Industrial Hemp Act 2017

The Act’s core regulatory architecture is a licence model allocating decision‑making authority principally to the Chief Executive of the relevant department, but with a built‑in police gatekeeping role. Key definitional and structural concepts determine who is covered and what standards apply.

• Industrial hemp. Defined as hemp grown from certified hemp seed and with THC in leaves and flowering heads not exceeding 1 per cent (s 3). The requirement that plants be grown from certified hemp seed connects regulatory compliance to a seed certification regime to be set in regulation (s 3, certified hemp seed). There is an implicit two‑tier potency concept: seed certification is tied to a typical THC threshold of 0.5 per cent while the plant threshold is 1 per cent (s 3).

• Licence types. Two licence types are created: industrial hemp licences authorising commercial production, manufacturing use, food production, research and other specified purposes (s 8(1)); and special licences authorising handling of non‑industrial hemp for scientific purposes (s 8(2)). Applications must be in a form approved by the Chief Executive, include prescribed fees and information, and may require additional records (s 8(3)).

• Fit and proper person and associates. The Chief Executive must be satisfied that neither the applicant nor any associate has been found guilty of a drug‑related offence and that applicant and associates are fit and proper persons (s 10(1)). The Act contains a broad definition of ‘associate’ including persons with relevant financial interests, powers to influence, or holding relevant positions in the business, and identifies relatives, domestic partners and other positions that may be relevant (s 4; s 10(3)). The fit and proper inquiry may consider character, convictions, history of non‑compliance, ownership structure and financial circumstances (s 10(2)).

• Police role and criminal intelligence. Every application and renewal must be provided to the Commissioner of Police for inquiry and report (s 9(3); s 14(2)). The Commissioner must notify the Chief Executive within 60 days whether they support or oppose issuing or renewing the licence and provide reasons; if the Commissioner opposes, the Chief Executive must not issue or renew the licence (s 9(4)-(5); s 14(3)-(4)). Criminal intelligence may be classified by the Commissioner, restricting disclosure and allowing confidentiality in tribunal or court proceedings and permitting the Commissioner to prevent the Chief Executive from disclosing grounds beyond a public interest statement (s 5).

• Inspectors and enforcement. Inspectors may be appointed by the Chief Executive or may be police officers (s 3, definition of inspector; s 18). Inspectors can enter non‑residential premises, inspect vehicles/equipment, require documents, take samples to test THC concentration, and seize material where contraventions are suspected, where material is required for evidence, or where a licence is suspended or cancelled (s 19-20). Seized material must be dealt with according to prescribed regulations (s 20(2)).

• Register and confidentiality. The Chief Executive must keep an Industrial Hemp Register listing licence holders and cultivation/processing locations and such other information as regulations require (s 26(1)-(2)). Access is limited to prescribed persons and disclosure of personal information, location of specified premises and commercial‑in‑confidence information is prohibited except where authorised (s 26(3)-(6)). Breach of confidentiality carries a significant penalty (s 26(5)).

• Regulatory margin. The Act gives broad powers to make regulations about fees, testing, disposal, and confers discretion to the Minister or Chief Executive over matters the regulations may provide (s 30(1)-(2)). Delegation is permitted (s 27). The State regime is subject to Commonwealth law limits (s 7).

These concepts combine to create a licensing mechanism where entry, retention and operation in the hemp sector are subject to administrative approvals, policing input and confidentiality rules for law enforcement intelligence. The statutory text embeds specific compliance levers, seed certification, THC testing, recordkeeping, register obligations, inspection and seizure, and administrative discretion in the Chief Executive with a de facto veto in practice if the Commissioner of Police opposes a licence application or renewal (s 9(5); s 14(3)).

The Act affects multiple parties across the private and public sectors. Primary affected groups are prospective and existing hemp growers, processors and suppliers, the Chief Executive and departmental staff, police and inspectors, laboratories, seed certifiers and persons who may be associates of applicants or licence holders.

• Applicants and licence holders. Any person intending to possess, cultivate, process or supply hemp for commercial production, manufacture, food production or research must apply for an industrial hemp licence (s 8(1)). A person seeking to possess, cultivate, process or supply hemp that does not meet the industrial hemp definitions for research must apply for a special licence (s 8(2)). Applicants must supply prescribed information, pay fees and provide criminal history reports and consents for financial or confidential enquiries when required (s 8(3); s 9(2)). Licence holders are subject to licence conditions, recordkeeping obligations and must not use hemp beyond the purpose stated in the licence (s 12(6); s 25).

