Industrial Relations (General) Regulations 1997

The regulations work by translating statutory terms in the Industrial Relations Act 1979 into administrable rules. The main concepts that the regulations fix are: employment record keeping; the prescribed salary threshold for unfair dismissal and contractual benefit claims; the non‑national system employer list; fee schedules and waiver powers; bargaining initiation and response procedures; and definitional prescriptions cross‑referenced to other statutes.

Employment records. Regulation 4 operationalises section 49D(3) of the Act by specifying acceptable recording media and formats: entries must be in English and may be kept in a bound or loose‑leaf book with one employee per page (reg 4(1)(a)(i)-(b)), or may be stored by mechanical, electronic or other devices provided the recorded particulars remain in their original recorded form and can be reproduced in written English (reg 4(1)(a)(ii)). The regulation also requires that pay‑period entries be identifiable and that records be kept in a way that enables compliance with s 49D to be readily ascertained (reg 4(1)(c)-(d)). Any alteration to an employment record must be annotated to identify nature, author and date of alteration (reg 4(2)). Those are the precise technical benchmarks for compliance with the statutory record‑keeping obligation.

Prescribed amount for unfair dismissal/contractual benefit claims. Regulation 5 fixes the “specified salary” used in the definition of “prescribed amount” at $90,000 before indexation and sets out how contractual salary is to be calculated depending on the employee’s employment history in the prior 12 months (reg 5(1)-(2)). Regulation 6 prescribes an annual indexation mechanism using an indexation factor derived from published Australian Statistician average weekly earnings figures, and provides rounding rules when the indexed amount is not a multiple of $100 (reg 6).

National system employer exclusions. Regulation 7 declares each employer listed in Schedule 4 not to be a national system employer for the Fair Work Act, with the declaration to take effect from 1 January 2023 (reg 7(1)-(2)). Schedule 4 is divided into two parts: Division 1 contains an extensive list of local governments; Division 2 contains a shorter list of regional councils.

Fees, waivers and fund appropriation. Regulation 9 directs that the fees in Schedule 1 apply before the Commission, and Schedule 2 before the Court. Regulation 9(2) lists common items for which no fee is payable (for example registration of officers, cancellation of certificates, filing notices of change of office, filing of a warrant to appear as an agent, and filing notices of discontinuance). Waiver power is vested in the Registrar or Deputy Registrar for Schedule 1 fees, and in the Clerk (with limited Presiding Judge authorisation) for certain Schedule 2 fees (reg 10). All fees received are to be credited to the Consolidated Fund (reg 11).

Bargaining notices and admissibility. The regulations prescribe the forms for a notice initiating bargaining (GFB 1) and the response (GFB 2) and require the notice to be accompanied by all particulars in the form (regs 12-13; Schedule 3). A practical admissibility rule requires a copy of the notice or response to be filed with the Registrar at least seven days before any Commission proceeding or conference if the document is to be admitted, with a narrowly drawn exception for applications under s 42A(2) (reg 14).

Cross‑referential definitions. The regulations prescribe the Police Force as a public sector entity for s 26(2B) (reg 15), list federal counterpart organisations for specified unions (reg 16), prescribe other states’ industrial statutes to be treated as industrial law for s 49G(1)(c) (reg 17), and identify a list of Commonwealth, State and Territory statutes to be treated as work health and safety laws for s 49G(1)(b) (reg 18).

These concepts convert statutory signals into administrative inputs that govern documentation, jurisdiction, monetary thresholds and inter‑jurisdictional recognition. The instrument relies on external statistical series for indexation, delegated administrative discretion for fee waivers and Registrar/Clerk actions for day‑to‑day implementation.

The regulations affect a set of identifiable actors by imposing procedural requirements, imposing monetary thresholds, defining jurisdictional coverage, and allocating administrative powers.

Employers. All employers subject to the Industrial Relations Act are affected by the employment record provisions (reg 4). The rules specify the required language, format and auditability of employment records and the annotation required for any alterations. Employers listed in Schedule 4 are affected distinctively because they are declared not to be national system employers (reg 7). That declaration changes which industrial regime governs those employers by reference to the Fair Work Act, as the regulations operate “for the purposes of section 80A(2)” of the Act.

Employees. The prescribed amount and indexation rules (regs 5-6) apply to calculations relevant to unfair dismissal and contractual benefit claims. That affects employees whose salary falls within the prescribed thresholds. The regulations set the mechanics for determining the contractual salary to be used in assessing whether the prescribed amount threshold is met (reg 5(2)), potentially influencing an employee’s eligibility to pursue certain claims under the Act.

