The document revolves around several core concepts and institutional mechanisms that shape incentives and constraints.

Eligible Organisations and Administering Organisation

• Only organisations listed in Appendix B are Eligible Organisations and may act as the Administering Organisation submitting applications (4.1; Appendix B). That confines applicant institutions predominantly to Australian universities and a few other higher education bodies.

Key Industry Partner and Other Industry Partners

• Each application must include a Key Industry Partner that is a separate organisation meeting specific criteria: an organisation with an Australian Company Number (ACN), an Australian government entity, or an Australian not-for-profit/charity registered on the ACNC register (4.8). Other Industry Partners can be Australian or international organisations that provide additional support (4.9).
• Key Industry Partners cannot be Eligible Organisations, controlled entities of Eligible Organisations, or entities more than 50 per cent owned by Eligible Organisations (4.10.b-d). They also cannot be on the National Redress Scheme list of institutions that have not joined (4.10.1).

Funding architecture

• For each scheme the ARC provides both a salary contribution (fixed annual amounts listed in the funding table 3.1) and a ceiling on project costs (3.1). Salary and project contributions are treated as a package and not awarded separately.
• The guidelines note the figures are based on 2022 funding levels and may be subject to variation and indexation (3.1).

Eligibility and career-stage definitions

• The schemes have distinct career-stage tests and application limits: Early Career Fellows should have five or fewer years of industry/academic research experience (FTE) and hold an HDR or equivalent (A1.2-A1.3); Mid-Career applicants should have five to 15 years (B1.2-B1.3); Industry Laureate applications must request funding for specified team sizes and nominate a Key Industry Partner (C1.2).
• Limits on multiple applications per candidate (4.3; A1.5; B1.5) and restrictions on holding concurrent ARC Fellowships (4.5) are set to control overlap.

Assessment and decision-making

• Assessment is competitive, peer‑reviewed and scored against published assessment criteria (7.1-7.2; Parts A-C). Selection Advisory Committee (SAC) and Detailed Assessors provide rankings; the CEO and Minister take national interest, security and government priorities into account (process flow; 7.8-7.9).
• Applicants must submit a National Interest Test statement for public-facing explanation of the project’s contribution to Australia’s national interest (7.6).

Permitted/ineligible activities and budget items

• Expenditure must be a direct cost of the proposed research or training related to commercialisation and translation (5.2).
• Ineligible activities include research already funded by Commonwealth grants, certain medical research and clinical trials, and activities not meeting the definition of research in the Glossary (5.3).
• The guidelines prohibit a list of ineligible budget items such as capital works, general purpose equipment, relocation, entertainment, legal costs associated with commercialisation and salary top-ups above published salaries unless sourced from non‑ARC funds (5.4).

Monitoring, IP and reporting

• The ARC requires ethics plans, data management plans and compliance with the Australian Code for the Responsible Conduct of Research and Open Access policy (8.18, 8.19, 8.21, 8.22).
• Intellectual Property arrangements are to be negotiated between Administering Organisation and industry partners; the ARC does not claim ownership of IP arising from the project (8.20).
• Reporting and monitoring obligations are set out, with RMS as the reporting channel and audit powers reserved to the ARC (8.24-8.26).

Probity and information handling

• The ARC provides appeals limited to administrative process errors (not to merits of peer review) and requires conflict of interest declarations and management processes in line with the Australian Code and ARC policies (9.2-9.7). The ARC may disclose confidential information to other Australian Government bodies and is subject to the FOI Act (9.10-9.12).

These concepts configure a particular incentive structure: government selects and funds a limited number of fellows to promote industry-academia mobility and translation, with constraints on eligible partners, permitted use of funds and monitoring obligations to manage public accountability and research integrity. The selection process centralises discretionary judgment at the peer-review, CEO and Minister levels while imposing detailed compliance requirements on grantees.

Primary payees and recipients

• The Administering Organisation is the Eligible Organisation that applies and, if successful, will receive grant funding and enter the grant agreement with the ARC (4.1; Appendix B; 8.5-8.8). Eligible Organisations are listed in Appendix B and are almost exclusively Australian universities and specified tertiary institutions.
• The Industry Fellow (the named candidate) is the individual whose salary the ARC will partially fund. Each application must nominate one candidate (4.2; 3.1).

