International Monetary Agreements (Quota Increase) Act 1980

This Act revolves around three core legal concepts: parliamentary approval of international financial consent, the specific numerical quota in SDRs, and statutory cross-reference to prior domestic legislation for financing and implementation.

Parliamentary approval of international consent: Section 4 is framed as approval of “the giving of consent by Australia” to the IMF quota increase. The text does not specify the form of the executive act that constitutes that consent; it records Parliament’s approval of that giving of consent. The effect is to place the quota increase within domestic statutory authorisation.

The numerical quota: The Act specifies the new quota precisely, 1,185,000,000 special drawing rights, and uses the term “special drawing rights” in the operative provision (s 4). The statute therefore fixes the static legal commitment in both quantum and currency unit (SDRs), rather than leaving the amount to subordinate instruments.

Reference to earlier financing machinery: Section 5 operates by reference. It states that section 7 of the International Monetary Agreements Act 1947 applies to any payment by Australia caused by the quota increase “as it applies to payments under that Act” (s 5). The heading for s 5 is “Issue of securities”, which signals the subject matter of s 7 in the 1947 Act relates to issuing securities as a financing mechanism. The 1980 Act does not reproduce s 7, nor does it restate the detailed powers, conditions, limits or procedures that s 7 might contain. Users must consult the 1947 Act to know the precise legal mechanics.

Commencement and temporal effect: Section 2 provides that the Act comes into operation on the day it receives Royal Assent. The compilation's endnotes record the original assent and commencement date as 19 September 1980 (Endnote 3). The compilation also records an amendment history (Endnotes 3 and 4) including a repeal of s 3 by a 2024 amending act (Endnote 4), which affects the statute's present text.

Statutory minimalism and delegated details: The Act is minimalist: it performs a discrete legal authorisation and delegates execution and payment mechanics to the 1947 Act. This creates a modular legislative structure where the quota approval is listed in this standalone Act and the operational finance powers remain in a standing statute.

Primary legal obligor: Australia. The Act expressly approves the giving of consent by Australia to increase its IMF quota and covers “any payment to be made by Australia by reason of the increase of its quota” (s 4; s 5). The sovereign, acting through the Commonwealth government, is the payer and principal decision-maker in practice because the text binds Australia’s legal capacity to incur the financial obligation and ties financing to pre-existing statutory machinery.

Responsible institutions and officials (implied): The text does not name a specific Minister, department or statutory officeholder. However, because the Act makes section 7 of the International Monetary Agreements Act 1947 applicable to payments arising from the quota increase (s 5), any agencies or official actors who exercise powers conferred by that earlier Act will be implicated. The Act’s cross-reference therefore creates an operational link to whatever executive mechanisms exist under the 1947 Act; the compilation does not reproduce those mechanisms, so readers must consult the 1947 Act to identify the responsible agencies and procedural steps.

Budgetary and accounting stakeholders: Treasuries, central agencies and accounting officers will be materially affected because the Act approves a commitment expressed in SDRs and signals that payments may be made under the financing mechanism in the 1947 Act. Any department charged with implementing the payment (for example, the Department of Treasury, the Reserve Bank in an operational role, or the Finance portfolio) must coordinate the practical steps for converting the liability into domestic currency or issuing securities if that is the mechanism under s 7 of the 1947 Act. The Act itself does not specify appropriation or supply mechanics.

External stakeholders: The International Monetary Fund is the counterparty for quota subscriptions. The Act’s approval of Australia’s consent is a domestic legal precondition to Australia fulfilling international obligations to the IMF. Private sector financial institutions might be affected indirectly if the 1947 Act’s s 7 authorises issuance of government securities to finance the payment; such securities issuance would engage capital markets and primary dealers. The text in this compilation indicates the subject matter (s 5 heading “Issue of securities”) but does not set marketplace terms.

Legal advisers and compliance professionals: Because the Act delegates operational detail to the 1947 Act, lawyers, compliance officers and accountants advising on legal authority for payment, appropriation requirements, and securities issuance must consult both statutes and review the amendment history. The compilation notes that s 3 was repealed and that the Act has been amended (Endnote 4), so due diligence on current text and interplay with the 1947 Act is necessary.

