83A Recommendation to Parliamentary Workplace Standards and Integrity Commission

S. 83A(1) amended by No. 27/2024 s. 188(Sch. 3 item 1.4).

(1) Integrity Oversight Victoria may at any time make recommendations to the Parliamentary Workplace Standards and Integrity Commission in relation to any action that Integrity Oversight Victoria considers should be taken.

(b) to remedy any harm or loss arising from the conduct of any Parliamentary Workplace Standards and Integrity Commission officer.

(3) A recommendation to the Parliamentary Workplace Standards and Integrity Commission which is not contained in a report must be made in private.

(4) Subsection (3) does not limit the power of Integrity Oversight Victoria to make a public recommendation if Integrity Oversight Victoria considers that the Parliamentary Workplace Standards and Integrity Commission has failed to take appropriate action in relation to the recommendation.

(5) Integrity Oversight Victoria may require the Parliamentary Workplace Standards and Integrity Commission to give a report to Integrity Oversight Victoria, within a reasonable specified time, stating—

(a) whether or not the Parliamentary Workplace Standards and Integrity Commission has taken, or intends to take, action recommended by Integrity Oversight Victoria; and

(b) if the Parliamentary Workplace Standards and Integrity Commission has not taken the recommended action, or does not intend to take the recommended action, the reason for not taking or intending to take the action.

(6) The Parliamentary Workplace Standards and Integrity Commission must comply with a requirement of Integrity Oversight Victoria under subsection (5).
