Industry Research and Development (Support Plantation Establishment Program) Instrument 2023

The instrument relies on a short number of definitional and structural concepts. First, it uses the statutory mechanism of s 33 of the Industry Research and Development Act 1986, which is the authority under which the instrument is made (s 3). The instrument itself prescribes a program, which is defined in s 5(1) as "the Support Plantation Establishment Program". The program is described functionally in s 5(2) as providing funding to specified recipient classes.

The instrument defines or cross‑references key terms in s 4. "Australian business" is a two‑part test: the entity must conduct a business in an Australian State or Territory and must have an Australian Business Number for that business under the A New Tax System (Australian Business Number) Act 1999. The instrument notes that "entity" is defined in the principal Act. "Long‑rotation plantation" is defined materially: it must be managed to predominantly produce logs for processing into timber for construction and manufacturing, and the optimum length of time for maturity is expected to be between 25 and 40 years. The term "plantation" is adopted from the Regional Forest Agreements Act 2002. State and Territory forestry bodies are defined functionally as entities established by or under State or Territory law, or parts of State or Territory governments, that manage plantations or engage in forestry‑related activities.

The instrument is explicit that the program’s purposes include both environmental and supply objectives (s 5(3)(b) and (c)), linking carbon sequestration as indicated to the establishment of new long‑rotation plantations (s 5(3)(b)), and increasing domestic timber supply (s 5(3)(c)). It therefore ties land‑use investment subsidies to an articulated climate‑related benefit and an industrial supply objective.

The instrument also specifies, for the purposes of s 33(3) of the Act, the constitutional heads of power that may be engaged in relation to the program (s 6). Those include the corporations power (paragraph 51(xx) of the Constitution) (s 6(a)), the external affairs power as it relates to implementing Australia’s obligations under the Kyoto Protocol and the UNFCCC (s 6(b)), the power under paragraph 51(xxxvi) together with s 96 financial assistance to States (s 6(c)), and the government of a Territory under s 122 (s 6(d)). Subparagraphs s 6(b)(i) and (ii) refer specifically to Articles 2 and 10 of the Kyoto Protocol and Article 4 of the UNFCCC respectively. The instrument therefore links the program to international obligations and to mechanisms for Commonwealth assistance to States and Territories.

In structural terms, the instrument is short and declaratory. It prescribes a program and names its beneficiaries and purposes but does not itself provide operational instruments, grant criteria, or administrative rules. The instrument also contains commencement and minor drafting notes about the commencement table (s 2), including that information in column 3 is not part of the instrument and that the table relates only to the instrument as originally made.

The instrument identifies three direct recipient classes: Australian businesses, State forestry bodies and Territory forestry bodies (s 5(2)). An "Australian business" is an entity that conducts a business in an Australian State or Territory and has an Australian Business Number for the business under the A New Tax System (Australian Business Number) Act 1999 (s 4). Therefore potential private recipients are limited to businesses meeting both elements of that definition. The instrument also explicitly contemplates State and Territory public sector forestry actors, defined as entities established under State or Territory law or parts of State or Territory governments that manage plantations or engage in forestry‑related activities (s 4).

The program’s purposes in s 5(3) make plain who will be targeted by funding: entities or bodies intending to establish new long‑rotation plantations. The statutory definition of long‑rotation plantation is consequential for eligibility in practice: the plantation must be grown and managed to predominantly produce logs for processing into timber used for construction and manufacturing, and the optimum maturity is expected to be between 25 and 40 years (s 4). That definition will filter out short‑rotation woodlots, plantations intended principally for bioenergy or pulp where rotation lengths are shorter, and other afforestation efforts that do not aim predominantly at logs for construction/manufacturing or that have markedly shorter rotation horizons.

Indirectly affected parties include landowners (private and public) who control areas proposed for plantation establishment, downstream processors who might benefit from increased domestic timber supply, and the broader public because the instrument contemplates carbon sequestration as an environmental outcome (s 5(3)(b)). The instrument does not itself impose obligations on landowners who are not applicants or recipients, nor does it create property rights or carbon credits in the text. It also does not set rules for how funding is to be disbursed or which contractual conditions will be attached to funding; those procedural details will be material to prospective applicants and their commercial partners but are not specified here.