Others: Parliamentarians and auditors will be stakeholders in oversight, but the Act itself does not create reporting or oversight clauses; any such requirements will be found in the earlier act or in other financial legislation, not in this text.

Statutory duty to approve the consent: Section 4 records Parliament’s approval of Australia’s giving of consent to an IMF quota increase to the specified SDR amount. The duty imposed by the statute is textual and declarative; it does not itself impose ancillary obligations such as reporting, timelines or operational duties. The immediate legal effect is to authorise the consent within domestic law.

Application of pre-existing payment rules: Section 5 creates a duty of conformity by importing section 7 of the International Monetary Agreements Act 1947 to payments arising from the quota increase. The Act does not restate s 7, but the importation means that any procedural duties, conditions, or limitations that s 7 imposes on payments under the 1947 Act will apply equally to payments arising from this quota increase (s 5). The heading of s 5, “Issue of securities”, indicates the subject matter that s 7 addresses in the 1947 Act, so duties under that section are likely relevant to financing; however the specific content of those duties is not within this compilation.

Rights implicit in parliamentary authorisation: By approving the giving of consent, the Act secures Australia’s entitlement to participate in the revised quota arrangement at the specified SDR level. That is an entitlement of the Commonwealth as a member of the IMF. The statute does not create private legal rights for third parties, nor does it alter private contracts. Any rights that arise (for example, rights to be paid in SDRs or rights relating to the IMF’s internal governance) are external to this Act and are governed by IMF agreements and other domestic enactments.

Administrative discretion and limits: The Act itself does not confer fresh discretionary powers beyond what section 7 of the 1947 Act may already provide. Instead it channels payments into that existing statutory framework. The practical decision-making discretion, how to make payments, whether to issue securities, terms of issuance, conversion of SDRs to domestic currency, depends on the content of s 7 and associated rules. Therefore, the Act limits new statutory duties to approval and transposes operational duties to the 1947 Act.

Temporal duties: Section 2 sets commencement on Royal Assent, so duties to act under the Act, and rights it creates, arise from that date (s 2). The Act does not otherwise specify time limits for payments or further approvals.

Recordkeeping and legal certainty duties: The Act fixes the quota amount in statutory form (s 4). This creates a clear textual reference for auditors, account preparers, and legal advisers to rely on when reconciling Australia’s IMF commitments. The duty to align payments with the 1947 Act (s 5) creates a requirement for officers to consult and apply that earlier statute in execution.

The Act contains no express criminal penalties, civil fines, or enforcement mechanisms within its four operative provisions. Sections 1, 2, 4 and 5 do not prescribe sanctions for non-compliance or set up a regime of penalties or administrative enforcement. Instead, the statute performs an approving and referential function: it approves the consent (s 4) and refers payments to the mechanics of the 1947 Act (s 5).

Enforcement implications depend on the earlier statute: Because s 5 imports section 7 of the International Monetary Agreements Act 1947 to payments arising from the quota increase, any enforcement mechanisms that apply to payments under the 1947 Act by virtue of s 7 will, by the language of s 5, be applicable to these quota-payments as well. The compilation does not reproduce s 7 or any enforcement provisions from the 1947 Act, so the presence or absence of penalties, criminal or civil, or of administrative remedies, cannot be determined from this text alone. Practitioners must consult the 1947 Act to identify applicable sanctions, enforcement processes, or dispute resolution provisions that govern payments and securities issuance in the context of international monetary agreements.

Judicial enforcement and review: The Act does not provide special statutory standing or procedural pathways for judicial review of decisions taken under its authority. Any challenge to executive measures taken pursuant to the Act,such as a challenge to a payment or to the method of financing, would proceed under general administrative law principles and under whatever procedural rules apply to the exercise of powers in the 1947 Act. The compilation contains no litigation history or references to judicial decisions.

Oversight by Parliament and auditors: The Act itself does not create new reporting obligations or audit pathways. However, the fact of statutory approval and the importation of the 1947 Act’s payment rules mean that parliamentary financial oversight (estimates committees, appropriation processes, Auditor-General audits) will engage as usual through mechanisms outside this Act. The compilation does not specify how those oversight processes are to be engaged.

