Industry Research and Development (Accelerate Adoption of Wood Processing Innovation Program) Instrument 2022

This instrument prescribes a discrete funding program under the Industry Research and Development Act 1986 (the Act). It does three operational things. First, it formally designates the Accelerate Adoption of Wood Processing Innovation Program as a prescribed program for the purposes of subsection 33(1) of the Act (s 5(1)). Second, it describes at a high level what the program will fund: funding to commercial wood processing facilities to enable innovation in wood processing, including developing new wood processing lines and improving capability and capacity (s 5(2)). Third, it states the program purpose in specific, enumerated terms: to support commercial wood processing facilities to undertake one or more of (a) developing new wood products, (b) improving capacity to make existing products, (c) increasing utilisation of wood supply, and (d) improving sustainability by reducing carbon emissions, all with the objective of boosting participation in domestic and international timber markets (s 5(3)).

Legally, the instrument is made under section 33 of the Act and therefore operates as a delegated instrument prescribing a program under that statutory head (s 3; s 5(1)). The instrument also specifies which heads of Commonwealth legislative power the prescription relies on for the purposes of subsection 33(3) of the Act: trade and commerce with other countries and among the States (Constitution, s 51(i)); foreign and trading or financial corporations (s 51(xx)); external affairs insofar as it relates to assisting Australia meet obligations under the Kyoto Protocol, the Paris Agreement and the UN Framework Convention on Climate Change (with specific treaty articles mentioned) (s 6(c)); and the government of a Territory (s 122) (s 6).

The instrument defines key eligibility and scope terms. It limits the program to commercial wood processing facilities that are located in an Australian State or Territory, are not State Forestry or Commonwealth wood processing facilities, and are owned by an Australian entity (definition in s 4). The definitions also clarify that wood includes timber, pulp and wood fibre, and that wood product means a product containing wood (s 4).

The instrument does not set grant mechanics, criteria, application procedures, funding sums, contracting terms, reporting requirements, or penalties. It prescribes the program, its broad scope and purposes, and the constitutional powers relied on to support the program.

The instrument establishes several tightly circumscribed concepts that determine scope, eligibility and legal basis.

• "Commercial wood processing facility" is an operative eligibility concept. It requires the facility to be located in an Australian State or Territory, to be neither a State Forestry wood processing facility nor a Commonwealth wood processing facility, and to be owned by an Australian entity (s 4). Each limb is cumulative. The instrument therefore excludes facilities that are owned or operated by the Commonwealth or by a State or Territory or their statutory authorities (those are separately defined).

• "State Forestry wood processing facility" and "Commonwealth wood processing facility" are defined as facilities owned or operated by State/Territory governments or their statutory authorities, and by the Commonwealth government or its statutory authorities, respectively (s 4). These definitions operate as exclusionary categories for the program.

• "Wood" and "wood product" are defined broadly, with wood expressly including timber, pulp and wood fibre, and wood product meaning any product containing wood (s 4). This definition sets the material scope of projects the program may fund.

• The "program" is prescribed for the statutory purpose of subsection 33(1) and is described in operational terms (s 5). The program's funding objective is innovation in wood processing, with examples provided: developing new lines, improving capability and capacity (s 5(2)). The program's stated purpose is narrower again: driving product development, capacity improvement, increased utilisation of supply, and sustainability via emissions reductions, in service of boosting participation in domestic and international timber markets (s 5(3)).

• The instrument separately specifies the constitutional and legislative powers relied upon to support the prescription under subsection 33(3) of the Act. These include trade and commerce, corporations, external affairs as relating to particular treaty obligations (Kyoto Article 10, Paris Article 4, UNFCCC Article 4), and the government of a Territory (s 6).

Mechanically, the instrument converts a government policy choice into a statutory prescription that enables the Minister or delegate under the Act to administer funding within the named program. The instrument contains no procedural provisions for grants, no detailed eligibility tests beyond facility ownership and type, and no reporting or accountability provisions. That absence is a defining characteristic: the instrument prescribes the program and its broad purposes while leaving implementation detail either to the Act itself or to subsequent administrative instruments, grants guidelines, funding agreements or departmental practice operating under the Act.

Primary subjects

• Commercial wood processing facilities that meet the definition in s 4 are the direct recipients and primary affected parties. To be eligible in principle a facility must be located in an Australian State or Territory, must not be a State Forestry or Commonwealth wood processing facility, and must be owned by an Australian entity (s 4). These three conditions determine the set of businesses the program targets.

