International Labour Organisation (Compliance with Conventions) Act 1992

The International Labour Organisation (Compliance with Conventions) Act 1992 is a short, enabling statute. Its operative components are: a short title (s 1), a commencement provision that brings the Act into force on the day it received Royal Assent (s 2), and a single substantive power granting the Governor‑General authority to make regulations prescribing procedures to be observed for the purposes of the Tripartite Consultation (International Labour Standards) Convention, 1976 (s 3). Section 3 names the Convention and records its adoption date by the ILO General Conference as 21 June 1976.

The Act’s long title records a broader legislative purpose: to make provision for giving effect to an international convention and to amend the Migration Act 1958 and the Navigation Act 1912 so as to enable Australia to ratify certain international conventions. The compiled text before you, however, contains only Parts 1 and 2 and s 3 as operative provisions. The compilation includes endnotes that record later statute law revision activity; in particular, several parts and sections that formerly appeared in the Act were repealed by the Statute Law Revision (Spring 2016) Act 2016 (see Endnote 4).

Mechanically, therefore, the Act does the following now: it provides a delegated‑law power to the Governor‑General to make regulations that prescribe procedures "to be observed" for purposes of the specified ILO Convention. There are no further substantive prescriptions, definitions, duties, penalties, or enforcement measures in the text of the compiled Act itself. The timing of its operation is immediate from Royal Assent (s 2), and the legislative history shows the Act first assented to on 24 December 1992 (Endnote 3). The compilation is current to amendments up to Act No. 67, 2016 (compilation date 17 November 2016), and notes the repeal of Parts 3 and 4 and sections 4 to 11 by that 2016 Act (Endnote 4).

In short, the present statutory effect is to enable an executive regulation‑making power tied to implementation of the Tripartite Consultation Convention; the Act does not itself set out what procedures must or must not be observed.

The Act contains a very small set of legal concepts, each expressed tersely in the three operative provisions and the long title.

• Enabling power for regulations (s 3). The central legal concept is delegation: the Governor‑General "may make regulations prescribing procedures to be observed" for the purposes of the Tripartite Consultation (International Labour Standards) Convention, 1976. The phrase "prescribing procedures to be observed" is broad and procedural in its language; the Act does not define "procedures", "to be observed", or the scope of "for the purposes of" the Convention.

• Tripartite Consultation (International Labour Standards) Convention, 1976. The Act explicitly links the regulation‑making power to a named international instrument, adopting the Convention's full title and the adoption date of 21 June 1976. The Act thus operates as domestic enabling legislation tied to an international commitment, rather than by directly reproducing the Convention’s text.

• Delegation and executive rulemaking. By vesting power in the Governor‑General to make regulations, the Act locates decisionmaking in the executive arm through subordinate legislation. The Act does not itself contain procedural constraints, parliamentary savings clauses, transitional rules, or thresholds for the exercise of that delegated power.

• Commencement mechanics (s 2). The Act’s commencement is immediate on Royal Assent. The compilation records the assent date (24 December 1992) in Endnote 3 and the compilation’s amendment status up to 17 November 2016.

• Historical amendments and repeals (Endnote 4). The endnotes show that various parts and sections that once formed part of this Act were repealed by the Statute Law Revision (Spring 2016) Act 2016. That history shapes the Act’s present‑day scope and explains why the statute is now reduced to an enabling regulation‑making provision.

Because the Act contains no substantive definitions, rights or duties, the meanings of any terms used in regulations under s 3 will be anchored in the regulations themselves, any incorporated instruments, and the Tripartite Consultation Convention. The Act therefore functions as a narrow statutory bridge: it ties domestic regulatory capacity to the international instrument named, rather than embedding the instrument’s content in primary legislation.

The immediate legal actors identified in the Act are the Governor‑General (as the regulation‑maker) and, indirectly, anyone who will be subject to regulations made under s 3. The Act does not enumerate particular classes of persons, occupations, or organisations; it ties potential obligations to later regulations and to the Tripartite Consultation Convention.

• Executive decisionmakers. The Governor‑General is expressly empowered to make regulations (s 3). In practice, and by constitutional convention, that power will be exercised on advice of ministers and implemented by the relevant Commonwealth agencies. The Act therefore vests primary responsibility for specifying procedures in the executive branch.

• Workers, employers, unions and government agencies (potentially). The Convention referenced is a tripartite instrument by its nature, addressing relations among governments, employers and workers. The Act’s long title signals an intent to give effect to an international convention and to enable ratification steps in other federal statutes. While the Act itself does not name affected classes, the conceptual scope of the Tripartite Consultation Convention implies that future regulations could impose procedures that bind or affect representative bodies, employers, employees, unions, and relevant administrative decisionmakers.

