46Interim Notification Scheme

#### 46 Interim Notification Scheme (1) Where: (a) before the commencement of this section, an importer or manufacturer of a new industrial chemical had notified the chemical under the scheme known as the Interim Notification Scheme; and (b) the chemical has been assessed under that scheme, whether before or after the commencement of this section; then: (c) for the purposes of section 39: (i) the applicant is to be taken to have complied with the requirements of this Act regarding the notification of the chemical; and (ii) the chemical is to be taken to have been assessed under this section; and (d) the Director must give the applicant an assessment certificate for the chemical. (2) The assessment certificate is not to contain any matter that was given in confidence for the purposes of the notification and assessment. (3) Where a person who notified a chemical under the scheme introduces the chemical before receiving the assessment certificate for it, the person does not commit an offence under subsection 21(1) because of the introduction.
