#### 103H Ascertaining the fair value of other capital instruments (1) APRA must comply with this section before giving a recapitalisation direction that directs a general insurer to issue capital instruments other than shares, or rights to acquire shares, in the insurer. (2) APRA must comply with any requirements of the regulations relating to ascertaining the fair value of the capital instruments. (3) Regulations made for the purposes of this section may specify different requirements in relation to different kinds of capital instruments.