• Associates and relatives. The Act reaches persons whose financial interests, powers or positions allow significant influence over the business of the applicant or licence holder (s 4(1)). For the fit and proper assessment, the Chief Executive may examine the character and convictions of associates and relatives as part of determining suitability (s 10(2)(a)-(b); s 10(3)). This means that ownership structures, trustees, directors and family members can affect eligibility.

• Inspectors and police. Inspectors appointed by the Chief Executive and police officers act as inspectors under the Act (s 3, definition of inspector; s 18). South Australia Police have a statutory role in reviewing applications and renewals, and the Commissioner has powers to classify criminal intelligence with confidentiality protections (s 9(3)-(5); s 5). Police decisions to oppose issuing or renewing a licence are determinative under the Act (s 9(5); s 14(3)(c)).

• Chief Executive and Minister. The Chief Executive administers the licensing scheme, carries out investigations, issues and conditions licences, maintains the Industrial Hemp Register and appoints inspectors (s 8-16; s 18; s 26). The Minister and Chief Executive may delegate functions and may exercise discretions where the regulations provide (s 27; s 30(2)(c)). For special licences the Chief Executive must consult the Minister responsible for the Controlled Substances Act 1984 before determining (s 9(6)).

• Laboratories, seed certifiers and supply chain participants. The Act contemplates submission of samples to laboratories or approved places for THC testing (s 19(1)(e)). The statutory requirement to grow industrial hemp from certified hemp seed links compliance to a seed certification regime to be prescribed by regulation (s 3). Processors, packagers and distributors are affected by recordkeeping and supply definitions (s 3, definition of supply; s 12(6)(a)-(b)).

• Public authorities and prescribed persons. The Industrial Hemp Register restricts access to prescribed persons or classes authorised by the Chief Executive (s 26(3)). The Chief Executive may disclose register personal information to public authorities for law enforcement or proper administration of the Act (s 26(6)).

• Broader market and legal actors. The schedule amends the Controlled Substances Act 1984 to exempt conduct carried out in accordance with the Industrial Hemp Act from certain controlled‑substances offences (Schedule 1, Part 2), affecting how controlled‑substances law applies to regulated hemp operations. Commercial counterparties, financiers and acquirers are impacted by the non‑transferability of licences (s 12(7)), the fit and proper inquiry (s 10), and register confidentiality (s 26).

Who pays: applicants and licence holders bear the costs of fees (s 8(3)), prescribed renewal fees (s 13(3)(c)), providing criminal history reports and consents for enquiries (s 9(2)(b)-(c)), compliance costs including recordkeeping and testing (s 12(6); s 19(1)(d)-(e)), and potential costs associated with seizure disposal where the regulations provide for cost recovery (s 20(3)(b)). The Act permits regulations to prescribe fees, including recovery, reduction or waiver mechanisms (s 30(2)(a)).

In short, the Act affects applicants and licence holders directly, reaches into their ownership and associate networks, places operational reporting, testing and confidentiality obligations on them, and embeds policing inputs and administrative discretion in licensing decisions.

The Act imposes a set of statutory duties on applicants, licence holders and persons interacting with inspectors, while also granting specific procedural rights such as review by the Tribunal and protections for self‑incrimination. These duties and rights determine operational compliance and avenues for challenge.

Duties of applicants and licence holders

• Application duties. An applicant must apply in a form approved by the Chief Executive, pay the prescribed fee and provide any information or records required to determine the application (s 8(3)). The Chief Executive may require production of documents, consents for financial/confidential information, and a criminal history report from South Australia Police or the ACC (s 9(2)(a)-(c)). Failure to comply with a Chief Executive notice may lead to refusal to determine the application (s 9(2)).

• Fit and proper duty. Applicants and licence holders must satisfy the fit and proper person test: neither the applicant nor any associate may have been found guilty of a drug‑related offence and the applicant and associates must be fit and proper persons as required by s 10(1). The Chief Executive may consider character, convictions, history of non‑compliance, corporate structures and financial circumstances (s 10(2)).