• Australian entities that own commercial wood processing facilities are the legal owners who would receive funding or enter into funding agreements. The requirement that the facility be owned by an Australian entity (s 4(c)) excludes foreign ownership as an eligibility criterion in the instrument.

Excluded subjects

• State Forestry wood processing facilities and Commonwealth wood processing facilities are expressly excluded from the category of "commercial wood processing facility" and therefore are not targets of the program as prescribed by this instrument (s 4). State Forestry facilities are defined to be those owned or operated by State or Territory governments or state statutory authorities; Commonwealth facilities are those owned or operated by the Commonwealth or Commonwealth statutory authorities (s 4). That exclusion shifts benefit away from government-owned processing facilities and towards private (Australian-owned) commercial operators.

Indirectly affected parties

• Suppliers to eligible facilities, such as machinery vendors, technology providers, consultants and constructors, stand to benefit from funded investments in new processing lines, capacity upgrades and improved utilisation. The instrument does not name these parties but their commercial involvement is an implied transmission mechanism because funding is to facilities for capital and capability improvements (s 5(2)-(3)).

• Competing facilities that are ineligible because of foreign ownership or government ownership will be affected by competitive dynamics if funded facilities expand capacity, develop new products, or reduce costs through innovation. The instrument sets incentives that may change market shares within domestic and export markets, but the instrument itself does not prescribe market interventions beyond funding (s 5(3)).

• State and Territory governments may be indirectly affected because the instrument excludes their facilities, and because the program explicitly invokes Commonwealth heads of power that include trade and corporations, and external affairs, potentially overlapping with areas where States have regulatory authority (s 6).

Rights created by the instrument

• The instrument creates, by prescription under the Act, an entitlement for eligible commercial wood processing facilities to participate in the program in the sense that the program will provide funding for specified innovation outcomes (s 5(1)-(3)). That is a programmatic right to be considered for funding; the instrument does not create an individual legal entitlement to receive funds absent the Act’s grant processes or subsequent funding agreements.

• Eligible facilities have a stated normative right to seek funding for projects aimed at four categories of activities: developing new wood products, improving capacity for existing products, increasing utilisation of wood supply and reducing carbon emissions through improved sustainability, with the objective of boosting domestic and international market participation (s 5(3)). The instrument frames the allowable project types, which will guide funding applications and project design.

Duties and obligations

• The instrument does not itself create duties or compliance obligations for recipients beyond the definitional eligibility tests. It does not contain grant conditions, reporting duties, timeframe obligations, or performance measures. Any duties on recipients will derive from the Act’s broader grant framework and from funding agreements or program guidelines issued pursuant to the Act.

• The instrument imposes a definitional limitation that functions as an eligibility duty on applicants: they must be able to demonstrate that the facility is located in an Australian State or Territory, is not a State Forestry or Commonwealth facility and is owned by an Australian entity (s 4). Those are factual predicates that an applicant will need to satisfy in any application process.

Administrative discretion and decision rights

• The instrument itself does not specify the decision-making rules for grant allocation. It prescribes the program and its objectives, but leaves the exercise of funding discretion to the administrative apparatus under the Act and any delegated instruments, guidelines or funding agreements not included in this text (s 3; s 5(1)). The instrument thus allocates decision rights to the Minister or delegate under the Act’s scheme rather than to the instrument itself.

Effect on contractual freedom

• The instrument does not modify private contract law or create direct contract obligations between parties other than by enabling funding agreements under the Act’s machinery. Any contractual terms will arise from grant agreements or procurement contracts entered into by funded entities; those are not set out here.

No penalties in the instrument

• The instrument contains no offence-creating provisions, civil penalty clauses, administrative fines, or explicit enforcement mechanisms. It does not prescribe sanctions for misuse of funds, false applications, or breaches of program conditions. There are therefore no penalties located within this instrument itself.

Enforcement mechanisms likely external to the instrument

• Because the instrument is a prescription under the Act (s 3; s 5(1)), any enforcement or penalties applicable to program recipients will arise from the Act’s grant framework, from funding agreements entered under that framework, or from general Commonwealth law. The instrument does not identify or describe those mechanisms. Readers must therefore look to the Industry Research and Development Act 1986 and the program’s grant documentation for enforcement provisions.

Administrative enforcement discretion

• The instrument leaves the exercise of discretion over funding and any consequent enforcement to the Minister or delegate under the Act’s administrative apparatus. The instrument’s silence on enforcement creates implementation uncertainty: the manner in which breaches will be investigated, the remedies available to the Commonwealth, and the administrative processes for recovery of funds or sanctions are not stated here.