Bodies administering the program will be affected though unnamed in the instrument. The instrument is made under s 33 of the Industry Research and Development Act 1986 (s 3) and was made by Murray Watt as delegate of the Minister for Industry and Science, which signals ministerial or departmental administrative responsibility. The instrument’s specification of constitutional powers (s 6), in particular s 96 financial assistance to States and the Territories power, indicates the program may be implemented through agreements or funding arrangements with State or Territory governments, and thus State and Territory budgetary and forestry departments are affected prospectively.

Finally, the instrument’s cross‑references to other statutes (Regional Forest Agreements Act 2002 for "plantation", and the ANTS (ABN) Act 1999 for ABN requirements) mean that administrators and applicants will need to consult those statutes to determine whether an entity or plantation meets the definitions adopted in this instrument.

The instrument does not itself impose duties or confer rights in the form of detailed operational obligations, statutory entitlements to funding, or administrative process rights. Its primary legal effect is to prescribe the program under s 33 of the Industry Research and Development Act 1986 and to define who may be eligible to receive funding and for what purpose (s 5(1)-(3)). Consequently the "duties and rights" that matter in practice will arise from subsequent grant agreements, program guidelines, funding determinations or administrative instruments made in implementation of the program. The instrument provides the legal basis for those downstream instruments by naming the program and specifying its recipients and purposes.

From the instrument itself the following practical duties and rights can be inferred and must be checked against subsequent program documentation. Rights: an entity that satisfies the "Australian business" definition or a State/Territory forestry body stands within a class of prospective recipients eligible to receive funding from the prescribed program (s 5(2)). That creates a prima facie entitlement to participate in whatever application and awarding processes are established, but it does not create a legal right to receive funds independent of the administrative decisions to be made later. The instrument does not create an automatic statutory entitlement to funding.

Duties: recipients of funding, once selected under the program’s operational rules, are likely to be subject to obligations customary in funding agreements, such as milestones for plantation establishment, reporting on carbon sequestration or timber production, and compliance with environmental and land tenure laws. The instrument does not spell out these duties. The legal duty to comply with any specific conditions attached to funding will arise from the funding agreements or program rules, not from this instrument itself.

Statutory duties implicit in the definitions include the requirement for private applicants to have an Australian Business Number for the business and conduct a business in a State or Territory (s 4). That is a precondition for being within the class of entities to which funding may be provided. For State and Territory forestry bodies, the definition requires being established by or under State or Territory law or being part of the government and managing plantations or engaging in forestry‑related activities (s 4). These definitional gates will be used administratively to accept or reject applicants.

The instrument also establishes the program’s stated objectives as legal facts to be taken into account (s 5(3)). Administrators will therefore be able to link contractual terms and selection criteria to the three purposes in s 5(3): establishment of new long‑rotation plantations, carbon sequestration through tree growth in those plantations, and increasing domestic timber supply. The instrument effectively authorises administrators to prioritise those outcomes when framing duties in grant agreements, though it does not prescribe exactly how.

Finally, the instrument’s s 6 identification of constitutional powers constrains the legal bases upon which administrators and Parliament may enact further measures related to the program. That list is relevant to the legal rights and obligations that might flow from Commonwealth funding agreements with States, corporations or Territories because it identifies the constitutional heads the instrument is premised upon.

The instrument as provided contains no penalty provisions and no enforcement regimes. It does not create criminal offences, civil penalties, administrative sanctions or statutory enforcement powers in the text. Its effect is declaratory and enabling: it prescribes the Support Plantation Establishment Program under the Industry Research and Development Act 1986 and identifies recipients and purposes (s 5). Any penalties, sanctions or enforcement mechanisms that will apply to program participants must therefore be created in subsequent instruments, funding agreements, grant conditions, or other legislative or regulatory instruments not contained within this instrument.

