42 Pause of statutory timeframe – Information Act 2002 (1) If section 40 prevents the Commissioner from exercising a power or performing a function under the Information Act 2002, any timeframe specified within which the Commissioner must act under that Act is paused until the later of the following: (a) the Inspector determines that the Commissioner may resume exercising the power or performing the function; (b) a person recommended for appointment under section 40 assumes responsibility for the matter. (2) To avoid doubt, a timeframe that resumes in accordance with subsection (1) resumes from the point it was paused.
