82 Costs of attending Board of Inquiry (1) This section applies to a person who attends a Board of Inquiry— (a) in accordance with a notice to attend; or (b) at the request of the Board of Inquiry. (2) Subject to subsection (3), the person is entitled to be paid expenses and allowances in accordance with the prescribed scale. (3) Subsection (2) does not apply— (a) in an inquiry that is being conducted concurrently under this Act and under the law of the Commonwealth, another State or a Territory, unless the establishing Order for the Board of Inquiry provides otherwise; or (b) if the establishing Order does not authorise the Board of Inquiry to incur expenses or financial obligations to be met from the Consolidated Fund.