Industry partners and contributors

• The Key Industry Partner must be an external organisation meeting statutory criteria (ACN, government entity or registered ACNC charity) and cannot be an Eligible Organisation or controlled by one (4.8-4.10). Other Industry Partners may be Australian or international organisations providing complementary support (4.9).
• Industry partners may provide cash and in‑kind contributions. Cash contributions must not be sourced from Commonwealth, State/Territory or Local Government appropriations for research or from funds used to leverage other government research funding (4.11).

Researchers and trainees

• Postdoctoral Research Associates (PDRAs) and Postgraduate Researchers (PGRs) can be funded under the Industry Laureate scheme and are intended beneficiaries of stipend/salary contributions listed in the Industry Laureate funding table (3.1; C1.2).
• Academic supervisors and other participants working on the project are affected by the reporting, ethics, IP and open access rules (8.18-8.22).

Government decision‑makers and advisers

• The ARC manages the application process, assigns Detailed Assessors and Selection Advisory Committee members, and makes recommendations via the CEO to the Minister (Sections 1 process; 7.2; 7.8). Commonwealth agencies beyond the ARC may be asked for security or other advice during assessment (7.4).

Administrators and research offices

• The Research Office within each Administering Organisation is the principal contact point for applicants and is responsible for certifying the application, managing grant agreements, reporting and ensuring compliance (front matter; 6.1; 8.13-8.15).

Wider stakeholders with indirect impacts

• The public and industry sectors may be affected indirectly by research outputs and translation/commercialisation resulting from funded projects. The ARC will publish project details, including title, summary and funding amounts on GrantConnect (8.1-8.2), which exposes project narratives to public and commercial scrutiny.
• Aboriginal and Torres Strait Islander communities are specifically named as stakeholders where projects involve First Nations research; additional criteria and expectations apply (Parts A-C assessment criteria).

Who pays and who decides

• The ARC provides the public funding; the Administering Organisation receives and manages it (3.1; 8.5). The ARC and the Minister exercise decision power: the Selection Advisory Committee and ARC CEO provide advice and recommendations, but the Minister makes the final funding decision (7.8-7.9). The ARC also retains monitoring and audit powers and may refuse to recommend incomplete or non‑compliant applications (7.3; 8.25).

Behavioural constraints and choices

• Administering Organisations must structure employment of fellows at specified minimum academic levels (A for Early Career, C for Mid‑Career, E for Laureate) and ensure fellows spend significant time both in the Key Industry Partner setting and the Administering Organisation (at least 20% in each) (8.14-8.17; A1.9; B1.9; C1.7).
• Candidates cannot undertake an HDR during the project (4.6) and must have met obligations on prior ARC projects (4.7). Candidates cannot be named on more than one IFP application in a round (4.3).

Net effect on stakeholders

• The guidelines concentrate direct financial benefit on selected fellows and their project teams (salary and project-cost contributions), while imposing compliance, reporting and IP negotiation duties on Administering Organisations and industry partners. The Ministerial final decision and ARC monitoring centralise control of public research funding choices while requiring applicants to navigate peer-review procedures, ethics, data and reporting obligations.

Obligations of the Administering Organisation (You)

• Only an Eligible Organisation may apply and, if successful, will be the Administering Organisation responsible for administration of the grant (4.1; Appendix B).
• You must complete and submit the application via RMS following Instructions to Applicants (6.1-6.2). You cannot change the application after the closing date unless invited by the ARC (6.3).
• You must ensure the Industry Fellow is supported to spend significant time both in the Key Industry Partner setting and in the Administering Organisation (at least 20% of project activity period in each) and provide appropriate facilities for project-related activities (8.14).
• You must enter into and execute the grant agreement within 30 calendar days of offer; the ARC will not make payments until the grant agreement is executed and is not responsible for project expenditure incurred before execution (8.5-8.8).
• You must submit periodic reports through RMS as required by the grant agreement, including end-of-year, final and post-project reporting, and notify the ARC of administrative changes such as name, contact or bank account (8.23-8.25).
• You must comply with research integrity and ethics requirements (Australian Code, ethics plan) and have a data management plan in place before project commencement (8.18-8.19; 8.22).
• You must ensure Intellectual Property (IP) arrangements are negotiated with Key Industry Partner(s) and Other Industry Partners; the ARC does not claim ownership of IP arising from the project (8.20).
• You must manage conflicts of interest and document processes to do so, in line with the Australian Code and ARC Conflict of Interest and Confidentiality Policy (9.5-9.7).