Because the instrument does not specify monitoring, reporting or auditing arrangements, it leaves open the administrative design question of how compliance and enforcement will be handled. The absence of enforcement detail carries specific practical consequences. Administrators will need to decide whether to impose contractual remedies such as clawback provisions, repayment obligations, withholding of payments, performance milestones, or termination rights in funding agreements. Those contractual designs will determine how failure by recipients to deliver plantations, meet rotation‑length criteria, or achieve sequestration outcomes will be remedied.

The instrument’s identification of potential constitutional bases (s 6) has indirect enforcement significance where funding is provided to States or Territories. Financial assistance under s 96 of the Constitution, identified in s 6(c), is conventionally tied to conditions that the Commonwealth can impose on recipients receiving grants. The instrument’s reference to s 96 does not itself create conditionality, but it signals that the Commonwealth may intend to rely on financial assistance mechanisms that historically permit conditions. Whether and how conditions are imposed, and the associated enforcement mechanisms, will be determined in subsequent agreements.

Likewise, where the program funds corporations under the corporations power identified in s 6(a), enforcement of contractual obligations may occur through ordinary civil remedies for breach of contract. The instrument does not set out whether recipients will be bound by specific statutory compliance regimes or administrative sanctions.

In short, the instrument creates no penalties or statutory enforcement machinery on its face. Parties should expect that any enforcement regime will be set out in the operational grant instruments that follow, and those instruments will determine the practical legal risks for recipients.

The instrument interacts with a narrow set of other laws by explicit cross‑reference and by invoking constitutional heads of power. These interactions are signalled in the text rather than detailed.

Industry Research and Development Act 1986: The instrument is made under s 33 of that Act (s 3) and prescribes a program for the purposes of s 33(1) (s 5(1)). Practitioners must therefore consult the principal Act to understand the legal effects and administrative framework that s 33 provides, including any procedural, delegation and consultation requirements contained in the Act. The instrument itself notes that several expressions used in the instrument are defined in the Act, including "entity" (s 4, note).

A New Tax System (Australian Business Number) Act 1999: The definition of "Australian business" in s 4 requires that an entity have an Australian Business Number under that Act for the business. That cross‑reference imports whatever requirements apply under the ANTS (ABN) Act 1999 for obtaining and holding an ABN. In practice, it means that private applicants must be properly registered and must have the ABN relevant to the business for which they seek funding.

Regional Forest Agreements Act 2002: The instrument defines "plantation" as having the same meaning as in the Regional Forest Agreements Act 2002 (s 4). The operation of the program therefore depends on that Act’s definition of plantation. Applicants, administrators and legal advisers must consult that Act to determine whether a proposed planting site or scheme meets the statutory meaning of "plantation" for the instrument’s purposes.

International instruments: The instrument expressly links the program to Australia’s international environmental obligations by specifying external affairs powers in s 6(b). It identifies Articles 2 and 10 of the Kyoto Protocol and Article 4 of the United Nations Framework Convention on Climate Change as particular measures relevant to external affairs (s 6(b)(i)-(ii)). This cross‑reference means that the Commonwealth may treat program measures as an effort to give effect to those international instruments, which could be invoked as part of the legal basis for Commonwealth legislative or executive action supporting the program.

Constitutional provisions and federal fiscal law: Section 6(c) of the instrument invokes paragraph 51(xxxvi) together with section 96 of the Constitution as specified legislative powers. Section 6(d) invokes section 122 concerning government of Territories. These references indicate that the Commonwealth contemplates relying on the corporations power, external affairs power and fiscal assistance power, and possibly the Territories power, to support program measures. Practically, that can affect how funding is structured: funding to States may be framed as financial assistance under s 96, which historically permits conditions; funding to corporations may be framed under the corporations power; funding linked to international obligations may be framed under external affairs. The instrument itself does not set funding mechanisms but makes clear which legal bases the program will be associated with.

