sec.138 Effect of amalgamation on commission decisions
If the commission fixes an amalgamation day, from that day— a commission decision that bound a proposed deregistering organisation and its members immediately before that day binds the amalgamated organisation and its members; and a reference in a commission decision to a deregistered organisation is taken to include a reference to the amalgamated organisation. A reference to an organisation’s obligation to a deregistered organisation is taken to include the amalgamated organisation.
- (a) a commission decision that bound a proposed deregistering organisation and its members immediately before that day binds the amalgamated organisation and its members; and
- (b) a reference in a commission decision to a deregistered organisation is taken to include a reference to the amalgamated organisation. Example for paragraph (b) — A reference to an organisation’s obligation to a deregistered organisation is taken to include the amalgamated organisation.