Obligations and obligations of Industry Partners

• The Key Industry Partner must certify commitment to successful completion of the project and any financial contributions, and must have appropriate governance arrangements in place (8.16).
• Key Industry Partners must ensure the Industry Fellow spends significant time in an industry setting (at least 20%) and provide appropriate facilities (8.17).
• Key Industry Partner cash contributions cannot be sourced from government appropriations for research or funds used to leverage other government research funding (4.11).
• Key Industry Partners cannot be Eligible Organisations or controlled/majority-owned by them (4.10.b-d), and cannot be on the National Redress Scheme list of institutions that have not joined (4.10.1).

Rights and responsibilities of the Industry Fellow

• The Industry Fellow is responsible for authorship and intellectual content of the application and must appropriately cite and acknowledge significant contributions (8.13.1).
• Fellows must obtain legal right to work and reside in Australia before project commencement if not citizens (8.13.1.b).
• Fellows must meet residential, time commitment and relinquishment requirements specified in the grant agreement (8.13.1.c).
• Fellows cannot undertake a Higher Degree by Research during the project activity period (4.6).

ARC rights and discretionary powers

• The ARC manages assessment through peer review and can recommend not to approve an application if incomplete, inaccurate, misleading, or in breach of the Australian Code for Responsible Conduct of Research (7.3).
• The ARC may seek advice from Commonwealth agencies on security or other matters at any time and may act on that advice (7.4; also in process flow).
• The ARC will publish grant offers on GrantConnect within 21 calendar days of the date of effect and may publish project descriptions that differ from the application (8.1-8.4).
• The ARC may monitor progress, re‑examine claims, request records, conduct site visits or request independent audits of claims and payments (8.25).

Appeals and administrative redress

• Appeals are limited to alleged errors in the NCGP administrative process and cannot challenge committee decisions, assessor ratings/comments or assessment outcomes (9.2). Appeals must be authorised by the Administering Organisation’s Deputy Vice-Chancellor (Research) or equivalent and lodged within 30 days of notification (9.3).

Confidentiality, privacy and FOI

• Applicants must certify compliance with the Privacy Act 1988 and Australian Privacy Principles and must impose the same privacy obligations on subcontractors (9.8-9.9).
• The Australian Government may use and disclose confidential applicant information to other Australian Government business or functions (9.10), but will treat information as confidential only where specific criteria are met (9.11). Records are subject to the Freedom of Information Act 1982 (9.12).

Financial management and use of funds

• ARC funding will typically be paid monthly and the ARC will not pay more than the approved grant amount (8.9-8.11). Grant funds must be used for direct project costs and cannot be used for excluded items such as capital works, certain equipment, legal expenses for IP commercialisation, salary top-ups above specified levels unless from non-ARC funds (5.2-5.4).

Other duties and conditions

• Ethics plans and data management plans must be in place before project commencement (8.19-8.22).
• Variations to the grant agreement are required for changes to fellowship duration, Key Industry Partner, or where project changes mean it no longer aligns with the project description (8.12).
• The grant agreement used is the ARC Linkage Program IFP sample agreement and contains standard terms and conditions that cannot be changed; special conditions will be identified in the offer (8.6).

These duties allocate responsibilities across the ARC, Administering Organisations, Industry Partners and Fellows. Rights are limited and largely procedural: publication of grant outcomes, appeals constrained to administrative errors, and ARC discretion over assessment and security-related refusals.

Express enforcement powers stated in the guidelines are administrative and contractual rather than criminal. The document focuses on monitoring, reporting, and grant-agreement-based enforcement rather than specifying statutory penalties.

Monitoring and audit powers

• The ARC explicitly reserves the right to monitor progress, re-examine claims, request records, conduct site visits and request independent audits of claims and payments (8.25). These are direct compliance mechanisms the ARC may use to verify use of public funds and compliance with grant terms.
• The ARC will assess reports submitted through RMS and may re-examine claims; this creates an evidentiary basis for remedial action within program rules (8.25).

