17 Power to compel production of documents and other things or attendance of witness (1) For the purposes of its inquiry, a Royal Commission may serve written notice on a person requiring the person to— (a) produce a specified document or other thing to the Royal Commission or a Royal Commission officer before a specified time and in the specified manner; or (b) attend the Royal Commission at a specified time and place to produce a specified document or other thing; or (c) attend the Royal Commission at a specified time and place, and from then on from day to day until excused, to give evidence; or (d) attend the Royal Commission at a specified time and place, and from then on from day to day until excused, to give evidence and to produce a specified document or other thing. (2) A notice to produce or notice to attend in relation to a Royal Commission— (a) must be in the prescribed form (if any); and (b) must contain the following information— (i) a statement outlining the provisions of sections 23 and 46; (ii) examples of what may constitute a reasonable excuse for failing to comply with the notice; (iii) how the person may object to the notice; (iv) any other prescribed information; and (c) must be served in accordance with section 19. (3) Subsection (2)(a) does not apply to a notice to produce or notice to attend for the purposes of an inquiry of a Royal Commission that is being conducted concurrently under this Act and under the law of the Commonwealth, another State or a Territory.
