are designed to operate alongside the International Transfer of Prisoners Act 1997 and other domestic and international legal obligations. The Schedule expressly addresses relationships with other instruments and leaves substantive domestic legal frameworks in place.

• Supremacy of domestic law for many matters. The Agreement repeatedly defers to the domestic law and procedures of the receiving State for enforcement after transfer (Article 10.2). That means parole, remission, conditional release, confinement conditions, and medical or social care will be governed by the law applicable in the receiving State once transfer is effected. Courts and correctional services in the receiving State will apply their existing statutory schemes to the transferred person, subject to limitations in the Agreement such as the prohibition on more severe adapted sentences (Article 10.3).

• Consistency with multilateral obligations. Article 5 of the Agreement states explicitly that the bilateral Agreement shall not affect any obligations under multilateral conventions to which one or both Contracting States are party. That preserves each State’s obligations under applicable conventions, treaties or customary international law. The Agreement therefore interacts as a bilateral complement rather than a substitute for multilateral instruments.

• Relationship with the International Transfer of Prisoners Act 1997. The regulation is made under s 8 of that Act (reg 3) and expressly declares India a transfer country for the purposes of the Act (reg 5). It further provides that the Act applies to India subject to the Agreement (reg 6). Practically, transfers processed under the Act will be governed by the Act’s processes and powers in so far as they do not contradict the Agreement; where the Agreement elaborates or limits matters, those bilateral terms apply to transfers involving India. The regulation thus operates as the statutorily required domestic step linking the Act to the Agreement.

• Interaction with criminal proceedings and jurisdiction. Article 4(f) requires that no other legal proceedings be pending in the transferring State in which the sentenced person’s presence is required. Article 9.1 then preserves exclusive transferring State jurisdiction for review, modification or cancellation of convictions. These provisions integrate with domestic criminal processes: a pending appeal, new charge or other proceeding may bar transfer under Article 4(f) until resolved domestically.

• Death penalty and commutation. Article 4(i) precludes transfer where the death penalty has been imposed, except where the death penalty was commuted to imprisonment or life imprisonment. This clause interacts with domestic capital punishment regimes: if a sentence still includes a death penalty, transfer is not allowed unless commuted. Where domestic law allows commutation, transfer becomes possible only when the condition in Article 4(i) is satisfied.

• Military law convictions. Article 4(j) excludes persons convicted under military law unless both States agree otherwise. That interacts with domestic military justice systems and may require inter‑state negotiation where military convictions are involved.

• Transit and third‑party arrangements. Article 12 allows either State to enter into transfer arrangements with third States, and the other State must cooperate in facilitating transit subject to domestic law and certain exceptions. This interacts with immigration, aviation, and transit law in any State whose territory may be used for passage.

• Translation and document requirements. Article 13 imposes a requirement that documents be in English or accompanied by an English translation. For transfers involving non‑English documents, translation obligations interact with evidence rules and administrative requirements under domestic law.

• Non‑exclusive remedies. The Agreement’s dispute settlement provision (Article 16) limits disputes between Competent Authorities to mutual resolution and diplomatic channels. It does not displace domestic remedies that may be available to individuals under national law (for example, judicial review of administrative decisions in the transferring State), but the Agreement does not create or alter such domestic remedies. Any rights to judicial review or appeal remain grounded in domestic law.

Overall, the regulation and Agreement are structured to operate in concert with domestic criminal and corrections law, multilateral treaty obligations, and administrative procedures. The Agreement preserves each State’s existing legal powers while providing a bilateral procedural framework for transfer, consent, information exchange and cost allocation.

The Regulation text includes an explicit commencement table and a note that the table relates only to the instrument as originally made and will not be amended to deal with later amendments (reg 2). The instrument is made under s 8 of the International Transfer of Prisoners Act 1997 (reg 3). The instrument’s Schedule reproduces the bilateral Agreement signed 18 November 2014.

No amendments to this regulation are contained in the source text provided. The commencement provision states that the instrument commences on the later of the day after registration and the day the Agreement comes into force for Australia, and requires the Minister to announce the day the Agreement enters into force for Australia by notifiable instrument (reg 2). The footnote in reg 2 indicates a notifiable instrument dated 21 December 2016 (F2016N00043) and implies that paragraph (b) of the commencement condition applied on that date. The source contains a note: “This table relates only to the provisions of this instrument as originally made. It will not be amended to deal with any later amendments of this instrument.” That indicates the instrument as originally made had only the Schedule and provisions shown.