Audit and accountability

• The instrument does not provide for auditing, performance measurement, reporting cycles, or compliance checks. If the program requires reporting or is subject to audit, those requirements will be imposed through separate instruments, guidelines, or funding agreements under the Act rather than by this instrument.

Implication for applicants

• Prospective applicants should not rely on the instrument for enforcement standards. They should expect standard elements of grant arrangements (such as warranties, representations, reporting obligations and clawback provisions) to appear in program documentation administered under the Act. The instrument provides the program framework and purposes; the penalties and enforcement detail are intentionally omitted and must be obtained from the Act and program-specific instruments.

Statutory foundation under the Industry Research and Development Act 1986

• The instrument is explicitly made under s 33 of the Industry Research and Development Act 1986 (s 3). It therefore sits within the Act’s delegated-program framework. Subsection 33(1) allows the prescription of programs. The instrument uses that mechanism to prescribe the Accelerate Adoption of Wood Processing Innovation Program (s 5(1)). Any procedural or substantive limits on the program deriving from the Act therefore apply.

Constitutional heads of power and external affairs

• The instrument sets out the constitutional powers on which the prescription is said to rely for the purposes of subsection 33(3) of the Act (s 6). These include trade and commerce with other countries and among the States (s 6(a)), corporations power (s 6(b)), external affairs to the extent necessary to assist Australia meet obligations under specified international agreements (Kyoto Protocol Article 10, Paris Agreement Article 4, UNFCCC Article 4) (s 6(c)), and the government of a Territory (s 6(d)). The instrument therefore frames the program as compatible with or supported by these heads of Commonwealth power; this affects legal interaction with Commonwealth constitutional law.

Interaction with international instruments

• The instrument explicitly links the program to Australia’s international climate obligations by invoking the Kyoto Protocol, the Paris Agreement and the UNFCCC in s 6(c) and by stating reducing carbon emissions as an enumerated program purpose (s 5(3)(d)). Those treaty references are invoked as part of the external affairs head; however the instrument does not incorporate treaty obligations into domestic law, nor does it create treaty-based legal obligations on recipients. The references specify that the external affairs power is being relied upon insofar as measures would assist Australia to meet its obligations under those treaties (s 6(c)).

Effect on State and Territory laws

• The instrument excludes State Forestry wood processing facilities (s 4) and thereby interacts structurally with State or Territory ownership and regulatory regimes. Because the prescription targets privately owned Australian entities located within States and Territories, it potentially overlaps with state planning, environmental, and forestry regulations that govern wood processing facilities. The instrument does not modify State law. Any regulatory compliance obligations under State law remain applicable to participating facilities.

Original instrument and commencement

• The instrument contains a commencement table in s 2. It states that the whole of this instrument commences the day after it is registered (s 2(1), commencement table). The instrument notes that the table relates only to the provisions as originally made and that it will not be amended to deal with later amendments (s 2(1) note). That language is administrative and indicates the instrument’s initial commencement mechanics.

No amendments recorded in the text

• The version of the instrument provided contains only the original provisions and an explicit note that the commencement table relates to the instrument as originally made. The instrument contains no subsequent amendment schedule, no later versions, and no recorded amendments within the text supplied. There is therefore no internal amendment history recorded in this document.

Procedure for amendment

• The instrument is made under s 33 of the Industry Research and Development Act 1986 (s 3). Any amendment to the prescription would need to comply with the Act’s processes for making instruments, including any requirements for publication and registration applicable to legislative instruments or disallowable instruments, depending on the statutory classification under the Act. The instrument itself does not specify the amendment process.

Notes about versioning information

• Section 2(2) makes an administrative observation: any information in column 3 of the commencement table is not part of the instrument and may be edited in any published version (s 2(2)). That is a procedural note about publication metadata rather than a substantive amendment.

Implication for users

• Practitioners seeking the authoritative current text should check the registered instrument and any subsequent amending instruments or program guidelines published under the Act. The instrument as provided contains the original enactment and no recorded amendments.

No litigation recorded in the instrument

• The instrument contains no reference to litigation, court challenges, judicial review proceedings, or case law. It does not mention any dispute or legal interpretation arising from the instrument itself.

No judicial exposition of terms in the text

• Because the instrument as provided is a short delegated instrument that prescribes a program and sets definitions and purposes, the text contains no judicial exposition or precedent. There are no named cases, and no authority cited from courts.

Consequences for legal risk assessment

• The absence of litigation history in the instrument means there is no local textual guidance on how courts have interpreted eligibility, the interplay with treaty obligations, or the scope of the external affairs justification as used here. Any potential legal risks arising from the program’s design (for example, constitutional or administrative law challenges) would need to be judged against the Act and relevant case law outside this instrument, which is not included in this text.