• Legal advisers and compliance professionals. Because the Act does not create immediate substantive obligations, compliance professionals will be affected insofar as future delegated instruments are made. The Act makes it necessary for advisers to monitor the Federal Register and the relevant agency outputs for regulations issued under s 3.

• Those affected by repeals. Endnote 4 records that several parts and sections were repealed by the Statute Law Revision (Spring 2016) Act 2016. Where the repealed provisions formerly amended other statutes (for example, references in the long title to the Migration Act 1958 and the Navigation Act 1912), affected parties , such as those operating in migration or navigation contexts , should treat any operational changes as deriving from separate amending legislation or from regulations that remain in force elsewhere. The compiled Act as it stands does not itself impose or maintain those amendments.

Who pays and who bears compliance costs will therefore depend on the content of any regulations made under s 3. The Act itself imposes no explicit fees, sanctions, or administrative levies, and does not identify budgets, agencies, or personnel to implement new procedures. The point of legal effect is the future regulation; until such regulations are made the set of directly affected private actors is undefined in the primary text.

The Act, in its compiled form, imposes no immediate, substantive duties or confers rights on private persons. Its legal effect is to authorise future subordinate legislation that may prescribe procedures. The following statements are grounded in the Act’s text and endnotes.

• No direct duties in primary legislation. There are no operative clauses that set out obligations, compliance requirements, or prohibited conduct for employers, employees, migrants, seafarers or other private parties. The only operative substantive provision (s 3) is a power to make regulations prescribing procedures.

• Delegated legislative duties will be regulation‑based. Any duties, procedural obligations, or rights that arise in practice will be created by regulations made under s 3. The Act makes clear that the Governor‑General may "make regulations prescribing procedures to be observed for the purposes of" the named ILO Convention. Therefore, the locus of future duties is delegated legislation, not the Act itself.

• Rights of review or remedies are not specified. The Act does not include clauses about judicial review, appeal rights, compensatory schemes, or administrative review mechanisms. If those rights are to exist, they must be provided elsewhere: either within regulations made under s 3, within the Tripartite Consultation Convention as applied domestically, or in other Commonwealth statutes.

• Parliamentary role not spelled out. The Act does not include express parliamentary oversight measures specific to the exercise of s 3. Regulations made under Commonwealth Acts are subject to the normal parliamentary disallowance and tabling procedures available under the Legislation Act 2003 and the Legislative Instruments Act 2003 frameworks, but those frameworks are not enacted within this Act. The primary text is silent on any bespoke parliamentary check.

• Commencement and retrospective effect. The Act commences on the day of Royal Assent (s 2). It contains no provision for retrospective effect or for saving prior acts. Rights or duties, therefore, flow only from regulations made after the power to make them exists, unless the regulations themselves include temporal provisions, which the Act does not preclude or require.

• Repealed material. Historically, the Act contained further provisions (Parts 3 and 4, and sections 4 to 11) that were repealed by the Statute Law Revision (Spring 2016) Act 2016 (Endnote 4). Any duties or rights that those repealed provisions previously created are no longer part of this compiled Act. Users should consult the amendment history recorded in the endnotes to trace what was removed and when.

The Act contains no penalties, enforcement powers, or offence provisions. Its text does not create criminal or civil sanctions, nor does it confer specific investigative or enforcement authorities on officers or departments. The statutory landscape as contained in this compilation therefore has the following enforcement characteristics.

• Absence of sanctions in primary Act. There are no sections that impose fines, imprisonment, administrative penalties, or civil liability. The Act’s substantive provision is an enabling regulation‑making power (s 3) and does not itself impose punishments.

• Enforcement contingent on subordinate instruments. Any enforcement regime relevant to compliance with procedures "prescribed" under s 3 would be established, if at all, within the regulations made under that section or within other primary legislation. Because the Act delegates procedural specification rather than specifying enforcement, the nature and scale of enforcement will be contingent on the content of future regulations or on other statutes that implement or interact with the Convention.

• No specified enforcement agency or oversight body. The Act does not appoint or name a Commonwealth agency, inspectorate, tribunal, or officer charged with enforcing procedures prescribed under s 3. Responsibility for administering and enforcing any future regulations is therefore a matter for the executive via the enabling instruments, ministerial direction, or the administrative arrangements applied at the time regulations are made.

• Repealed enforcement provisions. The endnotes indicate that Parts 3 and 4 and sections 4 to 11 were repealed in 2016 (Endnote 4). Those repealed provisions likely contained additional material relevant to enforcement or interaction with other statutes, but that material is not in the compiled Act. To determine whether enforcement features ever existed in the original Act, or whether they were replicated elsewhere, consult the amendment and legislation history in the endnotes.

• Interaction with criminal or civil law frameworks not specified. The Act does not state whether contraventions of regulations will be criminal, civil or administrative in nature. The Act leaves potential categorisation, penalty quantum, and enforcement mechanism to subordinate legislation or to other legislative instruments.