In the Schedule itself, Article 17 provides that any amendments or modifications to the Agreement agreed by the Contracting States shall come into force in the same manner as the Agreement itself. Article 18 sets out the ratification, entry into force and termination procedure, including a 30‑day period after last notification for entry into force and a six‑month notice period for termination; the Agreement applies to sentences imposed before or after entry into force (Article 18.1-18.2). These provisions define the international amendment and termination mechanics but do not record any post‑signature amendments.

Because the regulatory instrument adopts the Agreement by schedule and ties its domestic commencement to the Agreement’s entry into force, any subsequent amendment to the Agreement at the international level would require adherence to the Article 17/18 mechanisms between the Contracting States and, domestically, might require the Minister to act per the International Transfer of Prisoners Act 1997 and the regulatory machinery for updating declared transfer countries. The instrument’s own note about not updating the commencement table for later amendments suggests that recorded amendments to this regulation itself are not embedded in the document provided.

For practitioners, the relevant implication is to check the current version of the regulation and Schedule published by the Attorney‑General’s Department or the Federal Register of Legislation for any later modifications or replacement instruments, since the source document reflects the instrument as originally made and provides the procedure for amendment by the Contracting States rather than any domestic amendment pathway.

The source text contains no references to any litigation, judicial decisions, or cases that interpret or apply this regulation or the bilateral Agreement. The Schedule is an international agreement in treaty form reproduced in the instrument; it does not cite any case law. The regulation itself is a domestic instrument made under s 8 of the International Transfer of Prisoners Act 1997 and there is no recorded case history in the text provided.

Given the absence of litigation material in the source, readers should understand that any judicial interpretation of the Agreement’s provisions, such as the meaning of “final judgement” (Article 4(e)), the scope of the transferring State’s exclusive jurisdiction (Article 9.1), or the limits on adaptation of sentence (Article 10.3),would need to be located in domestic case law concerning transfers under the International Transfer of Prisoners Act 1997 or relevant administrative decisions by the Competent Authorities. Those materials are not reproduced here.

If litigation arises, possible legal issues that a court could be called on to interpret include the adequacy of consent procedures under Article 7, the meaning of “incompatible” sentence under Article 10.3, the scope of the transferring State’s jurisdiction reserved under Article 9.1, the legality of cost recovery from a sentenced person under Article 14.2, or whether procedural requirements in Article 6 were met before the Contracting States gave consent in writing under Article 8. The Agreement’s Article 16 sends State‑State disputes to diplomatic channels but does not preclude domestic judicial review of administrative acts by a Competent Authority within a State’s legal system. Those interpretive issues would have to be tested in domestic courts; any relevant decisions are outside the source material provided.

For authoritative guidance on litigation or judicial precedents, practitioners must consult judicial databases, the Federal Register and administrative decisions of the Attorney‑General’s Department and the courts of competent jurisdiction. The present instrument contains no litigation history to cite.

Several practical pitfalls and constraints are embedded in the Agreement’s text that practitioners should note because they can prevent transfer or produce unintended legal outcomes.

• Finality requirement (Article 4(e)). The Agreement requires the judgement to be final. “Final” can be jurisdictionally defined in domestic law, and can exclude persons with pending appeals or review processes. This is separate from Article 4(f) which bars transfer where other legal proceedings are pending that require the person’s presence. Practitioners must confirm that the sentence is final and that no other proceedings are pending.

• Six months remaining rule (Article 4(d)). On the day of receipt of the request for transfer, the sentenced person must have at least six months of the sentence remaining, unless both States agree to waive. That timing requirement can be an absolute bar unless a bilateral waiver is negotiated. It requires forward planning: if there is less than six months to serve, transfer will generally not be available.

• Citizenship thresholds and definitions (Article 4(b)-(c)). Where India is the receiving State, the sentenced person must be an Indian citizen (Article 4(b)). Where Australia is the receiving State, the Agreement defines Australian citizen to include a person permitted to enter and remain indefinitely in Australia and who has community ties with a State or Territory of Australia, provided they are not an Indian citizen (Article 4(c)). Those citizenship and status tests may create complexity for dual nationals or persons with permanent residency but ongoing citizenship claims. The unusual formulation in Article 4(c) requires careful documentary proof of citizenship or residency status.

