Each of the following is a ground for directing the termination of an agency agreement— the agent is not, or is no longer, a suitable person to be an agent; a business or executive associate of the agent is not, or is no longer, a suitable person to be associated with an agent’s operations; the agent has been convicted of an offence against this Act, a gaming Act or a corresponding law; the agent has been convicted of an indictable offence; the agent has contravened a provision of this Act or a corresponding law (being a provision a contravention of which does not constitute an offence). For forming a belief that the ground mentioned in subsection (1) (a) exists, the chief executive may have regard to the following issues— the agent’s character or business reputation; the agent’s current financial position and financial background; the agent’s general suitability to act as an agent for a licensed provider. For forming a belief that the ground mentioned in subsection (1) (b) exists, the chief executive may have regard to the business or executive associate’s character or business reputation, and current financial position and financial background.