• Compliance with licence purpose and conditions. Licence holders must not possess, cultivate or supply hemp other than for the purposes specified in the licence, and must comply with licence terms and conditions (s 25). Licences last up to five years unless shorter term is specified (s 12(1)), are subject to prescribed terms and conditions and may be varied, suspended or revoked by the Chief Executive (s 12(2)-(4)). The Chief Executive may impose conditions requiring recordkeeping and provision of information about seeds, changes in executive positions or other matters (s 12(6)).

• Renewal duties. Holders seeking renewal must apply in writing at least three months before expiry, provide information relevant to fit and proper status of themselves and associates, pay prescribed renewal fees and produce other information reasonably required (s 13(1)-(3)).

• Recordkeeping, assistance and testing obligations. Inspectors may require production of documents, make copies, remove documents temporarily, and take samples or specimens for testing to ascertain THC concentrations or compliance (s 19(1)(c)-(e)). Conditions of a licence may require keeping and providing records and documents to the Chief Executive (s 12(6)(a)-(b)).

Rights and procedural protections

• Right to written reasons and notification. The Chief Executive must notify applicants of decisions to grant or refuse licenses and provide reasons where the application is refused (s 11(2)). Likewise, refusals to renew must be accompanied by reasons (s 15(3)(b)). However, where police criminal intelligence underpins a decision, the Chief Executive is not required to provide reasons beyond a public interest statement (s 5(2)).

• Show cause and natural justice. Before suspension or cancellation, the Chief Executive must notify the licence holder that they may show cause within 30 days and must consider any submission (s 16(2)). This provides an opportunity to respond prior to adverse action.

• Tribunal review. A person may apply to the South Australian Civil and Administrative Tribunal for review of a Chief Executive decision under s 34 of the Tribunal Act (s 17(1)). Time limits apply: generally one month from the decision, with an extension where written reasons are required and obtained (s 17(2)-(3)).

• Protection against self‑incrimination. It is a reasonable excuse to refuse to provide information or take other steps required by the Act if doing so would tend to incriminate the person (s 29). This is stated as a defence, not a blanket immunity for corporations or for all circumstances.

• Immunity for officials. The Chief Executive, persons acting under direction and inspectors are immune from personal liability for acts or omissions done in good faith under the Act (s 28).

Limits and duties in relation to policing and confidentiality

• Commissioner of Police’s confidentiality role. Information classified by the Commissioner as criminal intelligence may be withheld except to limited recipients, and where the Commissioner relies on criminal intelligence to oppose an application the Chief Executive may decline to provide grounds other than that the decision was in the public interest (s 5(1)-(3)). The Commissioner may only delegate the classification function to a Deputy or Assistant Commissioner (s 5(4)).

• Register confidentiality duties. The Chief Executive must ensure access to the Industrial Hemp Register is restricted to prescribed persons and protect personal information, location data and commercial‑in‑confidence information from unauthorised disclosure; unauthorised disclosure carries a maximum penalty (s 26(3)-(5)). The Chief Executive and authorised persons may disclose register personal information to public authorities for law enforcement or proper administration purposes (s 26(6)).

Enforcement duties imposed on inspectors and police

• Inspectors must produce identification certificates on request (s 18(5)-(6)) and must follow any requirements prescribed by regulation when seizing documents or things (s 19(2)-(3)). An inspector’s exercise of powers is conditioned on producing the identification certificate on request (s 19(2)).

These duties and rights frame the operational exchange between licence holders and the regulator: applicants and licence holders carry documentary, disclosure and compliance burdens and obtain administrative rights of notice, show cause and tribunal review, while law enforcement retains confidential inputs and the Chief Executive retains significant licensing discretion.

The Act sets out criminal offences and civil‑style administrative enforcement mechanisms, combining monetary penalties, imprisonment for the most serious licensing breaches, seizure powers and regulatory disposal mechanisms. Enforcement is exercised by inspectors and informed by police input.

Statutory offences and maximum penalties

• False or misleading statements. A person must not provide information under the Act that is false or misleading or omit matters that render a statement false or misleading. Maximum penalty $5,000 (s 21).