• Death penalty bar and commutation (Article 4(i)). Transfers are barred where the death penalty has been imposed, except where it has been commuted to imprisonment or life imprisonment. If a sentence remains death-penalty‑containing in the transferring State, transfer is not available unless commutation occurs. The timing and legal mechanism for commuting a death sentence are matters of domestic law and may delay or prevent transfer.

• Military offences exclusion (Article 4(j)). Persons convicted under military law are excluded unless both States agree otherwise. That may become an obstacle where the offence has a military component or the conviction is in a military jurisdiction.

• Consent formalities and verification (Articles 4(h), 7). Consent must be voluntary and informed according to the law of the transferring State (Article 7.1). The receiving State can verify, prior to transfer, that consent was freely given (Article 7.2). Different domestic procedures for obtaining and proving consent can lead to disputes or delays, and failure to observe the transferring State’s consent procedure can render a transfer procedurally defective.

• Detailed documentary requirements (Article 6.5-6.6). Requests must include comprehensive material: identity particulars, citizenship status, conviction certificates and judgements, details of remissions, medical and correctional reports, and sentencing remarks. Failure to provide the specified information or to provide English translations (Article 13) can cause delays or refusal. The sending State bears translation costs (Article 14.3), which can be material where large volumes of documentation exist.

• Transfer costs and recovery (Article 14). Although the receiving State bears the transfer and enforcement costs (Article 14.1), it may seek to recover transfer costs from the sentenced person (Article 14.2). Practitioners must advise clients that cost recovery is permitted and depends on the receiving State’s domestic recovery mechanisms. The Agreement does not cap recovery amounts nor prescribe recovery procedures.

• Adaptation of the sentence by the receiving State (Article 10.3). If the receiving State’s law makes the original sentence legally incompatible, the receiving State may adapt the sentence but must not impose a sentence more severe in nature or duration. However, the receiving State enforces the adapted sentence under its own law, which can have significant practical consequences for parole eligibility, remission and confinement conditions. The receiving State is bound by the transferring State’s factual findings as they appear in the conviction, but there may be ambiguity in what constitutes being “bound” by those findings in practice.

• Jurisdictional complexity on pardons and commutations (Article 9.2). Each State may independently grant pardon or commutation under its own Constitution or laws and must notify the other State in writing. This creates situations where one State’s executive clemency may affect the person’s status without the other State’s concurrence.

• Transit refusals and diplomatic risk (Article 12). Transit through the territory of the other Contracting State or third States can be refused if the person is a national of the transit State, or transit would infringe sovereignty, safety, public order or essential interests. This can complicate travel routes and logistics for transport.

• No direct judicial enforcement mechanism in the Agreement text (Article 16). The Agreement prescribes diplomatic-resolution mechanisms for inter‑State disputes and does not create an intra‑State judicial enforcement pathway for breaches of the Agreement. Domestic remedies may remain available, but reliance on diplomatic resolution can slow responses in practice.

• Language priority provision. The Agreement is equally authentic in English and Hindi but states that in case of differences, the English text shall prevail (final lines of Schedule 1). For practitioners using Hindi texts, the English text is the controlling version.

These “gotchas” illustrate that procedural, timing, citizenship, consent and document requirements are essential gating factors. Failure to satisfy any of the explicit requirements can delay or prevent transfer. Practitioners and Competent Authorities must be vigilant about the precise thresholds set out in the Agreement to avoid avoidable refusal or delay.

The Agreement and the regulation create a clear, document‑driven process that Competent Authorities and practitioners must follow. Below is a step‑by‑step compliance checklist grounded in the Agreement text (Schedule 1), and the regulatory obligations (regs 5-6).

1. Confirm the regulation and Agreement are in force.

   • Check that the bilateral Agreement has entered into force for Australia per Article 18 and reg 2; the Minister must announce the commencement day by notifiable instrument (reg 2). Do not proceed until the Agreement is active.