Discretion to refuse or not recommend

• In the assessment phase the ARC may recommend an application not be approved if it is incomplete, inaccurate, misleading, or otherwise breaches the Australian Code for the Responsible Conduct of Research (7.3). This is a pre-award enforcement discretion aimed at integrity of the selection process.
• The ARC may seek advice from Commonwealth agencies including on security matters and apply that advice in funding recommendations (7.4). This can effectively remove an application from funding consideration on security or national interest grounds without recourse in the document.

Contractual enforcement

• Successful applicants must execute a grant agreement containing standard terms and conditions that cannot be changed (8.6). The guidelines refer repeatedly to the grant agreement as governing the relationship (8.5-8.8). Enforcement of specific penalties , for example repayment, suspension, or termination , is not detailed in the guidelines themselves; those consequences generally reside in the terms of the grant agreement. The guidelines require that payments will not commence until the grant agreement is executed and that the ARC is not responsible for any expenditure prior to execution (8.7-8.8).

Appeals and limits on review

• The appeals process is limited to administrative-process errors and must be lodged within 30 days and authorised by a senior research officer (9.2-9.4). Critically, appeals do not extend to merits of committee decisions, assessor ratings or assessment outcomes (9.2). That narrows recourse available to unsuccessful applicants to procedural challenges only.

Publication and information disclosure as compliance tool

• The ARC publishes grant offers on GrantConnect and may publish project descriptions that differ from the application (8.1-8.4). Publication acts both as transparency and reputational enforcement: public disclosure of funding amounts and project descriptions increases scrutiny.

Probity, conflicts and privacy controls

• The guidelines require declaration and management of conflicts of interest and set out that the ARC will handle conflicts in line with Government policies (9.5-9.7). Mismanagement of conflicts could be a basis for ARC action though the guideline does not specify penalties.

Limits and gaps in enforcement detail

• The guidelines do not enumerate specific civil or criminal penalties or administrative sanction regimes within the document itself. Instead, enforcement beyond monitoring and audit is implicitly delegated to the standard grant agreement and to other Commonwealth policy instruments and agencies. The guidelines do, however, show the ARC’s capacity to withhold funds, refuse to recommend a grant, audit claims and require corrective actions.

In short, enforcement under these guidelines is exercised through:

• pre-award discretion to refuse funding (7.3-7.4);
• contractual controls embedded in the grant agreement that applicants must execute (8.6-8.8);
• post-award monitoring, audit and reporting requirements (8.24-8.26);
• constrained appeal rights limited to administrative error (9.2-9.4);
• transparency via publication and information-sharing with Commonwealth entities (8.1-8.2; 9.10-9.12).

Practitioners should therefore look to the standard grant agreement for the precise remedial and sanction provisions that operationalise enforcement, and treat the guidelines as setting out the ARC’s administrative powers and monitoring expectations.

Statutory basis and administrative law context

• The guidelines are approved under section 60 of the Australian Research Council Act 2001 after the Minister satisfied matters in section 59 (preamble). They are instruments of administrative policy that operate within the Commonwealth grants framework and the ARC’s statutory functions.

Commonwealth grants framework

• The guidelines explicitly state consistency with the Commonwealth Grants Rules and Guidelines 2017 (CGRGs) and commit to conduct the grant opportunity fairly and with safeguards against fraud and unlawful activities (9.1). This places the IFP within the general rules for Commonwealth grant administration, including transparency and reporting obligations on GrantConnect (8.1; 9.1).

Privacy, FOI and information sharing

• The guidelines require compliance with the Privacy Act 1988 and the Australian Privacy Principles (9.8-9.9). Applicants must certify compliance and impose the same obligations on subcontractors. The ARC may use and disclose confidential applicant information to other Australian Government business or functions (9.10) and documents are subject to the Freedom of Information Act 1982 (9.12). These provisions establish the intersection between grant administration and privacy/FOI regimes.

Research conduct and ethics regimes

• Research funded under the program must comply with the Australian Code for the Responsible Conduct of Research and with specific ARC policies including the Open Access Policy. Ethics plans and data management plans are required (8.18, 8.19, 8.21-8.22). These references connect the grant program to existing Australian research integrity frameworks and institutional ethics approvals.