• Failure to comply with a requirement. A person must not, without lawful excuse, refuse or fail to comply with a requirement made under the Act (s 22). Maximum penalty $15,000.

• Interference with inspectors. Obstructing, hindering, threatening or attempting to influence an inspector in the exercise of a power under the Act attracts a maximum penalty $15,000 (s 23).

• Impersonating an inspector. Maximum penalty $15,000 (s 24).

• Breach of licence conditions. A licence holder must not possess, cultivate or supply hemp otherwise than for the purposes for which the licence is granted and must comply with licence terms and conditions. Maximum penalty $15,000 or imprisonment for 12 months, or both (s 25).

• Register confidentiality breach. An authorised person who discloses protected information in the Industrial Hemp Register unlawfully is subject to a maximum penalty of $15,000 or imprisonment for 12 months, or both (s 26(5)).

Enforcement powers and administrative tools

• Inspectors’ search and seizure. Inspectors, including police officers acting as inspectors, may enter and inspect non‑residential premises believed on reasonable grounds to be used in contravention of the Act (s 19(1)(a)). They may intercept and inspect vehicles or equipment used for hemp activities, require production of documents and remove them temporarily to make copies, and take samples or specimens of soil, hemp or other plants for testing THC concentrations (s 19(1)(b)-(e)). Samples may be sent to a laboratory or place approved by the Chief Executive for testing (s 19(1)(e)). If an inspector seizes material under the Act, the seized material must be dealt with under the regulations (s 20(2)) and regulations may specify circumstances for destruction or other disposal and provide for recovery of costs incurred (s 20(3)).

• Suspension and cancellation. The Chief Executive may suspend or cancel licences where a holder requests it, contravenes the Act or licence conditions, is no longer a fit and proper person, the Commissioner requests suspension or cancellation on the basis of criminal intelligence, the licence holder ceases the activity, or prescribed circumstances exist (s 16(1)(a)-(f)). The Chief Executive must give a show‑cause notice at least 30 days before suspension or cancellation and consider submissions (s 16(2)).

• Non‑issuance on police opposition. If the Commissioner of Police notifies the Chief Executive that they oppose issuing or renewing a licence, the Chief Executive must not issue or renew it (s 9(5); s 14(3)(c)). This creates a decisive enforcement gate tied to law enforcement assessments.

Procedural protections in enforcement contexts

• Identification certificate. Inspectors (other than police) must be provided with an identification certificate and must produce it on request; inspectors must not exercise powers if they fail to produce the certificate when requested (s 18(5)-(6); s 19(2)).

• Regulations and procedural requirements. Seizure and handling of documents, samples and things must follow requirements prescribed in regulations (s 19(3); s 20(2)-(3)). The Governor may make regulations about fees, disposal and other procedural matters including delegation of discretionary matters to the Chief Executive or Minister (s 30(1)-(2)).

• Immunity for officials. The Chief Executive, persons acting under the Chief Executive’s direction, and inspectors have immunity from personal liability for good faith acts or omissions done in the exercise of powers under the Act (s 28). This affects potential civil claims against individual officials.

• Self‑incrimination. Natural persons may rely on protection against self‑incrimination as a reasonable excuse for not giving information or taking other required steps if doing so would tend to incriminate them (s 29). The protection is framed as an excuse rather than a full immunity.

Practical enforcement implications Enforcement under the Act combines criminal sanctions for non‑compliance with administrative controls (licence suspension/cancellation, seizure, disposal). The Act gives weight to police assessment by making police opposition determinative for licensing, and allows confidential use of criminal intelligence in decisions and proceedings (s 5). Regulatory detail around testing, disposal and cost recovery is left to regulations (s 19(1)(e); s 20(2)-(3); s 30), so on‑the‑ground enforcement practices will be shaped substantively by delegated instruments and the Chief Executive’s policies.

The Act is expressly framed to operate within the broader Commonwealth and State legal landscape. It both amends the Controlled Substances Act 1984 (SA) and is subject to the Commonwealth Narcotic Drugs Act 1967.

Commonwealth interaction and limits

• Primacy rule. Section 7 provides that a provision of this Act has no effect to the extent of any inconsistency with the Commonwealth Act and that the State Act is not to be taken to authorise anything that would result in operational inconsistency with the Narcotic Drugs Act 1967 (Cth) (s 7(1)). This means the Act’s operation is conditional on Commonwealth law and the state regulator must be alert to Commonwealth controls relevant to narcotics, including import/export, manufacture of controlled substances and scheduling regimes.