Practically, this means that at present there is no penalty exposure under this Act alone. Stakeholders should assess enforcement risk only after examining any regulations made under s 3 and any other statutes that may have been amended or enacted in consequence of ratifying the Convention.

The Act’s text and endnotes indicate limited but important interaction points with other Commonwealth statutes and with international obligations.

• Long title linkage to other statutes. The long title states that the Act amends the Migration Act 1958 and the Navigation Act 1912 "so as to enable Australia to ratify certain international conventions." While the operative text in this compilation no longer contains those amendments, the long title documents an original parliamentary objective linking this Act to those broader statutory frameworks. To the extent amendments to those Acts were made originally, the endnotes record material later repealed (Endnote 4). Therefore, potential or prior interconnections with migration and navigation law are part of the Act’s legislative history.

• Delegated instruments and the general statute book. Regulations made under s 3 will be subordinate legislation. As a matter of general legal operation, subordinate legislation interacts with primary Acts: regulations can prescribe procedures within the scope of the enabling Act and can create obligations enforceable under the limits of the enabling power. This compiled Act establishes the head of power for procedural regulations connected to the Tripartite Consultation Convention; the content and interoperation with other statutes will depend on the regulations’ drafting and any consequential amendments made to other laws.

• Interaction via ratification of international conventions. The Act’s purpose is domestic facilitation of an international convention. If regulations are used to implement procedural aspects of the Tripartite Consultation Convention domestically, they would function as part of Australia’s internal legal architecture for discharging obligations under the ILO instrument. The Act itself does not purport to make the Convention directly enforceable in domestic law; instead, it authorises procedures to be prescribed that are "for the purposes of" the Convention.

• Repealed parts and consequential legal effects. The endnotes show that Parts 3 and 4 and sections 4 to 11 were repealed in 2016 (Endnote 4). Those repeals alter the Act’s interaction profile. Any rights, duties, or cross‑references that formerly affected the Migration Act 1958, Navigation Act 1912, or other statutes may have been removed by the Statute Law Revision Act. Practitioners should consult the amendment history in Endnote 4 and the relevant amending Acts to determine the current state of interaction with those other laws.

The compilation records both the original enactment details and subsequent formal revision activity. Use these endnotes to track what changed and when.

• Original enactment. The Act is recorded as No. 220 of 1992, with Royal Assent dated 24 December 1992 and commencement on that same date (s 2). This information is recorded in Endnote 3.

• Compilation and amendments up to 17 November 2016. The compilation is current to amendments up to Act No. 67, 2016, with compilation registration date 17 November 2016. The cover material of the compilation notes that amendments made up to that date are included in the compiled text where relevant.

• Statute Law Revision (Spring 2016) Act 2016 (No. 67, 2016). Endnote 3 records the Statute Law Revision Act and its commencement for specified items on 17 November 2016. Endnote 4 sets out specific deletions: it records that Part 3, Part 4 and sections 4 through 11 were repealed by No. 67, 2016. The amendment history table lists "Part 3................... rep No 67, 2016" and similar entries for s 4 to s 11 and Part 4.

• Effect of repeals on the current compilation. Those repeals reduced the Act to Parts 1 and 2 and left only s 3 as the substantive provision. The compilation’s endnotes advise that the effect of uncommenced amendments is not shown and that the Legislation Register records any uncommenced amendments. The endnotes also state that modifications by other laws may alter the operation of the Act even if the compiled text is not textually amended.

• Editorial changes and misdescribed amendments. The compilation includes standard Legislation Act 2003 caveats about editorial changes made by First Parliamentary Counsel in preparing the registered compilation. The endnotes explain the abbreviation keys and how misdescribed amendments would be annotated.

• No further amendments recorded in the compiled text. Beyond the Statute Law Revision 2016 changes noted, the compilation includes no subsequent substantive amendments affecting the operative sections in the text of the Act as compiled to 17 November 2016.

Practitioners should consult the full amendment history set out in Endnote 4 and the series page on the Federal legislation register for any later changes after the compilation date. The endnotes provide the statutory pointers needed to reconstruct the Act’s historical breadth and the scope of the 2016 repeal activity.

The compiled text does not include, refer to, or summarise any litigation arising under this Act. The endnotes do not record judicial decisions, references to case law, or statutory interpretation disputes. The legislation history and amendment history focus on parliamentary enactment, assent and revision events, not on judicial outcomes.

Given the Act’s limited present content , a regulation‑making power in s 3 and minimal preliminary provisions , the Act itself is a slender vehicle for litigation unless regulations made under s 3, or other instruments prompted by it, give rise to disputes. If litigation were to occur, it would most likely concern:

• Validity of regulations made under s 3 in exercising delegated power, including questions of whether particular measures fall within "procedures to be observed for the purposes of" the named ILO Convention.

