What it does
This instrument prescribes, for the purposes of subsection 33(1) of the Industry Research and Development Act 1986, a single program titled the Portland Aluminium Smelter Assistance Program and identifies the legislative power relied on for that prescription as the Commonwealth power over trade and commerce with other countries and among the States. The instrument is made under section 33 of the Industry Research and Development Act 1986 (s 3). It gives a short, functional description of the prescribed program: “Financial assistance to the Portland Aluminium Smelter Project Unincorporated Joint Venture to support the production of aluminium at the Portland Aluminium Smelter for export” (s 5, table, Column 2). The instrument’s commencement provision records that the whole instrument commenced the day after registration, with the date detail given as 19 January 2017 (s 2, commencement table).
Mechanically, the instrument does three things and only three things within its four substantive provisions. First, it names the instrument (s 1). Second, it sets the commencement effect for its provisions (s 2). Third, it records the statutory authority under which it is made, namely s 33 of the Industry Research and Development Act 1986 (s 3). Fourth, it prescribes a single program and specifies the constitutional legislative head relied upon for the prescription (s 5 and s 6). The instrument contains a short definitions clause that equates “Act” with the Industry Research and Development Act 1986 (s 4).
The instrument does not itself set out eligibility criteria, funding amounts, payment mechanisms, application or approval processes, reporting, review mechanisms, or any enforcement or penalty regime. It records only that a program is prescribed and gives a brief description of that program’s object and beneficiary. Any operational, financial or administrative detail would need to be provided elsewhere, for example under the Act, in subordinate instruments, contractual documents with the joint venture, or administrative guidelines, but such materials are not contained in this instrument.