Controlled Substances Act amendment

• Schedule 1, Part 2 amends section 31 of the Controlled Substances Act 1984 to add explicit exceptions for activities undertaken in accordance with the Industrial Hemp Act 2017. The Schedule inserts paragraphs exempting cultivation, processing, possession, sale or supply of hemp by persons acting in accordance with the Industrial Hemp Act, and possession of industrial hemp cultivated or supplied pursuant to an Industrial Hemp Act licence (Schedule 1, Part 2, s 2(1)(a)-(ai); s 2(2)). It also imports the Industrial Hemp Act definition of industrial hemp into the Controlled Substances Act (Schedule 1, Part 2, s 2(2)). Practically, this narrows the application of state controlled‑substances offences so regulated hemp operations can lawfully proceed under the Industrial Hemp Act.

Administrative and criminal law interface

• Police functions and confidentiality. The Commissioner of Police’s role in investigating and reporting on licence applications is central (s 9(3)-(5); s 14(2)-(3)). Information classified as criminal intelligence for the purposes of the Act may only be disclosed to limited persons and can be used confidentially in Tribunal or court proceedings (s 5(1), (3)). The Commissioner may prevent disclosure of reasons in decisions where criminal intelligence underpins the police opposition (s 5(2)). This intersects with administrative law principles on procedural fairness and reasons for administrative decisions; the Act carves out a confidentiality exception where disclosure would prejudice law enforcement.

Tribunal and judicial review

• Review rights and evidence. The Act gives applicants and licence holders a right to Tribunal review under the South Australian Civil and Administrative Tribunal Act 2013 (s 17(1)). However, where the Commissioner relies on criminal intelligence, tribunals and courts must take steps to maintain confidentiality and may receive such evidence by affidavit from a senior police officer (s 5(3)). This modifies standard adversarial hearing practices in cases where classified intelligence is involved.

Privacy and information disclosure

• Register disclosure and public authorities. The Industrial Hemp Register requirement interacts with state privacy and law enforcement powers. The Chief Executive must protect register data but may disclose personal information to public authorities for law enforcement or where required by law (s 26(3)-(6)). These provisions intersect with obligations under the Privacy Act and other State information laws; however the Act gives explicit statutory bases and restrictions for register disclosures.

Regulatory delegation and other legislation

• Delegation and regulation. The Minister and Chief Executive may delegate powers under s 27, and the Governor may make regulations under s 30 with broad scope, including prescribing fees and permitting matters to be determined by the Minister or Chief Executive’s discretion (s 30(2)(a)-(c)). This means that the Act’s operational detail is likely to be substantially affected by subordinate legislation and administrative instruments, creating a regulatory matrix that will be applied alongside other State laws such as agricultural, biosecurity, food safety and occupational health legislation.

In short, the Industrial Hemp Act sits within a layered legal framework: it creates a state licensing and exemption regime while being effectively subordinate to Commonwealth narcotics law, amends the State Controlled Substances Act to carve out regulated hemp activity, and imposes confidentiality mechanisms that alter the form of administrative and tribunal review where criminal intelligence is involved.

The Act’s legislative history as provided in the source is concise and includes its assent and commencement dates, plus a related amendment to the Controlled Substances Act 1984.

• Passage and commencement. The Industrial Hemp Act 2017 (No 15 of 2017) received assent on 16 May 2017 and commenced on 12 November 2017 (Gazette 31.10.2017 p 4467) (Legislative history section). The Act came into operation by proclamation, as stated in s 2.

• Schedule amendment to Controlled Substances Act 1984. Schedule 1, Part 2 of the Industrial Hemp Act amends section 31 of the Controlled Substances Act 1984 (SA). The amendments insert new paragraphs (ah) and (ai) into section 31(1) to exempt cultivation, processing, possession, sale or supply of a plant, or the sale, supply or possession of a substance by a person acting in accordance with the Industrial Hemp Act 2017, and to exempt possession of industrial hemp cultivated or supplied under an Industrial Hemp Act licence (Schedule 1, Part 2, s 2(1)). Schedule 1 also inserts a definition of industrial hemp into section 31(3) of the Controlled Substances Act to align definitions (Schedule 1, Part 2, s 2(2)).