Organisations and unions. Schedule 3 forms and the bargaining provisions (regs 12-14) affect employers’ organisations, employer associations and employee organisations engaged in enterprise bargaining. Regulation 16 prescribes particular federal organisations as “federal counterparts” to named state organisations; this affects how inter‑jurisdictional relationships and industrial counterpart recognition are treated under s 49G(1)(b).

Registrars, Clerks and the Commission/Court staff. The regulation confers administrative roles and discretions upon the Registrar, Deputy Registrar and the Clerk , for example, to set payment means (reg 9(3)), to waive certain fees (reg 10), and to receive filings. Fees taken by the Registrar and Clerk are specified in Schedules 1 and 2 and are to be credited to the Consolidated Fund (regs 9-11; Schedules 1-2). The admissibility rule for bargaining notices sets a Registrar filing requirement for Commission proceedings (reg 14).

Local government bodies and regional councils. The comprehensive list in Schedule 4 specifically identifies a large number of local government entities and several regional councils which the regulation explicitly declares not to be national system employers (reg 7 and Schedule 4). For those listed bodies the jurisdictional consequence is that the national Fair Work Act does not treat them as national system employers for the specified purposes.

Legal practitioners, accountants and HR professionals. Those advising employers and employees will need to interpret and apply the record keeping rules (reg 4), compute indexation and prescribed amount thresholds (regs 5-6), ensure compliance with filing and admissibility rules for bargaining notices (regs 12-14), and advise on fee liabilities and possible waivers (regs 9-11; Schedules 1-2).

Policing and public sector policymakers. Regulation 15 prescribes the Police Force (as defined in the Police Act 1892) as a public sector entity for the purposes of section 26(2B); that affects how the Police Force is treated within the definitions and administrative schemes in the Act.

Users of the Commission and Court documents. Schedules 1 and 2 specify fees for searches, copies, filing, sealing orders, issuance and execution of warrants, and authenticated documents. Parties to proceedings who require transcripts, certified copies, or searches will face small monetary costs, and the waiver powers in reg 10 are available in limited circumstances.

Statutory interaction. The regulations interact with external statutory material such as the Australian Statistician’s published average weekly earnings figures (reg 6), and identify other state and Commonwealth statutes as relevant “industrial laws” and “work health and safety laws” (regs 17-18). Parties operating across jurisdictions need to account for those cross‑references when assessing applicable standards.

In short, the regulations affect any actor who must keep employment records under s 49D, any party facing thresholds under s 29AA, any organisation participating in bargaining under s 42, those using Commission or Court processes that attract Schedule 1 or 2 fees, and those whose employer is listed in Schedule 4 for national system coverage considerations.

The regulations create a set of specific duties and confer limited administrative rights or discretions. Below are the principal obligations and the administrative entitlements.

Employer duties on record keeping (reg 4). Employers must ensure employment records are kept in the English language, either by entries in a bound or loose‑leaf book with only one employee’s records on any one page (reg 4(1)(a)(i)-(b)) or by recording/storing particulars by mechanical, electronic or other devices provided the particulars remain in their original recorded form and can be reproduced in written English (reg 4(1)(a)(ii)). Employers must ensure each pay period record for each employee is identifiable (reg 4(1)(c)), and keep records in a manner that enables compliance with s 49D of the Act to be readily ascertained (reg 4(1)(d)). Employers must not alter records unless the alteration is annotated to identify the nature of the alteration, the person making it and the date (reg 4(2)). These are enforceable duties in the form specified by the regulation.

Duties related to notices initiating bargaining (regs 12-14; Schedule 3). A party giving notice under s 42(1) must use the form GFB 1 if it chooses to use the prescribed form and must include all particulars set out in that form (reg 12). The recipient may respond using GFB 2 (reg 13). For a notice or response to be admissible in any proceeding or conference before the Commission, a copy must be filed with the Registrar at least seven days before the proceeding or conference (reg 14(1)); there is a narrow exception for applications under s 42A(2) (reg 14(2)). The GFB 1 form, which is part of the regulations, contains an information block advising recipients they should notify the initiating party within 21 days if they wish to enter negotiations, and a note that postal service is deemed received two working days after posting. The regulation thus sets procedural duties about content, timing and filing.

Fee obligations and fee waiver rights (regs 9-11; Schedules 1-2). Parties before the Commission or Court are obliged to pay the fees specified in Schedules 1 and 2 for the matters to which those items relate (reg 9(1)). Certain routine items attract no fee (reg 9(2)). The Registrar or a Deputy Registrar may waive Schedule 1 fees when considered reasonable (reg 10(1)). The Clerk may waive Schedule 2 item 9 when considered reasonable and may waive Schedule 2 item 10 when permission has been given by the Presiding Judge (reg 10(2)-(3)). All fees received must be credited to the Consolidated Fund (reg 11).

