42 Costs of attending Royal Commission (1) This section applies to a person who attends a Royal Commission— (a) in accordance with a notice to attend; or (b) at the request of the Royal Commission. (2) Subject to subsection (3), the person is entitled to be paid expenses and allowances in accordance with the prescribed scale. (3) Subsection (2) does not apply— (a) in an inquiry that is being conducted concurrently under this Act and under the law of the Commonwealth, another State or a Territory, unless the letters patent establishing the Royal Commission provide otherwise; or (b) if the letters patent establishing the Royal Commission do not authorise the Royal Commission to incur expenses or financial obligations to be met from the Consolidated Fund.