Intellectual property and commercial law

• IP arising from projects must be negotiated between Administering Organisations and industry partners; the ARC does not claim ownership (8.20). The guidelines explicitly prohibit use of ARC funds for legal costs associated with commercialisation of IP (5.4.f). Those arrangements leave IP ownership and exploitation to contractual negotiation and to general commercial and corporate law rather than public grant rules.

Restrictions linked to other government schemes

• The Key Industry Partner’s cash contributions cannot come from Commonwealth, State or Territory or Local Government appropriations for research, nor from funds used to leverage other government research or research infrastructure funding (4.11). That rule avoids double-counting of public funds and interacts with other grant programs and appropriation rules.

Medical research and clinical trials

• The guidelines bar applications that involve medical research as defined in the ARC Medical Research Policy and explicitly bar use of ARC funds for clinical trials (5.3.b-c). This interacts with other regulatory frameworks governing medical research, ethics approvals, and clinical trial governance. Where projects might straddle domains, applicants must ensure alignment with the ARC Medical Research Policy referenced by the guidelines.

Employment, migration and taxation law

• Fellows must have the legal right to work and reside in Australia prior to project commencement if they are not Australian citizens (8.13.1.b). Salary contributions and GST treatment are specified: amounts are exclusive of GST unless stated (8.11). The salary contributions are a partial funding mechanism and do not supplant employment law, tax obligations, or superannuation; those obligations are managed between the Administering Organisation and the Fellow subject to applicable law and the grant agreement (8.14-8.15).

Administrative review and limits

• Appeals are limited to administrative procedural issues under the NCGP and not to merits of assessment (9.2). This intersects with administrative law principles around procedural fairness but confines remedies to process-related matters rather than policy discretion or assessment outcomes.

Other Commonwealth processes and security considerations

• The ARC may consult other Commonwealth agencies on security and related matters and act on their advice in assessment and recommendation stages (7.4). This creates an interface with national security frameworks and with inter-agency advice processes.

Overall, the guidelines are designed to operate within a web of Commonwealth statutes and administrative practices: the ARC Act authorises the instrument; privacy and FOI laws constrain information handling; research ethics and integrity regimes govern research conduct; appropriations and other grant programs constrain eligible sources of industry contributions; and inter-agency security advice may influence selection.

Document provenance and approval

• The guidelines are presented as Ministerially approved under the Australian Research Council Act 2001, with the preamble recording the Minister’s approval dated 26 August 2022. The document itself is a policy instrument issued by the ARC as grant guidelines.

Published updates, indexation and future variation

• Section 3.1 states the salary and stipend figures are based on 2022 funding levels and "may be subject to variation (for example, due to annual indexation). Updated levels will be listed on the salaries and stipends page of the ARC website" (3.1). This identifies a mechanism for numeric updates without necessarily changing the text of the guidelines themselves.
• The guidelines state the ARC publishes the grant guidelines on GrantConnect when the grant opportunity opens (Section 1 process and 6.1). That presumes periodic republication or replacement of guidelines for each round rather than freestanding statutory amendment.

Absence of formal amendment log in the text

• The provided document does not contain a formal amendment history table, nor does it identify prior instruments replaced, nor does it list earlier versions or dates of amendment beyond the approval date. The only temporal markers in the text are the approval date and the indication that figures are based on 2022 levels. Legal professionals should therefore treat the date of approval as the instrument’s effective provenance and consult GrantConnect and the ARC website for any subsequent revocations or updated versions.

Where substantive changes would appear

• Changes likely to be manifest in later documents include: updated salary/stipend amounts (3.1); revised Eligible Organisation lists in Appendix B; alterations to assessment criteria weightings in Parts A-C; or changes to ineligible activity lists. The guidelines themselves point readers to on-line pages for updated operational details (GrantConnect and ARC website references throughout).

Interplay with grant agreements

• Some elements of enforcement and procedural detail are deferred to the ARC Linkage Program IFP grant agreement (8.6). Substantive changes in enforcement or sanctioning powers may thus occur in the grant agreement or in separate Commonwealth policies rather than in these guidelines.

Practical implication for practitioners

• Because the guidelines reference external web pages for updated salary figures and the ARC repeatedly republish grant opportunities through GrantConnect, rely on the GrantConnect posting and the ARC website for the current operative version and for any post‑approval modifications. Check the RMS and the ARC’s published sample grant agreement for the operative contractual terms for a given round (6.1; 8.6).

