What it does
The Industrial Chemicals Charges (Excise) Regulations 2020 is a legislative instrument made under section 7 of the Industrial Chemicals Charges (Excise) Act 2019. Its sole mechanical function is to set the dollar amount of the registration charge that a person must pay when registering under section 17 of the Industrial Chemicals Act 2019 for a registration year. It does not create a power to register, suspend, or cancel registration; those powers reside in the parent Act. The Regulations replace what would otherwise be a blank rate or a nil amount in the enabling Act with a graduated fee scale based on the value of relevant industrial chemicals introduced by the person in the financial year preceding the registration year. Section 5(1) bifurcates liability: if the person introduced a relevant industrial chemical in the 12 months preceding the registration year, the charge is the amount set out in the table in subsection (2); if the person did not introduce any relevant industrial chemical, the charge is nil. The table in subsection (2) establishes eight bands. For values from $0 to $49,999 the charge is nil; for $50,000 to $99,999 the charge is $65; $100,000 to $249,999 is $180; $250,000 to $499,999 is $350; $500,000 to $2,999,999 is $2,100; $3,000,000 to $4,999,999 is $3,750; $5,000,000 to $14,999,999 is $24,500; and $15,000,000 or more is $35,000. The critical point is that these amounts are not marginal rates but lump-sum fees triggered by hitting a band; a person with $15 million in value pays $35,000, not a marginal calculation across bands. The value that places a person in a band is worked out under section 6, which aggregates both the import value and the domestic manufacture value of relevant industrial chemicals. Section 6(2) then permits a reduction for imported chemicals that are used as ingredients or components in the manufacture of other relevant industrial chemicals by the same person, avoiding double-counting. The rounding rule in section 6(3) rounds the final figure to the nearest whole dollar, with 50 cents rounding upwards. The Regulations also contain two application provisions in Part 3: section 7 provides that amendments made by the 2023 amending regulations apply to registration years beginning on or after 1 September 2023, and section 8 provides that the 2024 amendment applies to registration years beginning on or after 1 September 2024. The instrument does not set any penalty, create any offence, or prescribe any form of return; it is a pure fee-setting instrument.
