What it does
This Act establishes an independent Inspector of Custodial Services with a statutory mandate to inspect, monitor and report on custodial centres and custodial services in New South Wales, and it creates an Official Visitor program to handle complaints and inquiries from persons in custody. The objects explicitly state the policy goals: improving prospects for rehabilitation by improving standards and provision of custodial services, and promoting improved treatment and outcomes for persons on remand (s 2A(1)-(2)). The Act sets out appointment, eligibility and term rules for the Inspector (s 4; Schedule 1), prescribes the principal functions and a set of statutory powers for the Inspector (s 6-8, 7), and requires annual reporting and reporting on inspections, reviews and particular issues to Parliament (s 6(1)(d)-(f); s 12).
Mechanically, the Act requires periodic inspections with defined minimum frequencies: adult custodial centres at least once every five years and juvenile justice centres and juvenile correctional centres at least once every three years (s 6(1)(a)-(b)). The Inspector has statutory powers of access to records (including health records), to visit and examine custodial centres at any time, to require staff to produce documents and to attend to answer questions, to remove and retain copies or extracts of records, and to communicate with persons in custody (s 7(1)(a)-(f)). The Inspector must have regard to the legislation regulating custodial centres and services when exercising functions (s 7(2)).
The Act creates an Official Visitor regime (pt 2, div 2A; ss 8B-8K; sch 3) separated into Official Visitor (Adults) and Official Visitor (Children). Official Visitors are appointed by the Minister or the CDC Minister for children (s 8B-8C), must be assigned to centres (s 8F), must visit their assigned centre at least once a month (s 8G(1)), and their principal function is to deal with complaints and inquiries from persons in custody (s 8H(1)). Official Visitors may carry out private interviews with consent and must record and report complaints in a form and at times determined by the Inspector (s 8G(5); s 8H(4), (6)-(7)).