• Regulatory and subordinate instruments. The Act authorises the Governor to make regulations as necessary for the purposes of the Act (s 30). The text signals the expectation of delegated instruments setting thresholds, fees, seed certification procedures, sampling and testing protocols, disposal arrangements for seized material and other procedural matters (s 3, definitions; s 19(1)(e); s 20(2)-(3); s 30). The legislative history does not list the regulations themselves; practitioners must consult the consolidated legislation and subordinate instruments for implemented regulatory detail.

• No further amendments recorded in the source. The legislative history section provided in the Act text only records the principal Act (2017, No 15) with its assent and commencement dates and does not list subsequent amending Acts. Any subsequent amendments or regulatory instruments are not included in the provided source and must be checked in the official consolidated legislation repository.

In practice, the Act’s operation relies heavily on regulations to provide operational detail (s 30), and the Schedule’s amendment to the Controlled Substances Act is an integral structural change to avoid overlapping criminal liability where operations comply with the Industrial Hemp Act (Schedule 1, Part 2).

The source material contains no case names, reported decisions or litigation history related to the Act. The Act itself does establish statutory routes for administrative and judicial review that could generate litigation:

• Tribunal review. Section 17 gives persons a right to apply to the South Australian Civil and Administrative Tribunal for review of Chief Executive decisions under the South Australian Civil and Administrative Tribunal Act 2013 (s 17(1)). This is the primary statutory administrative review pathway for licensing decisions, refusals, renewals, suspensions and cancellations.

• Confidential evidence and criminal intelligence in proceedings. Where criminal intelligence is classified by the Commissioner of Police, the Tribunal or a court must, on application of the Commissioner, take steps to maintain confidentiality including receiving evidence and hearing argument in private and may take evidence by affidavit from a police officer of or above superintendent rank (s 5(3)). This will shape the evidentiary and procedural contours of any Tribunal or court matter involving police‑classified intelligence.

• Rights to reasons and timelines. The Act requires the Chief Executive to provide reasons when refusing applications or renewals (s 11(2)(b); s 15(3)(b)). Time limits for Tribunal challenges are generally one month from the decision, or from receipt of written reasons where those are sought within one month (s 17(2)-(3)). These procedural protections and timelines will be relevant to any judicial review or statutory review proceedings arising under the Act.

Because no cases are mentioned in the text, practitioners must check court and Tribunal databases for any post‑commencement decisions interpreting the Act, including issues such as the scope of fit and proper inquiries, the nature of chief executive discretions, the use and admissibility of criminal intelligence, or the lawfulness of seizures and disposals under regulations. The Act’s confidentiality provisions and the Commissioner’s control over criminal intelligence may also generate procedural litigation on access to reasons and material in administrative review contexts.

This section flags statutory features likely to generate practical pitfalls for applicants, licence holders and advisers. Each “gotcha” is anchored to a provision in the Act.

• Police veto on licences and renewals. The Commissioner of Police must be provided with every application and renewal (s 9(3); s 14(2)) and must notify the Chief Executive within 60 days whether they support or oppose (s 9(4)(c); s 14(3)(c)). If the Commissioner opposes, the Chief Executive must not issue or renew the licence (s 9(5); s 14(3)(4)). This gives police an effective veto power. Practitioners should not assume administrative discretion will override a police opposition.

• Criminal intelligence secrecy can restrict reasons. If the Commissioner relies on information classified as criminal intelligence, the Chief Executive is not required to provide reasons for refusing or cancelling a licence beyond saying the decision was in the public interest (s 5(2)). Confidential police information may also be heard in private and by affidavit (s 5(3)). This limits the transparency of adverse decisions based on law enforcement assessments.

• Broad concept of associate. The definition of associate in s 4 is wide: financial interests, relevant powers, relevant positions and any person in a position to exercise control may be treated as associates. For fit and proper inquiries the Chief Executive may examine associates and relatives (s 10(2)). This reaches into corporate structures and family relationships and can affect eligibility unexpectedly.