Indexation and monetary entitlements (regs 5-6). Regulation 5 prescribes the “specified salary” used in the definition of “prescribed amount” as $90,000, subject to indexation under reg 6 (reg 5(1)). Regulation 5(2) prescribes methods for calculating the salary provided for in an employee’s contract for the purposes of the prescribed amount definition, with separate calculations depending on continuous employment and leave without full pay. Regulation 6 prescribes the base and current weekly earnings measures that the Australian Statistician publishes, fixes indexation days and the indexation factor formula, provides for replacement of the indexable amount when the indexation factor exceeds 1, and gives rounding rules (reg 6(1)-(5)). Those provisions impose duties on administrators to apply external statistical figures and follow the conversion and rounding rules when determining indexed monetary thresholds.

Administrative prescriptions and definitional rights (regs 15-18). The regulations give rise to definitional effects that operate as rights of recognition or exclusion. For example, reg 15 prescribes the Police Force as a public sector entity for s 26(2B). Regulation 16 identifies federal counterpart organisations for specific state organisations. Regulations 17 and 18 treat certain state statutes and WHS statutes as “industrial laws” and “work health and safety laws” for s 49G(1) respectively. These are not discretionary; they are declaratory rules that fix how those terms operate in the Act’s cross‑references.

Admissibility constraint (reg 14(1)). A procedural right of the Commission to exclude a notice or response from evidence unless filing requirements are met is set out in reg 14(1). That places a duty on parties to ensure timely filing.

Rights to payment method determination (reg 9(3)). The Registrar and the Clerk may determine means of payment in addition to cash. That confers an administrative power to facilitate payments by other methods, which is an operational entitlement to alter payment mechanics.

Overall, the regulations transform statutory obligations into concrete duties such as how to keep and alter records, how to calculate prescribed amounts, what information a bargaining notice must contain and when it must be filed, what fees are payable and in what circumstances they may be waived, and which bodies and statutes are to be treated as belonging to defined categories in the Act. Rights are mostly administrative: waiver powers and payment method determinations reside with registrars, the Clerk and the Presiding Judge in narrow circumstances.

The regulations themselves primarily set administrative obligations and procedural admissibility rules rather than prescribing new criminal penalties. The enforcement architecture in the regulations operates by way of administrative compliance, filing requirements and fee regimes, with the Commission, Registrar and Court officers as enforcement touchpoints.

Enforceable obligations. The most direct enforcement‑oriented obligations are the employment record keeping rules (reg 4). While the regulations require how records must be kept and how alterations must be annotated (reg 4(1)-(2)), they do not by themselves create a specific monetary penalty within the text provided. Compliance with these requirements is framed as necessary to enable compliance with section 49D of the Act; any statutory enforcement or penalty would arise from the Act or other statutory provisions, not from these regulations alone. Practitioners should therefore treat the regulations as setting the compliance standard that will be used in enforcement processes which the Act authorises.

Admissibility as a quasi‑enforcement tool (reg 14). Regulation 14(1) has an exclusionary enforcement effect: a notice given under s 42(1) or a response under s 42A(1) will not be admissible in any proceeding or conference before the Commission unless a copy has been filed in the Registrar’s office at least seven days before the proceeding or conference. That is an exclusionary rule that directly affects procedural rights in Commission processes and functions as an enforcement lever to incentivise timely filing. The regulation creates an enforceable procedural consequence for non‑compliance with the filing requirement.

Fee obligations and appropriation (regs 9-11; Schedules 1-2). Failure to pay applicable fees is a practical enforcement point; the regulations specify which fees are chargeable and in which contexts (reg 9(1); Schedules 1 and 2). The Clerk and Registrar retain discretion to waive certain fees (reg 10), but otherwise fees are payable and must be credited to the Consolidated Fund (reg 11). Non‑payment would have practical consequences for filing and procedural progress before the Commission or Court.

Administrative discretion and internal checks. The regulations vest discretion in administrative officers. For Schedule 1 fees the Registrar or a Deputy Registrar may waive a fee when considered reasonable (reg 10(1)). For Schedule 2 the Clerk can waive item 9 in the Clerk’s discretion and item 10 only with Presiding Judge permission (reg 10(2)-(3)). Those delegated powers allow administrative mitigation of cost burdens and are internal controls for procedural fairness; they are also a potential channel through which inconsistent outcomes could arise if not exercised transparently.

Cross‑statutory enforcement. The regulations declare certain employers not to be national system employers (reg 7). That declaration changes which statutory enforcement framework applies to those employers. The regulations themselves do not set out the enforcement regimes of the Act or the Fair Work Act; they effect a jurisdictional determination that will determine the substantive enforcement regime relevant to those employers.

Absence of new criminal penalties in the instrument. The regulations do not themselves list criminal penalties, infringement notices or specified fines. Enforcement consequences stem from: adherence to procedural rules (for example the admissibility rule in reg 14); compliance with duties that feed into enforcement under the principal Act (for example reg 4 enabling compliance with s 49D); and payment or waiver of fees as administered by the Registrar and the Clerk.

Practical enforcement risks and implementation considerations. Because the regulations define technical standards (for example what constitutes proper employment records), they reduce ambiguity for enforcement processes by providing a yardstick for administrators and tribunals. At the same time, the degree of administrative discretion in fee waivers and payment method determination creates implementation risk that outcomes will vary depending on Registrar/Clerk practice. Lawyers and compliance professionals should therefore document compliance with the technical requirements in reg 4 and the filing timelines in reg 14 to avoid procedural exclusion, and should be prepared to seek waiver where fees would otherwise impede access to processes.

The regulations are tightly cross‑referenced to the Industrial Relations Act 1979 and to other Commonwealth and State statutes. The instrument both implements and clarifies how certain statutory terms and thresholds operate in practice, and it prescribes specific cross‑jurisdictional recognitions which affect coverage and procedural interaction with other legal regimes.

Interaction with the Industrial Relations Act 1979. The regulations expressly operate for the purposes of particular sections of the Act. For example, reg 4 is made for the purposes of Act s 49D(3). Regulation 5 is made for the purposes of the definition of “prescribed amount” in s 29AA(5) of the Act. Regulation 7 explicitly operates for the purposes of s 80A(2), declaring certain employers not to be national system employers. Regulations 12-14 implement parts of the Act dealing with bargaining (s 42 and s 42A). Regulation 15 prescribes an entity for the purposes of the definition of “public sector entity” in s 26(2B). Regulations 16-18 implement parts of the Act dealing with federal counterparts, industrial laws and work health and safety law references in s 49G(1). In each case the regulation provides the technical or declaratory content that gives effect to statutory terms.

Interaction with the Fair Work Act (Commonwealth). Regulation 7 declares certain employers not to be national system employers for the purposes of the Fair Work Act. The regulation does not itself restate the Fair Work Act’s coverage rules; it invokes the machinery in s 80A(2) of the Act to make a jurisdictional determination. The immediate legal effect is to keep the listed employers within the State industrial relations framework rather than the national framework. Practitioners should therefore consider both the Act and the Fair Work Act when dealing with entities near or on the boundary of national system coverage.

Interaction with administrative statistical series. Regulation 6 uses Australian Statistician published average total weekly earnings figures (seasonally adjusted) as the basis for indexation. That fixes the indexation mechanism to an external data source; changes in that published data will mechanically change the indexed “prescribed amount” without further legislative action.

Interaction with other States’ industrial legislation and WHS regimes. Regulations 17 and 18 explicitly list foreign State and Territory statutes to be treated as “industrial law” and “work health and safety law” respectively for the purposes of s 49G(1). That means the Act and its regulations will treat these identified statutes as relevant referents when construing cross‑jurisdictional questions. Regulation 16 also prescribes specified federal organisations as federal counterparts for named organisations. These cross‑references matter for multi‑jurisdictional organisations, unions and employers, because they affect how counterpart recognition, transferability and mutual recognition provisions operate.

Interaction with Police Act 1892. Regulation 15 prescribes the Police Force within the meaning of the Police Act 1892 as a public sector entity for s 26(2B) of the Industrial Relations Act. That links definitions across two state statutes and thereby affects how public sector entity provisions in the Industrial Relations Act apply to police.

Interaction with Commission and Court procedures. The regulations affect Commission and Court practice directly. For example the admissibility rule in reg 14 requires Registrar filing seven days prior to a Commission proceeding for the notice or response to be admitted. Schedules 1 and 2 specify fees for Commission searches, photocopies, filings and Court documents. The Registrar and Clerk are empowered to set payment methods (reg 9(3)) and to waive certain fees (reg 10). Those procedural and financial rules interface with the Commission’s and Court’s operational rules.

Overall, the regulations act as an interface layer between the Industrial Relations Act and other substantive regimes, including Commonwealth workplace law, state industrial statutes, WHS statutes and administrative procedures. They import external statistical data, prescribe cross‑jurisdictional recognitions and fix detailed administrative mechanics that determine which regime applies to a given employer and how statutory entitlements and processes are operationalised.

The regulation includes a detailed compilation table and numerous in‑text amendment annotations indicating that the instrument has been amended repeatedly since its original 1997 enactment. The following timeline extracts the key entries and indicates the nature and timing of material changes recorded in the instrument.

• Original regulations: Industrial Relations (General) Regulations 1997, published 30 September 1997, commencement 17 October 1997 (see r 2 and Gazette references). This established the base instrument.

• 2002 amendments: Industrial Relations (General) Amendment Regulations 2002 (Gazette 26 July 2002 p. 3459-64), commencement 1 August 2002. These amendments inserted Part 3 containing the unfair dismissal and contractual benefit claims provisions (regs 5-6), as indicated by the in‑text note that Part 3 was inserted on 26 July 2002.

• 2004 amendments: Industrial Relations (General) Amendment Regulations 2004 (Gazette 29 June 2004 p. 2516-20), commencement 29 June 2004. These amendments introduced Part 6 on bargaining for industrial agreements and Schedule 3 with forms GFB 1 and GFB 2 (see regs 12-14 and Schedule 3 notes).

• 2009: Industrial Relations (General) Amendment Regulations 2009 (Gazette 31 July 2009 p. 3026), operative from 31 July/1 August 2009 for relevant parts. Details in the compilation table indicate further updates.

• 2014 amendments: Gazette 27 June 2014 p. 2332; commencement 1 July 2014. These amendments inserted reg 15 prescribing the Police Force as a public sector entity (see reg 15 inserted note).

• 2022 consequential and amendment regulations: Industrial Relations Regulations (Consequential Amendments) Regulations 2022 Pt. 3 (SL 2022/100), published 17 June 2022 with commencement 20 June 2022; and Industrial Relations (General) Amendment Regulations 2022 (SL 2022/196), published 18 November 2022 with most regulations commencing 1 January 2023. In‑text notes show multiple insertions were made at SL 2022/100, including regulation 3 (definition of Clerk) inserted by SL 2022/100 r 50 and Part 4 (employers declared not to be national system employers) inserted by SL 2022/100 r 52. Schedule 4 listing local governments was inserted by SL 2022/100 r 55.

• 2024 amendment: SL 2024/31, published 7 March 2024, with regulations other than r 1 and r 2 commencing 8 March 2024. That instrument amended Division 2 of Schedule 4 (Regional local government employers) as noted: “Division 2 inserted: SL 2022/100 r. 55; amended: SL 2024/31 r. 4.”

• 2025 amendments: Industrial Relations Regulations Amendment Regulations (No. 2) 2025 Pt. 3 (SL 2025/12), published 22 January 2025, commencement 23 January 2025. In‑text notes indicate multiple insertions: regulation 16 (federal organisations prescribed to be federal counterpart) inserted by SL 2025/12 r 12; regulation 17 (state laws prescribed to be industrial laws) and regulation 18 (Commonwealth, State and Territory laws prescribed to be work health and safety laws) were also inserted by SL 2025/12 r 12. The compilation table records that regulation 8 was deleted at SL 2025/12 r 11.

In‑text amendment notes. The body of the regulation includes many inline notes recording precisely which regulation or schedule was inserted or amended and the Gazette or SL source. Examples: “Regulation 3 inserted: SL 2022/100 r. 50.”, “Regulation 4 amended: Gazette 26 Jul 2002 p. 3460.”, “Regulation 5 inserted: Gazette 26 Jul 2002 p. 3460‑1.”, and “Regulation 16 inserted: SL 2025/12 r. 12.”

Substantive changes over time. Key substantive insertions include the employment records rule (reg 4) inserted as part of the 2022 amendments, the Part 3 prescribed amount and indexation rules inserted in 2002, the bargaining forms and admissibility rules inserted in 2004, and the declaration excluding numerous local governments from national system coverage inserted in 2022. The 2024 and 2025 amendments refined Schedule 4 and added cross‑jurisdictional prescriptions respectively.

Practical implication of amendment timings. The compilation table is explicit about commencement dates. For example, the 2022 SL 2022/196 states that regulations other than r 1 and 2 commenced 1 January 2023; practitioners must track those commencement dates when advising about coverage or compliance. The instrument’s in‑text amendment annotations and the compilation table jointly document the chronological record necessary for historical compliance analysis.

Overall, the instrument is a living administrative instrument which has been updated periodically to address record keeping, bargaining process, jurisdictional exclusions and cross‑statutory recognitions. The compilation table and inline notes provide the primary source record of amendment events.

The regulation text compiled here does not include any reported judicial or tribunal decisions. The document itself contains no case citations and does not record any litigation that interprets or applies specific regulations. The schedules, forms and in‑text amendment notes are administrative in nature and the instrument’s compilation table records legislative amendment events rather than adjudicative outcomes.

Implications for practitioners. Because the compilation contains no litigation history, practitioners should not assume that the technical provisions such as reg 4 (employment records), regs 5-6 (prescribed amount and indexation), reg 14 (filing/admissibility), or the Schedule 4 declaration have been judicially considered in reported decisions merely because they are now part of the regulatory framework. The absence of cases in the text means that interpretative disputes about any ambiguous provision would need to be resolved by reference to the primary text of the regulations and the Act, and by consulting any Commission or Court decisions external to this compilation.

Places to look for interpretative authority. The regulations are expressly framed to give effect to particular sections of the Industrial Relations Act (for example s 49D, s 29AA, s 42, s 80A and s 49G). In practice, interpretative authority and litigation history relevant to these regulations may appear in:

• Decisions of the Western Australian Industrial Relations Commission and the Industrial Magistrates Court or Industrial Relations Court where the Commission/Court has had to assess whether a party complied with reg 4 record keeping standards or whether a bargaining notice complies with regs 12-14.
• Any rulings about whether an employer listed in Schedule 4 is properly excluded from national system coverage, and the consequences of that exclusion for jurisdictional disputes.
• Decisions interpreting how to apply the indexation factor in reg 6 where the underlying Australian Statistician figures or their timing raise questions.

Because none of those decisions are printed or cited in the regulation instrument itself, this document does not provide an internal litigation history. Advisers should therefore supplement this compilation with searches of Commission and Court decisions, and of any tribunal determinations or practitioner‑level guidance issued by the Registrar or Clerk, to identify how the technical rules have been applied.

Practical note on evidentiary and procedural rulings. The admissibility rule in reg 14(1) is a procedural rule that Commission registries are likely to enforce. Decisions about admissibility arising from late filing or improper particulars for GFB 1/GFB 2 may be recorded in Commission determinations even if absent from this text. Similarly, the exercise of waiver powers under reg 10 could be the subject of administrative review or judicial consideration where waiver decisions are litigated.

Summary. This regulatory compilation contains no litigation history. Its interpretative significance will be revealed in external Commission and Court decisions, which practitioners should consult to understand how the technical requirements have been enforced and litigated in practice.

The regulations are short and technical, but they contain multiple detail‑heavy rules that create traps for unwary practitioners and employers. Below are specific practical pitfalls and points where compliance often goes wrong.

Employment record format and language. Regulation 4 requires employment records to be kept in the English language (reg 4(1)(a)(i)). Employers who maintain records in other languages or who rely on untranscribed notes risk non‑compliance. If electronic systems store data in multiple language fields, ensure that the particulars required by the Act can be reproduced in written English (reg 4(1)(a)(ii)).

One employee per page and pay period identifiability. The regulation requires that only one employee’s records appear on any one page when a bound or loose‑leaf book is used (reg 4(1)(b)). Employers who keep multi‑employee spreadsheets or binder pages with multiple entries per page must ensure that the required “one employee per page” rule is observed or that the electronic alternative meets the equivalent standard by making each pay period per employee identifiable (reg 4(1)(c)).

Electronic original form and reproducibility. The regulations permit mechanical, electronic or other devices to store records only if the particulars remain in the form in which they were originally recorded and are capable of being reproduced in written English (reg 4(1)(a)(ii)). This creates two technical requirements: preserve the original electronic record integrity and maintain an auditable method to reproduce it in written English. Converting or exporting data in ways that lose metadata or original formatting may breach the “original form” requirement.

Alteration annotation requirements. Any alteration to employment records must be annotated to identify the nature of the alteration, the person making it and the date (reg 4(2)). Casual handwritten annotations without author identification or undated corrections can be treated as improper. Automated systems that overwrite data without a visible audit trail do not satisfy reg 4(2).

Missing mathematical formulae in reproduced texts. Regulation 5(2)(b)-(c) and regulation 6 contain mathematical formulas in the original regulation. In some reproductions of the instrument the formulae appear as images or are not fully captured. When advising on prescribed amount calculations, do not rely on a truncated or incomplete reproduction; consult the official published regulation to ensure the formula is applied precisely (the text contains formula placeholders in the copy you have).

Admissibility trap for bargaining notices. Regulation 14(1) creates a hard procedural rule: a notice under s 42(1) or a response under s 42A(1) is not admissible in a Commission proceeding or conference unless a copy has been filed with the Registrar at least seven days before the proceeding or conference. Filing late can therefore exclude the notice from evidence or argument. The only exception is for applications under s 42A(2) (reg 14(2)), so counsel and parties should file early to avoid exclusion.

GFB 1 particulars are mandatory. Regulation 12 requires that a notice given under s 42(1) may be given in the form of GFB 1 and “must be accompanied by all of the particulars set out in that form” (reg 12(b)). Omitting area, types of employment, or intended parties can render the notice defective for procedural purposes.

Timing for responses stated in form text. The GFB 1 information section advises that recipients should notify the initiating party within 21 days if they wish to enter negotiations, and notes that documents served by post are deemed received two working days after posting. While that 21‑day guidance is in the form, practitioners should not treat it as discretionary; it is the procedure provided to recipients to guard against later procedural disputes.

Rounded indexation outcomes. Regulation 6(4)-(5) provide rounding rules where an indexed amount is not $100 or a multiple of $100. If the indexation calculation results in $50 or a multiple of $50, it is rounded up to the next $100 (reg 6(5)(b)); other non‑multiples of $50 are rounded to the nearest $100 (reg 6(5)(a)). These specific rounding rules can produce materially different thresholds around the $90,000 figure and should be applied precisely.

Fee waiver discretion and limited remedies. Although some fees are small, waivers are discretionary and limited: the Registrar or a Deputy Registrar may waive Schedule 1 fees when reasonable (reg 10(1)); the Clerk may waive Schedule 2 item 9 when reasonable and item 10 only with Presiding Judge permission (reg 10(2)-(3)). If a party is unable to pay, seeking waiver early and documenting financial hardship or the public interest is important because waivers are not automatic.

National system exclusion list breadth. Schedule 4 contains a long list of local governments. If advising an employer about national coverage, check Schedule 4 carefully; an employer’s inclusion there continues to exclude them from being treated as a national system employer for the purposes of the Fair Work Act under reg 7(1). Also note that Division 2 of Schedule 4 was amended in 2024; check the most recent version for accuracy.

Fees small but cumulative. Many fees in Schedules 1 and 2 are low (for example, $1 to $50 in many items). However, multiple filings, photocopies, transcript pages and searches can add up. Also, Schedule 1 item 1 charges $50 for referring an industrial matter under s 29(1)(c)-(k). Ensure clients understand cumulative administrative costs.

Registrar/Clerk determination of payment methods. Regulation 9(3) allows the Registrar and Clerk to determine additional means of payment. Do not assume electronic payment will be available; confirm with the registry practice directions.

Prescribed definitions cross‑jurisdictionally. Regulations 16-18 added 2025 explicitly prescribe counterparts and other statutes as relevant referents. Where an entity operates across states, verify these cross‑references; they may affect how industrial, WHS and federal counterpart issues are treated under s 49G(1).

In sum, the principal “gotchas” arise from inflexible filing/admissibility timing, precise format and annotation requirements for employment records, incomplete reproduction of formulae in some text versions, and the need to apply indexation and rounding rules exactly. Practitioners should adopt checklists and maintain documentary audit trails to meet the technical requirements in these regulations.

Below is a pragmatic compliance checklist mapped to the regulations, suitable for employers, in‑house counsel, HR departments and advisers. It focuses on operational steps that correspond directly to the regulatory text.

Employment record keeping (reg 4)

• Ensure all required employment particulars are recorded in English. If records are maintained in other languages, maintain an English reproduction capability that reproduces the particulars in written English (reg 4(1)(a)(ii)).
• Choose an acceptable medium: either a bound or loose‑leaf book kept specifically for employment records with only one employee’s records per page (reg 4(1)(a)(i)-(b)), or an electronic/mechanical system that preserves the particulars in their original recorded form and allows reproduction in English (reg 4(1)(a)(ii)).
• Configure recordkeeping so each pay period entry for each employee is readily identifiable (reg 4(1)(c)).
• Maintain records in a manner that allow compliance with s 49D of the Act to be readily ascertained (reg 4(1)(d)).
• Implement an alteration audit protocol: any amendment to a record must be annotated to show the nature of the alteration, the person making it and the date (reg 4(2)). Where electronic systems permit, preserve an auditable change history with these details.

Prescribed amount calculations and indexation (regs 5-6)

• Treat $90,000 as the specified salary for the purposes of the prescribed amount in reg 5(1), subject to indexation under reg 6.
• Use the prescribed computation methods in reg 5(2) to work out the salary provided for in an employee’s contract depending on whether the employee was continuously employed for 12 months, was on leave without pay, or was employed for less than 12 months immediately before dismissal or claim. Note that the regulation contains formulae; consult the official published regulation text for the exact mathematical expressions where they are shown as images or formulae in the authorised source (reg 5(2)(a)-(c)).
• Apply the indexation method in reg 6: base weekly earnings and current weekly earnings are to be taken from the last Australian Statistician estimate published before the base date and before the indexation day respectively (reg 6(2)). Apply the indexation factor formula in reg 6(2) and implement the rounding rules in reg 6(5) to arrive at the rounded indexed amount.

Bargaining notices and responses (regs 12-14; Schedule 3)

• If initiating bargaining under s 42(1), use the GFB 1 form in Schedule 3 or ensure your notice contains all particulars set out in that form (reg 12). The form requires types of employment covered, the area of operation and intended parties.
• If responding to a notice, consider using GFB 2 (reg 13). Note the GFB 1 information block advising that a response should ordinarily be given within 21 days of receiving the notice.
• File a copy of the notice or response in the office of the Registrar at least seven days before any Commission proceeding or conference at which the notice/response is to be relied upon, because otherwise it cannot be admitted (reg 14(1)). Plan filing timelines to avoid exclusion.
• If an initiating party seeks an enterprise order under the Act when other parties decline negotiations, be prepared for the Commission processes that will follow; ensure all administrative filing and notice steps are correctly documented.

Fees, waivers and payments (regs 9-11; Schedules 1-2)

• Check Schedules 1 and 2 for the fees relevant to your matter. Examples: Schedule 1 item 1 is $50 for referring an industrial matter under a swathe of s 29(1) subparagraphs; Schedule 2 itemised fees range from $1 to higher amounts depending on the service.
• Note items for which no fee is payable under reg 9(2) such as registration of officers, cancellation of certificates, notice of change of registered office, filing a warrant to appear as an agent, documents already chargeable under the Act or other law, and filing a notice of discontinuance (reg 9(2)(a)-(f)).
• If fee payment is a barrier, apply promptly for a waiver: the Registrar or Deputy Registrar may waive Schedule 1 fees when reasonable (reg 10(1)); the Clerk may waive Schedule 2 item 9 when reasonable (reg 10(2)); the Clerk may waive Schedule 2 item 10 only with the Presiding Judge’s permission (reg 10(3)). Provide evidence supporting the reasonableness of the waiver request.
• Confirm acceptable payment methods with the Registrar/Clerk because they may determine additional means of payment beyond cash (reg 9(3)).
• Ensure receipts or proof of payment are preserved because all fees are to be credited to the Consolidated Fund (reg 11).

Jurisdictional checks for employers (reg 7; Schedule 4)

• If advising a local government or regional council, check Schedule 4 for inclusion. If listed, the employer is declared not to be a national system employer for the purposes of the Fair Work Act, effective 1 January 2023 (reg 7(1)-(2)). That will affect which statutory regime applies to employment disputes.
• For employers operating across state boundaries, review regs 16-18 (added in 2025) that prescribe federal counterparts and identify which State and WHS laws are treated as industrial or WHS laws under s 49G(1). This affects cross‑jurisdictional counterpart recognition.

Administrative and evidentiary practice (reg 14)

• Institute a procedure for filing bargaining notices and responses with the Registrar’s office early. Place calendar reminders for the seven day filing requirement before any anticipated Commission proceeding.
• If relying on postal service, note the GFB 1 form’s advice that postal service is deemed received two working days after posting; consider registered post or electronic delivery methods where the Registrar accepts them.

Record retention and audit readiness

• Although these regulations do not specify a retention period, keep employment records in the required format and maintain alteration annotations for an appropriate period consistent with the Act and related obligations. Maintain an accessible index and produce records promptly when required by the Commission or enforcement officers.

Consult the authoritative published regulations

• Where formulae or images appear in reproductions of the instrument, ensure you consult the official published text for the exact mathematical formulae in reg 5(2) and reg 6(2). The compilation here shows placeholders for formula images; use the Government Printer or legislation.gov.au authoritative text for precise calculations.

Document evidence of compliance and waiver attempts

• Keep written records of steps taken to comply with reg 4, copies of all notices GFB 1/GFB 2, filings made with the Registrar, proof of fee payments or waiver applications, and correspondence with the Commission’s registry. Those materials will be crucial if procedural admissibility is contested.

By following these steps and embedding the technical requirements in HR, payroll and legal process workflows, employers and their advisers can substantially reduce the likelihood of procedural exclusion, evidentiary disputes and record‑keeping challenges created by these regulations.
