### 75 Application for use of surveillance device
> > (1) In the case of a complaint of serious misconduct, an inquiry officer, with the approval of the Chief Commissioner or other person nominated under [section 62(3)](#GS62@Gs3@EN) , may apply for a warrant under [Part 2 of the](/view/html/inforce/2026-04-12/act-2006-022#HP2@EN) [Police Powers (Surveillance Devices) Act 2006](/view/html/inforce/2026-04-12/act-2006-022) as if the inquiry officer were a law enforcement officer within the meaning of that Act and a reference in that Part to a relevant offence were read as a reference to misconduct.
