What it does
This instrument, the Industry Research and Development (Space Infrastructure Fund Program) Instrument 2019, prescribes a specific Commonwealth funding program for the purposes of the Industry Research and Development Act 1986 (the Act). The instrument is made by the Minister for Industry, Science and Technology and is expressly made under section 33 of the Act (s 3). It brings the Space Infrastructure Fund Program into the category of “prescribed program” under the Act (s 5(1)), and defines the types of activities for which the program will provide funding (s 5(2)).
Mechanically, the instrument does three things. First, it prescribes the program named “Space Infrastructure Fund Program” as the program under subsection 33(1) of the Act (s 5(1)). Second, it specifies the scope of funding eligible under the program by listing particular types of infrastructure and facility projects that funding may support, including mission control facilities, manufacturing and skills facilities, robotics and artificial intelligence command and control facilities, space data analysis facilities (with listed end‑uses), satellite/spacecraft tracking upgrades, and facilities for certification and qualification of space objects and equipment (s 5(2)(a)-(f)). Third, it identifies the constitutional heads of power that Parliament may rely on in relation to the program for the purposes of subsection 33(3) of the Act, by naming five categories drawn from paragraph numbers in the Constitution (s 6).
The instrument also sets at least one eligibility criterion for applicants: for funding for the activities described in paragraphs 5(2)(a) (mission control facilities) and 5(2)(c) (robotics and AI command and control facilities), applicants must be trading or financial corporations to which paragraph 51(xx) of the Constitution applies (s 7). Definitions are provided for key terms used in the instrument: the Act and the Australian Civil Space Strategy are defined (s 4). The Australian Civil Space Strategy is identified by title and anchored to the text “as that document exists at the time this instrument commences” (s 4), and the instrument commenced the day after registration, 26 November 2019 (s 2 and table). The instrument does not itself set grant amounts, application processes, contractual terms, or enforcement penalties. It prescribes the program and its eligible activities and a specified eligibility criterion; operational implementation details are not contained in the instrument.
