105Variation of Schedule

#### 105 Variation of Schedule (1) The Minister may, by legislative instrument, declare that the Schedule is to be taken to be amended in a manner specified in the instrument, and that declaration has effect accordingly. (2) In addition to the requirement under the Legislation Act 2003 for the instrument to be registered, a copy of the instrument must be published in the Chemical Gazette. However, failure to publish a copy does not affect the validity or enforceability of the instrument. (4) The Minister is to cause all necessary action to be taken to ensure that, where the Schedule is taken to be amended by a declaration in force under subsection (1), a copy of the Schedule as taken to be amended is available for inspection by the public at the prescribed places at the prescribed times, and on payment of the prescribed fee (if any).