In sum, the instrument provides a clear approval date (26/08/2022) and anticipates routine administrative updates (indexation, web-published salary schedules) but does not embed a change log in the text supplied here. For current practice the relevant repository is GrantConnect and the ARC website.

The supplied guidelines do not reference any judicial decisions, case law, or litigation involving these specific guidelines, the Industry Fellowships Program, or the ARC’s administration of this program. The document contains no citations to court decisions nor to precedents concerning challenges to grant decisions. It also does not list prior arguments or judicial review outcomes.

Relevant procedural constraints on litigation or review are implied by the document:

• The appeals pathway described is administrative and limited to alleged errors in the NCGP administrative process, and explicitly excludes appeals against committee decisions, assessor ratings/comments, or assessment outcomes (9.2). That procedural limitation shapes potential legal strategies by restricting internal remedies to procedural complaints within 30 days and authorised by the institution’s Deputy Vice‑Chancellor (Research) (9.3-9.4).
• The Minister’s decision is stated to be final in all matters (7.9). That statement reflects an administrative finality in the program’s internal governance; in constitutional or administrative law fora, finality clauses influence but do not wholly preclude merits or judicial review where statutory or procedural fairness grounds exist. The guidelines themselves do not address the availability of judicial review outside the internal appeals process.

Practitioners seeking litigation history or judicial interpretation of these guidelines should note:

• The guidelines do not provide any recorded litigation history. If a legal issue arises , for example, a procedural fairness challenge to how the ARC applied the CGRGs or a dispute over grant agreement terms , the relevant materials would be the grant agreement and the ARC’s administrative record, and any litigation history would have to be found in court databases or legal reporting services, not in these guidelines.
• Because the guidelines repeatedly defer to the grant agreement for binding contractual terms (8.5-8.6) and set limits on appeals internally, the contractual document and the ARC’s exercise of discretion (including any security-related advice from Commonwealth agencies) are likely focal points in any external legal challenge.

In summary, the supplied instrument contains no litigation history. The document sets internal administrative remedies and indicates final ministerial decision-making, but it does not address the availability of judicial review or cite any case law. For any disputes, the grant agreement and external administrative law principles will be determinative, and practitioners must look beyond the guidelines to find any relevant litigation.

Practical traps and operational risks embedded in the guidelines that applicants and their advisers should watch for:

Limited applicant pool and partner constraints

• Only Eligible Organisations listed in Appendix B may be Administering Organisations (4.1; Appendix B). If your institution is not on that list it cannot be the applicant, even if it otherwise has the capacity to administer research grants.
• Key Industry Partners cannot be Eligible Organisations, controlled entities of them, or entities more than 50 per cent owned by Eligible Organisations (4.10.b-d). That prevents a university-affiliated company or a joint venture majority‑owned by a university from acting as the Key Industry Partner, which may complicate collaborations where the industry partner is a university spin‑out or controlled affiliate.

Cash contribution restrictions

• Key Industry Partner cash contributions cannot be sourced from Commonwealth, State, Territory or Local Government appropriations for research, nor from funds used to leverage other government research or infrastructure funding (4.11). If industry proposes to count government-funded co-investment or pass-through Commonwealth funds as its contribution, that will be ineligible.

Applicant and candidate limits

• An IFP candidate can only be named on one IFP application in a program round (4.3). Early Career individuals may submit a maximum of two Early Career applications (A1.5) and Mid-Career candidates a maximum of three Mid-Career applications (B1.5). These caps can awkwardly constrain multi‑party collaborations or competing institutional nominations.
• ARC Fellows or Award recipients cannot concurrently hold more than one ARC Fellowship or Award (4.5). Check a candidate’s existing ARC awards before nomination.

No post‑closing changes except by invitation

• Applications cannot be changed after the closing date and time unless invited by the ARC (6.3). That includes rectifying administrative mistakes outside special ARC invitations.

National Interest Test and confidentiality tension

• Applicants must provide a National Interest Test statement intended to be publicly understandable (7.6). At the same time the ARC will publish project title, summary and the National Interest Test response and may alter the published description from the application (8.1-8.4). Applicants with commercially sensitive proposals must carefully craft public statements and consider what they agree to publish; the guidelines warn applicants to ensure the project title, summary and National Interest Test do not compromise IP or confidentiality (8.3).

