290 Loss of protection (1) This section applies if a person makes a complaint and a court is satisfied that— (a) the complainant has given information to a person investigating the complaint that the complainant knows is false or misleading; or (b) the complaint is vexatious. (2) The complainant forfeits the protections under this Act in relation to the complaint. (3) However, a court may make an order that subsection (2) does not apply if the court considers that the complainant’s conduct mentioned in subsection (1) (a)— (a) has not materially prejudiced the investigation of the complaint; and (b) is of a minor nature.
