43 Cancellation on Executive Director’s initiative
Section 52 of the new law applies in relation to the cancellation of the assessment certificate as if: (a) subsection 52(1) were instead a power for the Executive Director to cancel the assessment certificate if the Executive Director is not satisfied that the risks to human health or the environment from the introduction and use of the industrial chemical can be managed; and (b) subsection 52(6) were limited to a requirement to give written notice of the decision; and (c) if the assessment certificate is issued under the new law in accordance with item 21 of Schedule 2 to the transitional Act—subsection 52(7) does not apply.
Note: Subsection 52(7) of the new law also does not apply in relation to an assessment certificate that is taken to be issued under the new law in accordance with item 19 of Schedule 2 to the transitional Act: see item 20 of that Schedule.