Where to look for disputes

• Any litigation or judicial review arising from decisions made under the program would likely focus on administrative law grounds such as legality, procedural fairness, jurisdictional error or Wednesbury unreasonableness, or on constitutional grounds if the scope of the Commonwealth’s power were challenged. The instrument itself does not provide examples of such litigation.

Practical note

• For current litigation status or precedents, a user must consult external legal databases, the registers of courts, and the consolidated registers of legislative instruments. Those sources are outside this instrument and not provided here.

Eligibility exclusions and ownership requirement

• The instrument restricts the program to facilities that are owned by an Australian entity (s 4(c)). That is a material eligibility constraint. A facility that is located in Australia but owned by a foreign entity would, on the plain wording, be excluded from the category of "commercial wood processing facility". Applicants must therefore be able to demonstrate Australian ownership to the satisfaction of administrators.

• Similarly, the instrument excludes State Forestry and Commonwealth wood processing facilities (s 4). Facilities owned or operated by State or Territory governments or their statutory authorities, and those owned or operated by the Commonwealth or its statutory authorities, are not within the target set. Entities that operate joint ventures with State bodies or that have ownership structures involving state statutory authorities may need to consider whether they are ineligible.

Definition duplication and drafting inconsistencies

• The instrument repeats the definition of "State Forestry wood processing facility" twice in the definitions section. While this does not change substantive meaning, it suggests a drafting duplication that users should note when parsing the definitions.

Ambiguity on "commercial" and what counts as a "facility"

• The instrument does not define "commercial" beyond the exclusion of State and Commonwealth facilities and the ownership requirement. It does not articulate whether part-time operations, small-scale producers, contract processors, or vertically integrated firms fall within the intended category. The absence of further definition means operational administrators will need to clarify the threshold for "commercial".

No procedural detail in the instrument

• The instrument prescribes the program and its purposes but contains no procedural detail: it does not set out application processes, evaluation criteria, funding caps, co-contribution requirements, performance metrics or timelines. This creates implementation uncertainty. Applicants cannot infer application or compliance requirements from the instrument alone; they must rely on separate program documentation.

Narrowly stated purposes but broad invocation of external affairs

• The program specifies reducing carbon emissions as one of four enumerated purposes (s 5(3)(d)) and invokes the external affairs power in relation to the Kyoto Protocol, Paris Agreement and UNFCCC (s 6(c)). That linkage may be used to justify funding for emissions-reducing projects. However, the instrument does not define what level of emissions reduction or what measurement standards will be required, producing potential uncertainty for applicants designing sustainability projects.

Check eligibility against the definitions

• Begin by confirming that the facility meets the definition of "commercial wood processing facility" in s 4. Specifically, confirm (1) the facility is located in an Australian State or Territory, (2) the facility is not a State Forestry wood processing facility nor a Commonwealth wood processing facility, and (3) the facility is owned by an Australian entity (s 4). Gather evidence of ownership and operational arrangements to establish these predicates.

Align project scope with permitted activities and purposes

• Design proposed projects to fall squarely within the program descriptions in s 5(2) and the enumerated purposes in s 5(3). The instrument identifies four permissible purposes: developing new wood products, improving capacity to make existing products, increasing utilisation of wood supply, and improving sustainability by reducing carbon emissions (s 5(3)). Project proposals should articulate which of these purposes are being advanced and provide measurable project objectives tied to those purposes.

Document sustainability and emissions outcomes if relevant

• If the proposal relies on s 5(3)(d) (improving sustainability by reducing carbon emissions), document the baseline emissions, the expected reductions, the methods for measurement and verification, and how the project will assist Australia meet international commitments as invoked in s 6(c). The instrument references the Kyoto Protocol, Paris Agreement and UNFCCC (s 6(c)), so proposals that seek to rely on the sustainability purpose should be able to show credible emissions outcomes even though the instrument does not prescribe measurement standards.

Prepare for administrative documentation under the Act

• The instrument prescribes the program under s 33 of the Act (s 3; s 5(1)). Administrative rules, grant guidelines, funding agreements and reporting obligations will be issued under the Act. Prospective applicants should obtain the program’s grant guidelines, application forms and any model funding agreements issued by the administering department. These documents will contain the operational compliance obligations not found in this instrument.

Anticipate State and Territory regulatory approvals

• Funding for physical upgrades, new processing lines or capacity expansion will often require planning approvals, environmental licences or other State or Territory authorisations. Build those regulatory timelines into project plans and cost estimates, since the instrument does not remove or relax such requirements.
