#### 397 Nature of proceedings for offences 397 Nature of proceedings for offences > > (1) Proceedings for an offence against this Act or the regulations may be dealt with summarily before— > > > > > (a) the Local Court, or > > > > > (b) the Commission in Court Session. > > > (2) The maximum penalty that may be imposed in the proceedings by the Local Court is a monetary penalty of 100 penalty units or the maximum monetary penalty provided in relation to the offence, whichever is the lesser. > > > (3) The maximum penalty that may be imposed in the proceedings by the Commission in Court Session is the maximum penalty provided for the offence. > > **s 397:** Am 2001 No 121, Sch 2.126 \[4\]; 2007 No 94, Sch 2.
