93 Immunity

S. 93(1) amended by No. 31/2024 s. 113(Sch. 1 item 1.153

(1) Integrity Oversight Victoria or an Integrity Oversight Victoria Officer is not personally liable for anything necessarily or reasonably done or omitted to be done in good faith—

(a) in the performance of a function or the exercise of a power under this Act; or

(b) in the reasonable belief that the act or omission was in the course of the performance of a function or the exercise of a power under this Act.

(2) Any liability resulting from an act or omission that, but for subsection (1), would attach to Integrity Oversight Victoria or an Integrity Oversight Victoria Officer attaches instead to the State.
