What it does
This Act is a machinery statute that manages the transition from the inland fisheries regulatory framework under the Fisheries Act 1959 (the former Act) and the Inland Fisheries Regulations 1973 (the former regulations) to the Inland Fisheries Act 1995 (the new Act). It does not create new substantive rights or obligations. Instead it provides for the automatic conversion, continuation, or extinction of existing authorisations, appointments, records, and subordinate legislation when the new Act commences on a day to be proclaimed. The mechanical operation is straightforward. Pending applications for licences that had not been determined before the commencement day lapse entirely under section 4. Existing recreational licences (angling and whitebait) become recreational licences under the new Act, retaining their original conditions, start date, and term, subject to the Commission’s power to revoke or vary conditions (section 5). Exemptions from holding an angling licence continue until the Commission revokes them, on the same conditions (section 6). Four types of commercial eel licences (feeding eel, migrating eel, assistant eel fisherman, juvenile eel) become commercial licences under the new Act, again retaining original conditions, start date, and term, with Commission power to vary conditions (section 7). Fish farm licences under the former Act become fish farm licences under the new Act, but with a fixed two-year sunset from the commencement day unless the Minister sooner cancels them; the Minister may vary requirements but is prohibited from reducing Atlantic salmon production levels below those determined by the Minister for transfer to a marine farm during the 1995-96 season (section 8). Permits issued by the Commission continue for a maximum of 12 months, or until expiry or cancellation (section 9). Wholly private fisheries registered under the former regulations become registered private fisheries under the new Act, with original requirements, restrictions, and term (section 10). Anything seized under the former Act and not yet dealt with may be dealt with under that Act (section 11). Officers and employees under the former Act’s Part III become officers and employees under the new Act, with officers holding for six months (or a shorter period determined by the Secretary) and employees continuing indefinitely (sections 12, 13). The Commissioner and Associate Commissioner continue in office until their original appointment expires or the Governor terminates it (section 14). Registers, returns, and records are carried over (sections 15, 16). The former regulations continue in force for 12 months unless rescinded, but any inconsistent provision in the new Act or instruments made under it prevails (section 17). The Governor may make regulations for savings and transitional matters, which may take effect from the commencement of the Act or a later date, enabling retrospective transitional rules (section 18). Until an order under the Administrative Arrangements Act 1990 assigns administration, the Act is administered by the Minister for Inland Fisheries through the Department of Environment and Land Management (section 19).
