What it does
This instrument prescribes a new national program under the Industry Research and Development Act 1986 by name, the Space Literacy and Workforce Program. The Minister for Industry and Science, Ed Husic, made the instrument on 4 July 2024 and it commences the day after it is registered (see commencement table at s2). The instrument records its legal basis as section 33 of the Industry Research and Development Act 1986 (s3).
Mechanically, the instrument does three things:
- It defines the program as a prescribed program for the purposes of subsection 33(1) of the Act (s5(1)). The instrument thereby establishes the Space Literacy and Workforce Program as the statutory object described in the Act’s processes for Industry Research and Development programs.
- It sets the substantive scope of that program by listing the kinds of activity the program funds or supports. The program is framed as a national initiative "that advances space education, awareness and participation in Australia" and specifically includes funding for the Australian Space Discovery Centre’s operation and expansion, promotion of space-related learning in the education sector, measures to support First Nations Australians into space careers, promotion of awareness of space careers, and provision of space-related STEM and related skill development opportunities (s5(2)(a)-(e)).
- It specifies which heads of Commonwealth legislative power are relevant to the program for the purposes of subsection 33(3) of the Act. The instrument lists five constitutional subjects by reference to paragraph numbers in section 51 and other constitutional provisions, namely postal and similar services (para 51(v)), astronomical and meteorological observations (para 51(viii)), the people of any race for whom special laws may be made (para 51(xxvi)), external affairs (para 51(xxix)), and enterprises peculiarly adapted to national government (para 51(xxxix) and section 61) (s6(a)-(e)).
