What it does
The Industrial Relations Commission Rules 2022 (NSW) are the procedural rules governing proceedings before the New South Wales Industrial Relations Commission. They replace the previous rules with effect from their publication on the NSW legislation website in 2022. The Rules operate under and must be read alongside the Industrial Relations Act 1996 (NSW), which confers the Commission's substantive jurisdiction and powers.
The Rules govern all stages of Commission proceedings: how proceedings commence, how they are conducted, dispute resolution processes, awards and enterprise agreements, appeals, specialist proceedings (civil penalties, WHS prosecutions, unfair contracts, small claims), and contempt. The 2024 amendments added significant new procedural material including mutual gains bargaining rules for enterprise agreement negotiations.
As procedural rules, these instruments do not themselves create substantive rights or obligations. Their function is to ensure proceedings before the Commission are conducted efficiently, fairly and consistently.