• Seed certification and two potency thresholds. Industrial hemp must be grown from certified hemp seed and have THC in leaves and flowering heads not more than 1 per cent (s 3). The separately defined certified hemp seed is seed certified as typically producing plants with THC not more than 0.5 per cent (s 3). Practically, growers must ensure they source certified seed under the regulations and also manage plant testing to meet the 1 per cent plant threshold. The dual thresholds create a compliance trap if seeds are uncertified or plant THC exceeds 1 per cent.

• Non‑transferability of licences. Licences are not transferable (s 12(7)). This has immediate consequences for business sales, corporate reorganisations and financing. Buyers cannot rely on licence transfers by operation; transactions must factor in the need to apply for new licences or restructure operations.

• Inspection powers focus on non‑residential premises. Inspectors may enter and inspect premises other than premises used as a residence if they reasonably believe hemp is being kept, cultivated or supplied contrary to the Act (s 19(1)(a)). Residential premises are excluded from this ground, but other provisions (e.g. vehicles) permit inspection; practitioners should note how the “premises” definition applies in practice (s 3, definition of premises).

• Seizure and disposal of material subject to regulations. Inspectors may seize material where contraventions are suspected or where a licence is suspended or cancelled (s 20(1)), but seized material must be dealt with according to the regulations (s 20(2)). Regulations may permit destruction and cost recovery from licence holders (s 20(3)). Licence holders should plan for potential loss and for regressive cost exposure.

• Record and disclosure obligations. Licence conditions may require keeping records, reporting seed sources and changes in executive positions or business structure (s 12(6)). The Industrial Hemp Register contains location data and is restricted, but authorised disclosures to public authorities for law enforcement are permitted (s 26(3)-(6)). Unauthorised disclosure attracts heavy penalties (s 26(5)).

• Time limits for Tribunal review. Review applications must generally be made within one month of the Chief Executive’s decision (s 17(2)), or from receipt of written reasons if those were requested (s 17(3)). Missing time limits can foreclose administrative review.

• Protection against self‑incrimination is limited. Section 29 provides that it is a reasonable excuse for a natural person to refuse to give identifying information that would tend to incriminate them. This is not an explicit immunity for corporations or universal exemption for all information.

• Commonwealth inconsistency. Section 7 makes the Act ineffective to the extent of inconsistency with the Commonwealth Narcotic Drugs Act 1967. Practitioners must assess whether proposed activities intersect with Commonwealth controls (for example export, import or manufacture of scheduled drugs) and not assume licensing under the State Act is sufficient for all activities.

These statutory features create areas of legal and operational vulnerability. Advisers should engage early with police, design shareholder and management structures to avoid associate issues, secure certified seed under the regulations, structure transactions to accommodate non‑transferability, and build compliance systems around recordkeeping, testing and inspection readiness.

Compliance under this Act requires operational, governance and information systems that respond to licensing, testing, recordkeeping, inspection, disclosure and renewal obligations. Below is a practical compliance checklist anchored to statutory requirements and the Act’s mechanisms.

Pre‑application due diligence

• Map ownership, control and associates. Identify all persons who could be treated as associates under s 4, including shareholders, directors, trustees, managers, family members and anyone with relevant powers. Since the fit and proper test examines associates and relatives (s 10(2)-(3)), restructure where necessary to avoid disqualifying associations.

• Criminal history checks. Obtain criminal history reports (National Police Certificate) for the applicant and relevant associates as required by s 9(2)(c). Where an applicant or an associate has a drug‑related conviction the licence must not be granted (s 10(1)(a)).

• Financial and corporate structuring. Prepare corporate documents, trust deeds and evidence of ownership structure with attention to s 10(2)(d) and (e) (satisfactory ownership structures and financial circumstances). Be prepared to give consents to enable the Chief Executive to obtain financial or other confidential information (s 9(2)(b)).

Application and supporting materials

• Use Chief Executive approved form and pay fees. Complete the application form required by s 8(3)(a), include the prescribed application fee and provide any other records requested by the Chief Executive.

• Provide seed sourcing and production plans. Since industrial hemp must be grown from certified hemp seed (s 3) and licences may require disclosure of seed sources (s 12(6)(b)(ii)), document where seed will be sourced, certification status and how seed will be handled.

