#### 276 Commission to have regard to certain matters 276 Commission to have regard to certain matters > For the purposes of exercising the power under this Division to grant or refuse leave to a person who has been convicted of a serious offence to hold office in organisations, the Commission must have regard to— > > > (a) the nature of the serious offence, and > > > (b) the circumstances of, and the nature of the person’s involvement in, the commission of the serious offence, and > > > (c) the general character of the person, and > > > (d) the fitness of the person to be involved in the management of organisations, having regard to the conviction for the serious offence, and > > > (e) any other matter that, in the opinion of the Commission, is relevant. > > **s 276:** Am 2016 No 48, Sch 1 \[73\]; 2023 No 41, Sch 1.2\[68\].
