sec.123 Referral to commission
The registrar may refer the application to the commission only if satisfied— there are reasonable grounds to inquire whether there has been an irregularity in the ballot that may have affected, or may affect, the ballot result; and the circumstances justify an inquiry. In deciding whether to refer, the registrar may consider other appropriate information the registrar knows about. If the registrar refers the application, the commission must— fix a time and place for the inquiry; and give directions to ensure the persons who must be given an opportunity to be heard under section 894 of the Act are given notice of the time and place.