Practical enforcement consequence: Because the statutory text ties payments to the earlier Act, failure to follow the processes required by the 1947 Act (if any) could expose officials to administrative consequences, and could affect the legal validity of payments. The compilation does not state those processes; legal advisers must review the 1947 Act to determine precise enforcement exposure.

Direct cross-reference to the International Monetary Agreements Act 1947: Section 5 explicitly makes section 7 of the International Monetary Agreements Act 1947 applicable to any payment made by Australia because of the quota increase (s 5). This is the principal statutory interaction. The 1980 Act therefore does not stand alone for implementation; it relies on pre-existing legal authority in the 1947 Act for the mechanisms of payment, which could include the issuance of securities, conversion between currencies, terms and conditions of subscription, and other practical steps. Because the compilation does not reproduce s 7, one must consult the 1947 Act for precise legal mechanics and limits.

Appropriation and supply legislation (not reproduced here): The Act does not itself enact appropriation or specify budgetary treatment. It is silent on whether payments will require appropriation through annual supply, a standing appropriation, or some other funding route. The text’s importation of s 7 may be intended to secure an operational financing mechanism, suggested by the s 5 heading “Issue of securities”,but the compilation does not state how this interacts with the Commonwealth’s constitutional appropriation requirements or with the Financial Management and Accountability framework. Practitioners must determine how the 1947 Act’s mechanisms interact with appropriations law and contemporary public finance legislation.

Amendments and later statutes: The compilation records that the Act has been amended (Endnote 3) and that one provision (s 3) was repealed by later legislation (Endnote 4). The Treasury Laws Amendment (Delivering Better Financial Outcomes and Other Measures) Act 2024 (No 67, 2024) appears in the legislation history and had commencement effect for the compilation on 10 July 2024 (Endnote 3). Users should check the amending instruments to identify how the 1980 Act now sits within the updated legal landscape.

International law relationship: The Act operates domestically to approve Australia’s consent to an IMF quota increase. It does not itself incorporate or vary the IMF Articles of Agreement; rather it authorises the domestic legal steps needed to fulfil Australia’s membership obligations. The relationship between this domestic statute and international treaty obligations is not further elaborated in the text.

Statutory interpretation implications: Because the 1980 Act imports s 7 of the 1947 Act “as it applies to payments under that Act” (s 5), courts and agencies will need to read the two statutes together when determining legal authority for particular payments. Any inconsistency or ambiguity will require reference to legislative history and to the precise wording of s 7. The compilation indicates that s 3 was repealed by later legislation (Endnote 4), so the current shape of the Act is the product of subsequent legislative pruning.

Regulatory and market law interactions: If s 7 of the 1947 Act authorises the issue of government securities to finance the payment (suggested by s 5’s heading), that would engage market regulation, disclosure rules and securities settlement processes. The compilation does not include those regulatory instruments; practitioners must map the 1947 Act’s powers against financial market regulation.

The compilation contains an endnotes section that records the legislative and amendment history relevant to the Act. Key points visible in this compilation are:

• Original enactment: The International Monetary Agreements (Quota Increase) Act 1980 was Act No. 151 of 1980, assented to on 19 September 1980 and commenced on the same date (s 2; Endnote 3). The Act was intended at that time to approve Australia’s consent to the IMF quota increase specified in s 4.

• Compilation and later amendments: This compilation is dated 10 July 2024 and indicates inclusion of amendments by “No. 67, 2024” (header information). The legislation history in Endnote 3 lists the Treasury Laws Amendment (Delivering Better Financial Outcomes and Other Measures) Act 2024 (No 67, 2024), which was assented to on 9 July 2024 and which had an item (Sch 4 item 29) commence on 10 July 2024 (Endnote 3). The compilation registration date is recorded as 26 July 2024.

• Repeal of s 3: Endnote 4’s amendment history states that section 3 of this Act was repealed by “No 64, 2024” (Endnote 4). The compiled text in the main body does not include a section 3, reflecting that repeal. The endnotes use the convention “s 3… rep No 64, 2024” to indicate that a later Act (number 64 of 2024) repealed that provision.