Other administrative and regulatory regimes: Because the program targets plantation establishment, its implementation will intersect with land‑use laws, environmental approvals, planning and native title frameworks, and any statutory carbon accounting or emissions regulation that governs whether sequestration achieved in plantations can be recognised in any official carbon accounting system. The instrument does not create or modify those regimes. Applicants and administrators must therefore plan for compliance with those laws in the course of establishing plantations.

In sum, the instrument is short and declaratory but explicitly anchors the program in a small network of existing statutes and constitutional powers. Effective implementation will require administrators and participants to engage with those instruments and with environmental and land use regulatory regimes that the instrument does not itself address.

The instrument contains only the initial commencement table and a drafting note about that table. Section 2 provides the commencement mechanics: the whole instrument commences the day after it is registered. The commencement table carries two notes. First, the table relates only to the provisions of this instrument as originally made and will not be amended to deal with later amendments of the instrument. Second, column 3 of the table is not part of the instrument; information may be inserted or edited in column 3 of any published version without altering the instrument itself (s 2(2)). There are no entries in the instrument indicating subsequent amendments, and the text contains no amendment schedule or retrospective modifications.

Section 3 records the authority under which the instrument is made, but it does not contain any saving or transitional provisions that would apply in the event of later amendment. Section 6 identifies the specified legislative powers "for the purposes of subsection 33(3) of the Act". That reference to s 33(3) suggests a procedural or legal relationship between the prescription of the program and the constitutional bases listed, but the instrument does not include a mechanism for altering those specified powers within the instrument itself.

Because the instrument is declaratory and short, amendments to the program in substance are likely to occur through either replacement or revocation of the instrument, or through separate subordinate instruments, grant determinations and program rules made under the principal Act. The instrument contains no express statutory timetable for review, expiry or sunset. Practically, therefore, programme designers and external stakeholders should expect that changes to eligibility, funding priorities, funding amounts, or administrative procedures will be effected by new instruments or by administrative instruments and not by amendment of the declaration alone.

For legal research purposes, the instrument’s own note not to amend the commencement table for later changes means that the printed commencement table remains a record of the original commencement mechanics rather than a running log of amendments. Any later modifications to the program will need to be traced in amended instruments, replacement instruments, or in records held by the administering department.

The instrument contains no record of litigation. It is a primary legislative instrument prescribing a program under the Industry Research and Development Act 1986 and does not itself report any judicial consideration or challenge. The text does include specific references to constitutional heads of power in s 6, namely paragraph 51(xx) (corporations), paragraph 51(xxix) (external affairs), paragraph 51(xxxvi) together with s 96 (financial assistance to States), and s 122 (Territories). Those references are declaratory of the legislative bases the Commonwealth regards as relevant, but they do not reflect any adjudication recorded in this instrument.

Because the instrument is short and declaratory, any litigation likely to arise in relation to the program will turn on subsequent administrative acts, funding agreements, or statutory measures that implement program obligations, conditions, or funding arrangements. The instrument itself does not create rights to funding that would readily give rise to litigable statutory entitlements; disputes are therefore most likely to be contractual, administrative law challenges to funding decisions, or constitutional litigation regarding the Commonwealth’s power to fund particular measures. The instrument’s explicit recitation of the constitutional bases may be intended to mitigate certain legal arguments, but the instrument records only the Commonwealth’s chosen specified powers and does not foreclose future legal challenge.

Because the instrument cites other statutes for definitions (for example the Regional Forest Agreements Act 2002 for "plantation") and imports the ABN requirement from the A New Tax System (Australian Business Number) Act 1999, litigation could in theory engage interpretation questions about those cross‑references, or about how the program interacts with environmental, native title, planning and land tenure laws, but none of these matters are addressed in the instrument itself.

Practitioners should therefore treat the instrument as the starting point for legal risk assessment. If and when operational documents, funding agreements or discrete legislative measures are produced under the program, those instruments are the likely sites of litigation and will need to be examined.

The instrument’s brevity contains a number of practical pitfalls for practitioners, applicants and administrators because many operational questions are left unspecified.

