What it does
This legislative instrument prescribes a single program under the Industry Research and Development Act 1986 (the Act), names its purpose, identifies the Commonwealth’s intended role in the program, and specifies the constitutional legislative power relied on for that prescription. The instrument is the Industry Research and Development (Zero Net Emissions from Agriculture Cooperative Research Centre Partnership Program) Instrument 2024 (s 1). It is made under section 33 of the Act (s 3). The operative prescription is that the Zero Net Emissions from Agriculture Cooperative Research Centre Partnership Program (the program) is a prescribed program for the purposes of subsection 33(1) of the Act (s 5(1)). The instrument makes three principal, concrete legal moves.
First, it prescribes the program so that the Commonwealth may participate as a partner in the Zero Net Emissions from Agriculture Cooperative Research Centre (the CRC), including by paying partnership fees (s 5(2)). Second, it states the purpose of the program: to influence and shape the CRC’s activities relating to mitigation of greenhouse gas emissions in the agricultural sector so as to help align those activities with the Commonwealth’s emissions mitigation objectives across the economy, and to contribute to meeting Australia’s obligations under specified international treaty articles (s 5(3)). Third, for the purposes of subsection 33(3) of the Act, the instrument specifies the Parliament’s external affairs legislative power as it relates to the UN Framework Convention on Climate Change, the Kyoto Protocol and the Paris Agreement, identifying particular articles in those instruments (s 6).
Commencement mechanics are explicit. The whole instrument commences, or is taken to have commenced, on the day after the instrument is registered (s 2 table). The instrument also contains definitions of key terms used within it, including Act, the relevant international agreements as they are “in force for Australia from time to time”, program (see s 5(1)) and CRC (s 4). The instrument does not set funding amounts, make detailed governance rules for the CRC, create new offences, or set reporting obligations; its legal effect is to enable the program to be treated as a prescribed program under the Act and to declare the Commonwealth’s permissible role in participating and paying partnership fees (s 5(1)-(2)).