• Editorial and compilation notes: The compilation contains standard commentary about editorial changes and misdescribed amendments (Endnote 1). It warns that the compilation does not show the effect of uncommenced amendments and that modifications by other laws might not be reflected in the compiled text (header notes). The endnotes list the laws that amended or affected the Act and provide the reader with references to the Register for any uncommenced amendments.

Practical implication of the amendment history: The Act’s present form is the result of subsequent statutory housekeeping. The repeal of s 3 indicates that the 1980 Act originally contained at least one additional provision that has since been removed. The 2024 Acts referenced in the endnotes made changes to the statute book that touch this Act; users should inspect the cited amending Acts (No 64, 2024 and No 67, 2024) on the Register for full detail where relevant. The compilation’s endnotes are the authoritative trail for amendment timing and textual change.

This compilation contains no references to case law, judicial decisions, or litigation arising under the International Monetary Agreements (Quota Increase) Act 1980. The Act’s text and endnotes do not list any court proceedings that interpret, apply or challenge the statute. The compilation therefore does not supply a litigation history.

Practical consequences of the absence of recorded litigation: The lack of reported cases in the compilation means there are no precedent-based authorities within this compiled text that clarify ambiguous points such as the nature of the consent approved in s 4, the operational meaning of importing s 7 of the 1947 Act, or the interaction of this Act with public finance or administrative law doctrines. Absent such judicial interpretation in the compilation, public officials and advisers must rely on the plain text, the cross-referenced 1947 Act, parliamentary materials, and general administrative and constitutional law principles when advising on or implementing measures under this Act.

Where interpretive questions are likely to arise: Common areas where litigation could occur (but for which no cases are recorded here) include:

• The legal effect and scope of “the giving of consent by Australia” as approved in s 4, including questions about whether the approval covers specific executive acts or is limited to a formal consent instrument;
• The application and scope of s 7 of the 1947 Act once imported by s 5, including whether that section authorises particular modes of financing or securities issuance and the limits on those powers;
• Questions about appropriation and constitutional requirements for payment, if a dispute arises about whether an appropriation was required or whether the 1947 Act’s mechanism displaces appropriation needs.

Because no cases are recorded, if litigators or litigant agencies require precedential footholds they will need to look outside this compilation to general administrative law and public finance decisions, and to the 1947 Act for specific operational rules. Any relevant litigation that post-dates this compilation would not be captured here; users should search legal databases and the courts’ records for subsequent cases.

Several practical and legal pitfalls arise from the Act’s brevity and its reliance on the International Monetary Agreements Act 1947.

1. Cross-referencing without reproduction: Section 5 makes s 7 of the 1947 Act applicable, but the 1980 Act does not reproduce s 7. A reader who assumes that s 5 itself contains the full financing authority will be mistaken. Practitioners must consult the 1947 Act to know what powers, conditions, limits and procedures apply. The 1980 Act’s heading “Issue of securities” gives an indicator of subject matter but not the operative details (s 5).

2. Appropriation uncertainty: The Act is silent about appropriation and does not specify funding pathways. It therefore leaves open questions about how payments will be treated under appropriation law. Whether payments require subsequent appropriation, or whether the 1947 Act provides a financing mechanism that operates without additional appropriation, cannot be determined from this compilation alone. Advisers should not assume appropriation status without checking the 1947 Act and current public finance statutes.

3. Fixed quantum in SDRs: Section 4 fixes the quota in special drawing rights at 1,185,000,000 SDRs. This fixes Australia’s legal commitment in SDR-denominated terms. Operationally, conversion to domestic currency or the timing of payments will depend on available mechanisms under the 1947 Act. The fixed quantum may interact with market exchange rates and with how the Treasury or Reserve Bank effects payments.

4. Repealed provision(s) and amendment trail: Section 3 has been repealed (Endnote 4). Users who rely on older commentary or legislative drafts that reference s 3 may be misled. Always verify whether older secondary sources refer to now-repealed parts of the Act.

5. Minimal oversight language: The Act contains no reporting, parliamentary oversight or accountability provisions specific to this quota increase. Any such obligations must be sought in other statutes or in administrative practice. Relying on the 1980 Act alone for oversight obligations is insufficient.