1. Definitions are limited but consequential. The eligibility label "Australian business" requires an ABN "for the business" and that the entity conducts a business in an Australian State or Territory (s 4). Entities that are transient, not registered for an ABN in respect of the relevant activity, or that perform activities in the Territories but not in a State may fall outside the definition. Confirming which ABN applies and whether the business is "conducted in a State or Territory" for the purposes of the instrument will require attention to application facts and to the ANTS (ABN) Act 1999.

2. "Long‑rotation plantation" is narrowly defined. The plantation must be grown and managed to predominantly produce logs for processing into timber used for construction and manufacturing and have an optimum maturity expected between 25 and 40 years (s 4). Projects designed for short rotations, for pulp, for bioenergy or for carbon purposes where rotation lengths are outside that range may not satisfy the definition. Applicants must therefore ensure their planting regimes and business plans align with that definition if they wish to fall within the prescribed program’s recipient class.

3. "Plantation" meaning is adopted from another Act. The instrument does not define "plantation" itself but adopts the meaning in the Regional Forest Agreements Act 2002 (s 4). That external cross‑reference means practitioners must consult that Act to resolve borderline cases. The absence of the plantation definition in this instrument can cause delays or disputes if program administrators and applicants differ about whether a proposed project is a "plantation".

4. No operational details in the instrument. The instrument prescribes the program and names recipients and purposes but contains no procedural requirements, selection criteria, funding caps, timing, monitoring or reporting obligations (s 5). That creates uncertainty about how the program will operate in practice. Prospective applicants should not assume funding will be available on particular terms until program guidelines or funding agreements are published.

5. Funding source and conditionality not specified. The instrument states only that the program "provides funding" (s 5(2)). It does not say whether the funding is Commonwealth appropriations, conditional financial assistance to States under s 96, loans, tax incentives, or another mechanism. The instrument’s specification of constitutional powers (s 6) signals possible avenues but does not commit to any funding model. Potential recipients should therefore avoid presuming the form or timing of support.

6. Carbon sequestration outcomes are referenced but not operationalised. The purpose in s 5(3)(b) links funding to reductions in carbon emissions through sequestration by trees, but the instrument does not say whether the sequestration will be quantified, audited, or translated into carbon credits, nor whether sequestration outcomes will attract separate valuation. Applicants should not assume automatic recognition in any emissions trading or carbon accounting framework without further program rules.

7. Delegation and maker identity. The instrument is signed by Murray Watt "as delegate of the Minister for Industry and Science" and also appended with his name and the title Minister for Agriculture, Fisheries and Forestry. The instrument records that it is made under s 33 of the Act (s 3). Practitioners should ensure the delegation under the principal Act is valid and that delegation instruments authorising the delegate to make the prescription are in place.

8. Interaction with State and Territory rules. Because the program targets plantation establishment, it will interact with State and Territory land‑use, planning, environmental and forestry laws. The instrument does not address these interactions or how compliance across jurisdictions will be managed. Applicants must check local approvals, native title, and environmental approvals early.

9. No penalties or enforcement in the instrument. There is no statutory enforcement regime set out; enforcement will depend on subsequent program documents. Applicants should expect conditions and possible clawbacks in funding agreements and should budget for compliance and reporting costs.

10. Temporal commitment implied by rotation length. The long‑rotation definition contemplates 25 to 40 year maturity. Funding recipients and financiers should note the long‑term nature of the commitment. The instrument imposes no mechanism to secure the social or environmental outcomes over the long term, and financial instruments and contracts will need to deal with long‑term stewardship risks.

These items are not defects of the instrument in a technical sense; they are design choices. But they are practical "gotchas" because they shift the burden of resolving core operational questions to later instruments and administrative practices.

Because the instrument prescribes a program but does not set operational rules, compliance in practice requires two categories of action: meeting the definitional gates established in the instrument, and following the operational requirements that will be set out in program guidelines and funding agreements when they are published.