• Present compliance systems. Include detailed operational procedures for cultivation, harvesting, drying, processing, recordkeeping and testing. Demonstrate capacity to measure and control THC concentrations to meet the 1 per cent threshold (s 3).

• Consents for checks. Provide the authorities and consents required by the Chief Executive to obtain financial or confidential information (s 9(2)(b)).

Engagement with police and Chief Executive

• Anticipate police engagement. The Chief Executive will forward applications to the Commissioner of Police (s 9(3)); the Commissioner has 60 days to report support or opposition (s 9(4)(c)). Early engagement with South Australia Police may reduce the risk of opposition and should be part of application strategy.

Licence conditions and operational compliance

• Implement recordkeeping systems. Licences may require recordkeeping and provision of records to the Chief Executive about activities and seed sources (s 12(6)(a)-(b)). Maintain contemporaneous harvest logs, seed traceability, processing details and supply records.

• Prepare for inspections and testing. Inspectors can inspect non‑residential premises, vehicles and equipment, require documents, and take samples for THC testing (s 19(1)(a)-(e)). Maintain chain of custody for samples, promptly comply with inspectors’ requests, and ensure samples can be provided to a Chief Executive approved laboratory (s 19(1)(e)).

• Identification and cooperation with inspectors. Inspectors (other than police) will have identification certificates and must produce them on request (s 18(5)-(6); s 19(2)). Ensure staff are trained to request and record inspection details and to cooperate without obstruction to avoid s 23 offences.

Handling adverse action and seizure

• Comply with show cause notices. If the Chief Executive proposes suspension or cancellation, respond to a show cause notice within the 30‑day period and provide any evidence to address alleged non‑compliance or fit and proper concerns (s 16(2)).

• Plan for seizure and disposal. If material is seized under s 20, the Act requires dealing with seized material under the regulations (s 20(2)). Prepare contingency plans for replacement crop, insurance and potential recovery of costs if regulations permit cost recovery for disposal (s 20(3)(b)).

Register obligations and confidentiality

• Ensure accuracy of register entries. The Chief Executive must maintain the Industrial Hemp Register and list licence holder names and cultivation locations (s 26(1)-(2)). Provide accurate information and notify the Chief Executive promptly of changes, especially changes in executive positions or business structure which licence conditions may require to be reported (s 12(6)(b)(iii)).

• Protect confidential information. Be mindful that access to the register is confined to prescribed persons and unauthorised disclosure attracts penalties (s 26(3)-(5)). Establish internal controls for handling register information.

Renewals, transfers and corporate transactions

• Renew in time. File renewal applications at least three months before expiry and provide updated information relevant to fit and proper status, pay renewal fees and include prescribed particulars (s 13(1)-(3)).

• Plan for non‑transferability. Licences are not transferrable (s 12(7)). If planning to sell or restructure the business, build transferability workarounds into transaction planning, such as conditionality on the buyer obtaining a new licence or transitional arrangements approved by the Chief Executive.

Legal and regulatory monitoring

• Monitor Commonwealth requirements. Because the Act is subject to Commonwealth law (s 7), monitor for any Commonwealth licensing, import/export or narcotics controls relevant to hemp products that may impose additional compliance requirements.

• Track regulations and guidelines. The Act relies on regulations for seed certification, sample handling, seizure disposal and fee setting (s 3; s 19(1)(e); s 20(2)-(3); s 30). Regularly review subordinate instruments and Chief Executive guidance to ensure compliance with technical requirements.

Dispute resolution and review

• Use available review rights promptly. If a licence is refused, not renewed or is suspended or cancelled, prepare Tribunal applications promptly within the one month statutory period (s 17(2)). If the Chief Executive’s reasons were not initially given, request written reasons within one month to preserve the review timeframe (s 17(3)).

• Consider confidentiality constraints. Where police classify information as criminal intelligence, be prepared for in‑camera hearings and evidence by affidavit rather than full disclosure (s 5(3)). Legal advice will be necessary where procedural fairness and access to reasons are constrained by law enforcement confidentiality.

In summary, compliance under the Industrial Hemp Act requires integrated governance, documentation, testing capabilities, proactive engagement with police and the regulator, and ongoing monitoring of regulations. Firms should document their compliance systems, control access to register data, plan for non‑transferability in transactions, and allow lead times for renewals and police reporting periods.