6. Ambiguity over the nature of “consent”: The phrase “the giving of consent by Australia to the increase of its quota” (s 4) may raise questions about whether the approval covers past, present or future acts, or particular instruments signed with the IMF. The text is declarative not procedural, so legal advisers should ensure that any consent instruments executed at the international level are accompanied by the domestic steps required by the 1947 Act.

7. Market effects if securities issued: The heading and cross-reference suggest the possibility of issuing securities to finance payments. If that occurs, market participants will need to align issuance with contemporary financial markets regulation, settlement arrangements and disclosure obligations. The Act does not address those layers.

8. Reliance on external instruments and amendments: The compilation warns that uncommenced amendments and modifications by other laws may affect the compiled text (compilation notes). Practitioners should check the Federal Register of Legislation and the cited amending Acts (including No. 64, 2024 and No. 67, 2024) for any further changes not visible in this compilation.

For public officials, legal advisers, accountants and compliance officers required to give effect to this Act, the steps below set out a practical compliance checklist grounded in the Act’s text and compilation notes. The list identifies actions justified by the Act’s content and by the fact that operational mechanics are to be supplied by the International Monetary Agreements Act 1947.

1. Confirm commencement and legal status: Verify the Act’s commencement (s 2) and relevant amendment history in the compilation’s endnotes (Endnote 3 and Endnote 4). The original commencement was upon Royal Assent on 19 September 1980; check for any later amendments that affect the Act’s content or operation.

2. Identify the precise legal obligation: Note that the Act approves Australia’s consent to an IMF quota increase to 1,185,000,000 SDRs (s 4). Confirm whether the relevant international consent instrument has in fact been executed and what domestic act of consent it requires. The Act records parliamentary approval; ensure that executive paperwork aligns with that approval.

3. Consult the International Monetary Agreements Act 1947, section 7: Because s 5 makes s 7 of the 1947 Act applicable to any payment by Australia caused by the quota increase “as it applies to payments under that Act,” compliance requires reading s 7 and related provisions of the 1947 Act. That will reveal the authorised financing mechanism, any limits, conditions, required approvals, trusteeship arrangements, or procedural steps (for example, if securities are to be issued, what authority and process govern issuance). The 1980 Act itself does not provide those details.

4. Determine appropriation and budget procedures: Do not assume payments are automatically appropriated. Determine whether the financing route under s 7 interacts with the Appropriation Acts or otherwise requires parliamentary appropriation or notice. Consult contemporary public finance legislation and Treasury guidance to align implementation with appropriation rules.

5. Prepare operational implementation plans: If section 7 of the 1947 Act authorises securities issuance or other financing steps, the responsible agency should prepare an implementation plan addressing:

   • timing and quantum of payments (matching the 1,185,000,000 SDR figure in s 4),
   • currency conversion and market execution procedures,
   • legal documentation for any securities issuance,
   • engagement with primary dealers and market infrastructure,
   • accounting treatment and reconciliations for auditors.

6. Coordinate with the IMF: Confirm procedural steps with the IMF to ensure that the domestic approval aligns with the international process for quota subscription or payment. Ensure that the form of consent and any certifications required by the IMF are met.

7. Legal documentation and records: Keep precise records that tie the international consent instrument, parliamentary approval under s 4, and the internal steps taken under the 1947 Act together. This record will be necessary for auditors, parliamentary committees, and legal scrutiny.

8. Check amending Acts and the Register: The compilation indicates later amendments and a repeal of s 3 (Endnote 4) and notes inclusion of amendments up to 2024. Check the Federal Register of Legislation for any uncommenced amendments or modifications that might affect implementation or financing mechanics.

9. Audit and oversight readiness: Because the Act itself contains no reporting clauses, ensure that internal reporting aligns with standard public finance oversight, and prepare materials for the Auditor-General and parliamentary estimates processes as needed.

10. Seek specialist advice where necessary: Given the cross-reference to the 1947 Act and the potential involvement of capital markets and exchange conversion, obtain specialist legal, accounting and market advice before executing payments or issuing securities.

In short, compliance is not satisfied by reading the 1980 Act alone. The statute authorises the consent and points to the 1947 Act for the operational tools. Implementing agencies must therefore integrate the 1980 Act’s approval with the detailed powers, limits and procedures found in the International Monetary Agreements Act 1947 and with current public finance law and market regulation.