2. Verify eligibility under Article 4.

   • Confirm the acts or omissions for which the conviction occurred constitute an offence under the receiving State’s law (Article 4(a)), or obtain mutual waiver of that requirement if both States agree.
   • Verify citizenship criteria: if India is the receiving State, confirm Indian citizenship (Article 4(b)); if Australia is the receiving State, confirm Australian citizenship or the equivalent status defined in Article 4(c) and that the person is not an Indian citizen.
   • Ensure the judgement is final (Article 4(e)).
   • Ensure no other legal proceedings requiring presence are pending in the transferring State (Article 4(f)).
   • Confirm at least six months of the sentence remain on the day the request will be received, unless both States agree to waive (Article 4(d)).
   • Confirm the death penalty has not been imposed (Article 4(i)), and that the conviction is not under military law unless both States agree (Article 4(j)).

3. Obtain informed consent from the sentenced person.

   • Follow the transferring State’s law for the procedure to obtain consent; take reasonable steps to ensure the person understands the legal consequences (Article 7.1).
   • If the person is incapable of giving consent, obtain consent from an authorised representative under the transferring State’s law (Article 4(h)).
   • Be prepared to allow the receiving State to verify consent prior to transfer (Article 7.2).

4. Prepare the transfer request and requisite documentation.

   • Draft a written request to the Competent Authority of the other State through diplomatic channels (Article 6.3), or coordinate with the Competent Authority to do so.
   • Include the information listed in Article 6.5: full identity details, citizenship/residence status, location, statement of facts, statement of law creating the offence, sentence commencement and termination dates, time already served, remissions, earliest eligibility date for release, copies of certificates of conviction and any judgements and sentencing remarks, correctional/medical/social reports, and any other information requested by the receiving State.
   • Ensure all documents are in English or accompanied by an English translation; bear translation costs as the sending State (Article 13 and Article 14.3).

5. Engage the Competent Authority.

   • The Attorney‑General’s Department is Australia’s Competent Authority (Article 3.1). Communicate directly with India’s Ministry of Home Affairs (Article 3.1-3.3) and provide the materials requested to enable informed consideration of transfer (Article 6.5-6.6).
   • Notify or confirm changes in Competent Authority in writing if applicable (Article 3.4).

6. Ensure mutual written consent.

   • Transfers require written consent from both Contracting States (Article 8.1). Coordinate with the Competent Authorities to secure written state consent before transfer arrangements proceed.

7. Plan logistics and costs.

   • Understand that the receiving State will arrange transport from the transferring State and bear transfer costs except for expenses incurred exclusively in the transferring State (Article 6.9 and Article 14.1). If the receiving State intends to recover transfer costs from the sentenced person, advise the person of that possibility and any available domestic avenues for challenging cost recovery (Article 14.2).

8. Address incompatibility and sentence adaptation.

   • Anticipate that the receiving State will enforce the sentence under its own laws (Article 10.2). If incompatibility is likely, seek to clarify in advance how the receiving State would adapt the sentence and ensure the adaptation is not more severe (Article 10.3). Obtain from the receiving State a statement describing enforcement and any adaptation before transfer if requested (Article 6.6.3).

9. Manage transit and third‑party arrangements.

   • If transfer involves third States, provide advance notice to the other Contracting State’s Competent Authority (Article 12.3) and obtain assurances if required (Article 12.4). Be aware that transit can be refused under the conditions in Article 12.1.

10. Maintain records and notify the sentenced person.

    • Keep records of all communications, translations, consent documentation and documentary exchanges. Inform the sentenced person in writing of actions taken under Articles 9 and 10 as required by Article 10.5.

11. Post‑transfer reporting and follow up.

    • The receiving State must provide information concerning enforcement, conditional release, completion of enforcement, escape, or as otherwise requested (Article 11). Monitor these reports and raise any concerns through the Competent Authority channels.

12. Use consultation and dispute mechanisms if problems arise.

    • If implementation issues or disputes occur, initiate Competent Authority consultations (Article 15) and, if necessary, pursue diplomatic channels per Article 16. For domestic administrative decisions, consider available domestic remedies such as judicial review, subject to the legal context in the transferring State.

13. Ensure compliance with domestic procedural obligations under the International Transfer of Prisoners Act 1997.

    • The regulation makes India a declared transfer country under the Act (reg 5) and applies the Act subject to the Agreement (reg 6). Practitioners must ensure that any procedural or statutory requirements under the Act are followed in parallel with the Agreement’s requirements.
