Division 3.3 Other privacy compliance matters Section 23 page 16 Information Privacy Act 2014 Effective: 16/12/25 R13 16/12/25 Authorised by the ACT Parliamentary Counsel—also accessible at www.legislation.act.gov.au 23 Commonwealth APPs apply to certain public sector agencies engaged in commercial activities (1) This section applies to the acts and practices of a public sector agency if— (a) the agency is prescribed by regulation; and (b) the acts and practices relate to the agency’s commercial activities. (2) The Commonwealth APPs apply to the acts and practices of the public sector agency as if the agency were an organisation within the meaning of the Commonwealth Act. Exemptions from application of Act Part 4 Section 24 R13 16/12/25 Information Privacy Act 2014 Effective: 16/12/25 page 17 Authorised by the ACT Parliamentary Counsel—also accessible at www.legislation.act.gov.au Part 4 Exemptions from application of Act 24 Exempt public sector agencies This Act does not apply to the following public sector agencies: (a) a board of inquiry under the Inquiries Act 1991; (b) a judicial commission under the Judicial Commissions Act 1994; (c) the judicial council established under the Judicial Commissions Act 1994, section 5A; (d) a royal commission under the Royal Commissions Act 1991; (e) Icon Water Limited, Icon Distribution Investments Limited or Icon Retail Investments Limited; (f) an agency prescribed by regulation.