Immediate steps based on the instrument text

1. Confirm entity status. Private applicants must ensure they qualify as an "Australian business" as defined in s 4: the entity must conduct a business in an Australian State or Territory and hold an Australian Business Number for that business under the A New Tax System (Australian Business Number) Act 1999. Confirm the ABN registration covers the business activity intended for the program application and that the business is carried on within a State or Territory.

2. Confirm forestry body status where applicable. State and Territory applicants must confirm they meet the definition of "State forestry body" or "Territory forestry body" in s 4 by establishing that they are established by or under State or Territory law or are a part of a State or Territory government and that they manage plantations or engage in forestry‑related activities.

3. Align project design with the "long‑rotation plantation" definition. Ensure the proposed plantation is managed to predominantly produce logs for processing into timber used for construction and manufacturing and that the plantation’s optimum maturity is expected between 25 and 40 years. Document rotation lengths, intended end products, and forest management plans to demonstrate alignment.

4. Check the meaning of "plantation" in the Regional Forest Agreements Act 2002. Because "plantation" is adopted from that Act, practitioners must verify that proposed sites and activities match that statutory meaning.

5. Note the commencement date. The instrument commences the day after registration (s 2). Any program documents or application windows will likely follow the instrument’s commencement, but do not assume funds are immediately available without program guidelines.

Anticipatory and procedural compliance steps

6. Monitor program guidelines and funding agreements. The instrument does not provide application forms, selection criteria, funding amounts, reporting obligations or enforcement provisions. Administrators will issue program guidelines and funding agreements; applicants should monitor the administering department’s publications and be prepared to comply with specified milestones, reporting, auditing, and any environmental compliance conditions.

7. Prepare for environmental and land‑use approvals. Plantation establishment will require adherence to relevant State and Territory planning, environmental and land tenure laws. Prepare environmental impact assessments, approvals, and native title risk assessments early. The instrument does not alter those regimes.

8. Budget for long term performance and reporting. The 25-40 year rotation horizon implies long‑term management obligations. Financial modelling, stewardship plans, and contractual covenants will likely be required by funders or by intergovernmental agreements. Prospective recipients should prepare for long‑term monitoring and maintenance costs.

9. Clarify funding model and conditionality. Because the instrument does not specify whether funding will be grants, loans, or financial assistance to States under s 96, applicants should not assume the form of funds. Seek clarity from program administrators about whether funds will be conditional, whether there will be clawback provisions, and what reporting standards will apply.

10. Coordinate with State and Territory governments where relevant. The instrument contemplates State and Territory bodies as recipients and references s 96 financial assistance to States and s 122 Territories power (s 6(c)-(d)). Applicants proposing projects that interact with State or Territory land or require approvals should engage early with relevant agencies to harmonise approvals and funding arrangements.

11. Document carbon outcomes carefully. If the funding application relies on carbon sequestration as a projected benefit, document the expected sequestration, methodology, baselines and monitoring plans. The instrument references carbon sequestration as a purpose (s 5(3)(b) but does not establish how sequestration will be measured, credited or enforced.

12. Legal counsel and contract drafting. Because the instrument does not set out enforcement or remedial regimes, legal counsel should be engaged to review any funding agreement, to negotiate representations and warranties, to secure appropriate indemnities, to design milestones and performance metrics, and to ensure the agreement addresses long‑term stewardship and transferability issues.

13. Records and transparency. Maintain robust records (ABN, business conduct evidence, planting and management plans, approvals, environmental assessments, carbon calculations) because administrators will likely require documentary proof of eligibility and performance.

14. Ascertain the delegation and authority chain. The instrument is made under s 33 of the principal Act and was executed by a delegate of the Minister for Industry and Science. Confirm that any administrative directions or applications are consistent with the delegation instruments and contact points identified in program documentation.

In short, compliance requires satisfying the definitional tests in the instrument and then complying with program specific rules that are not set out here. Applicants should not infer entitlement from this instrument alone; they must follow the subsequent procedural materials and funding agreements that will operationalise the program.