Ineligible activities with common misconceptions

• ARC funds cannot be used for clinical trials or certain types of medical research under the ARC Medical Research Policy (5.3.b-c). Projects marginally touching on clinical trials risk exclusion.
• Grant money cannot be used for legal or other expert costs associated with commercialisation of IP or for company start‑up costs (5.4.f). Applicants expecting the ARC to fund commercialisation transactional costs will be disappointed.

Salary top‑up management

• ARC salary contributions are fixed amounts set out in the funding table and published salaries/stipends pages; ARC funds cannot be used to top up salaries above published levels (5.4.g). Top-ups are possible only from non‑ARC sources. Administering Organisations must manage total employment packages accordingly (8.14-8.15).

Timing and activation risks

• The ARC will not pay for project expenditure incurred before execution of the grant agreement (8.7-8.8). Starting project activities or incurring costs before the grant agreement is signed risks non‑reimbursement by the ARC.

Appeals restricted to process errors

• Appeals are limited to administrative-process complaints and do not allow re-litigation of assessment outcomes or assessor ratings (9.2). If applicants want to challenge a decision on merits, their options are narrow.

Security and inter-agency discretion

• The ARC may seek security advice from other Commonwealth agencies during assessment and may act on it (7.4). That creates an uncertain variable where an otherwise compliant application can be held back for security reasons with little transparency in the guidelines about remedial steps.

Conflicts of interest and ARC discretion on assessor exclusions

• You may submit a Request Not to Assess naming up to three assessors but the ARC has discretion to accept or refuse such requests and will not notify You of the outcome (7.11-7.14). If you name an ARC College of Experts member you must accompany the request with comprehensive evidence or it may be rejected (7.13).

Audit trail for in‑kind valuation

• In-kind contributions must be valued based on likely actual cost and calculations should be documented because the ARC may audit these calculations (Glossary definition of in-kind contributions). Poor documentation or unsupported valuation methods can be challenged in audits.

IP negotiation left to parties

• Intellectual Property arrangements are for the Administering Organisation and Key Industry Partner to negotiate; the ARC does not claim ownership (8.20). That shifts risk of fair commercial terms and potential disputes to parties and requires careful contractual drafting outside the ARC’s standard grant agreement.

Administrative complexity and reporting burden

• Multiple required documents before commencement (ethics plan, data management plan), ongoing reporting obligations, and RMS-based submissions create administrative load. The ARC may request additional information or evidence to support certifications at any point (6.4; 8.24-8.25). Institutions with small research offices should budget capacity accordingly.

Tax, GST and financial caps

• Amounts in the guidelines are exclusive of GST unless expressly stated (8.11) and the ARC will not pay more than the approved grant amount (8.10). Overruns must be met by the Administering Organisation or partners.

Taken together, these “gotchas” show the program’s emphasis on formal compliance, discrete role allocation between universities and industry, and administrative documentation. Early planning , particularly around partner selection, public statements, IP arrangements and pre‑commencement compliance , is essential to avoid disqualification, loss of funding or audit challenges.

Step-by-step compliance checklist and tactical pointers grounded in the guidelines:

1. Confirm Eligible Organisation status and internal authority

• Ensure your institution is an Eligible Organisation in Appendix B and that the Research Office is designated as the formal contact point for ARC communications (4.1; Appendix B; front matter). Obtain internal authority to apply and the necessary institutional certifications, including Deputy Vice-Chancellor (Research) sign-off for any potential appeal (9.3).

2. Select and vet Key Industry Partners

• Choose a Key Industry Partner that meets the statutory tests: ACN or Australian government entity or registered ACNC charity and not an Eligible Organisation or a controlled/majority-owned entity of an Eligible Organisation (4.8-4.10). Verify the partner is not on the National Redress Scheme list of institutions that have not joined (4.10.1).
• Confirm that any industry cash contributions are not sourced from government appropriations for research or used to leverage other government research funding (4.11). Document the provenance of cash or in‑kind contributions to survive ARC audits.