• Administrative law challenges to the content or application of those regulations, including review grounds such as jurisdictional error, unreasonableness, or procedural fairness, to the extent those doctrines apply to instruments made under the Act.

However, the compiled Act contains no reported decisions, and the endnotes do not point to cases. Readers seeking litigation history should therefore:

• Search case law databases for decisions referencing the International Labour Organisation (Compliance with Conventions) Act 1992 by citation.

• Check whether any regulations enacted under s 3 have been the subject of judicial review applications or other litigation.

• Review whether the original provisions that were repealed by the Statute Law Revision Act 2016 were ever the subject of litigation while they were in force. The endnotes identify the repeals, which provides a path to historical litigation research.

In short, the compilation contains no litigation material. Any judicial history will arise from instruments made under the Act or from the repealed provisions as they existed prior to 2016.

Several practical and legal "watchouts" follow directly from the Act’s form and the endnotes. These are not normative judgements; they are concrete risks, uncertainties, and implementation issues that flow from the text and the recorded legislative history.

• The Act is enabling not prescriptive. Section 3 authorises regulations but does not prescribe the content, scope, or limits of those regulations. That means the substantive legal obligations and consequential burdens will be located in regulations yet to be (or previously) made. Relying on the Act alone for compliance advice will be insufficient.

• Broad delegation language. The power in s 3 uses broad terms: "may make regulations prescribing procedures to be observed for the purposes of" the Convention. Without statutory limits, the executive has latitude to frame procedures. The Act does not include express statutory constraints, objectives, or safeguards in the text. This creates an implementation risk for regulated entities who might face significant procedural obligations once regulations are issued.

• No penalties or enforcement regimes in the Act. Because the Act does not itself establish penalties or enforcement machinery, one must check whether any regulations made under s 3 (or other legislation) create criminal, civil or administrative penalties. Assuming the presence or absence of sanctions from the primary Act would be mistaken.

• Historical repeal may obscure original effects. Endnote 4 records the repeal of several parts and sections by the 2016 Statute Law Revision Act. If a practitioner is relying on secondary sources or older materials, they may encounter references to provisions that no longer exist. Always consult the endnotes and the consolidated text to confirm what remains in force.

• Parliamentary oversight and contestability. The Act does not specify parliamentary controls or preconditions for the exercise of s 3. While regulation‑making in Australia is subject to established parliamentary processes, this Act does not add any bespoke parliamentary hooks. The absence of limiting language in primary legislation means that scrutiny will primarily occur through the standard disallowance and tabling regimes applicable to delegated instruments.

• Uncertain interaction with Migration Act and Navigation Act. The long title refers to amendments to the Migration Act 1958 and the Navigation Act 1912 to enable ratification of conventions. The compiled Act does not show those amendments as operative provisions; some material appears to have been repealed. Practitioners dealing with migration or maritime matters should check the current versions of those statutes and any amending instruments, rather than relying on the long title alone.

Compliance in respect of this Act is essentially forward‑looking and monitoring‑centred, because the published text contains no immediate substantive obligations. The following checklist is grounded in the Act and its endnotes, and sets out concrete steps practitioners and affected entities should take.

• Confirm the current statutory text. The compiled Act as presented contains ss 1 to 3 and the endnotes. Confirm that there have been no further amendments since the compilation date (17 November 2016) by checking the Federal legislation register (the compilation itself refers readers to the Legislation Register for uncommenced amendments). This confirms whether any new substantive provisions exist.

• Monitor for regulations made under s 3. The Act’s operative instrument is a regulation‑making power conferred on the Governor‑General. To comply, you must identify whether regulations prescribing procedures under s 3 have been made. Check the Federal Register of Legislation and the Gazette for instruments made under the International Labour Organisation (Compliance with Conventions) Act 1992.

• Review the text and scope of any regulations. If regulations exist, review them for:

  • Who they apply to and whether your clients or organisation fall within those classes.
  • Specific procedural requirements and timelines.
  • Any penalties, enforcement provisions, or reporting obligations.
  • Transitional provisions, savings clauses and commencement dates.

• Assess interaction with other statutes. Where the regulations make procedural changes that affect migration or maritime matters, cross‑check the current versions of the Migration Act 1958 and the Navigation Act 1912, and any consequential amending instruments. The long title and the Act’s legislative history suggest those areas were relevant historically; the current state must be confirmed from primary sources.

• Prepare administrative capacity. Because the Act delegates procedure design to the executive, compliance obligations, if introduced, may create administrative burdens. If your client is likely to be captured by future regulations, begin scoping the recordkeeping, reporting and governance processes that would be required to observe procedural requirements.

• Build a monitoring and notification workflow. Ensure your compliance program has an alert mechanism to pick up:
