#### 90 Pharmaceutical Benefits Remuneration Tribunal (1) If the person who held office as Chairperson of the Pharmaceutical Benefits Remuneration Tribunal under the National Health Act 1953 immediately before the commencement is, at the commencement, appointed as a new Presidential Member, the person continues to hold that office of Chairperson, subject to subsection 99A(2) and section 99C of the National Health Act 1953, until the expiration of the term specified in the instrument of the person’s appointment as Chairperson. (2) If the person who held office as Chairperson of the Pharmaceutical Benefits Remuneration Tribunal under the National Health Act 1953 immediately before the commencement is not, at the commencement, appointed as a new Presidential Member, the person continues to hold that office of Chairperson, subject to section 99C of the National Health Act 1953, until the expiration of the term specified in the instrument of the person’s appointment as Chairperson. (3) Subject to the Remuneration Tribunal Act 1973, a person who holds office as the Chairperson of the Pharmaceutical Benefits Remuneration Tribunal under subsection (2) shall be paid: (a) such remuneration as is determined by the Remuneration Tribunal; and (b) such allowances as are prescribed. (4) Subsections 99A(2) and 99B(1) of the National Health Act 1953 do not apply in relation to a person who holds office as Chairperson of the Pharmaceutical Benefits Remuneration Tribunal under subsection (2).