3. Candidate eligibility and employment arrangements

• Verify the candidate meets the scheme-specific career-stage tests and HDR requirements (A1.2-A1.3; B1.2-B1.3; C1.2). For Early Career and Mid-Career, document FTE-year calculations and any career interruptions.
• Ensure the appointing Administering Organisation will employ the Fellow at the minimum academic level required (A1.9; B1.9; C1.7) and structure the employment package so ARC salary contributions are treated as a contribution to salary and on-costs, with any top-ups funded from non-ARC sources (3.1; 8.14-8.15; 5.4.g).

4. Budget and permissible expenditure planning

• Prepare a project budget strictly for direct costs of the research or training related to translation/commercialisation (5.2). Exclude ineligible items provided in 5.4 such as capital works, legal costs to commercialise IP, entertainment, relocation, or salary top-ups from ARC funds. If including in-kind contributions, document valuation methods and supporting evidence to withstand an ARC audit (Glossary; in-kind definition).

5. Draft National Interest Test and public-facing materials

• Prepare a National Interest Test statement that explains how the project contributes to Australia’s national interest in plain terms (7.6). Review the project title and summary for confidentiality and IP sensitivity because the ARC will publish project information and may alter descriptions for publication (8.1-8.4; 8.3).

6. Prepare ethics and data management documentation

• Ensure an ethics plan and requisite human- or animal‑research approvals are in place before commencement (8.19). Draft a data management plan aligned with ARC expectations and the grant agreement (8.22).

7. Application mechanics and RMS compliance

• Follow the Instructions to Applicants issued at opening and submit the completed application via RMS between opening and closing dates (6.1-6.2; 6.6-6.7). You cannot modify the application post-closing except by ARC invitation (6.3). Keep documentary evidence to support any certifications as the ARC may request evidence at any point (6.4).

8. Conflict of interest management

• Require declarations from all named participants regarding perceived, potential or actual conflicts of interest and maintain a documented process to manage conflicts in line with the Australian Code and ARC policies (9.5-9.7). If you intend to submit a Request Not to Assess naming assessors, follow the specific rules including timing (two weeks before close) and the requirement to justify naming ARC College of Experts members (7.11-7.13).

9. Anticipate security and inter-agency inquiries

• Be prepared to provide information and protections if the ARC seeks security advice from Commonwealth agencies and to modify the project if security concerns are raised (7.4). Have institutional processes for rapid response to such queries.

10. Grant agreement execution and pre‑commencement cautions

• If offered a grant, execute the standard ARC grant agreement within 30 calendar days and do not commence project activities or incur costs that you expect the ARC to pay before the agreement is signed (8.5-8.8). Ensure the grant agreement’s special conditions are understood and implemented.

11. Reporting, monitoring and documentation

• Implement systems to submit end-of-year, final and post-project reports via RMS on schedule and to retain records for potential site visits or audits (8.24-8.26). Maintain financial records separating ARC funds from other funds and document the use of in-kind contributions.

12. Intellectual Property arrangements

• Negotiate IP arrangements with Key Industry Partner(s) before the grant agreement is finalised, documenting access rights, licensing expectations, exploitation plans and revenue sharing. Ensure costs for IP legal work are budgeted from non-ARC sources because ARC funds cannot be used for those legal costs (8.20; 5.4.f). Consider conflict resolution and indemnity clauses in partner agreements.

13. Publication and open access compliance

• Plan for compliance with the ARC Open Access Policy and include dissemination strategies in the project plan, recognising public reporting obligations and the ARC’s rights to publish project descriptions (8.21; 8.1-8.4).

14. Governance, audit-readiness and risk management

• Establish internal governance to manage project deliverables, partner commitments and compliance tasks. Keep an audit trail of decisions, valuations (particularly for in-kind contributions), time allocations for Fellows, and partner contributions. Prepare for potential re-examination of claims and independent audits (8.25).

15. Contingency and variation procedures

• If changes occur to the Key Industry Partner, fellowship duration or project alignment, submit a Variation of Grant Agreement through RMS with supporting rationale as required (8.12). Do not assume informal agreement with partners suffices; follow formal variation processes to remain compliant.

Following these steps aligns institutional practice with the guidelines’ duties, reduces the risk of pre-award refusal or post-award audit problems, and positions Administering Organisations to meet the ARC’s monitoring and reporting expectations.
