22FDetermination of application

#### 22F Determination of application (1) The Director must grant an application for a controlled use permit in respect of a chemical and issue the permit to the applicant if the Director is satisfied of the following: (a) section 22C has been complied with in respect of the application; (b) the intended use of the chemical does not pose an unreasonable risk to occupational health and safety, public health or the environment, having regard to the following: (i) the inherent nature of the chemical; (ii) any guidelines prescribed for the purposes of this section; (iii) any other matters that the Director considers relevant. (2) The Director must grant an application for a renewal of a controlled use permit in respect of a chemical and issue the permit to the applicant if the Director is satisfied of the following: (a) section 22C has been complied with in respect of the application; (b) the conditions referred to in subsection 22B(2) have been met. (3) If any further information required by the Director under section 22D is not given to the Director within the period specified in the notice requiring that further information, the application is taken to have been withdrawn. (4) If the Director is not satisfied under subsection (1) or (2), the Director must refuse the application.
